1. Short title, extent & commencement. - (1) These Rulesmay be called as the "Bihar ~ood SafetyService(Amendment) Rules,2019."
(2) It will extend to the whole State of Bihar.
(3) It will come into force at once.
2. Amendment in rule-2 of the Bihar Food Safety Service Rules, 2014. - In rule-2 of the said Rules2014, clause (iii) shall be substituted by the follbwing :- "(Ill) 'Commission' meansBiharTechnicalServiceCommission;"
3. Amendment in rule-6 of the Bihar Food Safety ServiceRules,2014. -
(1)The Following para III shall be added after para (ii) of Column 5 of clause II of the appendix- I relatig to the qualifications for the direct recruitment on the post of food analyst asmeantion in procedure for recruitment in Rule6 :-
(iii) For appointment to the post of food analyst candidate must have to pass the\ .
examination held by FSSAI,NewDelhi.
(2)The rule-6 of the saidRule.s2014 shall be substituted by the following:- "6. Procedure for recruitment. - (1) The Department, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send requisition based on categorywise reservation to the Commissionlatest by so"April.
(2) In light of requisition, the Commissionshall invite applications by advertising vacanciesand shall prepare merit list on the basisof following:-
(a) FoodSafetyOfficer-
(i) Formarks obtained in Bachelor or equivalent Degree in the subjects mentioned in Qualification Column of Appendix-I - 70 Marks
(ii) Fbr higher degree (subjects) in qualification column of Appendix-I - 10 Marks
(iii) Work experience from Government insititute or equivalent - 20 Marks (2 marks for every six months and maxium 20 marks) Total 100 Marks Note - (i) The marks to be given to a candidate for bachelor or equivalent degree shall be determined by multiplying percentage of marks obtained in the examination of aforesaid course by multiple of 0.7. For example, if a candidate has obtained 50% marks, he will be given 50%X0.7 =35marks.
(ii) For every failure, candidate should be awarded negative 2 marks mention in Qualification column of Appendix-I
(iii) Work experience of Government Institutions means work experience under the Central Government, StateGovernment or any other State Governments.
(iv) It will be compulsory for the candidatesto have 33%marks for selection to qualify.
(b) FoodAnalyst-
(i) For marks obtained in Bachaloror equivalent Degree in the subjects mentioned in Qualification Column of section II of Appendix-I -70 Marks
(ii) For higher degree (subjects) in qualification column of section II of Appendix-I -10 Marks
(iii) Work experience for food analyst in Government Institutes (2 marks for every six months & maximum 20 marks) -20 Marks Total 100 Marks .Note ., (i) The marks to be given to a candidate for Master or equivalent degree shall be determined by multiplying percentage of marks obtained in the examination of, .
aforesaid course by multiple of 0.7.·For example, if a candidate has obtained 50% marks, he will be given 50%X0.7 =35marks.
(ii) For every failure, candidate should be awarded negative 2 marks mention in Qualification column of section II of Appendjx-I
(iii) Work experience of Government Institutions means Central Government, State Government or any other State Governments.
(iv) It will be compulsory the candidates to have 33% marks for selection.
(3).After preparing merit list on the basis of sub-rule (2), preliminary scrutiny of the certificates and medical checkup shall be conducted by the Commission with the cooperation of the Department, and thereafter, based on categorywise reservation final recommendation, in accordance with the requisitioned vacancies, shall be sent to the Department. At the level of Department also, after scrutiny of certificates, a declaration regarding antecedents of the recommended candidates shall be obtained in the prescribed form and their antecedents- shall be caused to be verified by the police.
(4) After recommendation of the' Commission, compliance of instructions issued by the Government, from time to time, with respect to the procedure of appointment, shall be necessary."
4. substitution of proviso to rule-13 of the Bihar Food Safety Service Rules, 2014. - The proviso to rule-13 of the said Rules 2014 shall be substituted by the following:- "Provided that the meeting of the Departmental Promotion Committee to consider promotion in the maximum grade-pay/pay-Ievel shall be presided over by the Chairman or any Member of the Bihar Technical Staff Selection Commission and for the higher posts of the Bihar Food Analysist Cadre, the meetting will be presided by the Chairman or any member of The Bihar Public Service Commission.
