PART III—Section 4 izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 344] ubZ fnYyh] c`gLifrokj] flrEcj 8] 2016@Hkkæ 17] 1938 No. 344] NEW DELHI, THURSDAY, SEPTEMBER 8, 2016/BHADRA 17, 1938 ऊजाᭅ दᭃता ᭣ यरूो अिधसचूना नई ᳰद᭨ ली, 7 िसत᭥बर, 2016 स.ं बीईई/एस ए᭛ ड एल/वॉटर हीटर/3/2015-16.—ᮧाᱨप िविनयमᲂ, अथाᭅत् ऊजाᭅ दᭃता ᭣ यूरो (᭭ टेशनरी भंडारण ᮧकार के िव᳒ुत ्जल हीटर पर ᮧदशᭅन के िववरण और िविध) िविनयम, 2016, 4 जनवरी, 2016 को अिधसूचना सं᭎ या बीईई/एस ए᭛ ड एल/वॉटर हीटर/3 ᳇ारा ऊजाᭅ सरंᭃण अिधिनयम, 2001 (2001 का 52) कᳱ धारा 58 कᳱ उपधारा (1) के अधीन यथा: अपिेᭃत उन ᭪ यिᲦयᲂ से, राजपᮢ मᱶ उ᭍ त अिधसूचना के ᮧकािशत होने कᳱ तारीख स े पᱹतालीस ᳰदन कᳱ अविध के अंदर आपिᱫया ंया सुझाव आमंिᮢत करने के िलए ᮧकािशत ᳰकए गए ह;ᱹ िजनके उससे ᮧभािवत होने कᳱ सभंावना ह;ै और उ᭍ त ᮧाᱨप िविनयमᲂ कᳱ ᮧितया ंजनता के िलए 4 जनवरी 2016 को उपल᭣ ध कराई गई थी;

और इस िवषय मᱶ ᮧा᳙ सझुावᲂ पर िवचार ᳰकया गया है;

अत: अब, कᱶ ᮤीय सरकार के पवूᭅ अनमुोदन स े᭣यूरो उᲦ अिधिनयम कᳱ धारा 58 कᳱ उपधारा (2) ख᭛ ड (i) के साथ पᳯठत धारा 14 के ख᭛ ड (घ) और धारा 13 कᳱ उपधारा (2) के ख᭛ ड (ढ) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए िन᭥ निलिखत िविनयम बनाती ह,ै अथाᭅत ्:-

1. सिंᭃ᳙ नाम और ᮧारंभ.—(1) इन िविनयमᲂ का सिंᭃ᳙ नाम ऊजाᭅ दᭃता ᭣ यूरो (भंडार ᳰक᭭म के जल हीटर के लेबलᲂ पर उनके संᮧदशᭅन कᳱ िविशि᳥यां और रीित), िविनयम, 2016 ह।ै

(2) ये राजपᮢ मᱶ उनके अिंतम ᮧकाशन कᳱ तारीख को ᮧवृ᭜ त हᲂगे।

2. पᳯरभाषा.— (1) इन िविनयमᲂ मᱶ, जब तक संदभᭅ से अ᭠ यथा अपेिᭃत न हो,- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (क) ''अिधिनयम” से ऊजाᭅ सरंᭃण अिधिनयम, 2001 अिभᮧते ह;ै (ख) “ᮧᱨप” स ेइन िविनयमᲂ स ेउपाबंध ᮧᱨप अिभᮧते ह;ै (ग) “लेबल” स ेजल के हीटर पर िचपकाया गया या ᮧदᳶशत िलिखत, मुᳰᮤत, िचि᭮नत, मुहर लगी या ᮕाᳰफक सामᮕी अिभᮧेत ह;ै (घ) “लेबल अविध” स े अिधिनयम कᳱ धारा 14 के खंड (क) के अधीन कᱶ ᮤीय सरकार ᳇ारा िविन᳸द᭬ ट ऊजाᭅ हािन मानक के अधीन ᭭थायी हािन कᳱ िविधमा᭠ यता अविध अिभᮧेत ह ैऔर यᳰद ᭭थायी हािन कᳱ िविधमा᭠ यता कᳱ अविध कᳱ अिंतम अविध िविन᳸द᭬ ट नहᱭ कᳱ गई ह,ै इस अविध को के᭠ ᮤ ीय सरकार ᳇ारा िविन᳸द᭬ ट नए मू᭨ यᲂ तक िविधमा᭠ य मानी जाएगी;

