Government of Bihar Department of Health Notification T3+ ob = 113 (20 pueg e 11,2013 In exercise of powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Bihar is here by pleased to make the following rules:- Chapter - 1 General Provisions

1. Title, Extent and Commencement:

(1) These rules may be called the Bihar Health Service (Appointment and Service Condition) Rules 2013,

(2) Itshall extend to the entire State of Bihar

(3) Itshall come into torce at once

2. Definitions: In this Rule unless anything otherwise requires in the context:

(a.) ‘Government’ means Government of Bihar (b.) ‘Department’ means Department of Health (c.) ‘Commission’ means Bihar Public Service Commission (d.) 'MBBS' degree means MBBS degree recognized by Medical Council of India.

(e.) ‘PG Degree’ means Post Graduate Degree recognized by Medical Council of India such, namely M.D., MS. and similar or higher degree.

(f.) ‘Higher Degree’ means DM, MCH degree or equivalent degree recognized by Medical Council of India & i Chapter - 2 Bihar Health Service Cadre

3. Constitution of Service:- (1) there shall be following two sub caders in Bihar Health Service Cadre:-

(a) Bihar Health Service : General Duty sub-cadre (b.) Bihar Health Service : Specialist sub-cadre

(2) Daoctors of these cadre can be transferred and posted anywhere in the State.

4(1) Appointments to the Bihar Health Service will be made by the Government against the posts of Medical Officer/Specialist Grade-1l. in view of the available vacancies. Each year, they shall be selected according 1o the procedure prescribed in these rules. The selection shall be made through the Bihar Public Service Commission and it shall be necessary to follow the age limit and reservation rules determined by the government.

(2). In ¢ of non availability of suitable doctors for appointment / promotion, in the public interest, Government may appoint doctors on contract from outside for a limited period. The procedure for such recruitment would be decided by the govt.

5 For appointment in General Duty Sub Cadre, minimum educational qualification shall be MBBS degree from a recognized university:

Provided that the postgraduate or higher degree holder in any subject of Medical science and the doctors appointed on regular/ contract basis in any Government hospital shall be given weightage for work experience.

6. For selection of doctors to appointment in General sub-cadre, candidates shall be given marks for their educational qualification and work experience. Apart from that, they shall also be given marks for the oral interview.

A total 100 marks shall be for educational qualification, work experience and interview.

The break up of these 100 marks shall be as follows:

(i) Marks obtained in MBBS: Total 50 Marks (ii.) PG orHigher Degree: Total 10 Marks (iii.) Work Experience after appointment in Government hospital on contract/regular has . Total 25 Marks

Provided that for each complete one year of work experience, candidates will be given 5 and thus maximum 25 marks will be given.

(v, Interview: Total 15 Marks Note - (a) The determination of marks to be given to the candidate for MBBS shall be in multipie of 0.5 of total percentage of marks obtained in the examination of said course. Thus, if a candidate has obtained 50% marks, he/she shall get 50 x 0.5 = 25 marks

(b) Minimum 30 marks will be required for consideration for the appointment in the General sub cadre and specialist sub cadre.

7. Postgraduate degree from a recognized degree university shall be the minimum educational qualification in the concerned subject for appointment in the specialist sub cadre.

Provided that holder of higher degree than postgraduate degree in related subjects and work experience of doctors appointed on regular / contract basis in govt. Hospital having post graduate degree shall be eligible for weightage .

8. For selection to the appointment in Specialist sub-cadre, candidates shall be given marks for their educational qualification and work experience. Apart from that, they shall also be given marks for interview, As per the above, for educational qualification, work experience and interview a total of 100 Marks will be given. The break up of 100 marks shall be as follows:

(i) Marks obtained in MBBS § Total 50 Marks

(i) Higher Degree than PG Degree t Total 10 Marks Such as DM/MCH and equivalent (recognized by the Medical Council of India) (iii.) Work Experience of appointment s Total 25 Marks in Government hospital on contract/regular basis.

