(2) ये राजपC म� �काशन क� तारीख को �वृ� त ह!गे ।

(ख) ‘’िनयुि �ािधकारी’’ स ेमहािनदशेक अिभ�ेत ह;ै (ग) ‘’िनधा:रण सिमित’’ से िविनयम 14 के उप-िविनयम (3) के अधीन ग8ठत सिमित अिभ�ेत ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (घ) ‘’गेट’’ से भारतीय िव+ान संJ थान और भारतीय �ौLोिगक� संJ थान! �ारा सचंािलत इंजीिनयNरग म� Oैजुएट एQटीRूड टेJ ट अिभ�ेत ह;ै (ङ) ‘’आंत8रक छानबीन सिमित’’ से िविनयम 14 के उप-िविनयम (2) के अधीन ग8ठत सिमित अिभ�ेत ह;ै (च) ‘’अनुसूची’’ से इन िविनयम! से संलU अनुसूची अिभ�ेत ह ै;
(छ) ‘’अनुसूिचत जाित’’ और ‘’अनुसूिचत जनजाित’’ के वही अथ: ह!गे, जो उसके िलए भारत के संिवधान के अनुV छेद 366 के /मशः खंड (24) और खंड (25) म� �दए गए ह[;
(ज) ‘’वै+ािनक काडर’’ स ेिविनयम 3 और िविनयम 4 के अधीन ग8ठत भारतीय मानक �यूरो वै+ािनक काडर म� िविन\द] पद अिभ�ेत ह।ै (झ) ‘’छानबीन सिमित’’ (screening committee) से िविनयम 9 के अधीन ग8ठत सिमित अिभ�ेत ह;ै (ञ) ‘’चयन सिमित’’ से िविनयम 10 के अधीन ग8ठत सिमित अिभ�ेत ह ै;
(ट) ‘’िनयम’’ से राजपC अिधसूचना सं. सा.का.िन. 584 (अ), तारीख 25 जून, 2018 �ारा �कािशत भारतीय मानक �यूरो िनयम, 2018 अिभ�ेत ह;ै (ठ) ऐसे श�द! और पद! के, जो इन िविनयम! म� �यु ह[ और प8रभािषत नहb ह[, िविभc अिधिनयम! या िनयम!
म� प8रभािषत ह[, वही अथ: ह!गे, जो उनके /मशः अिधिनयम और िनयम! म� समनुदिेशत ह[।
3. वै�ािनक काडर का गठन3. वै�ािनक काडर का गठन3. वै�ािनक काडर का गठन3. वै�ािनक काडर का गठन – भारतीय मानक �यूरो व+ैािनक काडर के नाम से +ात एक वै+ािनक काडर का गठन �कया जाएगा, जो पहली अनुसूची के Jतंभ (2) म� िविन\दd ट पद! दसूरी अनुसूची म� �दए गए िवषय! म� िनयुe त f यि य! से िमलकर बनेगा।

(क) त�कालीन भारतीय मानक संJ थान सेवा काडर के f यि जो भारतीय मानक �यूरो अिधिनयम, 1986 (1986 का 63) के अधीन वै+ािनक काडर के सदJय ;
(ख) इन िविनयम! के �ारंभ से पहले भारतीय मानक �यूरो के वै+ािनक काडर पर िनयु �कए गए gि ; और (ग) इन िविनयम! के अधीन िनयुe त f यि ।

6. वै�ािनक6. वै�ािनक6. वै�ािनक6. वै�ािनक----ख पर सीधी भत%ख पर सीधी भत%ख पर सीधी भत%ख पर सीधी भत% – (1) वै+ािनक-ख के पद पर सीधी भत- दसूरी अनसुूची म� उन िवषय! के संबंध म� िजसके िलए गेट आयोिजत क� जाती ह,ै के िलए िविधमा2य गेट Jकोर के आधार पर तथा उन िवषय! के संबंध म� िजसके िलए गेट परी@ा आयोिजत नहb क� जाती, उनके िलए �ितयोगी ऑनलाईन परी@ा के आधार पर उप- िविनयम (3) के अनुसार क� जाएगी।
(2) वै+ािनक! क� िवषयवार आवk यकता का अवधारण वै+ािनक! क� िवLमान संlया एवं िवषयवार 8रि य! के आधार पर काय:का8रणी सिमित के अनुमोदन से �कया जाएगा।
(3) 8रि य! को भरने क� पhित िनmानसुार होगी:
¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (क) यथा अवधा8रत 8रिe तयां अिखल भारतीय J तर पर मुlय समाचार पC! म�, अ2 य बात! के साथ-साथ, पद! क� संlया, अनसुूिचत जाित, अनुसूिचत जनजाित, अ2 य िपछड़ ेवगo, �दf यांगजन gि के िलए आर@ण, आवkयक अह:ताए ँऔर आयु संबंधी अपे@ा के संबंध म� पूण: जानकारी दतेे %ए िव+ािपत क� जाएगी। (ख) ऐसे अpयथ- िजनके पास साठ �ितशत स ेअिधक अकं! सिहत (अनुसूिचत जाितय! और अनुसूिचत जन जाितय!