(ङ) “मॉडल या मॉडलᲂ के पᳯरवार” से ᳰकसी िविश᭬ ट ᮩा᭛ ड का मॉडल या मॉडलᲂ कᳱ ᮰ेणी ह ैिजसके संबंध मᱶ परीᭃण ᳯरपोटᲄ का एकल समु᭒ चय लागू ह ैऔर जहा ंᮧ᭜ येक मॉडल के समान भौितक लᭃण, ᭭थायी हािन, ऊजाᭅ कुशलता ᭭ तर और िन᭬ पादन िविश᳥ताएं समान अिभᮧेत ह;ᱹ (च) “अन᭄ुाधारक” स ेऐसे ᭪ यिᲦ या अिभकरण स ेह ैिजसे िविनयम 7 के अधीन लेबल िचपकाने के िलए अनु᭄ा दी गई अिभᮧेत ह;ै (छ) “᭭टार रेᳳटग या ᭭टार ᭭तर स ेजल हीटर कᳱ ऊजाᭅ िन᭬पाद को ᭟योितत करने के िलए अिधिनयम कᳱ धारा 14 के खंड (क) के अधीन अिधसिूचत िव᳒ुत भंडारण जल हीटरᲂ के ᭭तर पर ᮧदᳶशत ᭭थायी हािन (ᳰक. वॉ. घं./ 24 हासᭅ/ 45 स)े कᳱ ᮰ेणी अिभᮧते ह ैl (ज) “᭪ यापारी या िवᮓेता” से ऐसा ᭪ यिᲦ जो जल हीटर कᳱ िबᮓᳱ या िवतरण करता ह ै और िजसके अंतगᭅत ऐस े दकुानदार, ᭪ यापारी, िविनमाᭅता और जल हीटर पर लेबल िचपकान ेके िलए अनुमित ᮧा᳙ अनु᭄ाधारक अिभᮧते ह ैl (झ) “जल के हीटर” से अिभᮧेत ह ैजो अिधिनयम कᳱ धारा 14 के ख᭛ ड (ख) के अधीन अिधसूचना मᱶ यथािविन᳸द᭬ ट सािधᮢ ह।ै

(2) यहां इसमᱶ ᮧयु᭍ त जो श᭣ द और अिभ᭪ यिᲦया ं अपᳯरभािषत ह ᱹ ᳰक᭠तु अिधिनयम मᱶ पᳯरभािषत ह,ᱹ उनका अिधिनयम मᱶ उ᭠ हᱶ ᮓमश: ᳰदया गया अथᭅ ही होगा।

3. लबेल पर ᮧदᳶशत ᳰकए जान ेवाली िविशि᳥या.ं—(1) ᮧ᭜ येक जल के हीटर पर, इसके लेबल पर िन᭥ निलिखत िविशि᳥या ंᮧदᳶशत कᳱ जाएगी, अथाᭅत्:- (क) ऊजाᭅ दᭃता ᭣ यूरो का ᮧतीक िच᭮न;

(ख) उपकरण;

(ग) ᮩांड का नाम;

(घ) िविनमाᭅण या आयात का मॉडल का नाम, स᭎ं या और वषᭅ;

(ङ) रेटेड ᭃमता (लीटर);

(च) रेटेड इनपुट पावर (ᳰक. वॉ.) (वा᭭ तिवक जाचं) (छ) ᭭ थायी हािन (ᳰक. वॉ. घं. / 24 घंटे / 45 िडᮕी से.) ;

(ज) लेबल कᳱ अविध;

(झ) ᭭ टार ᭭ तर; और (ञ) िवशेष ᮰ंृखला कोड;

(2) लेबल का िडजाइन, रंग, आकार और अतंᳶव᳥ इन िविनयमᲂ के साथ उपांबध अनुसूची मᱶ यथा िविन᳸द᭬ ट होगा।

4. लबेलᲂ के सᮧंदशᭅ के िलए समय-सीमा.—(1) िविनयम 3 मᱶ िविन᳸द᭬ ट सभी िविशि᳥यᲂ वाला लेबल इन िविनयमनᲂ के लागू होन ेकᳱ तारीख स ेछह मास कᳱ अविध के भीतर ᮧ᭜ यके जल के हीटर पर ᮧदᳶशत ᳰकया जाएगा।

