Assistants cadre under the Health Department.- Chapter-1 : PRELIMINARY
1. Short title, extent & commencement.--(1) These Rules may be called as the "Bihar O.T. Assistants Cadre Rules, 2014".
(2) It will extend to the whole State of Bihar.
(3) It will come into force immediately.
2. Definitions.-- In these Rules, unless the subject or context otherwise requires:-
(i) 'Government' means Bihar State Government;
(ii) 'Department' means Health Department;
(iii) 'Commission' means Bihar Staff Selection Commission;
(iv) 'Appointing Authority' means Civil Surgeon-cum-Chief Medical Officer;
(v) 'Cadre' means Bihar O.T. Assistants Cadre; and
(vi) 'Appendix' means appendix appended to these Rules.
3. Constitution of Cadre.-The Cadre of O.T. Assistants shall be District level In this cadre, number of posts in every grades and total number of posts in the cadre shall be as many as are sanctioned by the government from time to time. The O.T. Assistants of a district cadre will also be posted in the Medical College Hospitals and Super Speciality Hospitals located in the concerned district.
4. Chain of posts of cadre.--Different grades and Chain of posts of this cadre shall be according to Appendix-1.
Chapter - 2 : RECRUITMENT
5. Recruitment.--The appointment in this cadre shall be by direct recruitment to the basic grade posts, on the basis of recommendation of the Commission.
6. Qualification.--(1) For appointment by direct recruitment to the basic grade posts, minimum educational qualification shall be Intermediate/10+2 (Physics, Chemistry, Biology with English) pass. In addition to this, it shall be necessary to have passed O.T. Assistants diploma course from a government recognised institution.
(2) Minimum age limit shall be 21 years and maximum age limit shall be the same which may be determined reservation categorywise, from time to time, by the government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.
7. Procedure of recruitment.-- (1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April.
(2) In light of requisition, the Commission shall invite applications by advertising vacancies and prepare merit list on following basis :- 5 �बहार गजट (असाधारण), 26 फरवर( 2014
(a) For marks obtained in Intermediate/10+2----------------------------------------25 marks
(b) For marks obtained in higher degree (B.sc/M.Sc)------------------------------------------------10 marks
(c) For marks obtained in O.T. Assistants Diploma course examination---------------------------------------25 marks
(d) For working experience in Government Hospitals of Bihar State (5 marks per year, maximum 25 marks)- 25 marks
(e) For interview- 15 marks
Explanation.—The marks to be given to a candidate for Intermediate/10+2, and O.T.
Assistants Diploma course examination shall be determined by multiplying the percentage of total marks obtained in the aforesaid examination by multiple of 0.25. For example, if a candidate has obtained 50% marks, then he will be given 50% X 0.25 = 12½ marks.
(3) Procedure for Interview shall be determined by the Commission.
(4) After preparation of merit list, on the basis of sub-rule(2) Preliminary Scrutiny of certificates and medical tests will be caused to be conducted by the Commission with the cooperation of appointing authority and thereafter final recommendation will be sent to the Appointing Authority. At the level of Appointing Authority also, verification of antecedents of recommended candidates will be caused to be done after scrutiny of certificates.
(5) Compliance of instructions issued by the government, from time to time, with respect to procedure of appointment, after recommendation of the commission, shall be necessary.
Chapter - 3 : Probation/Departmental Examination/Confirmation
8. Probation Period.-- After appointment the candidates will be under probation.
Probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in extended period also, then the appointing authority may terminate service of such O.T. Assistants.
9. Training.-- During probation period, the probationer O.T. Assistant shall have to undergo such training as is prescribed by the Department.
10. Departmental Examination.--The O.T. Assistants shall have to pass the departmental examination arranged by the Department. The syllabus of departmental examination will be determined by the Department.
11. Confirmation.--On satisfactory completion of probation period, successful completion of training and after passing of departmental examination, an O.T. Assistant may be confirmed in the service.
12. Seniority.--The inter-se seniority of O.T. Assistants shall be determined according to the merit list prepared by the Commission.
Chapter 4 : PROMOTION
13. Promotion.-- (1) Subject to availability of vacancy and according to seniority, confirmed O.T. Assistants may be considered to be promoted on the posts mentioned in Appendix-1.