के अpयqथय! या समतु�य के िलए पचास �ितशत) इ2जीिनयरी अथवा �ौLोिगक� म� बैचलर िडOी अथवा �ाकृितक िव+ान म� माJटर िडOी या समतु�य ह ैऔर वे तीस वष: क� आयु के ह[, वै+ािनक-ख के पद के िलए आवेदन करन ेके पाC ह!गे :
पर2तु अिधकतम आयु-सीमा, � यूरो के अिधका8रय! और कम:चा8रय! क� दशा म� और gि य! के ऐसे �वगo क� बाबत, जो के2 �ीय सरकार �ारा समय-समय पर अिधसिूचत �कए जाए,ं उस िवJतार तक तथा उन शतo के अधीन रहते %ए, जो ��येक �वग: क� बाबत अिधसूिचत क� जाए,ं िशिथल क� जा सक� गी। (ग) िविधमा2य गेट के J कोर वाले को सा@ा� कार के िलए शाट:िलJ ट �कया जाएगा और सा@ा� कार या Oुप िडJकशन अथवा सा@ा� कार के िलए बुलाए जाने वाले परी@ाqथय! क� संl या िविधमा2य गेट J कोर के योr यता /म म� संबंिधत िवषय म� िव+ािपत 8रि य! क� संl या के चार गणुा से अिधक नहb होगी;
(घ) �ितयोगी ऑनलाइन परी@ा के माt यम स े भत- के िलए � यूरो �ारा महािनदशेक के िविनuयानुसार f यावसाियक संJ थान या एज�सी माtयम स े ऑनलाइन �ितयोगी परी@ा ली जाएगी और सा@ा� कार या Oपु िडJ कशन और सा@ा� कार के िलए बुलाए जाने वाले अpयqथय! क� संl या, संबंिधत िवषय म� िव+ािपत 8रि य! क� संl या के चार गुणा से अिधक नहb होगी, उ ऑनलाइन �ितयोगी परी@ा म� कम से कम पचास �ितशत अंक हािसल करने वाल ेअpयqथय! म� से योr यता के /म म� होगी। (ड) अpयqथय! का िवषयवार चयन एक या अिधक चयन सिमित �ारा योr यता के आधार पर �कया जाएगा िजसका अवधारण कुल �ाQ त अंक! �ारा �कया जाएगा िजसम� खंड (ग) म� िविन\दd ट गेट के J कोर के िलए पचासी �ितशत का मह�व होगा अथवा खंड (घ) म� िविहत परी@ा ��/या �ारा और खडं (ग) एवं खंड (घ) के अधीन सा@ा� कार या Oुप िडJ कशॅन और सा@ा�कार के िलए पं�ह �ितशत मह�व �दया जाएगा। (च) अनुसूिचत जाितय!, अनसुूिचत जनजाितय!, अ2 य िपछड़ ेवगo और �दgांगजन के �क2हb अpयqथय! का चयन, अनुसूिचत जाितय! या अनसुूिचत जनजाितय! या अ2 य िपछड़ ेवगo के अpयqथय! के िलए आरि@त 8रिe तय! क� संl या के िवJतार तक, जो खंड (ग), (घ) और (ड) म� अिधकिथत मानदwड के आधार पर नहb भरी जा सकती, आरि@त कोटा म� कमी को पूरा करने के िलए मापदwड को िशिथल करते %ए, चयन के िलए इन अpयqथय! क� उपयु ता के अधीन रहते %ए, �कया जा सकेगा। (छ) 8रि य! को भरने के िलए योr यता अनुसार सफल अpयqथय! क� आरि@त सचूी तैयार क� जाएगी जो ऐसी सूची को तैयार करने क� तारीख से एक वष: के िलए िविधमा2य रहगेी।
7. वै�ािनक7. वै�ािनक7. वै�ािनक7. वै�ािनक----ख के िलए प�रख के िलए प�रख के िलए प�रख के िलए प�रवी�ा और �ितभूवी�ा और �ितभूवी�ा और �ितभूवी�ा और �ितभू बंधप5 (बंधप5 (बंधप5 (बंधप5 (surety bondsurety bondsurety bondsurety bond)))):::: (1) सीधी भत- �ोcित पर वै+ािनक-ख के yप म� िनयुe त अpयqथय! क� प8रवी@ा अविध दो वष: क� होगी िजसके दौरान महािनदशेक उनके िलए ऐसे �िश@ण क� f यवJ था करेगा और ऐसे दािय� व दगेा जो उनके िलए आवk यक ह! तथा उ2 ह� प8रवी@ा अविध क� समािA के िलए िविहत िवभागीय परी@ा या परी@ाए ंउ� तीण: करनी होगी।
(2) प8रवी@ा क� अविध समाQ त होने पर प8रवी@ाधीन अpयqथय! क� मू� यांकन 8रपोट: �ाQ त करने के िलए और िन निलिखत के िलए कदम उठाए जाएगंे – 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (क) य�द कम:चारी ने िनयुि �ािधकारी क� सतंुि] के अनुसार प8रवी@ा अविध पूण: क� हो तो, यथािJथित उसक� पुि] क� जाएगी अथवा प8रवी@ा अविध क� सतंोषजनक समािA से संबंिधत आदशे जारी �कया जाएगा; या (ख) य�द परीवी@ाधीन अpयथ- ने सतंोषजनक yप से प8रवी@ा अविध पूरी न क� हो तो, यथािJथित संबh िनयम!
