Section 12: Removal of bar to attachment and sale by process of court

Nothing in any law shall prevent in any manner a bank from causing any land or any interest therein mortgaged of it or in respect of which a charge has been created in its favour by an agriculturist to secure any financial assistance to be attached and sold through a civil court and applying the proceeds of such sale towards all money due to it from that agriculturist including the costs and expenses as may be awarded by the court:
Provided that houses and other buildings (with the materials and the site thereof and the land immediately appurtenant thereto and necessary for their enjoyment) belonging to an agriculturist and occupied by him shall not be liable to such attachment and sale.
