It is hereby enacted in the Twenty-first Year of the Republic of India as follows:- Short title, I. (1) This Act may be called the Assam Shramik extent and Bahini (Amendment) Ac1., 1970. commencement.
(2) It shall have the like extent as the principal Act.

6. For section 9 of the principal Act, the following shall be substituted, namely:- "Ev_ideuc.e of 9. ( 1) The Executive Engineers on registering a Registrat10n·Shramik Bahini under section 8 shall issue a certificate of registration in the prescribed .form which shall be C'.)ndusive evidence that the Shramik Bahini has been duly registered under this Act. The Registration shall be valid for one year which may be renewed in the manner as pre3cribed."
Amen~ment 7. In section 10 of the principal Act, ( l) in sub of ~[cJ:~~~o section ( 1), lhe following Explanation shall be inserted Act XXIV at the en.l, namely: - of 1960.
"Explanation.-'Sk.illed L:tbour' for the purpme of this section ~hall include any Shramik or Shramik Bahini having special knowledge in any particular project, undertaking, work or contract of the State Government or any other Statutory body or Local Authority."
(2) For sub-section (2J, the following shall be substi tuted, namely:- "(2) The appropriate authority may, as and when considered necessary, allot works of any kind the value of which does not exceed Rupees fi fty thousand only to a Shramik B<lhini for execution without calling for tender at e>timated rate on receipt or an application from a Registered Sbrami k Babin\ . In case where tenders are invited the wo• ks may be allotted to Shra mik Bahini at the lowest accepted 'tender rate'."

24. ( l) The Subdivisional Officer of the Public Works Department of both Wings, viz, Roads and Buildings and Flood Control and Irriga tion, may, of his own motion, or on the application of a majority of the Executive Committee, or of not less than one-third of the members, hold an enquiry into the con• stitution, working, financial condi tions and accounts of a Shramik Bahini.

(2) The Nayak, the President and the Shramik Member of a Shramik Bahini shall furnish such information in regard to the affairs of the Shramik Bahini as the Enquiry Officer may require."
9. In section 25 of the principal Act~- (I) in su b-section (I) for the words "Chief Engineer" the words "Executive Engineer" shall be substituted.
(2) For sub-section (2), the following shall be substituted, uamc-ly :- ~2) T he aggrieved ::Shramik Bahini whose regis· tration is cancelled by a Registerfog Authority may, within thirty days from the date of such cancellation of registra tion, submit an appeal to the Superin~ tending Engineer of the Circle of Public Works Department of both Wings, viz., Roads and Buildings and Flood Control and Irrigation, as the case may be, where the Shramik Bahini has been registered originally, and the Superintentling Engi· neer shall be the Appellate Authority whose decision shall be final and not open to appeal or revision in any court.