और आदशे! के अनुसार प8रवी@ा क� अविध बढ़ाई जाएगी, जो छह माह से अिधक न हो या प8रवी@ाधीन अpयथ- काय:मुe त �कया जाएगा अथवा प8रवी@ाधीन अpयथ- क� सेवाए ंसमाQ त क� जाएगी:
पर2तु य�द परीवी@ाधीन अpयथ- को �ोcत �कया गया हो, तो उसे उपयुe त चयन सिमित क� िसफा8रश! पर उसक� सेवा समाQ त करने के J थान पर उसके पूव: पद पर वापस �कया जाएगा।
(3) यथािJथित, परीवी@ाधीन अpयथ- क� पुि] करने या परीवी@ा अविध को बढ़ाने, के िनण:य क� सूचना अpयथ- को सामा2 यत: परीवी@ा अविध समाQ त होने के आठ सQ ताह के भीतर �दान क� जाएगी।
(4) प8रवी@ा अविध पूण: होने के बाद प8रवी@ा अpयथ- क� पुि] Jवतः नहb होगी, अिपतु इसका औपचा8रक आदशे जारी �कया जाएगा, जब तक �क पुि] �कए जाने के िलए अथवा प8रवी@ाधीन अpयथ- को संतोष�द समािA के िलए कोई िवशेष आदशे न िनकाला गया हो, ऐसे परीवी@ाधीन अpयथ- को प8रवी@ा अविध म� ही माना जाएगा।
(5) िजस तारीख से पुि] �कया जाना �भावी हो, यथािJथित, वह तारीख िविहत प8रवी@ा अविध अथवा िवJ ता8रत प8रवी@ा अविध, के सतंोषपूण: समािA क� तारीख के बाद क� हो।
(6) वै+ािनक-ख के पद पर िनयुe त अpयथ- को � यूरो म� 2 यूनतम तीन वष: क� अविध क� सेवा का �ितभूबंधपC दनेा होगा जो �क � यूरो �ारा िविन\दd ट �yप म� होगा। उप-िविनयम (1) म� उि�लिखत अनुसार कोई f यि य�द िनयुि क� तारीख से तीन वष: से पूव: या तो � यागपC दकेर सेवा छोड़ने का िनण:य लेता ह ैया िबना अनुमित के सेवा स ेअनुपिJथत रहता ह,ै तो उसे अंितम िलए गये वेतन क� दर पर � यूरो को छह माह क� प8रलि�धयां लौटानी ह!गी, य�द उसन ेकमतर अविध के िलए काम �कया हो, उस मामले म� उसे ली गई पूरी रािश लौटानी होगी।
8888. �ितिनयिु8 9ारा अ: य. �ितिनयिु8 9ारा अ: य. �ितिनयिु8 9ारा अ: य. �ितिनयिु8 9ारा अ: य पद; पर चयन पद; पर चयन पद; पर चयन पद; पर चयन – (1) जहाँ काय:का8रणी सिमित �यूरो के िहत म� ऐसा करना आवkयक समझे, वहाँ वह वै+ािनक-ग और इसके ऊपर वै+ािनक-छ पद के J तर तक के पद! को �ितिनयुि पर भर सकेगी। पर2तु वै+ािनक-च और वै+ािनक-छ के पद! क� दशा म� के2 �ीय सरकार का अनुमोदन भी लेना होगा।
(2) ऐसे पद! को �मुख समाचार-पC! म� िव+ािपत �कया जाएगा, िजसम� �थम अनसुूची म� िविन\दd टानुसार पद!
