Section 13: Power to d issolve the Board

(J) If the State Government is satisfied that the Board has made default in performing any duties imposed on it by or under this Act or has abused its power, the State Government may, by notification in the Official Gazette, dissolve and reconstitute the Board under section 4:

Provided that before issuing the m filiation, the State Government shall give a reasonable opportunity to Board to show cause why it should not be dissolved and shall cons; c i the explanations and objec­ tions, if any, of the Board.

(2) After the. Board is dis; lived and until it is reconstituted, the powers, duties and function of the !’«'•.•..! under this Act shall be exercised or performed by the State Government <;-r by such officer or officers, as the State Government may appoint for ibis purpose.

11. R ules.—-(I) T 'no State (mveiimxm may, by notification in the official Gazette and subject to the ..mi ion ot previous publication, make rules to carry out the purposes of tin.; Act.

(2) In particular and without prejudice to the generality of the foregoing power, such rules mav be made for all or any of the following matters, nam e'y:—

(a) the agency for the manner of collection of sums specified in sub-section (3) of Section 3; and the period within which the same shall be paid to the ere lit. of the Fund ;

(/>) the manner in which the accounts of the Fund shall be maintain­ ed and audited under sub section (3) of Section 3 ;

(r) the procedure for defraying the expenditure incurred in administe­ ring the Fund ;

(d) the manner in which the Board shall conduct their business ;

(e) the duties and powers of the Inspectors and the terms and conditions of service of the Welfare Commissioner ;

( / ’) the registers and records to be maintained under the Act;

(^) the publication of the report o ’ the activities financed from the Fund together with a statement of accounts ;

(3) All rules made under this section shall be laid for not less than fourteen days before the Assam Legislative Assembly as soon as possible after they are made, and shall be subject to such modifications as the Legislative Assembly may make during the session in which they are so laid or the session immediately following.
