( I) A creditor whose debt is secured by mortgage or charge on the acquired land shall within 60 days of the date of publication of the final statement under sub-section 5 of Section 7 submit a claim petition to the Collector or the officer authorised.
(2) On receipt of the claim petition of creditor, the Collector or the officer authorised shall issue a notice to the person who is entitled to receive the compensation to tile objection. if any within 30 days of the service of the notice or such further time as he may follow.
I)) The Collector or the officer authorised shall give resonable opportunity to both the parties for producing evidence and being heard and shall then dispose of the claim.
(4) Except as expressly provided in these rules, the procedure laid down in the Code of Civil Procedure, 1908for hearingand disposal of suits shall, as far as practicable, be followed in hearing and disposal of claims under this rule.
(5) In disposing of any claim underthis rule finally, the Collector or the officer authorised shall given effect to the order, if any,of the appellate authority in any appeal perferred under Section 31 or against his order passed under proport ions in which they shall be paid.
