1. Short title, extent and cornmencement- (1) These rules may be called "The Bihar Prohibition and Excise Rules, 2O21".
(2) It shaU extend to the whole of the State of Bihar.
(3) These rules shall come into force on the day of its publication in the dffi.i^1 o^?crtF
2. Delinitions- In these rules, unless otherwise required in the context:
(1) "The Act" means the Bihar Prohibition and Excise Act, 2016 (Act 20 of 20t6X as amended from time to time);
(2) "Agency or Agent" means, individual firm/government institutions selected by the State Government for the purpose of procurement of Excise Hologram/Adhesive labels/ cPS enabled Digital lock;
(3) "Bulk litre" means a litre with reference to the bulk or quantity of the contents;
(4J "Chemical Examiner" means the officer appointed by the Government as chemical exarniner to the Excise Chemical Laboratory, Forensic Science Laboratory, the Central Revenue Control Laboratory or the Central Forensic Science Laboratory, and also includes the deputy chemical examiners of the above laboratories or any other laboratory declaied by the Excise Commissioner after due approval of the Department;
t5) "Department" means the Department of Prohibition, Excise and Registration, Government of Bihar;
(6) "Form" means form prescribed under these rules;
17) "New Excise Policy'' means the policy duly framed by the State Government and published vide gazette notification no. 3893 dated 2t-12-2015;
{8) "Person" includes ar individual, Hindu undivided family, partnership firm, cooperative society, and company incorporated under the Companies Act, 1956 (1 of 1956);
(9) "Section" means the section of the Act;
(10) "Year" means the year beginning with lst April and ending with 31st March of subsequent year.
Chapter 2 Requlation of Manufactorles.
The manufactories of hdustrial Alcohot- (1) The manufactorres shall obey the regulations and directives issued by the State Government in furtherance of New Excise policy and complete prohibition.
(2) The manufactories shall observe all ttre guidelines of the State Pollution Control Board.
(3) No manufactory shall make any alteration in the plant or add or remove any other permanent apparatus/plant/machinery without the prior approval of the Excise Commissioner. Such application for alteration, addition or replacement must be routed through the Collector. An apphcation for such alteration shall be made in Form EL- 1A. The Collector shall issue the permission in Forrn EL - 1B after receiving approval from the Excise Comrnissioner. The alteralion approved by the Excise Commissioner will be entered into the map.
(4) Proprietor of every manufactory must give 15 days prior notice in wdting to the Collector ol the date on which he proposes to commence operations and at least one month prior notice belore closure of its operations.
Grant of permits, passes etc. for export, transportation and transit of Indlstlial Alcohol and lltoxicants manufactured within the State of Bihar- The movement or transportation of Industrial Alcohol and Intoxicants manufactured within the State of Bihar shall be resulated in the following manner:-
(i) An export permit may be issued after the manufacturer produces a valid import permit to the Excise Commissioner. Upon receipt of the import permit and an application in form EL-2A, the Excise Commissioner shall consider giving an export permit valid up to a period of one month in form EL-28.
(ii) Consequent upon the issue of export permit, the Excise Officer deputed at the manufacturing unit shall be competent to issue movement pass on the date of movement authorizing the manufacturer to move the required quantity of industrial alcohol or intoxicants from the manufacturing point to the destination.
The pass so issued shall have validity up to the remaining period of exDort Dermit.

