NOTIFICATION BHARATIYA NAGARIK SURAKSHA BNSS (MAINTENANCE OF RECORDS) MAHARASHTRA RULES, 2023. No. Misc-0325/C.R.33/Special-09.— In exercise of the powers conferred by sub-section (1) of section 64, sub-section (2) of section 176, sub-section (2) of section 179, sub-section (3) of section 193, sub-section (1) of section 195, section 286, sub-section (2) of section 330, sub-section (2) of section 461, sub-section (2) of section 497 of the Bharatiya Nagarik Suraksha BNSS, 2023 (46 of 2023), read with section 24 of the General Clauses Act, 1897 (10 of 1897) and in supersession of all earlier notifications, rules, orders or instruments issued in this behalf, the Government of Maharashtra hereby makes the following rules, namely:-
1. Short title and commencement.— (1) These rules may be called the Bharatiya Nagarik Suraksha Sanhita (Maintenance of Records) Maharashtra Rules, 2025.
2. Definitions. -(1) In these rules, unless the context otherwise requires -
(a) “BNSS” means the Bharatiya Nagarik Suraksha Sanhita, 2023;
(b) “BNS” means the Bharatiya Nyaya Sanhita, 2023;
(c) “BSA” means the Bhartiya Sakshya Adhiniyam, 2023;
(d)“Court” means sub-section (5) of section 2 of BNS and clause (a) of sub-section 1 of section 2 of BSA;
(e) “Court of Session” means section 8 of BNSS;
(f) “Court of Judicial Magistrate” means section 9 of BNSS;
(g) “Documents” means sub-section (8) of section 2 of BNS and clause(d) of sub-section 1 of section 2 of BSA;
(h) “Form” means a Form appended to these rules;
(i) “Officer in charge of a police station” means clause (r) of sub-section (1) of section 2 of BNSS;
(j) “property” means clause (a) and (b) of sub-section 1 of section 497 of BNSS;
(k) “Section” means a section of the BNSS, BNS, BSA.
(2) Words and expressions used but not defined in these rules shall have the same meanings as are respectively assigned to them under the BNSS, BNS, BSA and General Clauses Act,1897.
3. The substance of information relating to the service of summons to be recorded under section 64(1) of the BNSS shall be record in a register in ‘Form-A’ by the police station.
4. The officer in charge of a police station shall record the reasons for not fully complying with the information received under clauses (a) and (b) of sub-section (1) of section 176 of the BNSS in its daily diary report. Such a report shall be included in the station diary. This report along with entries made in station diary this regard shall be forwarded fortnightly to the Magistrate overseeing the jurisdiction of the police station. In the cases falling under clause (b) of sub-section (1) of section 176 of the BNSS, the officer in charge as per sub-section (2) of section 176 of BNSS, shall immediately without delay notify the informant of the reason for the same either through physical mode, or through electronic mode like telephone, SMS, WhatsApp, e-mail etc.
5. Any police officer making an investigation, by order in writing, require the attendance before himself of any person being within the limits of his own or any adjoining station who, from the information given or otherwise, appears to be acquainted with the facts and circumstances of 13 the case; and such person shall attend as so required is entitle to receive the reasonable expenses of every person, attending under sub-section (1) of section 179 at any place other than his residence. To receive such expenses under sub-section (2) of section 179, the Investigating officer should issue a certificate for the same in format ‘Form- B’ and also maintain a register at his end in the format ‘Form-C’ for disbursement of allowances. These expenses include traveling expenses equal to ST bus ticket or the fare of the railway general class ticket or in case any other mode of transportation is taken by the person from their residence to the police station then he is entitled for equivalent traveling expenses of either ST bus ticket or railway general class ticket whichever is less and the daily allowance of Rs.200/- per day for food and other incidental expenses.
6. As soon as the investigation is completed, the officer in charge of the police station shall forward the substance of information, including through electronic communication to a Magistrate empowered to take cognizance of the offence on a police report. The substance of the report submitted under sub-section (3) of section 193 of the BNSS shall be submitted in the form of ‘Form-D’. The officer shall communicate the progress of the investigation either by way of using official e-mail (with delivery acknowledgment receipt), SMS/WhatsApp (through official mobile), postal letter (preferably Registered address), or through phone call log followed by SMS (through official mobile) provide the action taken by him, to the person, if any, by whom the information relating to the commission of the offence was first given.
7. Under sub-section (1) of section 195 BNSS, if any male person under the age of fifteen years or above the age of sixty years or a woman or a mentally or physically disabled person or a person with acute illness shall be required to attend at any place other than the place where such person resides and if such person is willing to attend and answer at the police station under section 194, such person may be permitted so to do, subject to condition that the Investigating officer shall obtain a written consent from the concerned person in format ‘Form-E’. This consent letter shall be handed over to the Investigating officer designated to physically inform the said person about the ongoing inquiry.
8. The substance of information under section 286 of BNSS, in every summary trial case, the Magistrate shall enter the record of summery trial in ‘Form-F’.
9. The substance of information relating to the documents submitted under sub-section (1) of section 330 of the BNSS before court either prosecution or accused, shall be listed under sub-section
(2) of section 330 of the BNSS in the format of ‘Form G’.
10. The warrant issued under clause (a) of sub-section (1) of section 461 of BNSS by the court for recovery of fine from the offender, in case of the non-payment of fine as sentenced by the court, shall be executed as laid down under section 72 to section 83 of BNSS provided that, no such warrant shall be executed by the arrest or detention in prison of the offender.
11. In case of recovery of fine under clause (a) of sub-section (1) of section 461 of BNSS, the Collector as prescribe under Maharashtra Land Revenue Code,1966 shall summarily determine any claims made by any person other than the offender in respect of any property attached in execution of such warrant.
12. The Court or the Magistrate shall, within a period of fourteen days from the production of the property under sub-section (1) of section 497 of BNSS before it, prepare a statement of such property containing its description in the format of ‘Form-H’. The Court or the Magistrate shall certify the correctness of the inventory/ description so prepared under sub-section (2) of section 497 taken in format ‘Form-H’. In case of photographs and/or videograph taken on mobile phone or any electronic media, the Magistrate shall also certify the correctness of the same to be true. The cases governed under any special statutes and/or rules, where the procedure and format has already been laid down for release of property, in such a situation the ‘Form-H’ shall not be applicable to those cases.