(2) अिधिनयम कᳱ धारा 14 के ख᭛ ड (क) के अधीन लागू संशोिधत ऊजाᭅ हािन मानकᲂ के ᮧारंभ होने पर और ᮧारंभ होने स,े ᮧत् येक अनु᭄ाधारक या ᭪ यापारी या िवᮓेता स ुिनि᳟त करेगा ᳰक – क) िवᮓय हतेु रखे गए जल हीटर, संशोिधत ऊजाᭅ उपभोग मानकᲂ के साथ स᭥कािलक होते ᱟए संशोिधत ᭭टार लेवल और संशोिधत लेवल अविध दशाᭅयेगा और जल हीटर का िविनमाᭅण वषᭅ भी ऐस ेसंशोिधत ऊजाᭅ उपभोग मानकᲂ के समकालीन होगा, और जल हीटर का िनमाᭅण पूवᭅवतᱮ ऊजाᭅ उपभोग मानकᲂ के साथ नहᱭ करेगा l ख) ᳞ौहारी, खुदरा ᭪ यापाᳯरयᲂ को जानकारी दनेे के िलए उनकᳱ जागᱨकता के साथ ही उपभो᭍ ताᲐ को िशिᭃत करने के िलए अपेिᭃत ᮧचार-ᮧसार सिहत सभी ᮧारंिभक उपाय इन िविनयमᲂ के अधीन ऐस े ᮧारंभ कᳱ तारीख स ेछह माह पूवᭅ िनयोिजत ᳰकए जाएगें।

5. लबेल ᮧदᳶशत करन ेकᳱ रीित.—(1) इकाई के सामन ेवाल ेस᭥ᮧदशᭅ पर लेबल लगाया जाएगा और यह िविनयम 3 के उपिविनयम (2) मᱶ सरलता से ᳰदखाई दनेा चािहए और अनु᭄ाधारक सिुनि᳟त करेगा ᳰक ᮧ᭜ येक रिज᭭ᮝीकृत इकाई या मॉडल पर पहचान के ᮧयोजन के िलए स᭥ᮧदशᭅ मᱶ लेबल िबᮓᳱ या ᳰकराए के ᳲबद ुपर ᳰदखाई दतेा ह ैऔर यह लेबल इकाई या मॉडल सिहत केᳲसग के बाहर मᳰुᮤत या िचपकाया गया होगा।

(2) ᮧदᳶशत नहᱭ कᳱ गई इकाइयᲂ के िलए लेबल इकाई या मॉडल सिहत केᳲसग के बाहर मुᳰᮤत या िचपकाया जाए और यह लेबल इकाई या मॉडल पर लगाया जाए, जब इकाई या मॉडल को इसकᳱ पै᳴ कग स ेबाहर िनकाला जाता ह ैया लेबल को ᮕाहक या ᮧयो᭍ ता को ᳰदए जान ेवाले द᭭ तावेज के भाग के ᱨप मᱶ सि᭥मिलत ᳰकया जाए।

6. लबेल सᮧंदᳶशत करन ेकᳱ अन᭄ुा.—(1) ᭣ यूरो कᳱ पूवᭅ अनु᭄ा के िबना िव᳒ुत् जल के हीटर पर कोई ᭭ टार नहᱭ िचपकाया जाएगा।

(2) उप- िविनयम (1) के अधीन ᭣ यूरो कᳱ अनु᭄ा लेन े के ᮧयोजन के िलए, आवेदन ᮧᱨप - I मᱶ और इले᭍ ᮝॉिनक ᮧᱨप मᱶ ᳰकया जाएगा:

परंतु जल के हीटर के ᮧ᭜ यके मॉडल के पᳯरवार के िलए पृथक आवेदन ᳰकया जाए;

(3) उप- िविनयम (2) के अधीन ᮧ᭜ येक आवेदन- पᮢ के साथ िन᭥ निलिखत सलं᭏ न हᲂगे – (क) ऊजाᭅ दᭃता ᭣ यरूो, नई ᳰद᭨ ली के पᭃ मᱶ दो हजार ᱧपए का आवेदन फᳱस अथवा भुगतान के ᳰकसी ᮧितᮕाहय इले᭍ ᮝॉिनक ढंग मᱶ दये होगा;

(ख) ऊजाᭅ दᭃता ᭣ यरूो, नई ᳰद᭨ ली के पᭃ मᱶ दये एक लाख ᱧपए कᳱ लेबल जमानत रािश; मांग पᮢ या भुगतान के ᳰकसी ᮧितᮕाहय इले᭍ ᮝॉिनक ढंग मᱶ:

