Whereas it is ocpedient to constitute and establish a tmchin& nsearchoriented, affiliating and partially n$identi81 University at Jodrat by upgmdiw the existing Jaganaath Barooah College (Autonomous) into a University having Open and Distance L%nang (ODL) facilities and matters connected therewith.

It is hereby enacted in the Seventy-fourth Ymr of the Republic of India as follows:.

Preamble Short title and commencement

( 1) This Act may be called the Jagmn8th Banoah University Act, 2023.

(2) it shall come into force at mice.

Definitions In this Act, unless there is anything repugnant to the subject or context-

(a) “Afnli8ta College” meals a college affiliated to the University under section 6(iii) and section 53;

“Affiliated Instiution" means an institution affiliated to the Univwshy under s@tion 6(iii) and section 53;

“Board of Studies” means a B€nlr} of Studia constituted under section 37;

“Campus” means a campus of the Jagannath Banx>ah University in different geographical locations;

(d) (C) “Court" means the Court constItuted under section 25;

“Department? means an academic department of the UniversitY and designated as such by it with reference to a subject or group of subjects of study in the University;

"Executive Council” and "Academic Council- means the Executive Council and the Academic Council constituted under section 28 and section 30, n$paXively;

“Faculty” means a Faculty of the University;

“Fiance Committee” means the Finance Committee oonstituted under , section 39;

(i) a) “Governor” means the Governor of the State of Assam;

(k) “Graduate” means a de©ee holder having a tx>na6de certiac8te from the University;

(1) “Hall” mans a unit maintained or recognised by the UniversitY in which provision is made for imparting nrtodal and supplementaIY instructions, holding meetings, University functions, COIWO%tion$ etc.

(m) “Hostel” means a unit of residence for the students of the UniversitY maintaind by the University in accordance with the pn>visions of this Act;

(n) “Librarian” in relation to the University means a Librarian o£ anY othef person holding the post of Librarian, appointed or rwoWind bY the University;

(0) “Post-Graduate Board” and 'Undw4ir:aduate Board” means the Post- Graduate Board and Under-Graduate Board constituted under section 33 and notion 35 nqwtively;

“Selection Committee” means the Selection Committee constituted under notion 41;

(t) “StaB Governrnent" means the Governmnrt of Assam;

“Statutes", "Ordinances", and "Regulations” mean the Statutes, Ordinances and Regulations, rwpectively, of the University made under this Aot;

(U) (V) “Teachers” meaRS Professors Associate Professors or Awistant Professws oftheUaivusity;

"Univusity” means the Jagannath Baro uh University constituted and established by upgrading the existing Ja8annath Barooab College (Autonomous) into aUnivwsity uadw this Act;

(W) (X) Q) “Univ@sity Laboratory” means a iabomtow maintaiaed ot rnana®d by the University, whether established by it or not;

“Univusity Library” means a library maintaiaai by the University whether instituted by it or not;

'University Professor”, “Associate Pmfesso?’, or “Assistant Professormeans a Professor, an Associate Professor, or an Assistant Professor for teaching and nwanb in the un}versi ly.

LegAl Entity of the 3.

University

(1) The Chancellor, the ViceChancellor, the members of the Court, the Executive Couneil and the Academic Council and all pe16cxts who may heruBer become such officers or members, so long as they contiaue to hold such office or membership, are hereby constituted a body oorponte by the name of 'The Jagann8th Bwooah University ”,

(2) The Univenity shall have perpetual sucoessioa and a common maI and sh8ll sue and be sued by the said name.

• Upgmdation of the existing JagAnnath Barooab College (Autonomous) to University

4. From the commenoelneat of this Act, the existing Jagaanath Barooah College (Autaromous) shall be doomed to have been upgraded to Jagmnath Barooah University. All aspect of taching and twanh shall be decided by the UnivmsiD'.

Property of Jagannath Buooah College (Autonomous) to be vested to the University 5 From tho date of commen@ment of this Act, the existing property, land, buildings, and all assets and liabilities of Jagnnnath Baruoah College (Autonomous) shall be transfewed to the Ja8annath Barwah University, 65 14 THE ASSAM GAZETTE, ExiRAORDnqARY, DECEMBER 12, 2023 Powers of the University

6. The Univnsity shall have the following powers, namely:–

(i) tO Drovide for instruction in such branches of laarnin theg, includin, Open and Distance Learning (GDL) courses as the University may think fit and to make provision for research to secure advancement, diffirsion and extension of knowledge in all spheres of learning;

(iii) to affiliate with it Or admit to any of its privileges or to rocoWise for any impose, either in whole or in part, any college or insBaden ormembas or student therwf, on such terms and conditions as may, from time to time, be pnscHbed, and to withdraw such affiliatiar, privileges or recognitions;