(iii) The Excise oflicer deputed at the manufacturing unit shall ensure that the movement of industrial alcohol is orrfi., u GpS enabled d igitally locked vehicle.
(iv) There shall be no fee for issuance ofany movement pass.
(v) The Excise Commissioner shall be competent to change ttle above procedure after due approval of the Department as and when the systems are made online or for any other purpose.
Pocrer to am€nd Forrns, Formats etc._ The Excise Commissione. shall be empowered, after approval of the Department, to prescribe, change, amend or delete any form, formats etc in order to make the entire Prohibition and Excise regime ,,online,, or for any other purpose.
Chapter 3 crain Based Distilleries.
ENA and Ethanol produclng Grain Based Distillerles_ If any grarn based dis.tillery is pr_oducing ENA or Ethanol, such distillery shall abide oy rne rorowrnq condrt_rons:_
(i) The manufacturer company/distillery shall not acr rn ally manner prejudicial to the Goveinment,s prohibition policy.
(ii) The distillery shall neither manufacture potable alcohol nor convert the ENA or Ethanol to potable alcohol.
(iii) All the consignments, be it raw material or the final product, entering in or exiting out of the distillery premises shall be transported in GPS enabled digitally locked containers.
(iv) The Excise Commissioner shall appoint excise officers and other functionaries as he thinks fit at t}le distillery for compliance of the provisions of the Bihar prohibition and Excise Act, 2016 and rules made there under.
(v) It shall be duty of the proprietor of the distillery to install CCTV camera systems for round-the-clock surveillance of the premises and surrounding areas to capture the movement of vehicles entering and exiting the distillery. The data of the same should be stored atleast for a period of one month for the use of the inspecting authority.
(vi) The ENA or Ethanol, if produced/manufactured by a manufacturer company/distillery, shall be subject to periodical chemical analysis by or under the specific or general orders of Excise Commissioner or Collector, and the manufacturer company shall take steps to iemedy any defects in the quality thereof to the satisfaction of tlre Excise Commissioner.

(vil) The manufacturer company shall be bound to make such arrangements. as may be prescribed in writing by the Excise Commissioner or Collector for the disposal o|lffluents, waste. natter and refuse.
(viii) The distiller shall kee showing )p accurate and regular daily accounts
(a) The quantity and description of materials used.(b) quantity of wash and Industrial alcohol manufactured.(c) quantity of wash used.
(d) quantity oflndustrial alcohol passed out
(e) quantities of wash and Industrial alcohol in store.(f) quantities of by-products such as impure spirit in store.(g) quantity of denaturants used and in store.(i") The manufacturer company, in compliance of judgement dated
14.O7.2Ot7 passed in SLP(C) 16823_16331/2012, shall be bound to undertake that it shall neither manufacture potable alcohol, nor convert the industrial alcohol to potable alcohol and additionally will not submit any application for renewal of licence for manufacture of potable alcohol.
(") The breach, non-performance or non_observance by the manufacturer company/distillery or his agent of any of the conditions specified by the Excise Commissioner or anv provlston of the Bihar prohibition and Excise Act, 2016 or rules framed thereunder, so far as they relate to the manufacture/production of lndustrial alcohol, shall be liable for penal acrion as per rte provisions of Chapter VI of the Act.
(xi) The manufacturer company shall be bound by all general or special orders which may be issued by the Excise Commrssroner from time to time.
Chapter 4 Ttansit and Transportatio! of Intoxicants, ENA/ Industrial Alcohol alrd empty bottles ?ransit and Transportation of Intoxicants, ENA/Industrial Alcohol_
(1) If any consignment of intoxicant or ENA/industrial alcohol is beins transported _by road through the territory of Bihar from a place outside the State of Bihar to another place outside the State of Bihar,it should mandatorily pass through one of the entry points or exit points declared by the Excise Commissioner. The driver or anv other person in-charge of the vehicle shall, at the time of entry, obtain a transit pass in Form EL-3B at such entry point upon submission of an application in Form EL-3A