Provided that for each complete one year of work experience, candidates will be given 5 and thus maximum 25 marks will be given.

(iv) Interview: Total 15 Marks Note :- (a) The determination of marks to be given to the candidate for MBBS shall be in multiple of 0.5 of total percentage of marks obtained in the examination of said course. Thus, if a candidate has obtained 50% marks, he/she shall get 50 x 0.5 = 25 marks

(b) Minimum 30 marks will be required for consideration for the appointment in the General duty sub cadre and specialist sub cadre.

Chapter -3 Direct Recruitment

9. ‘The appointment in basic category of both the sub cadres of the service shall be made by direct recruitment according to the provisions of chapter 2 of these Rules through recruitment examination to be conducted by the commission. The seniority list of both the subcadres shall be determined separately on the basis of merit lists recommended by the commission.

10. The department shall inform the commission the numbers of vacancies as on 1% April to be filled by direct recruitment.

11. Probation and Confirmation : In the beginning this appointment shall be made on probation.

The candidates selected for appointment may be made permanent/ given confirmed status after satisfactory service record and after passing of departmental examination.

12. Conduct of Recruitment Examination and declaration of vacancies:- After receiving information of vacancies to be filled by direct recruitment and requisition of vacancies from the government, the commission shall declare the number of vacancies to be filed by direct appointment in such manner as it thinks proper and shall invite applications from the candidates eligible under rule-6. The commission shall conduct Recruitment Examination each year, if not otherwise notified in view of number of vacancies.

13. Determination of Eligibility : - For the purpose of entrance in the recruitment examination, a candidate -

(a) Must have the same maximum age of the candidate on 1% August of the year in which examination is to be held as determined by the General Administration Department reservation category wise from time to time;

(b) Must be of good moral character;

(c) Must be mentally and physically healthy and free from physical disorders, which may create problems in performance of his duties as an officer of Bihar Health Service;

(d) Must be permanently registered with Medical Council of India or Medical Registration Councii of any State.

14. The Candidate must submit following records with his application:-

(1) Evidence of required qualification as specified in rule 13.

(2) Evidence of required qualification for weightage as specified in Rule 6 & 8.

(3) Character and conduct certificate from Head of the College from where he has passed his MBBS or PG examination;

(4) Certificate from the Head of the Institute from where he has completed 12 month’s internship;

(5) Permanent registration number from Medical Council of India or Medical Registration Council of any State;

(6) Matriculation Certificate or equivalent certificate for proof of age;

(7) Medical certificate from a government medical officer not below the rank of Civil Assistant Surgeon in prescribed format of the Commission.

(8) If he claims of reservation, Caste Certificate issued by the Sub-Divisional Officer/ District Magistrate of the District of which he claims to be permanent resident.

(1) If a candidate does not possess Admit Card received from the commission then he will not be allowed to appear in the Recruitment Examination

(2) The application of any such candidate shall not be accepted who is not eligible for appointment.

16. Notwithstanding any thing contained in foregoing provisions of these Rules the commission may require from a candidate to produce any such additional certificate on any point regarding his suitability, which it may deem necessary.

17. Subject to the provision of these Rules, decision of the commission shall be final with respect to the eligibility or otherwise in the Recruitment Examination.

18. Any candidate is guilty or declared guilty by the commission of the following:-

(1) getting support for his candidature by any means, or

(2) impersonation, or :

(3) using impersonation or

(4) submission of false document or such document which is forged, or

(5) giving wrong or false information or hiding important information, or

(6) taking support of other irregular or improper means for his candidature for the examination, or

(7) adopting unfair means during the examination

(8) troubling or hurting the personnels employed by the commission for conduct of the examination,

(9) auempting or instigating, as the case may be, any one or all actions specified in foregoing clauses, shall be liable for the following punishment in addition to penal prosecution :-

(a) to be declared disqualified by the commission for the examination for which he is a candidate,

(b) Forapermanent or for a specified period:

(1) to be debarred from any examination or any selection done by the commission.

(2) to bedebarred by the State Government from employment under the government.