(iV) to incorporate any ProvinciaII sod College of the State as a Constituent College of the University with prior approval of the Govnnment of Assam;

(v) to organis8 and undertake exUamwal teaching and extension education services;

(Vi) to hold examinations, grant and confer degrees, diplomas, certificates or other academic distinction on persons who-

(a) have passed a course of study in the Uni\'ersity or in any affiliated college, or

(b) are teachers in educational institutions under conditions laid down in the statutes, ordinances and ngulations and have passed the examinations of the Univwsity under like conditions, or (C)

(d) have passed a course of study by correspondence or open aRd distance mode, whether residing within the turitodal jurisdiction of the University or not, or have been registered by the University, suElwt to such eaaditions as may in laid down in the Statutes, Ordinanc% and ReBdations as external candidates, being persons residing within the territorial units to which the powus ofthe University extend;

(viii) to confer honorary degnes or other distinctions} to grant such diplomas and to provide such lectures and instructiorB for persons not king rnembers of the University, as the University may detemdne;

(iX) (X) to deprive or withdraw any degrees, diplomas, certificates or other distinctions granted to or conferwd upon by the University for gml and sufficient cause;

to propose to the Govanynent for crmtion of such teaching, administrative and other posts as the Univasijy may deem necessary from time to time and to make appointments thereto after the posts has been created by the Government of Assam, and due approval is accorded for ruruitment.

to rqulate and enfoiw dIscipline among students and employees of the University and to take such disciplinary measures in this tepId, as may be deemed necessary;

to determine conditions and make provision to conduoC entrance exalninations for admiwion into the University;

to cooperate or collaR>rate with any other Univasitia, wthodties or associations, or any other public or private body having puTDsa and objeaives similar to those of the UnIversity or appoint one or more represenMtives of the Universities to act upon any such body, wtthadtY Or assmiation for such lnrposes, as may be agrwd ulxxr, on such terms and condItions, asrnay bepnscribed from time to time;

to enter into a contract or MoU or agreement with any other otganiaHan ot institudon, recognized by the Government of India, Government of Assam and any other gate govemnBnt, for the aanshr of knowledge and te$hnology ou well-deiaed terms and conditions to raise funds for the University, for technical coHab>ration and any other coUabOMtiOn with due approval ofGovanmeot of Assam;

to alter into any agreement for the inco©om6on in the UrivetgtY of any other institutions and for taking over its rights, properties and Habilides and for wry other purposes Int repugnant to this Act with prior applovaI of the Government of Assam;

(xvii) to do all such other acts and things, whether incidental to the powers aforesaid or not, as may be nqrhed in order to further the objectives of the University.

University to be open to all

8. The University shall be open to everyone n94rdless ofgarder, raw or creed, it shall not tn lawful for the University to adopt or impose on any person wry test whatsoever of religious belief or probssion to entitle him to be admitted to it as a teacher or as a Hadnt m to hold any office therein, or to graduate or to enjoy or exenise any particular benefaction accepted by the University, where such test is made a condition thereof by any te$tamentary or other instrurnent creating such benefaction.

9. The following shall be the Officers oft:he Univwsity>

The Governor of Assam shall be the Chancellor of the UniversityChancellor 10. (1)

(2) The Chancellor, when present, shall preside over the meeting of the Court and Convocation of the University.

Powers and Duties of the Chancellor

11. (1) TIle Chancellor shall have the power to cause an inspection, by himwlf or by such person or persons as he may direct, the properties of the University, its buildings, laboratories and equipment and Colleges or Institutions or Centres maintained by the University and also of the examinations, teaching ald other works conducted or done bY the University and to eau se an enquiry to be made in like manner in respect of any matter connected with the Univusity.

The Chancellor shall, in every such case, give notice to the Executive CowwiI of his intention to cause an inspection or enquiry to be made, and the Executive Council shall be entitled to appoint a repn$entative who shall have the duty and right to be present and be heard atswh iasWtion Of alquiry.

The Chancellor may address the Vice Chancellor with nfelenoe to the result of such inspeetiar and enquiry, and the Vice Chanwllot shall communicate to thi Executive Council the views of the Chancellor with such advice as the Chancellor may offer upon the action to be taken thereon.

(4) The Executive Council shall communicate through the Vice Chanc€1k>T to the Chancellor such action, if my, as it is imposed to take or has hen taken upon the reSUlt of such inspection or enquirY.

