Section 4: Amendment in section 3 of the Bihar Act, 18 of 2002

In the said Act, the existing provision of section 3 will be read as sub-section (1) after that, The following new sub-section (2) shall be added, after sub-section (1) of section 3 of the said Act :- "(2) No police official below the rank of Deputy Superintendent of police or equivalent, having jurisdiction, shall investigate an offence under this Act :

Provided that if a police officer not below the rank of an Inspector of police is authorized by the State Government in this behalf by general or special order, he may also investigate any such offence without the order of Metropolitan Magistrate or a Magistrate of the first class, as the case may be, or make arrest thereof without warrant.
