Assa m act xi x of 197® (Received the assent of the Governor on the 19th December, 1970] THE ASSAM PANCHA YAT (AM END MENT) ACT, 1970 (Published in the Assam Gazett e Ex traord ina ry, dated the 19th Decem ber, 1970) An Act fa rthe r to amen d the Ass am P anchayat Act, 1959.

Preamble. Whereas it is expedient fu rther to amend the Assam Assam Act Panchayat Act, 1959 here inaf ter called the princi pal x x v̂ o f Act, in the manner here inaf ter app ear ing ; 195 ' It is hereby enacted in the Twenty-firs t Yea r of the Repub lic of India as fol low s:— Short t it le , 1.(1) This Act may be called the Assam Panch aya t extent a n d (Amendment) Act, J 97O.

Amendment 2. In section 11 of the prin cipal Act, for f AC tl° n s u b-sect ion (2) the following shall be subs tituted* Act XX IV nam el y of 1959.

"(2 ) Notwithstand ing any vacancy in the mem ­ bership of the Gaon Pan cha yat , the Depu ty Commiss ioner or the Subd ivisional Officer as the case may be, shall cal l a meeting of the Gaon Panchaya t (which meetin g shall be called the first meeting of the Gaon Panchayat ), for election of a President and a Vice-Pre siden t from amongst its members in the manner prescribed.” Amendment 3. Provided that one Secretary may be appointed for more than one Gaon Panchayat.

(2) Qua lification, sala ry and other conditions of service including disciplina ry actions of the Secre tary so app oin ted shall be govern­ ed by the rules to be ma de for the purpose .” Amendmen t 4. “ (1) Notwithstand ing any vacancy in the membership of the Anchalik Panch aya t, the Dep uty Commissioner or the Subdivisional Officer, as t he case m ay be, shall call a meet ing of the Anchalik Panchayat (wh ich mee ting shall be called the first meet ing of the Anchalik Pan chayat) for t he elect ion of a Preside nt and a Vice-President from amongst its members in the manne r prescribed .” Amen dmen t 5, In section 23 o f the prin cipal Act, for sub- ^ ’oFthe s c c t’o n t î e following shall be subst itu ted , Assam Ac t namely X X IV o f

“ (1) Notwithstanding any vacancy* in the me mb er­ ship of the Mahkuma Par isha d, the Dep uty Commis­ sioner o r the Subdivisional Officer, as the case may be, shall call a meet ing of the Mahku ma Parish ad (which meeting shall be called the first meet ing of the Mah­ kuma Parishad ) for the election of a Pres iden t and a Vice-President fro m amongst its mem bers in the manner prescribed.” Amendment 6. In secdon 32 of the principa l Act, in the existing Act X X IV of 1959 a» amended by Assam Panchayat (Amend­ ment) A ct ,

(1) the words “except Gaon Pan cha yat Sec reta ries” occurring between the words “ employees” and “ app oin ted ” and the word “ Firs t” occu rring between he word “ Panch aya t” a nd brac ket and word “ (Amend­ ment)” shal l be .deleted ;

(2) the punctua tion "ful l-stop (.) ” occ urr ing a t the end shall be substi tuted by the p unctuat ion "colon ( :) ” and thereaft er the following proviso shall be added, name ly:— "Provided further tha t a ll the G aon Panchayat Secre­ taries appo inted by th e State Governme nt after th e date of coming into force o f the Assam Panchyat (Amend- Assam Act ment) Act, 1964 shall be deemed to have been appo in- \ ted by the Mahkuma Par ishad under this Act .”

7. (1) The Assam Pancha yat (Amendm ent) Ordi- Am*™ O*- nance, 1970 is hereby repeale d. kf*v}70

(2) Notwi thst and ing such rep eal , anyth ing done or any action taken under th e Assam Panchaya t (Amendm ent) Ordin ance, 1970 shall be deemed to have been don e or take n under this Act as i f this Act had commenced on the twenty-sixth day of Sep tember, 1970 (the da te of p rom ulg ation o f the Ordin anc e).