THE ASSAM GAZBTrE, EXIRAORDRqARX DECEMBER 12, 2023 6517 (S) When the Executive Council within a rnsoIlable time, does not take action to the satisfaction of the Chancellor, the Chancellor may, aaef considering any explanation furnished or representation made by the Executive t::ouncil, issue such directions as he may think fit, and the Executive Council shall be Ix>und to eomply with such directions.

(8) Exlnn ses that may be incurred in conneaion with such inspection or enquiry and cati6ed as such by the Chancellor shall in a charge on the University.

The Chancellor shall have such other powers as may be conferred on him by or under the provisions of this Act.

The Chancellor, as the Head of'the University, shall have the power to suspend the activities of the v©ious authorities of the Univ@sity as and when circumstances so demand and vest all pawen and hmations of these authorities in his owl hand or to control the 8ffa Rs of the authority or authorities so suspended in such manner and for such a period as deemed fit and rnsonablo by him.

(1) The Chancellor shall appoint the Vi®£ban®llor oa the ncommendation of an Advisory Board constituted tv the Chancellor for the purpose and consisting of thrw members, of when the Executive Cornea shall eh:t one mantnr, the State Government shall nominate one rnerntIec and the Chancellor shall nominate one membu. The Chancellor shall appoint one of aun as Chairmen of the Advisory Board.

(2) The Advisory Board shAll ncornmend a panel of names of three persons to the Chancellor, who may appobrt one of tIn mQommended persons as Vioe£hancellor. If the ChanocUol does not approve any of the Boon recunmeaded by the Advisory Board, he may call for a &8shteaornmardation.

(4) The Vic&Chaneellor shall tn a full.time officer of the University who shall hold office for a period of five years and shall be eligible for re appointment and shall retire on the date he altains the age of lay us.

Whenever there is any temporary vacancy in the Office of the Vice- Chancellor by masons for leave, innws or other causes, the Chaneellor shall make such other arr&ng'ments as he may think Ht, for exenising the powers and performing the duties of the ViceChanallot during the absence.

(5) The Ch&naellor shall determine the emohanents and other terms and conditions of servio& of the Vioe{hancellor, provided that the salary of the Vice-Chancellor shall not be less than Rs. 75000/- per month, as revised from time to time and all other allowanoes as are admiSsible under relevant rules.

Powers and Duties of 13.

Vice-ChanCellor

(1) The Vie@Chanoellw shall be 'the principal executive and academic oRion of the University and shall, in the BbHa@ of the Chancellors preside at meetings of the Court and Convocation of the Univel:sKY.

(2) it shall be the duty of the Vioe<;han®nar to ensure that the provisions of this Act, the Statutes, the Ordinances and the Regulations aw duly obswved.

(4) The Vioe..'(;baneellor shall have the power to caryme meetings of the Court, the Executive Council, the AQademic Council, the Finance Committee and the Construction Cournitte& In any emergency, whieh in the opinion of the ViooChaaoellor, reoHres immediate action to be taken the ViceChanceIbr shaH take such action as cleaned necessary, and shalt at the earliest opportunity, report his w:tion to the authoriQr or other body who or which in the ordinary course, would have dealt with the matter.

WInn wry such action taken by the Vice.Chance11Qr affects any person in the service of the University, such person shall be entitled to prefer an appeal &> dIe Exec©dve Council %rougr the officer, authority or other body of the University within thirty days from the date on which such action is communicated to him.

(6) The Vice-Chancellor shall give effect to any order of the Executive Council regarding the appointment, dismissal or suspension of an offimr or a teacher of the University or regarding the recognition or withdrawal of the recognition of any such teacher. H 6 shall exercise general control in the University,He shall be responsible for the maintenance of the discipline of the University.

The Vice Chancellor shall exercise such other powers as may be prescribed by the Statutes and Ordinances.

(7) Registrar 14. (1) The Registrar shall be appointed by the Executive Council on such terms, conditions and ranunera{ions as may be prescribed.

(2) The term of the Registrar shall be for five years, but he may be eligible for re-appointment.

(3) The Registrar shall be the Ex-officio Secretary of the Court, Executive Council, and Construction Committee. All communications, in general, to be addressed to and on behalf of the University shall be in the name of the Registrar.

Po\ver and Duties of the Regisbw 15 The powers and duties of the Regi3tr8r shall be the following, namely:-

(i) to be the custodian of the records, common seal, and such other property of the University as the Executive CoubciI shall commit nhis charge and to manage such properties;

(ii) to sign and verify all appointments, contracts add agreements made an behalf of thc Uni wrsKy and to act as Secntqy of such other Committees as may be prescribed by the Statutes;

(iiB to conduct the official Executive Council:

correspondence between the Court and the (iV) („) (*i) to issue all notices of convening meetings of all such Comrnittees or Councils or Boards of which he is the Secret£rry;

to arrange for and conduct the cxamihadon of the University till such time when the University appoints other officers, if any, for this puQose;

to perform such other work as rnay, from time to time, be pw$crib©d by the Executive Council;

(vii) to represent the University in any Court of Law and to sue any party for any liability to the University and breach of any contract entered into with the University.