क� संl या, िविहत अह:ताए,ँ आयु-सीमा, िविश] िवशेष+ता, य�द आवk यक हो, और अनुभव से संबंिधत पूण:
जानकारी दनेी होगी।
(3) ऐसे अpयथ- जो िविहत अपे@ाए ं पूरी करते ह! और िविनयम 9 के अधीन ग8ठत छानबीन सिमित �ारा शॉट:िलJ ट �कए गए ह!, उ2ह� चयन के िलए बुलाया जाएगा।
9. छानबीन सिमित 9. छानबीन सिमित 9. छानबीन सिमित 9. छानबीन सिमित (screening committee)(screening committee)(screening committee)(screening committee) – (1) �ितिनयुि �ारा भरे जाने वाले पद! के िलए �ाQ त आवेदन! क� छानबीन सिमित �ारा छानबीन क� जाएगी िजसम� � यूरो स े वै+ािनक-घ J तर के कम स ेकम तीन अिधकारी ह!गे और उनम� से सबसे ~ये� अिधकारी सिमित का अt य@ होगा िजस ेमहािनदशेक �ारा नामिन\द] �कया जाएगा :
पर2तु छानबीन सिमित म� कम से कम एक अिधकारी उस पद J तर से ऊपर का हो िजस पद के िलए चयन �कया जाना ह।ै

10. चयन सिमित10. चयन सिमित10. चयन सिमित10. चयन सिमित – (1) महािनदशेक �ारा वै+ािनक-ख, वै+ािनक-ग, वै+ािनक-घ और वै+ािनक-ड़ के पद पर चयन हतेु चयन सिमित का गठन �कया जाएगा िजसम� िन निलिखत सदJ य ह!गे:
(i) � यूरो के दो अिधकारी जो वै+ािनक-च के J तर से अ2 यून ह! िजनम� स ेजये� अt य@ होगा; और
(ii) बाहर स ेतीन िवशेष+ जो वै+ािनक - च क� पंि से अ2यून के ह!:
पर2तु अनुसूिचत जाितय! या अनुसूिचत जनजाितय! क� �ेणी से �कसी gि के चयन के संबंध म� इन �ेिणय! स े संबंिधत एक सदJय होगा।
(2) वै+ािनक-च और वै+ािनक-छ के पद! पर चयन के िलए चयन सिमित म� िन निलिखत सदJ य ह!गे:
(i) सिचव, �यूरो के �शासिनक िनयंCण वाले मंCालय या िवभाग -अtय@
(ii) सिचव, िव+ान और �ौLोिगक� िवभाग; -सदJय
(iii) महािनदशेक, भारतीय मानक � यूरो; -सदJय
(iv) िनदशेक, रा�ीय भौितक �योगशाला; -सदJय
(v) िनदशेक, क� �ीय खाL �ौLोिगक अनुसंधान संJथान; -सदJय
(vi) सिचव, काqमक और �िश@ण िवभाग या -सदJय उसका �ितिनिध जो �क संयुe त सिचव J तर से कम का न हो।
11. िनयिु8 �ािधकारी11. िनयिु8 �ािधकारी11. िनयिु8 �ािधकारी11. िनयिु8 �ािधकारी – चयन सिमित क� िसफा8रश पर िनयुि �ािधकारी �ारा सभी पद! पर िनयुि क� जाएगी:
पर2तु के2 �ीय सरकार के पूव: अनुमोदन के िबना वै+ािनक-च और वै+ािनक-छ के पद! पर कोई भी िनयुि नहb क� जाएगी।
12. िनरह+ता12. िनरह+ता12. िनरह+ता12. िनरह+ता - (1) कोई भी gि �कसी भी पद पर �ारंिभक िनयुि के िलए पाC नहb होगा, जब तक �क – (क) वह 21 वष: क� आयु पूरी ना कर ली हो; और (ख) वह भारत का नाग8रक हो या वह gि ऐसे �वग: से संबंिधत हो जो क� �ीय सरकार के अधीन िनयुि के िलए पाC हो।
(2) ऐसे f यि - (क) िजसने ऐस ेf यि िजसका पित या िजसक� प�ी जीिवत ह,ै िववाह �कया ह ैया िववाह क� संिवदा क� ह;ै या (ख) िजसने अपने पित या अपनी प�ी के जीिवत रहते %ए �कसी f यि से िववाह �कया ह ैया िववाह क� संिवदा क� ह,ै �कसी भी पद पर िनयुि का पाC नहb होगा।

(2) िनयु वै+ािनक को ऐसे �िश@ण और �िश@ण के अनु/म के �यौरे पर भारत या भारत स ेबाहर जाना होगा िजनका िविनuय समय-समय पर क� �ीय सरकार �ारा �कया गया हो। 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
(3) य�द �कसी भी कारण स,े �िश@ण के िलए �यौरेवार वै+ािनक, �िश@ण के दौरान या ऐसे �िश@ण के पूरा होन े के तीन वष: क� अविध के भीतर अपनी सेवा को छोड़ दतेा ह ैतो उसे �िश@ण क� पूरी लागत को �ितद� त करना होगा।

(2) आंत8रक छानबीन सिमित हतेु - (क) वै+ािनक-ड़ तक के Jतर पर �ोcित के िलए, महािनदशेक �ारा सिमित ग8ठत क� जाएगी, िजसम� �यूरो के कम से कम वै+ािनक-च के Jतर के तीन अिधकारी शािमल ह!गे, और उनम� स े~ये�तम सिमित का अtय@ होगा। (ख) वै+ािनक-ड़ से वै+ािनक-च और वै+ािनक-च से वै+ािनक-छ पर �ोcित के िलए, िनmिलिखत सदJय! क� एक सिमित ग8ठत क� जाएगी, अथा:त् -
(i) अपर सिचव या संयु सिचव, �यूरो पर �शासिनक िनयंCण वाले मंCालय या िवभाग; - अtय@
(ii) एक बाहरी सदJय, जो वै+ािनक-च या वै+ािनक-छ के Jतर स ेकम के न हो, - सदJय िजसे महािनदशेक �ारा नामिन\द] �कया जाए; और

