ASSAM ACT NO. IX OF 2018 (Received the assent of the Governor on 18th April, 2018) THE ASSAM MINISTERS' AND LEADER OF THE OPPOSITION'S SALARIES, ALLOWANCES AND AMENITIES ACT, 2018.
1080 THE ASSAM GAZETTE, EXTRAORDINARY, MAY 07, 2018 Preamble AN ACT to fix the salaries, allowances and amenities of the Ministers of the State of Assam and Leader of the Opposition in the Assam Legislative Assembly.
Whereas it is expedient to fix afresh the salaries and allowances of the Ministers of the State of Assam and Leader of the Opposition in the Assam Legislative Assembly in the manner hereinafter appearing ;
It is hereby enacted in the Sixty-ninth Year of the Republic of India as follows :- Short title and 1. ( 1) This Act may be called the Assam Ministers' and Leader of commencement the Opposition's Salaries, Allowances and Amenities Act,
2018.
Definitions Salaries .of the Ministers and the Leader of , the Opposition
(2) It shall be deemed to have come into force on and with effect from the 1st day of April, 2018 .
2. In this Act, unless there is anything repugnant to the subject or context,-
(a) "Leader of the Opposition" means the Leader of the Opposition in the Assam Legislative Assembly ;
(b) "Minister" or Ministers" includes Chief Minister, Cabinet Ministers, Ministers of State and Deputy Ministers of the State of Assam;
(c) "prescribed" means prescribed by rules made under this Act;
(d) "Schedule" means the Schedule appended to this Act.
3. There shall be paid,-
(a) to the Chief Minister of Assam, a salary of rupees one lakh and thirty thousand per mensum;
(b) to each of the Cabinet Ministers and Leader of the Opposition a salary of rupees one lakh ten thousand per mensum;

(c) to each of the Ministers of State a salary of rupees one lakh per mensum;
(d) to each of the Deputy Ministers a Salary of rupees ninety five thousand per mensum.
4. There shall be paid to the Ministers and the Leader of the Opposition, the allowances in connection with their duties as mentioned in the Schedule:
Provided that the Sitting Allowance shall not be admissible if the Minister or the Leader of the Opposition performs the official tour within the State of Assam or outside the State of Assam and halts during the period of the Session of the Assam Legislative Assembly.
Travel Facilities 5. The Ministers and the Leader of the Opposition shall be entitled to,- Amenities
(a) while 011. tour on public business within the State of Assam as well as outside the State, to travelling allowance as may be prescribed;
(b) for journeys performed in connection with medical treatment, to travelling allowances as may be prescribed.
6. The Ministers and the Leader of the Opposition shall be entitled to, -
(a) free furnished residence at Guwahati throughout the year which shall be maintained at public expenses;
(b) vehicles including vehicle for securities as may be necessary for security of the Ministers and the Leader of the Opposition to be maintained at public expenses;

(c) personal staff as may be prescribed;
(d) newspapers and magazines as may be prescribed;
(e) any other allowances or facilities or amenities as may be prescribed.

7. The Ministers and the Leader of the Opposition shall not, during the tenure of their office in respect of which they draw salaries and allowances,-
(a) practice any profession or engage in any trade or undertake for remuneration any employment other than · their duties as such Minister or the Leader of the Opposition, as the case may be.
(b) be entitled to any salary or allowances as are admissible to a Member of the Assam Legislative Assembly .
8. (1) The Speaker may, by notification in the Official Gazette, constitute a Committee consisting of maximum ten Members of the Assam Legislative Assembly, which may make rules in consultation with the State Government, for carrying out the provisions of this Act.

(2) The Committee constituted under sub-section (1 ), shall elect its Chairman and shall have power to regulate its own procedure:
Provided that till the rules are made under this section and come into force, the procedure as they existed prior to commencement of this Act, shall be followed for the purpose of determining the allowances, amenities and facilities which were admissible to Ministers and the Leader of the opposition prior to commencement of this Act for which rules are required to be prescribed under this Act.
(3) All rules made under this Act, shall be laid before the .Assam Legislative Assembly, as soon as may be, after they are made.
The Assam Ministers' and Deputy Ministers' Salaries and Allowances Act, 1958 and the Salary and Allowances of the Leader of the Opposition in the Assam Legislative Assembly Act, 1978, are hereby repealed .
The repeal by this Act of the enactments mentioned in section 9 shall not affect the validity, invalidity, effect or consequences of anything already done or suffered under the enactments so repealed.
