(1) Any tenant holding land in a temporarily- Reduct ion settled estate to which this Act applies may apply to .°* the Court of the Deputy Commissioner for the reduc- ‘n g s .. ‘n tion of his rent, on the gr ou nd - ' s S " estates.
J i (») that the soil of the holding has, during the tenancy on the present rent , become per manently deteriorated without the fault of the tenant, and («) that his landlord has obtained, or is entitled to obtain, on that account a reduction in the revenue payable in respect of the land covered by the holding.

(2) On receipt of such an application, the Court shall, in the manner prescribed, make a local enquiry or have a local enquiry made by the Sub-Deputy Col lector in charge of the area, wherein the land in ques tion lies, to determine whether the tenant is entitled to a reduction.
(3) When, after such enquiry, the Cour t holds that the tenant is entitled to a reduction of his rent, the Court may—notwithstanding an>thing in any con tract between the parties—direct such reduction of rent as it thinks fair and equitable.