No. BS/11/07/2019- In exercise of the powers conferred by section 39 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Bureau of Indian Standards (Recruitment to Scientific Cadre) Regulations, 2002, except as respects things done or omitted to be done before such supersession, the Governing Council of the Bureau of Indian Standards, with the previous approval of the Central Government, hereby makes the following regulations, namely:
1. Short title and commencement. - (1) These regulations may be called the Bureau of Indian Standards (Recruitment to Scientific Cadre) Regulations, 2019.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. - In these regulations, unless the context otherwise requires –
(a) "Act" means the Bureau of Indian Standards Act, 2016 (11 of 2016);
(b) “Appointing Authority” means the Director General;
(c) “Assessment Committee” means the committee constituted under sub-regulation (3) of regulation 14;
(d) GATE means the Graduate Aptitude Test in Engineering conducted by the Indian Institute of Science and the Indian Institutes of Technology;
(e) “Internal Screening Committee” means the committee constituted under sub-regulation (2) of regulation 14;
(f) "Schedule" means a Schedule appended to these regulations;
(g) "Scheduled Castes" and "Scheduled Tribes" shall have the same meanings as are respectively assigned to them in clauses (24) and (25) of article 366 of the Constitution of India;
(h) "Scientific Cadre" means the posts specified in Bureau of Indian Standards Scientific Cadre constituted under Regulation 3 and 4;
(i) "Screening Committee" means the committee constituted under regulation 9;
(j) “Selection Committee” means the committee constituted under regulation 10;
(k) "rules" means the Bureau of Indian Standards Rules, 2018 published vide Gazette Notification number G.S.R. 584 (E) dated 25 th June, 2018;
(l) words and expressions used in these regulations and not defined but defined in the Act or the rules shall have the meanings respectively assigned to them in the Act and the rules.
3. Constitution of Scientific Cadre. – There shall be constituted a Scientific Cadre to be called the Bureau of Indian Standards Scientific Cadre consisting of persons appointed to the posts specified in column (2) of the First Schedule and in the disciplines as given in the Second Schedule.
4. Members of Scientific Cadre. – The following persons shall be the members of the Scientific Cadre, namely:-
(a) persons from the erstwhile Indian Standards Institution Service Cadre who have become members of the Scientific Cadre under the Bureau of Indian Standards Act, 1986 (63 of 1986);
(b) persons appointed to the Scientific Cadre of Bureau of Indian Standards prior to the commencement of these regulations; and
(c) persons appointed under these regulations.
5. Method of recruitment, scale of pay, age-limit, qualifications, etc. – The method of recruitment to the posts of Scientific Cadre, scale of pay, age-limit, qualifications and other matters relating thereto shall be as specified in the First Schedule.
6. Direct Recruitment of Scientist-B. – (1) Direct recruitment to the post of Scientist-B shall be made in accordance with sub-regulation (3) on the basis of valid GATE score, in respect of those disciplines in the Second Schedule for which GATE is conducted, and by competitive online examination, in respect of those disciplines for which GATE is not conducted.