(¢) Disciplinary action under the Rules if he is already in government service.

19. Marks obtained in Viva-Voce shall be added to the marks obtained on the basis of educational qualification and work experience. Name of the candidates shall be prepared by the commission in order of merit on the basis of total marks obtained. The commission will then select such number of the candidates as fixed by the govt. and recommend their names for appointment.

20. While sending its recommendation under rule 19, the commission shall recommend the appointment of the candidates in reservation category (e.g. scheduled caste, scheduled tribe, extremely backward etc) according to reservation policy of the government as applicable, from time to time.

21. The candidates selected for recruitment examination shall turn up on the date, time and place notified by the commission on their own expenses.

22. The commission shall prepare consolidated result of the recruitment examination and after preparation of result as well as sending of the list as per rule - 19 to the government, intimation shall be sent to the candidates immediately.

23. Success of a candidate in the examination does not confer right to appointment unless after necessary enquiry the government is satisfied about his suitability for government job based on his character and antecedents.

Chapter - 4 Classification of Posts Promotion ctc.

24. Classification of posts, pay scale and promotion:

(a) Different posts in the service shall be according to schedule - 1

(b) The following posts shall be deemed to be administrative posts:-

(1) in-charge Medical Officer, Primary Health Centre,

(2) Deputy Superintendent, Referral Hospital/Sub-divisional Hospital/ Sadar Hospital;

(3) District level officer in charge of Disease control programmes;

(4] Civil Surgeons/Deputy Director & equivalent posts;

(5) Director/Regional Director;

(6) Director-in-Chief;

oL Posts mentioned in sl no. (1) & (2) shall be filled upon the basis of seniority from amongst the working doctors in the concerned hospital.

The total nos. of posts mentioned in sl. no.(4) shall be three times the total no. of sanctioned posts of Civil Surgeons in the State. Civil Surgeon shall be selected from amongst senior doctors of this level on the basis of seniority cum merit and efficiency. The post of Deputy Director and its equivalent shall be notified by the department.

For General Duty subcadre and specialist subcadre separate number shall be fixed by the Department from the total posts mentioned in serial no. (3), (4) and (5)

25. Dynamic ACP [€)] Doctors of Bihar Health Service will be granted first financial progression, along with up-gradation of post, on completion of six years. Second and third financial progression, along with up-gradation of post, will be granted after equal intervals of 6 years each following the first financial progression.

2) The facility of dynamic ACP will be provided up-to maximum pay scale of PB -4, Grade Pay - 8700, 26 Determined Qualifications for Dynamic ACP/Promotion:-

(1) Services of Doctors will be confirmed after satisfactory completion of probation period of two years, provided that they have passed prescribed departmental examination and got necessary treasury training.

(2) The Dynamic ACP/Promotion will be considered on the basis of recommendation of Departmental Promotion Committee. Departmental Promotion Committee will recommend Dynamic ACP/ Promotions after considering following things:-

(a) Character Roll;

(b)) Vigilance report ;

(c.) Other standard as may be determined for this purpose from time to time by the State Government

(3) KALAWADHI and Other conditions for promotion shall be determined separately by the Department.

(4) Reservation - Reservation shall not be required for dynamic ACP as by this mechanism lhe(sincm‘)\x}red post it-self is elevated (in-situ promotion). For promotion against the / 8 S LN need-based posts above the level of dynamic ACP, it will be necessary to follow the prescribed reservation roster.

Chapter -6 Miscellaneous

27. Power of removal of difficulties - The powers, for interpretation of any rule / sub rule or removal of any difficulty arising in implementation of these Rules, shall vest in the Government.

28. Repeal and Savings- (1) The Bihar State Health Services (Basic Grade) Recruitment Rules, 1984 and Bihar District Medical Cadre/Bihar Health Service Cadre (Appointment on Regular / Contract basis and Service Conditions) Rules, 2008 are hereby repealed.

