ASSAM ACT NO. VIII OF 2018 (Received the assent of the Governor on 18th April, 2018) THE ASSAM SPEAKER'S AND DEPUTY SPEAKER'S SALARIES, ALLOWANCES AND AMENITIES ACT, 2018.
AN ACT Preamble.
to fix the salaries, allowances and amenities for Speaker and Deputy Speaker of Assam Legislative Assembly.
WHEREAS it is expedient to fix afresh the salaries and allowances of the Speaker and the Deputy Speaker of the Assam Legislative Assembly in the manner hereinafter appearing;
It is hereby enacted in the Sixty-ninth Year of the Republic of India as follows :- Short title and commencement.
1.
(1) This Act may be called the Assam Speaker's and Deputy Speaker's Salaries, Allowances and Amenities Act, 2018.
(2) It shall be deemed to have come into force with effect from the l st day of April, 2018.
Definitions. 2.
In this Act, unless there is anything repugnant to the subject or context,-
(a) "Speaker" and "Deputy Speaker" means the Speaker and the Deputy Speaker of the Assam Legislative Assembly;
(b) "prescribed" means prescribed by rules made under this Act.
Salaries of the Speaker and the Deputy Speaker.

There shall be paid,-
(a) to the Speaker a salary of rupees one lakh and twenty thousand per mensem;
(b) to the Deputy Speaker a salary of rupees one lakh per mensem.
Allowances. 4.
There shall be paid to the Speaker and the Deputy Speaker the following allowances in connection with their duties :-
(i) Parliamentary Assistance Allowance : Rs. 10,000 per month.
(ii) Sumptuary Allowance : Rs. 20,000 per month 2
(iii) Daily Allowance While on tour and halt within the State of Assam in connection with performing official duties.
While on tour and halt outside the State of Assam in connection with performing official duties.
: Rs. 1850 per day : Rs. 2500 per day
(iv) Sitting Allowance : Rs. 1850 per day :
Provided that the Sitting Allowance shall not be admissible if the Speaker or the Deputy Speaker as the case may be, performs the official tour within the State of Assam or outside the State of Assam and halts during the period of the Session of the Assam Legislative Assembly.
Travel facilities. 5.
Speaker and the Deputy Speaker shall be entitled to,-
(a) while on tour for official purpose within the State of Assam as well as outside the State, to travelling allowance as may be prescribed;
(b) for journeys performed in connection with medical treatment, to travelling allowance as may be prescribed.
Amenities. 6.
Speaker and Deputy Speaker shall be entitled to,-
(a) free furnished residence at Guwahati throughout the year which shall be maintained at public expenses;
(b) vehicles including vehicles for securities as may be necessary for security of the Speaker and the Deputy Speaker to be maintained at public expenses;
(c) personal staff as may be prescribed;
(d) newspapers and magazines as may be prescribed :
Provided that the Speaker shall be entitled to the privileges of using the free furnished residence, Government vehicles and personal staff on his ceasing to hold office for such period as may be prescribed.
Prohibition against practicing any profession during the tenure of office as Speaker or Deputy Speaker.

The Speaker and the Deputy Speaker shall not, during the tenure of their office in respect of which they draw salaries and allowances, -
(a) practice any profession or engage in any trade or undertake for remuneration any employment other than their duties as Speaker and Deputy Speaker;
(b) be entitled to any salary or allowances as are admissible to a Member of the Assam Legislative Assembly.
3 Power to make rules.

(1) The Speaker may, by notification in the Official Gazette, constitute a Committee consisting of maximum ten Members of the Assam Legislative Assembly which may make rules in consultation with the State Government, for carrying out the provisions of this Act.
(2) The Committee constituted under sub-section (1), shall elect its Chairman and shall have power to regulate its own procedure:
Provided that till the rules are made under this section and come into force, the procedure as they existed prior to commencement of this Act, shall be followed for the purpose of determining the allowances, amenities and facilities which were admissible to the Speaker and the Deputy Speaker prior to commencement of this Act for which rules are required to be prescribed under this Act.
(3) All rules made under this Act shall be laid before the Assam Legislative Assembly, as soon as may be, after they are made.
Repeal of Assam Act No.XXV of 1958 and Assam Act No.XVI of 1958.
9. The Assam Speaker's Salaries and Allowances Act, 1958 and the Assam Deputy Speaker's Salaries and Allowances Act, 1958 are hereby repealed.

The repeal by this Act of the enactments mentioned in section 9 shall not affect the validity, invalidity, effect or consequences of anything already done or suffered under the enactments so repealed.
