(2) Notwithstanding such repeal, anything done or any action taken under the Assam Public Premises (Eviction of Unauthorised Occupants) ’ Ordinance, 1971, shall be deemed to have been done or taken under this Act as if this Act had commenced on the eighth day of February, 1971 (the-date of promulgation of the Ordinance). Whereas it is expedient to amend the Gauhati University Act, 1947, hereinafter called 1947.°* the principal Act, in the manner hereinafter appearing ; It is hereby enacted in the Twenty-seventh Year of the Republic of India as follows:— Short title, extent and commcncment. 4

(2) It shall have like extent as the principal Act. ' ■ •s.

2. In Section 2 of the principal Act, the sub- - seotion -(e)' shall be substituted by the following, namely :— , \ i Amendment of Section 7 of Assam Act XVI of

4. •» "(e) "Government” in this Act shall mean th e State Government of Assam unless where the Government of Mariipur ' and the Government of Arunachal Pra desh are specifically mentioned in any Section of this Act.” » ■ ■ ■• In 'Section 7 of the principal Act, clause
(ii) shall be deleted and subsequent clauses viz.,' (iii), (iy), (v), (vi), (vii),
(viii), (ix), (x), '(xi), (xii), (xiii) and
(xiv) shall be renumbered as clauses
(ii), (iii), (iv), (v), (vi), (vii); (viii),
(ix), (x), (xi), (xii) and (xiii) respectively. f t In Section 8A of the principal Act, after clause (3), the following shall be inserted as clause (.4) and subsequent clauses viz. clauses (4) and- (5) shall be renum bered as clauses (5) and (6) respectively. 5. In Section 9 uf the principal Act, in sub section (1), the clause (xvii) shall be substituted by the following, namely :— "(xvii) one 4hird of the Principals of Degree Colleges affiliated to .the Uni versity by election from 'among themselves in the manner prescribed • by the Statutes. 6. In Section 12 of the principal Act, in sub-section (1), a fte r clause (v), the following shall be inserted as clause
(vi) and clause (vii) and subsequent clauses viz., clauses (vi), (vii), (viii), (ix),
(x) , (xi), (xii), (xiii) and (xiv), shall be re-num bered as clauses (viii), (ix), ((x),
(xi) , (xii), (xiii), (xiv), (xv) and (xvi) respectively. "(vi) The D irector of Public Instruction, M anipur.

7. In Section 15A of the principal Act, a fte r sub-section (1), the following shall be inserted as sub-sections (2), (3) and (4), nam ely : — "(2) if a m em ber of the Selection Com m ittee is unable to attend, he m ay send his opinion in w riting to the Vice- Chancellor and such opinion shall be taken into consideration by th e Com m ittee in m aking its recom mendations.
Explanation :—For the purpose of th is Section, the co-opted m em bers will be deemed to be m em bers of the Selec tion Com m ittee for the purpose for which they are co-opted.
(3) If the Executive Council does not accept any of the recom m endations of the Selection Com m ittee it shall re fe r the m atter to the Chancellor stating c learly the reasons for not agreeing w ith the Selection Com m ittee and the decision given by the Chancellor th e re on shall be final.
(4) The Executive Council shall cons titu te one or m ore Com m ittees for m aking recom m endations to the Execu tive Council for appointm ent to o ther adm inistrative posts and m ay prescribe by Ordinance the procedure and m ethods to be followed in m aking such recom m endations.” 616 THE ASSAM GAZETTE, EXTRAORDINARY, OCT. 27, 1976 Amendment of Section 21 of Assam Act XVI of

8. In Section 21 of the principal Act, clause
(g) shall be substitu ted by the following, nam ely :— "(g) the condition for affiliation by the Excutive Council of Colleges and Halls not m aintained by the U niversity and for w ithdraw al of such affiliation in consultation w ith the G overnm ent :
Provided that no s ta tu te relating t© the m anagem ent of Colleges and Halls and condition of services of employees shail apply to the G overnm ent Colleges and G overnm ent Aided Colleges in respect of which the respective G overn m ent of Assam, M anipur and A runachal P radesh under whose te rrito ria l ju ris diction the Colleges are situated, shall m ake necessary rules in consultation w ith the U niversity. No new Degree Colleges shall be given perm ission or affiliation by the U niversity w ithout th e prior concurrence of th e respective G overnm ent of Assam, M anipur and A runachal Pradesh. Perm ission and affiliation of a new Pre-U niversity College in M anipur and A runachal P radesh m ay be given by the U niversity w ith the prior concurrence of the res pective G overnm ent of M anipur and A runachal P radesh and th a t the Execu tive Council shall have no jurisdiction to perm it and affiliate new P re-U niver sity class or College w ithin the State of Assam :
Provided fu rth e r th a t the Executive Council shall have jurisdiction over affilia tion of existing P re-U niversity Section of Degree Colleges and of existing P re U niversity Colleges having P re-U niver sity course only under its jurisdiction w ith in the S tate of Assam and conduct the P re-U niversity Exam inations till such tim e the G overnm ent, by Notifica tion in th e official G azettee, appoint and vest all such pow ers of th e Execu tive Council to the Board of Secondary Education, Assam.” J U.
