FH. / ff. at. @.) — fae arg ax (fH. &. / FH. at. a.) } X faa sere ateeqe (faferrat Eareai)] /10 [oar. a. 1/11/2013-£.at] ate PA, APH aes MINISTRY OF POWER NOTIFICATION New Delhi, the 30th September, 2015 S.O. 2673(E).—Whereas in exercise of the powers conferred by clauses (g) and (n) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Central Government in consultation with the Bureau of Energy Efficiency had specified the Neyveli Thermal Power Station | [6x50 MW + 3xl00 MW], Neyveli, Cuddalore, Tamil Nadu, being the designated consumer vide “entry No. 106 in the Sector Table-(viii) Thermal Power Plant’, the Energy Consumption Norms and Standards - Net Heat Rate of 4131kcal/kWh-for the period 2012-2013 to 2014-2015, in relation to its current level of Energy Consumption Norms and Standards - Net Heat Rate of 4453 kcal/kWh, being the base line Energy Consumption Norms and Standards- Net Heat Rate and Net Product Output of 3335 Million Units (kWh) for compliance in the target year 2014- 2015, vide notification of the Government of India in the Ministry of Power number S.O. 687(E) dated the 30th March, 2012 published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (11) dated the 30th March, 2012; under the Energy Conservation (Energy Consumption Norms and Standards for Designated Consumers, Form, Time within which, and Manner of Preparation and Implementation of Scheme, Procedure for Issue of Energy Savings Certificate, and Value of Per Metric Ton of Oil Equivalent of [art ware 3(ii)] FRA HT USA ; STITT 3 Energy Consumed) Rules, 2012 notified vide notification of the Government of India in the Ministry of Power number G.S.R. 269(E) dated the 30th March, 2012 published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (1) dated the 30th March, 2012;
And whereas the said designated consumer has requested the Central Government for exemption from compliance with the Energy Consumption Norms and Standards-Net Heat Rate- specified in para | above for its plant comprising of 6xSOMW + 3x100MW as they are due for decommissioning on completion of their service life and are being continued to operate till the commissioning of New Neyveli Thermal Power Project (NNTPP) of 2x500 MW capacity, as conveyed by the Tamil Nadu Generation and Distribution Corporation Limited, Chennai, to tide over the acute shortage of power in the State of Tamil Nadu;
And whereas the said designated consumer has proposed to retire its units at its plant in two stages, envisaging decommissioning of 300 MW capacity each in October, 2017 (units 3, 4, 5, 6, and 9) and April, 2018 (units 1, 2, 7, and 8) respectively, to synchronise with the commissioning of unit 1 and unit 2 of the New Neyveli Thermal Power Project (NNTPP) of 2x500 MW capacity in October, 2017 and April, 2018 respectively;
And whereas the Central Government, in consultation with the Bureau of Energy Efficiency, has considered the request of the aforesaid designated consumer and is of the opinion that it is necessary and expedient in the public interest to agree to the decommissioning of the said Neyveli Thermal Power Station 1;
Now, therefore, in exercise of the powers conferred by section 53 of the Energy Conservation Act, 2001 (52 of 2001), the Central Government, in consultation with the Bureau of Energy Efficiency, hereby exempts the designated consumer, namely, the said Neyveli Thermal Power Station 1, Neyveli, Cuddalore, Tamil Nadu from the compliance with the Energy Consumption Norms and Standard-Net Heat Rate- in the target year 2014-15 of the first cycle (2012-13 to 2014-15) referred to in paragraph | above for the period up to 31st March, 2017 subject to the following conditions, namely:—
(a) The said designated consumer shall ensure that all the units of its Neyveli Thermal Power Station 1, Neyveli, Cuddalore, Tamil Nadu are decommissioned or retired by 31* March, 2017 and furnish to the Central Government in Ministry of Power, Bureau of Energy Efficiency and to the State Designated Agency of the State of Tamil Nadu the confirmation of decommissioning of all the units of the said Neyveli Thermal Power Station! by the said date;
(b) the said designated consumer, in lieu of the aforesaid exemption, shall invest an amount of at least Rs. 109,04,07,598 (Rupees One hundred nine crores, four lakhs, seven thousand,five hundred and ninety-eight only) in the establishment of renewable energy generating capacity, the amount being equivalent to the value of energy in terms of tonne of oul equivalent under rule 16 of the Energy Conservation (Energy Consumption Norms and Standards for Designated Consumers, Form, Time within which, and Manner of Preparation and Implementation of Scheme, Procedure for Issue of Energy Savings Certificate and Value of Per Metric Ton of Oil Equivalent of Energy Consumed) Rules, 2012 as per following formula, namely:— The Value of Energy in terms of tonne of oil equivalent = [{Baseline Net Heat Rate (kcal/kWh) — Net Heat Rate (kcal/kWh) for the target year} x Net Product Output (Million Units)] /10 [F.