Controller of Examinations

16. (1) The Controller of Examinations shall be a full-time salaried officer of the University and shall be appointed by the Executive Council on a full-time basis;

It shall tn the duty of the Controller of Examination to hold various examinations of the University and its constituent and affiliated Colleges;

The Controller of Examinations shall be the authQdty to hold examinations and ensure that the results are declwed h time.

(3) Deputy Controller of Examinations 17-

The Deputy Controller of Examinations shall be a full-time salaried oahu of the University and shall be appointed by the Executive Caunoil a1 a full-time basis Academic Registrar (1) The Academic Registrar shall tn appointed by the Registrar on recommendation of the Executive Council. He shall be the Secretary of the Academic Council and shall be responsible for preparation of curriculum, syllabus and text books for different courses of the University. The term of the Academic Registrar shall be for five Years but may be reappointed if found eligible.

(2) The Academic Registrar shall support the Vice Clwrwllar and the Registrar on all academic matters.

Tho Executive Council shall appoint the Dean of Students Welfare from among the Professors/Associate Professors of the University.

Director of Open and Distance Learning

20. The Executive Council shall appoint the Dimtor for the DireGtqzte of Opa and Distance Learning from among the Professors/Associate Professors of-the University.

The Executive Council shall appoint Directors for different Multi or Inter- Disciplinary progmmm6s.

The term of the Deans and Directors of the University shall be for a period of thr@ years.

(3) Subject to the control of the Exwutive Council, he shall manage the investments of the UniveniV and be rwIDnsible for preparing ard presenting the annual ®timates and statements of accounts and for proper maintenance of the fUnds.

Subject to the powers of the Executive Council the Finanw Ofncw shaH tn nslwnsible for ensuring that all expenditure is incurred for the purposes for which they are generated.

The Finance Officer shall exercise such other powns as may be pwscHbed by the Statutes and the Ordinances.

(6) The Qfbcer shan be wsponsR>le for the auditing of accounts of the University at least once in every year and at interval of not more than fiReea months and the audit shall be done by Comptroller and Auditor General of India:

Provided flat the Chanceltor may, on the rwommendation of the Executive Counoil in the case of a casuai vacancy, may ask the Registrar to perform the duties ofFinaace OBicm.

(3) When a person was% to tn a member of the Court, he shall cease to be a memtHr af any of the authorities or committees of the University of which he may happen to be a member by virtue of the membership of the Court.

(4) With the approval of the Court, the Vice Chancellor may remove an elected or selected mernber.

The Court shall meet at least twice a year on a date or dMS to be fixed by the Vice C:hancenor. One such meeting shall be held in Jmuary and shall be called the Annual General Meeting. The Court may also meet at such times, as it may from time to time deteanine.

the Post<}raduato Board Subject to the provisions of this Act, the Statutes and the Chdiaances, the Post{3raduato Board shall have the following powers and duties:-

(i) to recommend to the Acadaaio Council the pattern of Post-Graduate courses, the examinations to be held for such course% and their revision;

(ii) to approve the curricula and syllabi for the post<;mduate courses and -to modify than, as ileaned necessary, aR@ considering the recomrnendation$ of Boards of Studies;

(iii) to recommend to the Executive Council for the institution and award of fellowships, scholarships, prizes, honorary degrees and other awards or other academic distinction$; and for instituting and conferring of degJees, dpras, titles, cwtifi%tes and otheT academic distirntions in the Post'Graduate courses on the basis of examinations and fort Ire withdrawal ofthe same;

(X) to approve the panels of the examiners for Post-Graduate Examiaations, with or without modifications, after considering the recommendations of the Boards of Studies and to modify the same at any time after consultation with the Boards of Studies concerned.

three Principals selected by the Academic Council from the afHlhted colleges;

(viii) to review the works of the UndeRGraduate departments and Colleges or Institudons or eaRns engaged in Under- Graduate courses and research and to call for a report thereon and to take an steps necessary for the improvement of the standards of research and teaching and other aEairs therein;

(iX) to ooasider the measures suggested by the Academic Council on any matter afFecting the acadwric work of the University md to express its views on them; to oonsid@ any matter nfewd to it by the Executive Council or the Academic Cauneil and to submit reports thereon to the Executive Council or the Academic Council, as the case may be;

(x) to approve the panels of the examiners for Under Graduate Examinations, with or without modiaGations, after considwing the recommendations of the Boards of Studies and to modi© the same at any time after consultation with the Boards of Studies conc©ned;

(xi) to appoint committees and to fix their terms ofrefennw in regard to any aratter within the jwisdiction of the Under43raduate Bmrd.