परंत,ु लघु उ᳒ोग के मामल ेमᱶ, जमानत रािश केवल प᭒ चीस हजार ᱧपए होगी-; और (ग) यथा: िविन᳸द᭬ ट द᭭ तावेज ᮧᱨप I 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

7. अन᭄ुा ᮧदान करना.—(1) िविनयम 6 के अधीन कोई आवेदन ᮧा᭡ त होने पर और इससे सतुं᭬ ट होन ेपर ᳰक इसमᱶ दी गई सभी अपेᭃाᲐ का पालन ᳰकया गया ह,ै ᭣ यूरो ऐसी ᮧाि᳙ कᳱ तारीख से एक मास कᳱ अविध के भीतर, िविनयम 8 मᱶ यथा: िविन᳸द᭬ ट िनबंधनᲂ एवं शतᲄ के अ᭟ यधीन जल के हीटर पर ᮧᱨप-2 या इले᭍ ᮝॉिनक ᮧᱨप मᱶ लेबल िचपकाने के िलए अनु᭄ा ᮧदान कर सकता ह।ै

(2) ᭣ यूरो, ᮧᱨप -3 मᱶ रिज᭭ टर बनाकर रखेगा और इसमᱶ अनु᭄ाधारक के नाम ᮧिव᭬ ट करेगा, िजसके एक डटेा बेस का भी रखरखाव ᳰकया जाएगा।

(3) उप- िविनयम (1) के अधीन इस ᮧकार ᮧदᱫ अनु᭄ा उस अविध तक िविधमा᭠ य होगी जो के᭠ ᮤ ीय सरकार ᳇ारा धारा 14 के ख᭛ ड (क) के अधीन यथा: अिधसिूचत ऊजाᭅ हािन मानक ᳇ारा ᭭ टार ᭭ तर के िलए िविन᳸द᭬ ट कᳱ गई ह।ै

(4) अनु᭄ाधारक ᳇ारा अन᭄ुा के नवीकरण के िलए आवेदन छह मास के भीतर ᳴कत ुइस अविध कᳱ समाि᳙ से तीन मास पूवᭅ ᳰकया जाएगा। ऐसा आवेदन, अनु᭄ा कᳱ समाि᳙ स ेकम स ेकम तीन मास पूवᭅ ᳰकया जाएगा और इसके साथ ऊजाᭅ दᭃता ᭣ यरूो, नई ᳰद᭨ ली के पᭃ मᱶ मांग पᮢ के ᱨप मᱶ या इले᭍ ᮝॉिनक ढंग मᱶ एक हजार ᱧपए का दये फᳱस होना चािहए।

(5) िविधमा᭠ यता कᳱ अविध समा᭡ त होन े के प᭫ चात ् ᳰकसी आवेदन का नवीकरण नहᱭ ᳰकया जाएगा और अनु᭄ाधारक को नया आवेदन पᮢ ᮧ᭭ तुत करना होगा।

(6) उप- िविनयम (4) के अधीन नवीकरण के िलए, आवेदन-पᮢ िमलन ेपर और सभी अपेᭃाᲐ का अनुपालन होन े के संबंध मᱶ समाधान होने पर, ᭣ यूरो ऐसा आवेदन ᮧा᭡ त होने कᳱ तारीख से एक मास कᳱ अविध के भीतर ᮧᱨप-2 मᱶ अनु᭄ा का नवीकरण कर सकता ह।ै

(7) जो अनु᭄ाधारक उस तारीख से जल के हीटर के मौजूदा मॉडल पर लेबल िचपकाने को जारी रखने कᳱ अन᭄ुा कᳱ मांग करता ह,ै िजस तारीख स ेसंशोिधत ᭭ टार ᭭ तर लागू ᱟआ ह,ै केवल ᮧᱨप 4 मᱶ एक घोषणा ᮧ᭭ तुत करेगा।

(8) यᳰद िव᳒ुत् जल के हीटर के नए मॉडल कᳱ योजना संशोिधत ᭭ टार ᭭ तर के साथ समᮓमण कर शुᱨ करने कᳱ ह ै तो अनु᭄ाधारक को नया लेबल िचपकाने कᳱ अनु᭄ा लेगा और ऐसी अनु᭄ा के िलए आवेदन संशोिधत ᭭ टार ᭭ तर के लागू होन े से छह मास पूवᭅ ᳰकया जाए।

