XX III OF 20 04 (R ec eive d the as se nt o f th e Gov erno r o n 27 th D ec em be r, 20 04 ) THE ASS AM PA RL IAMEN TA RY SE CR ET AR IE S (APPOINTMENT SALARIES, ALLOWANCES AND MISCELLANEOUS PROVISIONS) ACT, 2004 AN ACT to provide f or the appoin tme nt, salary , allowances and oth er misce llan eou s prov isions of the Par liam entary Secretaries in the State o f Assam, Prea mble Whe reas it is expedient t o prov ide for th e appo intm ent sala ry, allowanc es and other misce llaneo us provis ions o f the Parl iamenta ry Secretar ies in the S tate o f Assam;
It is hereby en acte d in the fifty fifth year of the Republic o f India as follows:
Short title, 1 .(1) T his A ct may be ca lled the Assam Parli amen tary Sec retarie s (Ap pointm ent , Salarie s, extent and Allowanc es and Misce llan eou s Provision s) Act, 2004 commencement.
(2) It ex tends to the whole of Assam.
(3 ) It sha ll com e into force at once.

(a) ‘Ch ief Mini ste r’ means the Ch ief Minister of Assam;
(b) ‘Mem ber’ means a M emb er of the Assam Leg isla tive A ssem bly;
(c) ‘Parl iam entary S ecr eta ry' mean s a Mem ber o f the Ass am Leg isla tive Assembly app oin ted as th e Par liam enta ry Secretary under this A ct by the C hief Minister ;
(d) ‘presc ribed’ means p rescr ibed by the rules made u nde r th is Act; and
(e) ’sp ecif ie d ' m ea ns sp ec if ie d by noti fi ca tion publishe d in th e Offi cia l Gazet te o f the S tate o f Assam.
Appointment o f 3. The Ch ief Minister may, having regard . to the circumstances Par liam entary and the need o f the situation, at any tim e appoint such num ber o f Parlia men tary Secretaries Secreta ry. a n d t 0 e a c jj o p ([i e m t)u t je s a n ( j fu n c t jo n s a s h e m ay deem fit an d pr op el IE ASSAM GAZETTE, EXTRAORDINARY, DEC. 29, 2004 1705 Rank, status , 4. A Parliamentary Secretary shall be of the rank and status of powers and a Min ister of State and shall exercise such powers, disc harge such functions and perform functions o f m a v assigned to him by the Ch ief Min ister by way of a notification Secretary11 publ ished in the Officia l Gazette.

Salary and Par liam entary Secreta ry shall be entit led to such sala ry and allowances as are allowances o f admissible to a Minister o f State under the Assam Ministers, Ministers of State and Deputy Parliamen tary Ministers Sala ries and Allowa nces Act, 1958.

No twi ths tanding any thing contained in any other law for the tim e being in force a draw salary and Parl iam ent ary S ecr eta ry shal l not, whi le he draws salary and a llowances for his o ffice as such allowances as Parliamentary' Secreta ry, be entitled to any salary or allowance as a Membe r o f the Assam Member Leg isla tive As sembly.
9. A P arl iam ent ary Sec retary shall not, dur ing hi s o ffic e as such Parliamentary Secretary, practise any profession or engage in any trade or commerce and undertake for remuneration any employment o ther than his duties as such Pa rliam entary Secretary .

Power to make rules
10.(1) The S tate G overnment may, b y noti fication published in th e Offic ial G aze tte, mak e rules for carrying out the p urposes o f this Act.
1706 THE ASSAM GAZETTE, EXTRAORDINARY, DEC. 29, (2 ) A ll ru les made by the State Go ver nm ent under th is Act shall, as s oon as may be after they are m ade, b e laid before the State Leg isla tive As sembly, As sam w hil e it is in session , for a tota l period o f not less than fourteen days w hic h ma ybe comprised in on e sess ion or tw o or more succ essiv e session s, and shall, un less some later ditto is appointed, take ef fect from the date o f their publicat ion in the Offi cia l Gazette sub jec t to such m odifi catio n or amendm ents as the Leg isla ture may , during the said period agree to make, so however , that any such m od ifi ca tio n or am endm ent shal l be without prejudice to foe validity o f anything previously done thereunder.
Repeal 11. The As sam Parliamentary Secretaries ( Appointm ent, Salari es, Al low ances and Misc ell aneous Provisions) Ordinance, 2 00 4 is hereby repealed.
