Government of Bihar Department of Agriculture DIRECTORATE OF HORTICULTURE Notification Letter No.- 13/D.H-406/2019- /Agri. Patna, Date 202131 In exercising the powers conferred by the provision of Article 309 of the Constitution of India of all rules made in this behalf, His Excellency, the Governor of Bihar hereby formulates the following rules for the recruitment, promotion and service conditions of clerical services which are under the control of Directorate of Horticulture, namely:-
1. Brief Name, Description and Commencement:
(1) These rules may be called the Bihar Agriculture Departmental (Horticulture) Group-7 Clerical (Recruitment, Promotion and Other Services) Rules, 2021.
(2) This shall be applicable across the State of Bihar
(3) These shall come into force from the date of its publication in the official gazette.
2. Definition:
(1) Department means Department of Agriculture (Directorate of Horticulture), Government of Bihar
(2) “Cadre” means the cadre of clerical services (Udyaan level – 7) of Directorate Horticulture, Bihar
(3) Commission means Bihar Staff Selection Commission
(4) “Year” means financial year i.e. the period from 1st April to 31st March of ensuing year
(5) “Concerned Authority” means “Director Horticulture”
(6) “Member” means Person recruited under Lower Division Clerk cadre post
(7) “Appointing Authority” means Director Horticulture, Department of Agriculture, Government of Bihar
3. Constitution of Cadre and hierarchy of the post: This service shall be at the State level and Director Horticulture under the Department of Agriculture, Government of Bihar shall be the appointing cum controlling authority
(1) The basic position of this service shall be Lower division Clerk
4. Structure of the cadre: (a) The structure of the clerical cadre shall be as follows:

(b) The sanctioned posts for the above positions shall be as approved by the Government of Bihar from time to time basis.
(c) The Grade pay/pay scale of the said posts shall be as approved by Finance Department, Government of Bihar from time to time basis.
(d) Persons working under this cadre prior to the effective date, shall by default continue as part of this cadre
5. Recruitment and Promotion under the basic category-
(1) Post and educational qualification: The educational qualification for Lower division Clerk shall be intermediate or equivalent qualification along with knowledge of operating computers and computer typing.
(2) The minimum age for recruitment shall be 18 years and the maximum age shall be the same which State Government (General Administration Department) determines on time to time basis.
(3) The recruitment will be done by Director Horticulture on recommendation by Bihar Staff Selection Commission for the Lower Division Clerk post.
(4) The appointing authority shall take stock of the vacancies as on 1st April of each year and shall send the requisition to commission by 30th April.
(5) 85% of lower division clerk posts shall be filled through direct recruitment and 15% shall be filled on seniority based promotion of suitable Group „D‟ attendants having intermediate qualification. After the first pay rise of the promoted personnel on Lower Division clerk post, passing of computer competency examination, Hindi typing and drafting examination and departmental examination shall be mandatory for second pay rise. Then after next pay rise shall be applicable. Provisions of recruitment on compassionate grounds as approved by State Government from time to time, shall be also applicable.
(6) Director Horticulture shall send the requisition for vacancies as per the due procedure to Bihar Staff Selection Commission and the Bihar Staff Selection Commission shall publish advertisement for the vacancies, select the successful candidates based on competitive exam and send the list of candidates on merit basis as recommendation to the recruitment authority. The validity of the merit list shall remain till one year from the date of recommendation.
6. Recommendation of candidates by Commission: Commission will create separate merit list for general and other reserved categories based on the total marks obtained in the written examination. From these lists, the Commission shall send recommendation to Directorate of Horticulture (Agriculture Department) based on the reported requisition.
7. Reservation: The compliance of reservation/roaster as notified by the State Government from time to time, will be mandatory in recruitment and promotion.
8. Departmental Examination: (1) The Departmental examination will be conducted by Revenue Board. It shall be mandatory to pass the departmental exam conducted by the Revenue Board for the clerical cadre.
(2) All personnel who have passed the departmental exams conducted previously by the Agriculture Department, prior to these Rules being effective, shall be considered exempted from the Departmental Exam conducted by the Revenue Board.
9. Service Confirmation- The service confirmation shall be done after passing of Departmental Exam (Hindi typing and drafting examination and departmental examination conducted by Revenue Board).
10. Promotion:
(1) All the posts of Upper Division Clerk shall be filled through the promotion of lower division clerks on seniority basis after passing the departmental exam.
(2) For promotion to Upper Division Clerk, the duration based on salary (grade pay) determined by the General Administration Department of State Government shall be applicable
(3) The prescribed provisions of reservation under the services of State Government as prescribed by the General Administration Department from time to time, shall be applicable.
(4) The seniority list amongst the personnel appointed based on the recommendation of Bihar Staff Selection Commission and the personnel appointed after promotion in the same calendar year based from the lower post, shall be prepared as per the criteria prescribed by General Administration Department.
11. Departmental Promotion Committee: The formation of Departmental Promotion Committee shall be done through another order by the Department.
12. Remaining Matters- Any matter or points not covered under these rules, the provisions of the existing rules/ manual/ order/ instruction by State Government shall be applicable for the time being.
13. Repeal and Savings-
(1) All the orders/instructions/circulars released for the recruitment/service condition of this cadre before the commencement of these rules in so far are hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the orders so repealed shall be deemed to have been done or taken under the corresponding provisions of these rules.