(2) For promotion, completion compliance of instructions regarding 'KALAWADHI' determined by the Government, from time to time, shall be necessary.
(3) Compliance of instructions issued by the Government, from time to time, with respect to promotion, and character Roll/PAR allegation/ departmental proceedings/criminal proceedings, etc shall be necessary at the time of consideration of promotion.
14. Departmental Promotion Committee.-- Promotion may be considered on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department separately.
Chapter - 5 : MISCELLANEOUS
15. Reservation.-- Compliance of provision of Reservation Act of the Government and reservation roster for direct recruitment as well as promotion, issued from time to time, by the Government shall be necessary.
16. The chain of posts mentioned in Appendix-1 shall be effectives only after approval of the Government. If, in course of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in Appendix-1, then the Appendix-1 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules.
17. The personnels appointed/promoted and working on the posts of this cadre mentioned in Appendix-1, before coming into force of these Rules, shall be deemed to be automatically included in this Cadre.
18. Residue matters.-- For the subjects which have not been provided in these Rules, provisions of concerned Codes/Rules/Resolutions/Instructions shall apply.
19. Removal of doubts.-- If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of the Department shall be final.
20. Removal of difficulties.--If any difficulty arises in implementation of provisions of these Rules, the Department shall have powers to remove such difficulty.
21. Repeal & Savings.-- (1) The Rules and all resolutions, orders, instructions etc.
issued earlier, from time to time, by the Department with respect to this cadre, shall be deemed to be repealed with effect from the date of coming into force of these Rules.
(2) Notwithstanding such repeal, any work done or any action taken in exercise of powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to be any work done or any action taken under these Rules presuming that these Rules were in force on the date on which such a work was done or such an action was taken.

Assistants Cadre Rules, 2014"
1. Shorttitle, extent and commencement.-(1) These Rules may be called the "Bihar O.T. Assistants Cadre (Amendment) Rules, 2019."
(2) It shall extend to the whole state of Bihar.
(3) It shall come into force from the date of its publication in the official gazette.
2. Substitution of rule-2 (iii) of the "Bihar O.T. Assistants Cadre Rules, 2014.- Rule 2
(iii) of the said Rules shall be substituted by the following:- "(iii) 'Commission' means the Bihar Technical Service Commission;"
"(iv)'Appointing Authority' means Director-in-Chief, Health Services, Bihar."
3. Substitution of rule-3 of the Bihar O.T. Assistants Cadre Rules, 2014.- Rule - 3 of the said Rules shall be substituted by the following:- "3. Constitution of cadre.-The O.T. Assistent shall be state level cadre. In this cadre, number of posts in every category and total number of posts in the cadre shall be as many as may be sanctioned by the Government, from time to time."
4. Substitution of rule-6 of the Bihar O.T. Assistants Cadre Rules, 2014.- Rule -6 of the said Rules shall be substituted by the following:- "6 Qualification:- (1) For direct recruitment to the basic category posts, minimum educational qualification shall be pass in Intermediate/+2(with Physics, Chemistry, Biology with English) pass. In addition to this, it shall be necessary to have passed O.T.
Assistants diploma course /Bachelor in O.T. Assistant Techonology course from union of India and other states government recognized Institution and it shall be necessary to have a Certificate related thereto.
(2) For the direct recruitment in O.T. Assistants Cadre, minimum age-limit shall be 18 years and maximum age limit shall be such as may be determined reservation categorywise, from time to time, by the Government. 1st August of the concerned year shall be deemed to be cut off date for determination of age."
5. Substitution of Rule-7 of the Bihar O.T. Assistants Cadre Rule-2014. Rule-7 of the said Rules shall be substituted by the following:- "7 Procedure of recruitment.-(1) The appointing authority, after calculating vacancies on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Department latest by 30th April and the consolidated requisition shall be sent to the Commission by the Department latest by 15th May.
(2) For the selection, full marks will be 100 (one hundred) as follows:-
(a) For the marks obtained in Intermediate/+2 - 30 Marks
(b) For marks obtained in Diploma in O.T. Assistants Course examination - 25Marks
(c) For higher degree in course of O.T. Assistants - 20 Marks (B.Sc/M.Sc) (B.Sc.-10 marks and M.Sc.- 10 marks)
(d) For Work experience in Government Hospitals- (5 marks per year, Maximum 25 Marks) - 25 Marks Total 100 Marks 4 ॢबह�र गजट [स�ध�रण�� 7777 tuojh 2020tuojh 2020tuojh 2020tuojh 2020 Note:The marks to be given to a candidate for marks obtained in Intermediate/+2 and Diploma Course in O.T. Assistants examinations shall be determined by multiplying percentage of total marks obtained in the examinations of said courses by a multiple of 0.3 or 0.25respectively. For example, if a candidate has obtained 50% markshe will be given 50x0.3=15 or 50x 0.25= 12.5 marks respectively.
(3) The Commission shall send recommendation to the Department according to the merit list prepared on the basis of sub-rule (2) as well as requisitioned vacancies. After scrutiny of certificates of the recommended candidates the Department shall allot their cadre. Thereafter, the Appointing Authority concerned shall make appointments after causing medical check-up, verification of antecedents, etc by complying the guidelines issued by the Government (General Administration Department), from time to time.
(4) After recommendation of the Commission, compliance of instructions issued by the Government (General Administration Department), from time to time, with respect to procedure of appointment, shall be necessary."
6. Substitution of rule-13 of the Bihar O.T. Assistants Cadre Rule 2014 .- Rule 13 of the said Rules shall be substituted by the following:- "13. Chain of Promotion.-(1) Subject to availability of vacancies, confirmed Lab Technicians may be considered for promotion, according to seniority-cum-merit, to the higher posts mentioned in the Appendix-1.
(2) For consideration of promotion, compliance of instructions regarding KALAWADHI issued by the General Administration Department, from time to time, shall be necessary. Compliance of instructions issued by the General Administration Department regarding Character Roll or PAR, maintenance of recommendation in the sealed cover, etc in the context of promotion, shall be necessary at the time of consideration of promotion."

