2. The bund shall be in the form con tained in Act V of the schedule and the provisions of the Code of Cr i minal Procedu re, 1898, shall, in so far as they arc applicable, apply to all mat ters connected wi th such bond and the non-execution the reo f as if it were a bond to keep the peace orde red tu b e execute d under ^ciV of section 106 of tha t Code . 1393
(3) If the conviction is set aside on appea l or otherwise, the bond so executed shall become void.
An orde r under this section may also be made by an Appel late Co urt , or by the High Co urt when exercis ing its powers o f revision.
9C. Whoever, being the owner or occupie r or hav ing the use o f any house, room , enc losure , space vessel, vehic le o r place, knowingly per mi ts it to be used for the commission by any o th er person of an offence pun isha ble unde r sectio n 9 sha d be liab le to the pun ishme nt p rovided in th at section
9D. (1) When any opium has been imported exp orted, t ran sport ed or sold or is possessed by any person on acc ount of any oth er person, and such oth er person knows or has reason s to believe t ha t such import, export, t ran sport o r sale was, or that such possession is on his acc ount, that opium shall, for the pu 'po se o f this Act, be deem ed to have been imp ort ed , exp orted, tra nsporte d or sold by, or to be in posses sion of such oth er person.
(2) Not hing in sub -ser tion T) sha ll abso lve any person who imports , xporis, tra ns po rt, sells or has possession opium on acc ount oi an othe r person from liabil ity to any punishm ent un de r this Act for unlawful import, exp ort , transports, sale or possession of opiu m.
Abeimeau 9E. Who ever attem pt to com mit a n offence a nd in such at tem pt does any act tow ards the commission of the offence pu nishab le un de r section 9 or section 9C shall be liable to p unishm ent p rovided for the offence.
9F. Wh oev er abets an offence punishable under tliis Act shal l, wh eth er such offence be or be not com mit ted in consequence of such abe tme nt, an d notwith standing anything con tained in section 116 of the India n Penal Cod e, be punished with the pun ishm ent provided for the offence.