(2) The Transit Pass so issued in Form DL-3B shall be surrendered by thecoBcemed driverfperson_in_charge oi vehicle before exit at the last destined exit point of State of Bihar within a peiod of 24 Hours fromthe date and time of issue of Transit pass at the frrst entrv point. fhefailurc of driver/person in charge in this regard *fi .it'u"t p""rt provisi.ons of Chapter i{ of the AcL
(3) Pvey vehicle transiting through the State of Bihar shall, upon entryin the State, at the time of issuance of transit pe.mii, elt a ces enabled digital lock installed in such manner and on piyment of such fee as may be prescribed by the Excise Commissioner. "
(4) Empty bottles .for the purpose of bottling intoxicants being transported or in transit through tle territory of Bihar shall be carried in digitally locked containers. Failure to do so will attract the penal provisions of Chapter VI of the Act.
(5) Any officer within t] e meaning of Section 73 of the Act shall have power to intercept the movement, ca-l1 upon the driver/person_in_ charge of the vehicle to furnish the transit pass issued at entry check post and any other paperi/documents related to transportation of consignment and, upon reasonable suspicion, shall be able to detairt,_.search and inquire into and upon such search and inquiry, on finding violation of any direction of the Excise Commissioner or the provisions of the Act or these Rules, may seize any document, conveyance, anima-l or intoxicant, and shall be empowered to take action under the provisions oI the Chapter VI of the A;t.
Accidents or breatdown ofvehicles ln translt or transport
(1) Should the vehicle or conveyance carrying the intoxicant sufler aI accident or breakdown, the driver or the person-in-charge of the vehicle or the owner of the vehicle must inform immediatelv about the incident lo the loca.l Excise Officer/police Otficer. Any unnecessary delay will have to have sufficient explanation.
(2) When information of such incident is received by a police Officer, he shall forthwith report the matter to the local officer of prohibition ald Excise Department who, upon receipt of such information, shall immediately visit the accident site and tal<e note of the loss, if any, of the intoxicant along with taking photographs ol the site.
(3) The Excise Offrcer shall then prepare a detailed inventory and submit a report to the AssisLalt Corrrnissioner of Excisc /Excise Superintendent of the district concerned. If it is not possible for the owner to transfer the intoicant to some other means of conveyance or if he is unwilling to receive the stock of the intoxicant then, upon the report of tie Assistant Commissioner of Excise/Excise Superintendent, the same shall be confiscated by the Collector and destroyed as per provisions of the Act.
Chapter s Storage and Locking of Iadustiial Atcohol
9. Storage oflndustdal Alcohol_ (i) Industrial Alcohol shall be storedin warehouses that shall be inspected by the authorized Excise ofliceron a regular basis.
(ii) Any enhancement of storage capacity shall be made only after duepermission of the Excise Commissioner.
lO. Collectioa of samples of industrial alcohol. _
(1) Any Officer within the meaning of Section 6 of the Act will be empowered to take samples of industrial alcohol for analysis. Samples in triplicate shall be taken in the presence of the manufacturer or his authorzed representative and such samples shall be immediately and securely sealed in the presence of the manufacturer or hls authorized representative with their signature on the label to be affixed on the sample. Out of samples so collected, one bottle of sample shall be handed over to the manufacturer or his repr.esentative, the second bottle of sample shall be dispatched to the chemical examiner for aralysis and the third sample shall be kept in the store of the local Excise office.
If the manufacturer or his representative is not present or refuses to sign on the label for any reason, then the sample shall be collected by the Excise Officer and the label shall be signed by him/her. The reason for the same shall be noted and forwarded in the forwardine Ietter.
(2) Where the sample is found not to conform to the prescribed specilications on chemical examination, the manufacturer shall be liable for penal action as per the provisions of Chapter VI of the Act and the samples shall be destroyed aiter a period of six months in the manner prescribed by the Excise Commissioner unless there is an order to the contrary of a Court of competent jurisdiction.

Chapter 6 Cantotlment Area Matters On Military Consignments to CSD {Canteen Stores Department) Catteens etc.-
(i) All the intoxicatts that are required to be moved from one place to another for the purposes of CSD Canteen run bv the Armed Forces shall be through trartsport vehicles under army escort.

