GOVERNMENT OF ASSAM ORDERS BY THE GOVERNOR LEGISLATIVE DEPARTMENT LEGISLATIVE BRANCH NOTIFICATION The 26th June 1991 No- LGL- 42/90/25 .—The following Act of the Assam Legislative Assembly which received the assent of the President is hereby published for general information.

THE ASSAM TEA PLANTATIONS EMPLOYEES’ WELFARE FUND (AMENDMENT) ACT 1990 A Act Further to amend the Assam Tea Plantations Employees’ Welfare Fund Act, 1959.

Preamble Whereas it is expedient to amend the Assam Tea Assam Act Plantatons Employees’ Welfare Fund Act, 1959, i9g0 X V I ° hereinafter called the Principal Act, in the manner hereinafter appearing;

It is hereby enacted in the Forty-first Year of the Republic of India as follows, nsmely:—- Short title, 1.(1) This Act may be call' d the Assam Tea Plantations extent andEm Dloyeeg* Welfare Fund (Amendment) Act, 1990.

(2) It shall have the like extent as the principal Act.

(3) It shall come into force on such date as the State Government may, by notification in Official GazeVe, appoint.

Amendment 2. In the principal Act, in sub-section (2) of Section 3A, of Section 3 A t words “and the 31st December’’ in between the words the Act x t H o f ™ J u n e ” and “ of a calendar year” shall be deleted;

3. In the principal Act, in sub-section (3) of section 3A clauses (a), (b) and .(c) shall be substituted by the following clauses respectively. .

<!(a) Employer’s contribution shall be st such rates as the Government may prescribe from time to time by a notification in the Official Gazette, but the Employer’s rate of contribution shall not be less than two rupees per employee (temporary & permanent) and payable as on the 30th June every year ::

Provided that till such higher rate is prescribed the employer’s contributicn ;ball be two rupees per employee as on 30m day of Jun: every year and payable are every twelve months ending cn 30th day of June every year

(b) Employees contribution shall be at the rate of one rupee per employee as on 30th day of June every year, and payable for every twelve months ending on 30th day of June every year.

(c) The State Government s contribution shall be twice of the employee’s contribution as on 30th day of June every year and payable for every twelve months ending on 30th day of June every year.” .

Amendment 4. In the principal Act, in sub-section (4) of Section of Section 3A 3 A the words ‘‘and the 15th day of January” in between pfAssamAct 'he words “July” and “every year” shall be deleted.XVI of 1960.

5. In the principal Act, in the first proviso to subjection

(5) of Section 3A the words “and December” in between the words “June” and “ev<ry year” shall be deleted; and in the second proviso the word “months” in between the words “ for the” and “aforesaid” shall be substituted by the word “month” and the words “or months” occurring subse quently in between the words “month” and “with” shall be deleted.

6. In tbe principal Act,—in subjection (8) of section 3A, the words “and January” in between the words “July” and “every year” and the words “and the 31st December” in betv een the words ‘ 30th June” and “every year” shall be deleted and the words ‘ equal to the employer’s” occurring in between the word “amount” and the word “contribution” shall bs substi­ tuted by the words “twice the emplojee’s” .