(2) The discipline wise requirement of scientists shall be determined with the approval of the Executive Committee on the basis of the existing strength of scientists and the discipline-wise vacancies.
(3) The manner of filling up vacancies shall be as under:
(a) vacancies as determined shall be advertised on All-India basis in the leading newspapers giving, among others, full information regarding discipline wise number of posts, reservation for Scheduled Castes, Scheduled Tribes, Other Backward Classes and Persons with Disability, the qualifications and age requirement;
(b) candidates possessing Bachelor’s Degree in Engineering or Technology or Medicine or equivalent or Master’s Degree in Natural Sciences or equivalent with not less than sixty per cent marks [fifty per cent for Scheduled Castes and Scheduled Tribes] with maximum age of thirty years shall be eligible to apply for the post of Scientist-B:
Provided that the upper age limit may be relaxed in case of officers and employees of the Bureau and in respect of such categories of persons as may, from time to time, be notified by the Central Government to the extent and subject to the conditions notified in respect of each category;
(c) the candidates having valid GATE score shall be shortlisted for interview and the number of candidates to be called for interview or group discussion and interview shall be not more than four times the number of vacancies advertised in the respective disciplines in order of merit of valid GATE score;
(d) for appointment through competitive online examination, a competitive online examination shall be conducted by the Bureau through a professional institution or agency as decided by the Director General and the number of candidates to be called for interview or group discussion and interview shall not be more than four times the number of vacancies advertised in the respective disciplines, in order of merit from among those who have secured at least fifty percent marks in the competitive online examination;
(e) candidates shall be selected discipline wise by one or more Selection Committees on the basis of merit as determined by the aggregate marks obtained by giving eighty five percent weightage to GATE score prescribed in clause (c) or examination process prescribed in clause (d) and by giving fifteen percent weightage to interview or group discussion and interview under clause (c) and clause
(d);
(f) candidates belonging to any of the Scheduled Castes or the Scheduled Tribes or Other Backward Classes may, to the extent the number of vacancies reserved for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes and Persons with Disability cannot be filled on the basis of the criteria laid down in clauses (c), (d) and (e), be selected by giving relaxation to make up the deficiency in the reserved quota, subject to suitability of these candidates for selection.
(g) a reserved list as per merit of successful candidates for filling the vacancies may be drawn which shall remain valid for a period of one year from the date such list is drawn.
7. Probation and Surety Bond for Scientist-B. - (1) The candidates appointed as Scientist-B on direct recruitment or on promotion shall be on probation for a period of two years during which the Director General shall arrange to give them such training and responsibilities as deemed necessary and prescribe departmental examination or examinations to be passed for successful completion of probation.
(2) On expiry of the period of probation, steps shall be taken to obtain the assessment reports of the probationer and to – ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 31
(a) confirm the probationer or to issue orders regarding satisfactory termination of probation, as the case may be, if the employee has completed his period of probation to the satisfaction of the appointing authority; or
(b) extend the period of probation by not more than six months or discharge the probationer or terminate the services of the probationer, as the case may be, in accordance with the relevant rules and orders, if the probationer has not completed the period of probation satisfactorily:
Provided that if the probationer is a promotee, he may be reverted to his former position instead of terminating his service on recommendations of the appropriate Selection Committee.
(3) The decision to confirm the probationer or to extend the period of probation, as the case may be, shall be communicated to the probationer normally within eight weeks of expiry of period of probation.
(4) The confirmation of the probationer after completion of the period of probation is not automatic but is to be followed by formal orders and as long as no specific orders of confirmation or satisfactory completion of probation are issued to a probationer, such probationer shall be deemed to have continued on probation.
(5) The date from which confirmation should be given effect to is the date following the date of satisfactory completion of the prescribed period of probation or the extended period of probation, as the case may be.
(6) A candidate, on appointment to the post of Scientist-B, shall furnish a surety bond in the form specified by the Bureau, for serving the Bureau for a minimum period of three years, and in case such person decides to leave the service either by resignation or absence from service without permission, earlier than three years from the date of employment, he shall be required to reimburse the Bureau six months’ emoluments at the rate last drawn by him unless he has worked for a shorter period in which case he shall be required to reimburse the full amount drawn by him.
8. Selection to other posts by deputation. – (1) Where the Executive Committee considers it is expedient so to do in the interest of the Bureau, it may fill up such number of posts at the level of Scientist-C and above upto Scientist-G by deputation:
Provided that in case of posts of Scientist-F and Scientist-G, approval of Central Government shall also be required.