Board of Studies 37. Every teaching Department and Chntw shall haw a Board of Studies which shall be the §aming authority of all academic pro©ulnmes and awdcuIa of the respective department and centres. Each Board of Studies shall ooasist of the following members, namely:-

Powers and Duties of 38 the Board of Studies Subject to the plovi sion s of this Ad, tIn Statutes and the OaHnm ws, euh Board of Studies shall have the following powus and dutks, namely:–

(i) to make reoornmendations to the Post<3raduate or the Un<!eb Graduate Board, as the case may be, about the pattern of cowses, cwricu]um, and D,llabi to tn laid down for di#erurt .cowws and the examinations to be held for such eour©s and to make rwommendatioa s for revision of courses, syllabi, curdoul8 and examinations in so far as they relate to the field of the par#jgular depanlnent/centre or branch of studies,

(ii) to prepare and, when necessary, revise the panel of examiners for difFerent examinations for submission to the Examination Committees; and

(iii) to oonsider any other mattBr nfened to it by the Post Graduate or Under Graduate Board, the Academic Council or the Executive Council, as the eau may be, and to submit a report to the authodty concerned upon the matter so referred.

Finance Committee 39. There shall be a Finance Committee of the University consisting of the following members, namely :–

(i) The Vio&Chaneellor as Chairman;

(ii) Registrar;

(iii) Two members elected from the Court allm amongst its mernbers;

(iV) Two manbers $1wted by the Executive Council eoin Bs members;

(V) Two members to in nominated by the State Governmalt, one from the Finance Dewtuunt and the other from the Hjgrer Education Department, Government of Assam;

(Vi) Finance (and Accounts) Offioer as MenU Secretary.

. Functions of the Finurce Committee

40. The functions of the finance Cornmitteo shall be as follows:–

(i) to examine the annual budget '®timates and to give advice mId suggestion to the Executive Council thereon;

(ii) to make Mommendations to the Execwdve Council relating to the finances of the Unjwnity;

to examine everY WNosal R>r new expenditures involving a sum of monqf exceeding rupees one lakh and to advise the Executive Council thereon;

(iii) (iV) (V) to review the 6nancial position’of the University periodically;

to suggest, in general, the mans for the improvement of the financial position of the University;

to review grades of pay for all staff of the UniversiEy so that dey conform to the State Government rules and policies and nport to dIe Executive Council;

(vii) to deal with such other matters relating to the financial matters of the University, as may tn prescribed by dw Statutes md Ordinances.

41. (1) The Committee shall sit at least twioe a year, and all the expenditures of the University shall be placed before the Cornrniaee.

There shall be a Selection Committee fm making recommendations to the Executive Council for the appointment of Professors, Associate Professor& Assistant Profess% Registrar, Finance Officer, Controller of Examinations, Librarian, Deputy :Registrars, Deputy Controller of Examinatims and other officers of the Urlivusity as may be provided for by the Statutes eonsistiag of the following members, namely:- Selection Cornrnittee

(i) The Vice-Chancellor Committee;

as Chairman of the Selection

(ii) three persons not holding any office of profit under the University of whom one is to be nominated by the Chancellor, one is to tn nominated by the Exnutive Council, and the other is to be nominated by the Aaademic C©wrcil;

(iii) the Registrar shall tn the Member-Secretary of the Selection Committee, except for the Set<!tion Conunittee for the appointment of Regisaar, and in such a case the Vice Chancellor shall nominate one person as Memtnr Sewtary in consultation with the Executive Council, In making recommendations for the appointment of Professors of the University, the Selection Committee shall have the Head of the Department concerned, if he is a Professor, one Professor of the Departrment to be nominated by the Vice£hance11or, and two pwwrs not in the services of the tJntvasity to be norninated by the Executive Council out of a panel of not less than five names of persons reoammended by the Academic Council, who have specific knowledge of the subject for wIHeh the Professor isto be selected, In making recommendations for the appointment of Associate Professors or Assistant Professors and other teadhas of the University, the Selection Committee shall be constituted with the Head of the Dep&Ment concerned, one Profwor of the Department to be nominated by the Vice Chancellor, and two persons to be nominated by the Executive Council out of a panel of not less than five names of persons recammended by the Academic Council being persons not eonnected with the University, who have specific krowledge of the subject for which the teachn is to be selected:

Provided that where the Executive Council proposes to make an appointment otherwise than in order of merit arranged bY the Selection Committee, the post of Professors, Associate Profesor$ and Assistant Professors, it shall record its reasons in writing and submit them to the Chanoen% who may q>prove the proposal or return it to the Executive Council for rwonsideration. After nconsideraMon, if the Executive Council desires to pursue its original proposal, it shall refer the matter again to the Chancellor for his decision which shall be final:

Provided further that, where a Selection C(xnmittee ncommwds to the Executive Council the name of one person only, and that person is not aweptable to the Executive Council, the Executive Council shall record its rmsons in writing for not accepting their recommendation and direct the Registrar to advertise the vacanqy again and convene a meeting of the Selection Committee for making a fresh recommendation, and in dqjng sc, communicate to every member of the Selection Cownittee thueoa, as recorded above.

(6) If the Executive Council does not acwpt any of the ncommendadons of the Seleotion Committee, it shall nfer the nutter to the ChUIcellor, stating cle©ly the reasons for not apwing with the Selection Committee, and the decision given tv the Chancellor thereon shall be etla!.

(7) The Executive Council shall eonstitu@ one or more Committw$ for making reoomrneadatioas to the Executive Council for appointment to other administrgtjv9 posts and may prescribe through Ordinance the procedure and moth(Hs to be followed in making such r%ommendations.

Faculties 42. (1) The University shall include the Faculty ofHumuati% Science, law, Agriculture, Cornrner% Management, Mass Conrmw$cation, &rvironrnental Science, Indian Fine Arts and such other Facultjn as may be prncdbed by the Statute£ Each faculty shall, subject to the control of the Academic Council, have charge ofteachin& the courws of study and the 19$eanh work, including delivery ofconstatancy services in snh subjects as may be assigned to such faculty by the Ordinanws.

(3) Each faculty shall consist of,–

(i) The Heads of the DepaRrnents;

(ii) Such teachers of subjecB assigned to the acuIty as may be appointed to the faculty by the Academic CouxSl;

Provided that a teacher so elected shall hold office for a period of two years from the date of his election;

Provided that in student shall be eligible to be or oontinr© to be a member of the SMdents' Advisory Council unless he is enrolled as a student. A student mearbet shall cease to be such a member if he fails to pass at the next Universily Examination.

Functions of the Students’ Advisory Council

46. The functions of the Students’ Advisory (•ouncjl shall be as aglows:

(i) to make reoommeadadons to the Executive Counail and the Academia Coundl in the matters affecting the students’ corporate life of the University in so far as it concerns the students and the cb curricular 8ctiVities;

(ii) all rules affeoting discipline, welfare, sports, library, Management of Hostels, extension work, social work students’ health, N.C.C, National Swvice Scheme etc., shall be placed before the Students’ Advisory Council for its views before the Executive Council takes any decision;

(iii) ( iv) (V)

(1) the Via&Chancellor or any authority of the University may ask for the views of the Studonts’ Advisory Council on any mattw concerning the welfare of studentg the Chairman of the Students’ Advisory Council shall be the authority to decide whether a matter dow or does not concern the students;

the Students Advisory Council shall frame its own rules of business and shall $ubrnit the same to the Executive Council fm consideratian and approval.

Univ©siV Fund 47. :1:he University shall have a Fund to be known as “Jagannath Barooah University Fend” to whiCh shaH be credited all its income, fws, finBS, cantrH>utions, donations, loans and advances from any other sources.

The State Govenunent shall, for the purpose of this Act, contribute annually to the University Fund so as to enablo the University to run smoothly and efficiently.

Accounts and Audit 48. The annual accounts and balance sheet of the Univwsity shall be pqw©d under the dir%tion of the Executive Council and shall be submitted to the Comptroller and Auditor General for the puT>0% of Audit

(2) The acoount when audi@1 by Comptroller and Auditor General shall be submitted through the ExeQutive Council to the UnIversity Court, the Chancellor and to the State Government and thereupon, the State Government shall publish the same in the Official Gazette. The Exwutive Council shall also submit to the Court on or before such date as may be prwcdbod by the Statutes, a statanent of the financial estimates for the ensuing year.

(3) The annual accowlts and the final estimates shall be considaed by the Court at its annual meeting and the court may pass resolutions whereon and communicate the same to the Executive council.

(7) Such Annual Statement of Accounts shall, together with copies of the audit report, be tabled before Assam Legislative Assembly.

The Finance Committee of the University shaH conduct half-yearly in©rnal audit and the report of such audit shall be submitted to the State Government regularly.

Notwithstanding anything contained hw9unde& the State Government shall have powers, as deemed necessary, to order an audit of the accounts of the University.