8. लबेल पर िविशि᳥या ंᮧदᳶशत करन ेके िलए िनबंधन और शत.ᱸ—ᮧ᭜ येक अनु᭄ाधारक और ᭪ यापारी और िवᮓेता िन᭥ निलिखत िनबंधनᲂ एवं शतᲄ का पालन करेगा, अथाᭅत:- (क) जल के हीटर के लेबल पर ᮧदᳶशत ᭭ टार ᭭ तर अिधिनयम कᳱ धारा 14 के ख᭛ ड (क) के अधीन कᱶ ᮤीय सरकार अिधसिूचत जल के हीटर के िलए ऊजाᭅ हािन मानकᲂ के अनᱨुप हᲂगे। (ख) यह लेबल जल के हीटर के ऐस ेमॉडलᲂ पर ही िचपकाया जाएगा िजसके िलए अन᭄ुा ᮧदान कᳱ गई ह।ै (ग) लेबल को अनु᭄ाधारक कᳱ लागत पर मᳰुᮤत और जल के हीटर पर िचपकाया जाएगा। (घ) अनु᭄ाधारक, ᭪ यापारी और िवᮓेता यह सुिनि᳟त करेगा ᳰक जल के हीटर पर लबेल पर ᮧदᳶशत ᭭ टार ᭭ तर हर समय बना रहगेा। (ङ) अनु᭄ाधारक िविनयम 9 मᱶ यथा: िविन᳸द᭬ ट लेबल फᳱस का भगुतान करेगा। ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 (च) अनु᭄ाधारक ᭣ यूरो को िविशि᳥या ंदये करेगा िजसमᱶ लेबल लगे उप᭭ करᲂ को बनाने का ᭣ यौरा और िवᱫीय वषᭅ कᳱ ᮧ᭜ येक ितमाही के अतं मᱶ िन᭥ निलिखत मास के भीतर ᮧ᭜ यके ितमाही के िलए दये ᮧो᭞भूत ल ेबᳲलग फᳱस कᳱ िविशि᳥यां हो। (छ) अनु᭄ाधारक, ᭣ यूरो को अपने लेबल लगे उ᭜ पादᲂ कᳱ िबᮓᳱ के िलए िनयु᭍ त ᮧ᭜ येक वषᭅ कᳱ 30 अᮧलै या उसस ेपहले अिधकृत िवतरकᲂ, ᭪ यपाᳯर यᲂ और थोक िवᮓेताᲐ एवं िवᮓेताᲐ कᳱ सूची दगेा। (ज) अनु᭄ाधारक, ᭪ यापारी और िवᮓेता ऐसे अ᭠ य िनबंधनᲂ एवं शतᲄ का पालन करᱶगे जो ᭣ यूरो ᳇ारा, मानक और लेबᳲलग के संबंध मᱶ ᭣ यूरो कᳱ िनदᱷिशका मᱶ अंतᳶव᭬ ट िनबंधनᲂ और शतᲄ सिहत िविन᳸द᭬ ट ᳰकए गए हᲂ।

9. लबेल फᳱस.—(1) ᮧ᭜ येक अनु᭄ाधारक, ᭣ यूरो को िव᳒ुत् जल के हीटर पर ᮧ᭜ येक िचपकाए गए लेबल के िलए दो ᱧपए कᳱ फᳱस का भुगतान करेगा।

(2) उप-िविनयम (1) के अधीन िविन᳸द᭬ ट लेबल फᳱस, ᮧ᭜ येक िवᱫीय वषᭅ कᳱ अिंतम तारीख स ेएक मास के भीतर वाᳶषक तौर पर संदᱫ ᳰकया जाएगा:

परंतु यथा िविन᳸द᭬ ट अविध के भीतर लेबल फᳱस के भुगतान मᱶ चूक पर, ᭣ यूरो िविनयम 6 के उप-िविनयम (3) के ख᭛ ड (ख) के अधीन ᮧितभूित िनᭃेप से इस पर दस ᮧितशत ᮧित वषᭅ कᳱ दर से इस पर ᭣ याज के साथ बकाया रकम वसलू करेगा औरयᳰद इसे जमा ᳰकए जाने कᳱ अंितम तारीख से एक वषᭅ के भीतर पूरा लेबᳲलग शु᭨ क वसूल नहᱭ ᳰकया जाता, ᭣ यूरो अनु᭄ाधारक को ᮧदᱫ सभी अनु᭄ा र᳎ कर सकता ह ैऔर अन᭄ुाधारक का नाम ᭪ यितᮓमी के ᱨप मᱶ समाचार पᮢ मᱶ ᮧकािशत कर सकता ह।ै

