(2) These Rules shall apply to the clerical cadre employees of the General Pror,identFundofficesoftheStateofBi|rar.Inthecontextoftheconcemed offices. it shall extend to the state level (3t It shall come into force at once.
i. D"fi.ritiona.- In these rules. unless othenvise requires in any context- ( 1) "Governor" means the Governor of Bihar;
l7) "Govemment" means the Government of Bihar;
(3) "Department" means the Finance Department;
(4) "Directorate" means General Provident Fund Directorate;
iri "subordinate Office" means District Provident Fund Office;
ie ; "Commission" means The Bihar Staff Selection Commissionl l'7 ) "Appointing authority" means The Joint Commissioner' Accounts Adminisration:
(8) ''Cadre" means the clerical ca&e of General Provident Fund Directorate and its subordinate offices:

(10) ,,Mernber,, ,nL*, -y person appointed to the cadre and it includes anv person appointed and working on a regular basis in the clerical grade under the deneral provident Fund Dtectorate before coming into force of these Rules.
3. Constitution of cadre.- (1) The constitution of the clerical cadre in General Provident Fund Directorate and its subordinate ofirces shall be as follows:- Sl. No. Name of the Cate I-evel

ChaPter 2 APPointment
4.CadreStrength.-ThecadrestrengthshallbedeterminedbytheFinance Depanment as per its requirements.
5. Appointmeni to the Service.- (l) Eighty five percent of the posts in the category of i-wer Division Clerk level shall, on the recommendation of the Commisston, be i;l; by direct appointment and fifteen percent of such posts shall be filled without any examrnation on the tasis of seniority, from amongst such Class Four employees of the GoYemment who possess the required qualification for the appointrnent as Clerks:

(5) The Commission shall adr,ertise the vacancies and shall recommend. to the appoinrins aurhorit),. il-re nanles of successful ca,.rdidates in order of the merit prepared after selecrion r)n the basis of The Competitive Examination. The merit list shall be valid for a period of one )'ear from the date of receipt of such recommendation.
167 The appointing authority shall. after due scrutiny of the credentials. appoint the candidates on probation for a period of trvo years.
(7) For the purpose of appointment to the post of Lorver Division Clerk by promotion. the appointing authority shall prepare a seniority list of such Group 'D' employees having requisite qualifications for appointment to the said post, and the promotion on the basis of seniority may be giYen from the said list on the basis of the recommendation of the Depanmental Promotion Committee.
6. Qualifications.- (1) The educational qualification for appointment in this cadre shall be lntermediate (10+2) pass or equivalent alongwith knowledge of computer operation and computer typing.
(2) The minimum age for the appointment shall be 18 years and the maximum agelimit shall be such as may be determined, by the General Administration Department, Govemment of Bihar, from time to time.
, ,. 7. Reservation.- The rules, circulars and orders regarding reservation issued by the General Administration Department shall apply to the appointments and promotions under theie Rules.
8. Probation period.- (1) All trwer Division Clerks appointed under Rule 3 shall remain on probation for a period of two years from the date of appointment and such probadon period may be extended for one year if the services and work of the probationer are not satisfactory:
Provided that the probation period shall not be extended as aforesaid iJ, the appointing authoriry, for reasons to be recorded in writing, is satisfied that there is no chance of improvemenl in the conduct and the working of the probationer.
(2) The services of such clerk being found unsatisfactory even during the extended period of probation, the clerk appointed on probation shall be terminated from senice.
9. Confirmation.- The service may be confirmed only on completing the probation period and conFrdential reports of the said period being satisfactory and after passing the Departmental Examination and the Computer Competency Test determined by Government.
10. Level of Cadre.- This cadre will be State [rvel Cadre. The employee of this cadre may be transferred to any District Provident Fund Office of the State of Bihar.
11, Seniority-- ( I ) The seniorit-v of the employees b;r direct recruitment shall be in order of the merit-Iist recommended by the Commission.
(2; The persons appointed by promotion in any one year shall be senior to the persons appointed by direct recruitment in the same year.

(cXi) The seniority of such employees rvorking as a clerk in The Rajkiya Lekhan Samagri Bhandar evam Prakashan, Gulzarbagh, Patna and who have been posted in the General Provident Fund Directorate and subordinate oflices consequent to seryice transfer, shall be determined in accordance with the date of their appointments.
(ii) The seniority of such employees rrorking in the non-Clerical cadre in Rajkiya Lekhan Samagri Bhandar evam Prakashan, Gulzarbagh, Patna and who have been posted on class 3 posts in the General Provident Fund Directorate and subordinate ollices consequent to service transfer shall be determined in accordance with the dates of posting consequent to service transfer:
Provided that the seniority of the employees posted upon service transfer shall be determined in accordance with their dates of birth:
Provided further that in case of similarity of the dates of birth of the employees specified in the first proviso, the seniority shall be determined in accordance 'rvith their educational qualification.
(d) The seniority of such excess employees of Water Development Corporation, who have been appointed (absorbed) in the General Provident Fund Directorate by transfer shall be determined from the dates of their joining ulder the General Provident Fund Directorate.- ' (4) Notwithstanding anything contained in sub-rule (3), in view of the special circumstances, and having regard to the appointments from the various sources under the General Provident Fund, no claim for stepping up of pay of any employee on the basis of senioritv under these rules shall be admissible.

12. Promotion.- (l) Promotion to the post of Upper Division Clerk may be given only on confirmation in the cadre, passing in the Hindi Noting and Drafting Examination and in both the papers of the Departmental Accounts Examination at higher level.
(2) Promotion to the posts of Upper Division Clerk and higher posts may be given on the basis of senioriry*-cutn-eligibility on the recommendations of the Departmental Promotion Committee.
(3) Kalawadhi for promotion shall be such as may be determined by the General Administration Department from time to time.