Assistants Cadre Rules, 2014(As amended from time to time)":-
1. Short title, extent and commencement.-(1) These Rules may be called the "Bihar O.T. Assistants Cadre (Amendment) Rules, 2022."
(2) It shall extend to the whole State of Bihar.
(3) It shall come into force from the date of its publication in the official gazette.
2. Substitution of rule-6(1) of the Bihar O.T. Assistants Cadre Rules, 2014(As amended from time to time)".- Rule -6(1) of the said Rules shall be substituted by the following:- "6 Qualification:- (1) For direct recruitment to the basic category posts, minimum educational qualification shall be pass in Intermediate/+2(with Physics, Chemistry, Biology and English). In addition to this, it shall be necessary to have passed O.T. Assistants Diploma Course/Bachelor in O.T. Assistant Technology Course from Institution recognized by the Union of India or State of Bihar or any other State Governments and it shall be necessary to have a Certificate related thereto.

Assistant Cadre Rules, (as amended time to time) 2014"

(2) It will extend to the whole state of Bihar.

2. Substitution of rule-6 (2) of the "Bihar O.T. Assistants Cadre Rules, 2014.- Rule 6 (2) of the said Rules shall be substituted by the following:- "(2) for direct recruitment in the O.T. Assistants Cadre, minimum age limit shall be 18 years and maximum age limit shall be the same as may be determined reservation category wise, from time to time, by the government. 1st August of the Advertised year shall be deemed to be cut off date for determination of age."

3. Substitution of rule-7(2), (3) (4)and (7) of the Bihar O.T. Assistants Cadre (Amendment) Rules, 2014.- Rule -7(2), (3), (4)and (7) of the said Rules shall be substituted by the following:- ''7. Procedure of recruitment.- (2) The commission shall advertise the vacancies and invite application forms from eligible candidates andon the basis of written competitive examination and experience the candidates shall be selected. :-
(a) Full marks for the written competitive Examination- - 75marks
(b) Experience Marks:-For contractual work in State Government hospitals/Institutions of Bihar and Non Private hospital (under control of Central Government, Panchayati Raj institutions, and urban local bodies) located in Bihar. 5 marks/year shall be given for working experience on same post while working in above mentioned hospitals/Institutions. Maximum 25 Marks (Number of working days as part of an year will be multiplied by 5 and then after divided by 365, shall be added as proportional marks) - 25 marks Total -100 marks
(3) Benefit of work experience shall be given only to those applicants who pass the competitive examination. The certificate of work experience issued by Civil Surgeon of the concerned district, Principal of Medical College, Superintendent of Medical College and Hospital, Director in case of Super speciality Hospital and in case of head of those Institutions which are mentioned in Para 2 (b) will be acceptable.
(4) Benefit of work experience of contractual worker and upper age relaxation for the period of contractual engagement will be applicable for those regular appointed candidates who are working on the same post.
(5) The Commission shall prepare merit list on the basis of sub-rule (2) of rules and shall send reservation category-wise recommendation in accordance with the requisitioned vacancies to the Department. Thereafter, the appointing authority concerned shall make appointments after verification of certificates, conducting medical tests, verification of antecedents, etc. and complying guidelines regarding the appointment issued by the Government (General Administration Department), from time to time.
(6) After recommendation of the Commission, it shall be necessary to follow instructions regarding procedure of appointment issued by the Government, from time to time.