10. लबेल जमानत फᳱस का ᮧितदाय.—िविनयम 9 के उप-िविनयम (2) के उपबंधᲂ के अ᭟ यधीन, अनु᭄ाधारक िव᳒ुत् जल के हीटर का िविनमाᭅण न करन ेपर लेबल जमानत फᳱस के ᮧितदाय का हकदार होगा।

11. ᭣ यरूो ᳇ारा स᭜ यापन.—(1) ᭣ यूरो अथवा इसकᳱ नामिन᳸द᭬ ट अिभकरण, ᭭ वयमेव अथवा इस े िशकायत ᮧा᭡ त होने पर, यह सिुनि᳟त करने के िलए स᭜ यापन करेगा ᳰक जल के हीटर के लेबल पर ᮧदᳶशत ᭭ टार ᭭ तर और अ᭠ य िविशि᳥यᲂ के अनᱨुप है और ᳰक यह अनु᭄ा के अ᭠ य िनबंधनᲂ एवं शतᲄ के अनुपालन मᱶ ह।ै

(2) स᭜यापन ᮧयोजन के िलए, ᭣यूरो या नामिन᳸द᳥ अिभकरण, िविनमाᭅता सुिवधा या भ᭛डागार या फुटकर िवᮓय कᱶ ᮤ स,े जैसा वह उिचत समझ,े यादिृ᭒छक तौर पर नमूने एकᮢ करेगा l

(3) जहां उप- िविनयम (1) के अधीन िशकायत ᮧा᭡ त होने पर, ᭣ यूरो ᳇ारा जांच और अशंाकंन ᮧयोगशालाᲐ हते ु रा᭬ ᮝीय परीᭃण ᮧ᭜ यायन बोडᭅ (एनएबीएल) ᳇ारा स᭥यक ᮧ᭜ याियत ᭭ वतंᮢ ᮧयोगशाला मᱶ जल के हीटर कᳱ जांच पर आᭃेप कर स᭜ यापन करना अपिेᭃत ह,ै वहां अनु᭄ाधारक को ऐसे परीᭃण के िन᭬ पादन के िलए नोᳯटस जारी ᳰकया जाएगा और िशकायतकताᭅ स े᭣ यूरो के पास परीᭃण, पᳯरवहन संबंधी खचᭅ और अ᭠ य आकि᭭मक ᭪ यय, ऐसी समयाविध मᱶ जमा कराने कᳱ मांग कᳱ जाएगी जो ᭣ यूरो ᳇ारा अवधाᳯरत कᳱ गई हो और यᳰद आᭃेप परीᭃण के अधीन िलए गए नमूने िवफल रहत े हᱹ, ᭣ यूरो को नमूने लेने, नमून ेके पᳯरवहन और जांच ᮧभारᲂ कᳱ लागत के िलए सभी ᭪ यय कᳱ ᮧितपूᳶत अनु᭄ाधारक ᳇ारा कᳱ जाएगी और ᭣ यूरो उि᭨लिखत ᭪ यय िशकायतकताᭅ को ᮧितदाय करेगा और जहा ंउप᭭ कर आᭃेप परीᭃण पर पास हो जात ेह,ᱹ तब िशकायतकताᭅ ᳇ारा जमा कराए गए ᭪ यय ज᭣ त कर िलए जाएंगे।

(4) जहां परीᭃण के िलए जल के हीटर के नमूने ᭭ वयमवे परीᭃण अथवा आᭃेप परीᭃण के दौरान परीᭃण मᱶ असफल रहते ह,ᱹ वहां अनु᭄ाधारक को एक अ᭠ य अवसर ᳰदया जाएगा और ᭣ यूरो, अनु᭄ाधारक कᳱ लागत पर रा᭬ ᮝीय परीᭃण 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] और अंशाकंन ᮧयोगशाला बोडᭅ (एनएबीएल) ᳇ारा स᭥ यक ᱨप से ᮧ᭜याियत ᭭ वतंᮢ ᮧयोगशाला मᱶ ᮧथम जांच मᱶ ᮧयु᭍ त जल के हीटर के दो गुने पᳯरमाण मᱶ दसूरा परीᭃण करेगा;