(2) Only such CSD Canteens of the Military which are located ,,r{thin the.
-cantonment area, military "t"tio,l" ."J- J.' iIiJ"" "a,,or,"notified under the Cantonment Act, 2006 shall be allowed tostore any liquor or intoxicants.
(3) No personnel of the Armed Forces or retired personnel of theArmed Forces shall be a liquor outside il ;#jffiXl ;" "i?l]"fi i,,X'.,i":% ":,:'",::::stations so declared under the cantonment d"t,---ood,r. u.ryother notification.
(4) The Department shall issue necessary guidelines lorrransportation, storage and accounting of stocl in such places.
Chapter z Confiscation and Disposal.
Sealing of Pre'nises- (A) (i) If arly offence is or has been commrtted inany premrses {w^hole or part thereof) under the Act, any officer withinrne meanrng ot Section 73 of t}re Act may immediately seal thepremises (whole or part thereo0.
, Immediately here means that sealing should be done in the course oJ the raid itself. In any case, sealing shill be done witlin 24 hours of the institution of First Information Report.
(ii) Seating shall be reported to the Collector withiIl 24 hours of the seatlng.
(iii) Ifthe premises used, is a temporary structure which cannot be effectively sealed, ttre police Officer/Excise Officer shall, as soon as possible after obtaining the order ol the Collector, demolish tne temDorary structure.
(iv) Whe19 ".r" t-*".t , is or has been manufactured, botfled,distributed, collected, stored, sold, purchased, imported, exported or transported in any premises or part thereol such premises shall be fully sealed.
{v) As far as possible, only that portion of private residential premises which has been used for committing offence shall be sealed and not the whole premises or entire resldence.
(vi) Where any residential premises or part thereof is being used to provide facility to consume intoxicant(s) to other persons, such premises shall be compulsorily sealed.
Explanatiol:- If a premises is consisting of multi unit with different ownership only the specific unit where the offence has been committed shall be liable for sealine.
(Bl Confiscation of premises or other properties
(i) The Collector, on receipt of proposal of conliscation of any premiseso. part thereof or any property liable for conflscatron lrom porice Officer/Excise Officer, shall issue show "u""" "oti"" to the owner(s) -. of the premises or property.

(iv) If the person to whom notice has validly been served fails to appearin the proceeding on two consecutive dates fixed for hearinf,. theconfrscating authority-shall proceed to pass the order ex_parte.{vl lne Uollector shall, after hearing the parties, pass appropriate orderof confiscation or unsealing, .i the ca"e may be,'with respect toscaled/seized p(enises or property on thc basis of hie satisfaction whether an offence has been committed or not in terms of the Act.(vi) The Collector shall pass the order of confiscation within 90 days fromthe date of appearance of the affected party/parties after appreciation of evidences with reasoned order.(vii) Any person aggrieved by the order passed by the Collector under theprovisions of t}}e Act may fite appeal in the manner prescribed under these rules.
13 (Al. Seizure of aniaal/vehlcle/ vessel/ other conveyance_
(i) On interception and search, if an officer within the meaning of Section73 of the Act finds that any animal, vehicle, vessel or other conveyance is being used for carrying any intoxicant or liquor, thenthe same shall be seized and forwarded to tlle nearest police station/Excise Office \a'it}}in whose jurisdiction the seizure has been effected along with seizure list for institution of case.
(ii) Upon institution of the case, the proposal for confiscation of aaimal/vehicle/vessel/other conveyance shall be sent to the Collector alongwith due verification report of the District Transport Offrcer or any authority authorized for the purpose of registration of the conveyance and the report of chemical examiner within 30 days of. seizure. In case of delay in submission of the proposal for confiscation, the Police/Excisc officer will have to explain the aetay.
(B). Con{iscation ofVehicles, Vessels or other Conveyances
(i) The Collector, on receipt of proposal for confiscation of any vehicle(s) or other conveyances from police Officer/Excise OIficer, shall issue show cause notice to owner of the said vehicle or tie vessel or other conveyance,

Expalnation: the word "hnaliB/ connotes the date of order of Excise Commissioner passed under Section 92 of the Act.
Chapter _8 .
BSBCL and its Role.
BSBCL (Bihar State Beverages Corporatio! Limitedl. _ The tJihar State Beverages Corporation Limited is a company incorporated under the Companies Act, 1956 under the aegis of the prohibition, Excise and Registration Department to provide, encourage and initiate facilities for promoting total prohibition and other works related to the department.