The annual budget estimates shall, after the Executive Council finalises these, be circulated to the Chancellor, State Government and all Tnernbers of the COurt at least fifteen days before theY ate submitted to the State Government.

The University shall obtain prior approval from the Finance (Budget) Department of the State Government for opening any account in a Naiionalizod Bank or any other Bmk. TIle opel#ion of such Account by the University shall be, as per approvals accorded from time to time, by the said Deputment.

(8) Statuns 49. Subject to the provisions of this Act, the S&tutes may provide for all or any of the following matters, nnnely:-

(i) introduction ofChaic

(iii) (iV) the conferment of honorary Degrees;

the Institution of Fellowships, SQhOl8nhip, Exhibition and Prizes;

the terms of office, the method of appointment and the conditions of service of the officers of the University;

the constitution, powers and duties of the autbodtin - of the University;

the establishment ofHostels and their maintenance;

the constitution of Pensims, Insurance and Provident Funds for the tnnefit of the officers, twchas, clerical and other stafE (iX) (X) the maintenance of a register of registered graduates; and All matters, which by this Act, are to be or may be presctn>ed by the Staaltes.

Framing of Statutes 50. (1) Subjast to the provisions of this Act and with the q>proval of the Cowl the Executive Council may make Statutes for the purpose of canyhg out the provisions of this Act and in nspoct of the following all matters, namely :-

(i) every draft of the Statute proposed by the ExecutiVe CouacH shall be submitted to the Court for con$ideration. The Court shall consider such a draft at its next meeting. The Court may pass the Statute or may amend it or may return the Statute to the Executive Council for re-consideration;

(iii) any draft of a Statute proposed by the Executive Counoil and njeced by the Court shall be submitted to the ChanoeIIor, who may refer it back to the Court for ncoasidentiar;

every Staar@ pa&sed by the Court shall be submitted to the Chaaoellor, who may give or withhold his consart or refer it back to the Court for wconsidwatioa;

Ordinances 51. Subject to the provisions of this Act, and Statutes, the Executive Council may frame Ordinances to provide for all or any of the following matters, namely:– (D the adrnission of students to dIe University and their enrolment as such;

(ii) ILe courses of stay n be laid down for all Degrees and Diplomas oftbe University;

the conditions under which the students shall be admitted to the Degee and Diploma nurses, the examinations of the UniversitY and the eligibility for the lkgre© and Diplomas;

the conditioIU of residence of the students of the UaiversitDq

(iii) (iV) (V) rwognition of the Hostels;

(Vi) the qualifying attendance nquind in the various oowses;

(vii) the extension of teaching in any suitable Centre within the State bY means of University extension lectuns or others;

the emolurnents and conditions of service of teachers of the UnivelsitY;(viii) (iX) the fees to be charged for study in the University ard for admission to the examinations, Degrees and Diplomas of the Univusity;

the formation ofDepmtments of teaching in the faculties;

the constitution, powers and duties of the Boards of the University;

(xiii) the conduct of examinations; and all matters which by this Act or the Statutes are to be or may be provided by the (>rdinanws.

Subjects to the provisions of this Act, Statutes and Ordinances, each of the authorities of the University may make Regulations consistent with this Ad, the Statutes and the Ordinances for the purpose of cwrying out the duties and for 6xercisiag the powers assigned to the authority concerned under this Act, the Statutes and the Ordinances.

(2) Without pnbtiia to the generality of the preceding subsection, such Re8llatiOn3 may provide for all or any of the following matters, namely:-

(i)

all matters which are required to be prescribed by the regulations und6r this Act, Statutes or dIe Ordinarc€s;

all matters solely cx>noerning the 8uthoriti% and not otherwise provided for by or under this Act, Statutes or Ordinanow.

(3) Notwithstanding &nyBHng aontained in preceding sub..sections, Ole Executive Council may direct, except the Court, to maIn such amendments and anu Iments of any regulations eaaled by the authority in such manner as it may speci& :

PH>vided that any authority which is dissatisfied with such dilution$ of the Executive Council may appeal to the Chancellor, and the decisions of the Chancellor given in the appeal shall be had.

Affiliation 53. After the commencement of this Act, any College or Institution applying for affiliatiOn to the University shall satisfy the Executive Council,-

(a) that the CoIlege shall be under the management of a duly constituted Governing Body, which shall include at least two representatives of the teaching staff of the College or Institudon, as the case may be, including the Principal;

(b) that the land and building,s of the College or Institution, as the case may be, and the equipment for teaching therein are adequate and suitable;

(e) (D that the strength and qualification of the teaching staff are sumcient for the courses to be imparted in the College or Institution and that the tenure of the offiw of teaching staff is wasoaable;

that adequate arrangement shall be made for the welfare, discipline and supervision of its students;

that the financial rwoumes of the College or Institution are adequate to make provisions for its continued maintenance and effIcient working;

that the affiliation of the College or !nstitutioa shall not aRoct the educational facilities provided by other CollegeS or Institutions in the same neighbourhood.