(5) जहां, दसूरा परीᭃण असफल होता ह,ै ᭣ यूरो,- (क) ᮧᱨप 5 मᱶ अनु᭄ाधारक को सभी रा᭔ य नामोᳰ᳎᭬ ट अिभकरणᲂ को िनदशे दगेा ᳰक ᮧᱨप 5 के जारी होन ेकᳱ तारीख स ेअनु᭄ाधारक दो मास कᳱ अविध के अंदर करेगा;

i. िव᳒ुत जल के हीटर के लेबल पर ᮧदᳶशत ᭭ टार ᭭ तर सही करेगा या परीᭃण के दौरान ᮢुᳯटयᲂ और किमयᲂ को दरू करेगा;

ii. ᭣ यूरो के ᳰदशा- िनदᱷशᲂ के अनुपालन मᱶ बाजार स ेसभी ᭭ टॉक को वापस लेगा; और iii. िव᭄ािपत सामᮕी पर ᮧदᳶशत िविश᳥ताए ंमᱶ पᳯरवतᭅन करेगा;

(ख) उपभो᭍ ताᲐ के लाभ के िलए, ᭣ यूरो के अिभिहत अिभकरण स ेजांच पᳯरणामᲂ कᳱ ᮧाि᳙ कᳱ तारीख से, दो मास के भीतर अन᭄ुाधारक का नाम, ᮩा᭛ ड का नाम, मॉडल का नाम या मॉडल सं᭎ या, ᮧतीक िच᭮न और अ᭠ य िविनदᱷश ᳰकसी दिैनक रा᭬ ᮝीय अथवा ᮧादिेशक समाचारपᮢ अथवा इल᭍े ᮝॉिनक अथवा जो वह ठीक समझᱶ ᳰकसी अ᭠ य रीित से ᮧकािशत करेगा;

(ग) संबंिधत रा᭔ य नामिन᳸द᭬ ट अिभकरण को अिधिनयम, कᳱ धारा 27 के अधीन अनु᭄ाधारक और ᭪ यापारी के िवᱨ᳍ ᭠ यायिनणᭅयन कारᭅवाई करने के िलए ससंिूचत करेगा।

(6) अन᭄ुाधारक उप-िविनयम (5) मᱶ िन᳸द᭬ ट दो मास कᳱ अविध समा᭡ त होने के दस ᳰदन के भीतर,- (क) ᭣ यूरो को ᳰदशा-िनदᱷश के अनुपालन मᱶ कᳱ गई कारᭅवाई के सबंंध मᱶ ᮧᱨप 6 मᱶ अनपुालन ᳯरपोटᭅ भेजेगा;

और (ख) यᳰद ख᭛ ड (क) मᱶ िन᳸द᭬ ट अनपुालन ᳯरपोटᭅ ᮧा᭡ त नहᱭ ᱟई ह ैया िविन᳸द᭬ ट अविध के भीतर िनदᱷश का पालन ᳰकए िबना ᮧा᭡ त होती ह,ै इस ेजारी िनदᱷशᲂ का अनअनुपालन माना जाएगा और ᭣ यरूो ᳇ारा इस ᮧभाव के आदशे जारी कर ᳰदए जाएंगे।

(7) ᭣ यूरो अिधिनयम कᳱ धारा 17 के अधीन कारᭅवाई करने और उ᭍ त उप-िनयम के खंड (ख) के अधीन पाᳯरत आदशेᲂ के ᮧवᭅतन के ᮧयोजन के िलए सभी रा᭔ य अिभिहत अिभकरणᲂ को खंड (क) (ख) मᱶ िन᳸द᭬ ट अनपुालन ᳯरपोटᭅ और उप-िविनयम (6) के खंड (ख) मᱶ जारी आदशेᲂ कᳱ ᮧित, आव᭫ यक द᭭ तावेजᲂ सिहत भेजगेा;

(8) जहा ं अनु᭄ाधारक, ᭣यूरो ᳇ारा उप -िविनयम (5) के तहत जारी ᳰकए गए ᳰदशािनदᱷशᲂ के अनुपालन मᱶ असफल रहता है , वहां ᭣यूरो सभी रा᭔य नामोᳰ᳎᳥ अिभकरणᲂ को सूचना दतेे ᱟए – (क) िविनयम 7 के उप -िविनयम (1) के तहत अनु᭄ाधारक को ᮧदᱫ स᭥मित वापस ल ेलेगा;

