Bihar Subordinate Planning Cadre Rules, 2009 Chapter 1 Preliminary
1. Short Title, Extent and Commencement :-
(i) These Rules may be called the Bihar Subordinate Planning Cadre Rules,
2009.
(ii) It Shall be applicable to the whole of the State of Bihar.
(iii) It Shall be immediately come into force.
2. Definitions' :- In these Rules, Unless the context requires otherwise.
(i) "Governor" means the Governor of Bihar.
(ii) "State Government" means the Government of Bihar State.
(iii) "Administrative Department" means the Department of Planning & Development.
(iv) "Commission" means the Bihar Karmchari Chayan Ayog.
(v) "Appointing Authority" means the Principal Secretary/Secretary of the Department of Planning & Development, Government of Bihar.
(vi) " Cadre" means Bihar Sub Planning Cadre.
(vii) "Member of the Cadre" means Planning Assistant (Senior Statistical Assistant appointed to the Bihar Sub Planning Cadre and Promoted as Sub Planning Officer).
(viii) "Schedule" means schedule appended to this rule.
3. Constitution of the Cadre :- This Cadre Shall be a State Cadre.
4. Structure of the cadre :-
(i) This Cadre will be under the administrative control of the Department of Planning and Development.
(ii) The details of different Categories of posts of this Cadre are given in Schedule 1.
(iii) The State Government may, from time to time, fix the strength of different categories of this Cadre and in addition to the designed posts, approve the creation/ abolition of the permanent/temporary posts in this Cadre by notifying in the Gazette.
(iv) on the date of commencement of this Rule, the employees previously recruited and working on the posts mentioned in the Schedule will automatically be treated as members of this Cadre.
5. Status of the Post :- The members of this Cadre Shall be Non-gazetted. Chapter 2 Recruitment
6. Sources of Recruitment :-
(i) All Posts of Basic grade of this cadre shall be filled up through the direct recruitment by written competitive examination conducted by the commission from time to time. Subject, syllabus and minimum qualification for competitive examination for recruitment shall be prescribed by the State Government and Commission from time to time in accordance with established rules and provisions.
(ii) The Merit List shall be valid for a period of one year from the date of its receipt in the department from Commission.
(iii) The administrative department shall determine the number of vacancies existing in each year and send the number of vacancies to the Commission on 1st April for recruitment.
7. Minimum Educational Qualification of the Candidate :-
(i) Graduate Degree with Economics/Mathematics/Statistics from any recognized University shall be compulsory.
(ii) Certificate course of minimum six months in Computer Application from any recognized institutions shall be compulsory.
8. Probation/ Departmental Examination/Confirmation :-
(i) Every employee shall, on appointment against the basic post vacancy, be on probation for a period of two years. Probation period may be extended for on year if the appointing authority is satisfied that probationer may improve during the extended period for permanent appointment. If the services are found not satisfactory during extended probation period, services may be terminated.
(ii) It shall be compulsory for every employee to pass the departmental examination conducted by Central Examination Committee of Revenue Board.
(iii) After first increment, the next increment shall be admissible only after passing the prescribed departmental examination.
(iv) Confirmation and promotion shall only be considered after passing the Departmental Examination, but this provision shall not be applicable to the members of this cadre appointed before the commencement of this rule.
9. Seniority-The inter-se seniority of the direct recruits shall be determined in accordance with the merit list prepared by the commission. Chapter 3 Promotion
10. (i) Promotion shall be made on different post of this cadre after the completion of time bar fixed by the department of Personnel & Administrative Reforms from time to time.
(ii) Cent-Percent post of Sub Planning Officer Shall be filled on the basis of promotion of Planning Assistant on the basis of Seniority-cum-Merit.
(iii) Employees of this cadre shall be promoted on the recommendation of Departmental Promotion Committee.
11. Reservation :- It shall be compulsory to follow the rules/ circulars/rosters/etc. prescribed from time to time by the State Government regarding reservation policy in recruitment in basic post and promotion on higher post. Chapter 4 Pay
12. Pay Scales :- Pay scales of various grades of posts shall be as mentioned in the schedule-1, or their corresponding revised scales notified by the State Government from time to time. Chapter 5 Miscellaneous
13. Training :- A member of this Cadre may be sent on training within or outside the state for such a period as the state government may determine. The assessment of an employee on the conclusion of the training may be taken into consideration by the Departmental Promotion Committee.
14. Other conditions of this Cadre :-
(i) Other conditions applicable to this Cadre such as, disciplinary action, leave, retirement benefits etc. shall be governed by the respective rules framed for employees and officials of the state government.
(ii) On the date of the commencement of these rules the following, previously created, basic grade posts of the Administrative Department shall be known with changed designations mentioned in Column 3. 15. Repeal
(i) On the date of the commencement of these Rules all other related and relevant circulars/decisions will rest rescinded.
(ii) In spite of such rescindation the work done or decisions taken under above mentioned Rules shall be treated as the work done or decisions taken under these rules, as if these rules were in force on that date on which such work was done or such decisions were taken.
(iii) State Government through the Administrative Department shall have powers to amend the provisions of these Rules and issue circulars/directions making clarifications on any doubts raised and its interpretation shall be final. The administrative department may determine the procedures, for giving effect to the provisions of these Rules, provided they are not contrary to any provisions of these Rules.
