The Building and Other Construction Workers (Regulation of Employmentand Conditions of Service) Second Ordinance, 1996.Ordinance · 1996

(1) No court shall take cognizance of any offence punishable under this Ordinance except on a complaint—

(a) made by, or with the previous sanction in writing of, the Director-General or the Chief Inspector; or

(b) made by an office-bearer of a voluntary organisation registered under the Societies Registration Act, 1860; or

(c) made by an office-bearer of any concerned trade union registered under the Trade Unions Act, 1926.

(2) No court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the first class shall try any offence punishable under this Ordinance.

Cognizance of offences.

55. No court shall take cognizance of an offence punishable under this Ordinance unless the complaint thereof is made within three months from the date on which the alleged commission of the offence came to the knowledge of the Director-General, the Chief Inspector, an office-bearer of a voluntary organisation or, as the case may be, an office-bearer of any concerned trade union.

CHAPTER XI MISCELLANEOUS

56. A Board may, by general or special order, delegate to the Chairperson or any other member or to the Secretary or any other officer or employee of the Board, subject to such conditions and limitations, if any, as may be specified in the order, such of its powers and duties under this Ordinance as it may deem necessary.

Delegation of powers.

57. Every Board shall furnish from time to time to the Central Government and to the State Government such returns as they may require.

Returns.

58. The provisions of the Workmen's Compensation Act, 1923, shall so far as may be, apply to building workers as if the employment to which this Ordinance applies had been included in the Second Schedule to that Act.