16. Role of BSBCL,-(l) BSBCI. shall act as an implementing agency of the Department with regard to fulfillment of ttre otriectiv-es ot totat prohibition.
{2) BSBCL shall also be responsible for implementing and strengthening the enforcement infrastructure in order to a'chieve t}}e objectives of total prohibition.
(3) It shall also support and assist Health Department authorities in establishing and operating De-addiction centers at such places as the State Government may decide from time to time .
(4) BSBCL shall also encourage voluntary prohibition in the State and shall reward such organizations, NGOs, persons, workcrs, women groups in terms of the New Excise policy, 2O15. BSBCL shall also undertake awareness campaigns ani advertising m promote voluntary prohibiticrn arrd undei.take various outrcach programs to generate social awaieness about the ills of addiction.
(5) BSBCL shall also suppur I zLnd assist the Collcctor in cnsurins proper enforcement of total prohibition regime by providin!
adequate finalcial aid infrastructuial support in setting up check posts, barriers, haajat end mdalkhana, vehicles, conveyince, man power, IT equipment and such other assistance that the Collecror mav require.
Chapter - 9 Rewards zrnd Incentives.
77. Rewards-
(l) Cash Rewards to Covernment Servants - The Department may, from its own funds, provide or announce cash reward to the personnel of the Department who have done outstanding work in enforcing the prohibition regime.
{2) Cash Rewards to informers. -The Department may also make provisions for giving reward to civilians who help in ensuring maJor recovery of intoxicants and/or illegal liquor.
(3) Prohibition Medals.-The Department may also confer prohibition Medals for good work done by any Excise officers/police officers.
(4) The Department shall make detailed guidelines for conferring cash rewards, Prohibition Medals etc.

Chapter 11 Procedure for grant ofball in bailable offences.
Bail in case of an offeace contnltted for the lirst tine under sub sectton (1) of Section 37(tl and offencb under Section 54(21 of the Act, The provisions of Section 436 of Criminal procedure Code, 1973 shall be applicable for bail in case of an offence committed for the first trme under sub-section (1) of Section 3Z and sub-section (2) of section 54 of the Act. To establish the identity of the person to be released on bail, the concerned person has to furnish vaiid photo identity card along with the bail bond.
Chapter-12 Appeal and Revision Appeal and Revislon - (1) Every appeal under Section-92 shall be made in tlle form of a petition addressed to the authoritv to whom the appeal lies, shall be drawn up in concise and intelljgible language, shall bear the signature or mark of the appellant and hiJ d;ly authorized lawyer.
(2) The petition of appeal shall contain the following particulars:
(a) The name, father's name, occupation and place of residence or business address of the appella-nt;
(b) The date of order appealed against;
(c) A brief and precise statement of facts;
(d) The grounds of objection to the order appealed against.
(3) The petition shall be accompanied by arl original certified of the order appealed against.
Hearing of appeal - (1) The appeuate authority shall flx a date for regular hearing and issue notice for the same.

Copy of order to be supplied - A copy of order passed in appeal shall be supplied free of cost to the appellant and another copv shall be sent to the officer whose order forms the subject matter of appeal.
Ptocedure to be followed for filing revision _ The procedure prescribed for appeal shall also be applicabte for filing revision,
(i) The Secretary of the Department shall exercise the power of Revision.
(ii) A date for regular hearing of the revision shall be fixed.
(iii) If, on the date frxed for hearing, the revisionist does not appear before the said authority either in person or through an agent, the said authority may decide the revision application ex parte on the basis of material available on record.
(iv) The said authority shall pass the Revision order within 30 days from the date of appearance of the affected party on appointed date with reasoned order.