Acts or Proceeding,s not to be invalid by reasons of certain irmguladHes

54. No act or proceeding,s of the University or ofanyauthodty or Canmittee of the University shaH be invalid merely by reasons of the existence of any vacancy or vacancies among its members or by reason of the in%lidtty of the election, nomin4tion, appointment of any of its mearbns or by reason of any inegu]aRty in the manner of choosing a member.

Chancellor’s 55 decision to be final in certain matters Whenever any quesdon arises as to whether any person has been duly elected, appointed, cLown or nominated as, or is entitled to be, a member of any authority or Body of the Universi€y or whethw any doc;ision of any of the Authorities or of the Vice£hance11or of the University is in conformity with aris Act, the Statutes and the Ordinances, the question shall be nfened to the Chancellor whose decision shall be final.

Subject to the provisions of this Act, the VicbChaReellor, with due approval of the Chancel]or, may delegate any of his powers or duties oonfened upon, imposed by or under this Act, to an Officer under his direct administrative control.

Transitory PravisioIIS:

57. (1) All posts ofJagganath BancA College (Autonomous), including the vacant posts, shall be &ansfernd immediately to the Ja8annat:h Bwooah Univusity with effect from the date of commencement of this Act Further, Bow posts shall be created as pu nwinment with the approval of the Gov©nmeat.

The existing twdhin8 staff of Jagannattr Barooah College (Autonomous) quaHfied to teach in the University shall bnarne teaaring staff of the Jag#nnath Ba©oah Univ@sig as per the transitory provision of this Act. The unqualified teaohing staff, if any, may be transfelled to nearby colleges.

For Associate Pmfessor$ who wish to be promoted to Professors, they must go through the pR>per wl®don of Professorship, as per UniversiEy Grant Commission (UGC) BrideHnes applicable, for appointment of Professors in a University and not through Career Advancement Scheme (CAS). They shall be considered as fresh appoinuwnt s, and sewiw rules applicable for University IWDfesson at the time of appointment shall be cm$idewd.

Pension matters of all existing teaching and non-teaching stafF of Jagannath Barooah College (Autonomous) under both Old Pension Scheme (OPS) and New Pqsiolr Scheme (NPS), as the case may be, shall be protected and carried over under the financial jurisdiction of Jagarma fh Barooah University, For pensions, the window for opting for the route of Accountant General, Governmart of A sum or Jagannath Barooah University will remain open for up to two years;

(13) Notwithstanding that all the oaicns and members of the authorities constituting the University have not been appointed, nominated, chosen or elected, as the case may be, the Univusity shall be denied to have come into existence on and #on the date on which this Act colnw into faroe.

(14) The existIng Councils and Boards of the Ja©math Barooah College (Autonomous) shall remain functional till the formation of the same by the Vice-Chancellor.

All salary and pension matters of the present and past teachn and staff of Jagannath Barooah College (Autonomous) (now upgraded to Jaganuath Bamoah UrHversity) shall be handled by the Directorate of Higher Education, Assam.

If, at any time, the State CovertImerit is of the opinion that special reasons exist that the affairs of the University are not managpd in fw{hwanoe of the objective of the University for which any grant or donation is specifically made by the State Govemment, public bodies or individuals, or that the University Funds are misappropdated ar misapplied, the State Government may indicate to the Executive Council such maRu in regard to which the State Government desires an explanation and call upon that body within reasonable time to offer such explanation as it may desire to offer, with any propoul which it may desire to make, If the Council fails to offer any explanation or make proposal(s) which, in the opinion of the State Government is or an unsatisfactory, the State Government may issue such instructions as may appear to them to be necessary and desirable in the circumstances of the case, and the Executive Council shall give effect to such instructions.

If any dispute arises as to the interpntation of any of the provisions of this Aa, the interpretation given tv the Chan anor shall be final aId binding to all canoernecl Removal of Difficulties ( 1) If any difficulty aljses as to the first @nsdtution arwconstitution af any authority of the Univer$iV after the wmmen®ment of this Act or otherwise in giving effect to the provisions of this Act, the State Government may, by order, ranove the dimcuhies as deemed necessary for the purpose.

Notwithstanding all that is contained in this Act, any difficultY Or dispute encountered by the University shall be attended to tV the Vice-Chancellor in order to provide a solution, in coil$uh8tion with the Chancellor.
