Chapter:-1 Preliminary
1. Short title, extent & commencement- (1) These Rules may be called as the "Bihar Architect cadre Rules, 2014"
(2) It will extend to the whole state of Bihar.
(3) It will come in to force at once.
2. Definitions-In these Rules, unless otherwise required in the subject or context:- 4 �बहार गजट (असाधारण), 11111111 जुलाई जुलाई जुलाई जुलाई 2014201420142014 (I) "State Government" means the Government of Bihar;
(II) "Appointing Authority" means Governor of Bihar;
(III)"Cadre Controlling Authority" means Building Construction Department;
(IV) "Commission" means Bihar Public Service Commission;
(V) "Service" means Bihar Architect Service;
(VI) "Cadre" means Bihar Architect Service cadre.
Chapter:-2 Service Cadre
3. Constitution of cadre-(1) In this cadre there shall be following categories of posts .
(i) Assistant Architect
(ii) Associate Architect
(iii) Senior Architect
(iv) Chief Architect
(2) The personnel appointed/working on the posts of this cadre prior to coming in to force of the Rules, shall be deemed to be automatically included in this cadre. The members of this cadre shall be gazetted officers.
4. Prescribed strength- The State Government may, from time to time allow for creation/deletion of the posts of various categories of this service. As per requirement and with consent of other departments the post of Architects in other departments may be extended and reorganized in this cadre.
5. Reservation- The provisions of State Government as enforced from time to time, shall be applicable on appointment/promotion in this service or cadre.
Chapter:-3 Recruitment
6. Direct recruitment- Direct recruitment on all the post of Assistant Architect shall be made in the light of Departmental requisition sent to Commission which shall conduct written/viva examination and shall make available the recommendation of selected candidates to the Department for appointment.
7. Qualification- The candidate shall have Architecture graduate degree from any recognized University or Institute and he shall have to be registered with the Council of Architecture, New Delhi.
8. Probation and period-The probation period of direct recruited Assistant Architect shall be for two years. In special circumstances the probation period may be extended for one year but if during the probation period or the extended period the service is not found satisfactory he/she may be released from service.
9. Training-All the officers shall be imparted training under the fixed training programme by the Department and by authorized training institute;
Provided that, if the training is not organized in time or in accordance with training programme is shall not come in the way for promotion.
10. Confirmation-The service on the post of Assistant Architect may be confirmed only after completion of Departmental responsibility and passing of Departmental examination as well as satisfactory service and conduct.
Chapter:-4 Promotion
11. Promotion- The promotion from the post of Architect service cadre (Assistant Architect) to the posts of Bihar Architect Service (Associate Architect) shall be given in following manner:-
(i) Assistant Architect to Associate Architect Associate Architect to Senior Architect 5 �बहार गजट (असाधारण), 11111111 जुलाईजुलाईजुलाईजुलाई 2014201420142014 Senior Architect to Chief Architect
(ii) Criteria for promotion from any post to higher post shall be seniority cum merit.
(iii) A list of eligible officers shall be prepared for promotion on the basis of their seniority which shall be three times more than the number of available vacancy.
(iv) Criteria for promotion up to the post of chief Architect shall be seniority with merit and confidential remarks as well as vigilance clearance.
(v) Promotion on the higher posts shall be given in accordance with kalawadhi fixed by the Government.
Chapter:-5 General/Miscellaneous
12. Residual Matter- (a) Age –Age limit shall be applicable as determined by General Administration Department for different posts under the State Government.
(b) Seniority-The inter-se seniority of directly recruited Assistant Architect shall be determined according to the merit list.
(c) Leave- The provisions contained in circular issued by General Administration Department and Finance Department shall be applicable in respect to leave and holiday.
(d) Transfer/Posting-The provisions contained in circular issued by Cabinet Secretariat & Co-ordination Department as well as General Administration Department shall be applicable in respect to transfer/posting.
(e) Pension-The new pension scheme shall be applicable for those personnel who joined on or after 01/09/2005
(f) Salary, Allowances and others-Salary, allowances and other service conditions shall governed/regulated by the general Government Rules/orders/Resolutions/Instruction notified for that purposes by the State Government from time to time.
13. Discipline and Appeal-The disciplinary proceeding against the member of the service shall be regulated according to provisions of Bihar Government servant (Classification, control and Appeal) Rules, 2005.
14. Removal of difficulties-If any difficulty arises in implementation of provisions of these Rules, The State Government may by Gazette notification remove such difficulty which the State Government may deem it expedient.
15. Repeal and savings- (a) By this Rules all rules/resolution/orders earlier notified in respect of the Cadre of Bihar Architect Service is hereby repealed.
(b) Notwithstanding such repeal, anything done or any action taken in accordance with the previous rules, regulations and instructions shall be deemed to have been done under this Rule.