2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said Rules shall be valid and shall be deemed to have been done or taken in exercise of the powers conferred by or under these Rules as if the Rules were enforced on the date on which such thing or action was done or taken.

i Title, Extent and Commencement :

(1) These Rules may be called as the Bihar Health Service (Appointment and Service Condition)(Amendment) Rules, 2014.

(2) Itshall extend to the entire state of Bihar.

(3) Itshall come into force from the date of publication in the official Gazette.

2. Rule-2(e) of the said Rules, 2013 shall be substituted by the foliowing “(e] ‘PG Degree’ means post Graduate Degree namely M.D., M.S. and equivalent or higher degree or Diploma/D.N.B. Degree recognized by Medical Council of India.”

3. first para of Rule-7 of the said Rules, 2013 shall be substituted by the following :

"[1) Post Graduate degree/Diploma or D.N.B. Degree from a recognized Univarsity shall be the minimum qualification in the concerned subject for appointment in the specialict sub-cadre.

the appeintment in pay scale of Specialist Grade-! in specialist sub cadre, three and five years work experiences will be essential for the candidates having P.G Degree and Diploma respectively. 1. Short title, extent and commencement. — (i) These Rules may be called the "Bihar Health Service (Appointment and service condition) (Amendment) Rule, 2019."

(ii) It shall extend to the whole state of Bihar.

(iif) It shall come into force from the date of issue of notification.

Rule-6_of the "Bihar Health Service (Appointment & Service Conditions) Rules, 2013 is substituted by the following:- "For selection of Doctors for appointment in General Sub Cadre, candidates shall be given marks for their educational qualification and work experience.

According to above, a total of 100 determined marks shall be for educational qualification and work experience. These 100 marks ‘shall be determined according to following:-

(i) Marks obtained in MBBS — Total 60 marks

(i) Post Graduate or Higher degree — Total 15 marks

(iii) Work experience after appointment in Government hospitals on regular/ contractual basis ~Total 25 marks"

Provided that for each complete one year of work experience 05 marks will be given and thus a maximum of 25 marks will be given.

Note-(a) The determination of marks to be given 1o a candidate shall be determined by multiplying total percentage of marks obtained in the examination of said course by a multiply of

0.6. For Example, if a candidate has obtained 50% marks, he/she shall be given 50x 0.6=30 marks.

Provided also that there shall be no provision of interview for appointment on the post of Medical officer. The recommendation shall be made by the Commission for appointment after preparation for merit list on the basis of marks obtained according to educational qualification and work experience. In accordance with the provision made in General Administration Department's Resolution no. 12535 dated 17.09.2018 (as amended form time to time), 50 percent /{Lj horizontal reservation in all reservation categories shall also a1 OActand Rule sec-2 09.07.2019 docx apply for the candidates who have passed from the Medical Colleges of the Bihar State.

4. Substitution of rule-8 of the Bihar Health Services (Appointment and Service Condition) Rules, 2013.- Rule-8 of the said Rule is substituted by the following:- "For selection of Doctors for appointment in Specialist Sub Cadre, candidates shall be given marks for their educational qualification and works experience."

According to above, a total of 100 determined marks shall be for educational qualification, work experience. These 100 marks shall be determined according to following :-

(i) Marks obtained in MBBS — Total 60 marks

(ii) Higher degree Post Graduation, namely DM/ MCH or equivalent (Recognized by Indian Medical Council) ~ Total 15 marks

(iii) For each complete one year of work experience after appointment of P.G Degree holder in Government hospitals on regular/contractual basis 05 marks will be given and thus a maximum 25 marks will be given.

Note- (a) The determination of marks to be given to a candidate for MBBS shall be done by multiplying total percentage of marks obtained in the examination of said course by a multiple of

0.6. For Example, if a candidate has obtained 50% marks, he/she shall be given 50x0.6 = 30 marks.

(b) For consideration of appointment in Specialist Sub Cadre, a minimum qualifying marks of 30 will be required.