(2) The posts to be filled by deputation shall be advertised in the leading newspapers giving, among others, full information regarding number of posts, prescribed qualifications, age-limit, special expertise, if required and experience as specified in First Schedule.
(3) Candidates who fulfill the prescribed requirements and are shortlisted by the Screening Committee constituted under regulation 9 shall be called for selection.
9. Screening Committee. – (1) Applications received in response to the advertisement for posts to be filled by deputation shall be screened by a Screening Committee consisting of not less than three officers of the Bureau not below the rank of Scientist-D and the senior most amongst them shall be the Chairperson of the committee, to be nominated by the Director General:
Provided that at least one officer in the Screening Committee shall be above the rank of the post for which the selection is being made.
(2) The candidates as shortlisted by the Screening Committee shall be considered by the Selection Committee for selection.
10. Selection Committee. – (1) Selection Committee for selection to the posts of Scientist-B, Scientist-C, Scientist-D and Scientist-E shall be constituted by the Director General comprising the following members, namely:- 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
(i) two officers of the Bureau not below the level of Scientist-F, senior among whom shall be the Chairperson; and
(ii) three experts from outside not below the rank of Scientist-F;
Provided that one such member shall belong to the Scheduled Castes or Scheduled Tribes category, in case of selection of person from these categories.
(2) The Selection Committee for selection to the posts of Scientist-F and Scientist-G shall comprise the following members, namely:-
(i) Secretary, Ministry or Department having -Chairperson administrative control of the Bureau;
(ii) Secretary, Department of Science and Technology; -Member
(iii) Director General, Bureau of Indian Standards; -Member
(iv) Director, National Physical Laboratory; -Member
(v) Director, Central Food Technological Research Institute; and -Member
(vi) Secretary, Department of Personnel and Training -Member or his representative not below the rank of Joint Secretary.
11. Appointing Authority. – Appointments to all posts shall be made by the appointing authority on the recommendations of the Selection Committee:
Provided that no appointment to the posts of Scientist-F and Scientist-G shall be made without the prior approval of the Central Government.
12. Disqualification. – (1) No person shall be eligible for initial appointment to any post, unless –
(a) he has attained the age of twenty-one years; and
(b) he is citizen of India or belongs to such category of persons as may be eligible for appointment under the Central Government.
(2) No person, –
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any post.
13. Liability of Scientists to serve in India and outside. – (1) Scientists appointed shall be liable to serve anywhere in lndia and outside lndia.
(2) Scientist appointed shall be liable to undergo such training and be detailed on courses of instruction in India or outside lndia as the Central Government may decide from time to time.
(3) Scientists detailed for training shall refund in full the cost of training, if for any reason, during the training or within a period of three years after the completion of such training, he chooses to discontinue his service.
14. Promotions of Scientists-B and above. – (1) The promotions to the posts of Scientist-C upto level of Scientist-G shall be made from amongst the officers serving in the immediate lower grade in the manner as laid down in the Modified Flexible Complementing Scheme for Scientific organisations as amended from time to time by the Central Government.
(2) An Internal Screening Committee for - ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 33
(a) promotion upto the level of Scientist-E, shall be constituted by the Director General, comprising of three officers of the Bureau not below the rank of Scientist-F and the senior most amongst them shall be the Chairperson of the committee.
(b) promotion of Scientist-E to Scientist-F and Scientist-F to Scientist-G shall comprise of the following members, namely:-
(i) Additional Secretary or Joint Secretary, Ministry or Department - Chairperson having administrative control of the Bureau;
(ii) one external member not below the level of Scientist-F or Scientist-G, - Member to be nominated by the Director General; and
(iii) one officer from the Bureau not below the level of Scientist-F - Member or Scientist-G, to be nominated by the Director General.
(3) An Assessment committee for -
(a) promotion upto the level of Scientist-E, shall be constituted by the Executive Committee, comprising the following members, namely: -
(i) two officers of the Bureau not below the level of Scientist-F, senior among whom shall be the Chairperson; and
(ii) three experts from outside not below the rank of Scientist-F;
Provided that one member shall belong to the Scheduled Castes or Scheduled Tribes category, in case of selection of person from these categories.
(b) promotion to the posts of Scientist-F, shall comprise of the following members, namely: -
(i) Secretary of the Ministry or Department having -Chairperson administrative control of the Bureau;
(ii) two Secretaries of other Ministries or Departments having administrative -Members control over institutions or organizations involved in research or scientific activities or their representatives who are at least one level above the post to which in-situ promotion under Modified Flexible Complementing Scheme is to be made;
(iii) Director General, Bureau of Indian Standards; -Member
(iv) Director, National Physical Laboratory; -Member
(v) Director, Central Food Technological Research Institute; and -Member
(vi) Secretary or Additional Secretary or Joint Secretary, -Member Department of Personnel and Training.