Provided also that there shall be no provision of interview for appointment on the post of Specialist Medical Officer. The recommendation shall be made by the commission for appointment after preparation of merit list on the basis of marks obtained according to educational qualification and work experience. In accordance with the provision made in General Administration Department's Resolution no. 12535 dated 17.09.2018 (as amended from time to time), 50 percent horizontal reservation in all % () T reservation categories shall apply for the candidates who have passed from the Medical Colleges of the Bihar State."

Rule-9 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is substituted by the following:- "9, The appointment in basic grades of both the sub-cadres of the service shall be made by direct recruitment on the recommendation of the Commission on the basis of marks calculated as per provisions of chapter- 2 of the Rules. The seniority list of both the sub cadres shall be determined separately on the basis of merit list recommended by the commission.” Rule-12_of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is substituted by the following:- "12. Conduct of recruitment Procedure and declaration of vacancies.- After receiving information of vacancies to be filled by direct recruitment and requisition of vacancies from the government, the commission shall declare the number of vacancies to be filled by direct recruitment in such manner as it thinks proper and shall invite applications from the candidates eligible under rule 6 and 8. The commission shall conduct recruitment procedure each year, if not notified otherwise in view of number of vacancies.” Rule-13 of the Bihar- Health Service (Appointment and Service Condition) Rule, 2013 is substituted by the following :- "13. Determination of Eligibility - For the purpose of entrance in the recruitment procedure, a candidate-

(a) Must have the same maximum age of the Candidate on 1¥ August of the advertisement year as determined reservation category wise by the General Administration Department from time to time :

Provided that, in any transaction of the appointment, the department may extend the maximum age limit by recording reasons thereof. (Departmental notification No.2/niyukti-01/10-431(2), dated 09.04.2014)

(b) Must be of good moral character.

Rule-15 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is deleted.

Rule-17 of the Bihar Health Service (Appointment_and Service Condition) Rule, 2013 the used word 'examination' is substituted by the word ' procedure’.

Rule-18(6),(7),(8) and (9) (a) of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is substituted by the follows:- "18(6) taking support of other irregular or improper means for his eligibility for the recruitment procedure.” "18(7) adopting unfair means during recruitment procedure.” "18(8) troubling or hurting the personnel employed by the Commission for recruitment procedure.” "18(9)(a) to be declared disqualified by the Commission for the requirement procedure for which he is candidate, or " The clause "Marks obtained in Viva-voce' of rule-19 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is deleted.

Rule-20 of the Bihar Health Service (Appointment _and Service Condition) Rule, 2013 is substituted by the following :- "0. While sending its recommendation under rule 19 the commission shall recommend appointment of candidates reservation categories (eg. Scheduled castes, Scheduled Tribes, Most Backward class, 50% horizontal reservation for candidates who have passed from the Medical Colleges in the Bihar State in all reservation categories, etc) [ (™ \% \§ < "].

13. Rule-21 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 is substituted by the following :- "21. During recruitment procedure, if deemed necessary by the commission, the candidates shall turn up on the call of the commission on the notified dated, time and place on their own expenses."

14. Rule-22 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 in substituted by the following :- "22. After recruitment procedure, the commission shall prepare consolidated list and after sending of recommendation related with the prepared list to the Government in light of provisions specified in rule-19, cach candidate shall be informed immediately.

15. In rule-23 of the Bihar Health Service (Appointment and Service Condition) Rule, 2013 the used word 'examination' is substituted by the word 'recruitment procedure.'

But these rules shall also be effective in respect of such matters, which are requisitioned by the Department and the merit list has not been published by the Commission.

2. Sub-rule (d) of rule (2) of the “Bihar Health Services (Appointment and Service Conditions) Rules, 2013” is substituted as under:- 'MBBS' degree means MBBS degree recognized by Medical Council of India or equivalent degree from foreign recognized institutions displayed on the website of the Ministry of Home Affairs, Government of India at that time. It will be mandatory for candidates passed in equivalent degree from recognized institutions to qualify the screening test of Foreign Medical Graduate Examination (F.M.G.E.) from National Board of Examination

3. Rule 2(¢) of Rule 2 of “Bihar Health Services (Appointment and Service Conditions) (Amendment) Rules, 2019” is substituted as under:- 2(e) Master's degree means a postgraduate degree recognized by the Medical Council of India such, MD/MS/DNB degree or equivalent degree from India or abroad recognized by the Medical Council of India/National Medical Commission.