(c) promotion to the posts of Scientist-G, shall comprise of the following members, namely: -
(i) Secretary of the Ministry or Department having -Chairperson administrative control of the Bureau;
(ii) two Secretaries of other Ministries or Departments having administrative -Members control over institutions or organizations involved in research or scientific activities or their representatives who are at least one level above the post to which in-situ promotion under Modified Flexible Complementing Scheme is to be made;
(iii) Director General, Bureau of Indian Standards; -Member 34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]
(iv) Director, National Physical Laboratory; -Member
(v) Director, Central Food Technological Research Institute; and -Member
(vi) Secretary or Special Secretary or Additional Secretary, -Member Department of Personnel and Training.
(4) The recommendations of the Assessment Committee in respect of officers of Scientific Cadre of the Bureau for promotion of Scientist-B to Scientist-C, Scientist-C to Scientist-D and Scientist-D to Scientist-E shall be referred to the Appointing Authority for approval.
(5) The recommendations of the Assessment Committee in respect of officers of Scientific Cadre of the Bureau for promotion of Scientist-E to Scientist-F and Scientist-F to Scientist-G shall be referred to the Central Government for approval.
(6) Promotions of the officers as recommended shall be effective from the date of such approval.
15. Promotion to the post of Scientist-B. – (1) The promotions shall be made to the posts of Scientist-B through Limited Departmental Competitive Examination.
(2) Officers eligible for promotions to the post of Scientist-B, as specified in First Schedule, shall be assessed for promotion on the basis of the following two components and the relative weightage for each component shall be as follows:-
(a) written examination - 50 per cent
(b) Annual Performance Appraisal Reports - 50 per cent
(3) The written examination shall consist of two parts covering the following:-
(i) general concepts relating to Standardization and Quality Control; and
(ii) technical knowledge pertaining to the respective discipline of the candidates, as provided in Second Schedule;
(4) The qualifying marks in the written examination shall be fifty five per cent [forty five per cent for Scheduled Castes and Scheduled Tribes].
(5) Marks for Annual Performance Appraisal Reports for the previous five years shall be allotted, out of a maximum of 10 marks for each year, according to the grading in Annual Performance Appraisal Reports on the following basis:
Outstanding 9 Very Good 7 Good 5 Average 3
(6) A select list will be prepared in order of merit of the candidates on the basis of the total marks obtained in written examination and Annual Performance Appraisal Reports of the previous five years according to their respective weightage.
(7) The select list in respect of officers for promotion to Scientist-B shall be referred to the Director General for approval.
(8) Promotions of the officers shall be effective from the date of such approval.
16. Standing committee. – (1) A Standing Committee to determine the equivalence of disciplines shall be constituted by the Executive Committee comprising of three officers of ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 35 the Bureau not below the rank of Scientist-F and the senior most amongst them shall be the Chairperson of the committee.
(2) In order to accommodate the dynamic needs of expertise that may be required, the Standing Committee shall also determine the additional disciplines as required from time to time for recruitment purpose.
17. Authorized strength of cadre. – (1) The authorized strength of cadre shall be such as may be determined from time to time by the Executive Committee with the approval of the Central Government and the cadre strength shall specify the number of posts to be covered under Scientific Cadre as a whole and is 579 as on date:
Provided that there shall be interchangeability between the posts of Scientist-B, Scientist-C, Scientist-D, Scientist-E, Scientist-F and Scientist-G on account of in-situ promotion under the Modified Flexible Complimenting Scheme subject to the condition that total numbers of these posts taken together shall not exceed the authorized strength of cadre.
(2) In-situ promotion under the Modified Flexible Complementing Scheme shall be personal to the officer concerned and shall not result in specific vacancy in lower grade on that account.
(3) The post currently held by concerned officer shall be upgraded and shall be personal to him for duration of his holding the in-situ promotion post.
(4) The vacancy that may be created owing to superannuation, resignation, removal or death of the officer shall result in the post reverting to the original position of Scientist-B.
18. Power to relax. - Where the Executive Committee is of the opinion that it is necessary or expedient so to do, it may, with the approval of the Central Government, for reasons to be recorded in writing, relax any of the provisions of these regulations in respect of any class or category of persons.
19. Saving. - Nothing in these regulations shall affect reservation, relaxation of age limit and other concessions provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Person with Disability, ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
20. Interpretation. - If any question relating to the interpretation of these regulations arises, it shall be decided by the Executive Committee with the approval of the Central Government.