4. Rule (5) of the “Bihar Health Service (Appointment and Service Conditions) Rules, 2013 is substituted as under :- For appointment in General Duty Sub-cadre, minimum educational qualification shall be MBBS degree from a recognized University or a equivalent degree declared by the Medical Council of India / National Medical Science Commission. Candidates passed from abroad should have equivalent degree from foreign recognized institutions displayed on the website of the Ministry of Home Affairs, Government of India at that time.

Provided that the post-graduate or higher degree holder in any subject of Medical science and the doctors appointed on regular/contract basis in any Government hospital shall be given weightage for work experience S. Rule (3) (i) of the “Bihar Health Services (Appointment and Conditions of Service) (Amendment) Rules, 2019 is substituted as follows:- i Marks obtained in M.B.B.S/Equivalent degree- Total 60 marks

6. Note to Rule (3) of the “Bihar Health Services (Appointment and Conditions of Service) (Amendment) Rules, 2019”~(a) at the end, the following proviso is inserted :-

Provided that the marks counted for the percentage of a candidate passed from foreign recognized institutions shall be marks obtained in the Medical Graduate Examination Screening Test (FMGE) by a multiplier of 0.6 will be done by multiplying.

Government of Bihar Health Department Notification File No.-2/M43/2022___ | 295(2 /Health. patna, dated: |5 [1f ) 555 In exercise of the powers conferred by the proviso to the Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make amendments to “The Bihar Health Service (Appointment and Service Condition) Rules, 2013" (as amended from time to time) as per the following rules —

1. Short titl a. The:

cxtent and commencement:

Rules may be called “The Bihar Health Service (Appointment and Service Condition) (Amendment) Rules, 2024.” b. These Rules extends to the entire State of Bihar.

¢. This notification will be effective from the date of issue.

2. Partial deletion of Rule 4(1) of “The Bihar Health Service (Appointment and Serviee Condition) Rules, 2013 :- The clause "Bihar Public Service" used in Rule 4(1) of the said rule is deleted.

3. Partial deletion of Rule 5 of “The Bihar Health Service (Appointment and Service Condition) Rules, 2013” :- The last paragraph/proviso of Rule 5 of the said rule is deleted.

4. Substitution of Rule 6 of “The Bihar Health Service (Appointment and Service Condition) Rules, 2013” :- The said rule is hereby substituted as follows- "Candidates will be given marks for competitive examination and work experience for the selection of doctors for appointment in gencral duty sub-cadre of the Bihar Health Services. The syllabus of the competitive examination will be the same as decided by the department. The total marks prescribed for competitive examination and work experience will be 100. Out of that 100 marks will be determined as follows :-

(i) For marks obtained in competitive examination - 75 marks

(i) On the basis of satisfactory service on cquivalent post - 25 marks rendered by the candidate on contractual basis, maximum weightage of 25 marks at the rate of maximum five marks per year (the proportionate marks obtained by dividing 365 after multiplying the number of working days by 5, will be added for any part of a year). will be given for work experience obtained in any non-private hospitals (cither Bihar government. Central government, Municipal corporation. Panchayati raj institutions or any other local institutions, including Military hospital) within the jurisdiction of the State of Bihar.

Total ma?\rks ~— 100 marks - NOTE :- (a) The marks to be awarded to a candidate for the marks obtained in the competitive examination will be determined by multiplying the percentage of total marks obtained in the said competitive examination by a multiple of 0.75. For example. if a candidate has obtained 60 percent marks in the competitive cxamination. then he will be given 60 x 0.75 = 45 marks. NOTE :- (b) The minimum qualifying marks for the competitive examination will be 30 percent."