(ख) के᭠ᮤीय सरकार को, अिधिनयम कᳱ धारा 14 के खंड (क) के अधीन कᱶ ᮤीय सरकार ᳇ारा अिधसूिचत ऊजाᭅ हािन मानकᲂ कᳱ अनुᱨपता मᱶ अनु᭄ाधारक ᳇ारा िवफलता कᳱ पुि᳥ मᱶ परीᭃण ᳯरपोटᭅ के साथ, कᱶ ᮤीय सरकार ᳇ारा ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7 अिधिनयम कᳱ धारा 14 के खंड (ग) के अधीन िवचार करन ेऔर कारᭅवाई करने के िलए उप- िविनयम (6) के खंड (क) मᱶ िन᳸द᭬ ट ᭣ यूरो कᳱ िनदᱷश ᳯरपोटᭅ भेजेगा। (ग) उपभोᲦाᲐ के लाभ के िलए, दो मास के भीतर, ᳰकसी रा᳦ीय या ᮧादिेशक दिैनक समाचार पᮢ मᱶ और ᳰकसी इले᭍ᮝॉिनक या ᳰकसी अ᭠ य रीित से जैसा ᭣ यूरो ᳇ारा ठीक समझ े जाए, अनु᭄ाधारक का नाम, ᮩांड नाम, मॉडल का नाम या मॉडल सं᭎या, संᮧतीक और अ᭠य िविनदᱷशन ᮧकािशत करेगा;

(घ) संबंिधत रा᭔ य अिभिहत अिभकरणᲂ को अिधिनयम कᳱ धारा 27 के अधीन अनु᭄ाधारक और ᭪ यापारी के िवᱧ᳍ आगे िविधक कारᭅवाई शुᱨ करने के िलए सिूचत करेगा।

12. अन᭄ुा का र᳎करण.—᭣यूरो, िविनयम 7 के अधीन ᮧदᱫ अनुमित को र᳎ कर सकता ह,ै यᳰद अनु᭄ाधारक – िविनयम 7 के तहत िविन᳸द᳥ ᳰकसी िनयम और शतᭅ का पालन नहᱭ करता;

(क) िविनयम 8 के अधीन िविन᳸द᳥ िनबंधन और शतᲄ का अनुपालन नहᱭ करता;

(ख) िविनयम 9 के अधीन िविन᳸द᳥ अविध के भीतर लेबल फᳱस का संदाय नहᱭ करता;

(च) अनु᭄ाधारक ᭣ यूरो को एक िववरण (हाडᭅ ᮧित तथा मानक और लेबᳲलग ऑनलाइन वेब पोटᭅल के मा᭟ यम से) ᮧ᭭तुत करेगा िजसमᱶ लेबल धारक उप᭭ कर के उ᭜ पादन और िवᱫीय वषᭅ कᳱ ᮧ᭜ यके ितमाही के अंत स े तीस ᳰदन कᳱ समय अविध के अंदर ᮧ᭜ यके ितमाही के िलए ᮧो᭞भूत लेबᳲलग फᳱस का िववरण होगा। यह िववरण ᭣ यूरो को ᭭ वचािलत ᮧणािलयᲂ के मा᭟ यम स ेभी ᮧदान कᳱ जाएगी;

(छ) अनु᭄ाधारक िव᳒ुत जल के हीटर के संबंध मᱶ अ᭠ य िववरण, िजसके िलए अनमुित ᮧदान कᳱ गई ह,ै जैस े और जब भी ᭣ यूरो ᳇ारा मांगा जाता ह,ै भी उपल᭣ध करेगा।

5. जब कभी ᭣ यरूो ᳇ारा समीᭃाधीन ᭭ टार ᭭ तर योजना मᱶ आशोधन ᳰकया गया ह,ै िव᳒ुत जल के हीटर का ᭭ टार ᭭ तर िन᭥ नानुसार उपांतᳯरत होगा:- (क) यᳰद संशोिधत ᭭ टार ᭭ तर के सामजं᭭ य मᱶ नया मॉडल शुᱨ ᳰकया जाता ह,ै ऐसी अनुमित के िलए ᭣ यूरो के पास उस तारीख स ेछह मास अिᮕम मᱶ आवेदन ᳰकया जाए िजस तारीख स ेनए ᭭ टार ᭭ तर लागू हᲂगे;

(ख) जहा ंपᳯरवᳶतत ᭭ टार ᭭ तर लागू करन ेके िलए मौजूदा मॉडल को जारी रखा जाता ह,ै ᭣ यूरो के पास ᮧᱨप 4 मᱶ घोषणा ही ᮧ᭭ तुत कᳱ जाएगी।

7. अत:, अब ऊजाᭅ दᭃता ᭣ यूरो (ि᭭थर भंडारकरण ᮧकार के िव᳒तु् जल हीटर पर लेबल ᮧदᳶशत करन ेकᳱ िविशि᳥या ं और रीित) िविनयमन, 2016 के िविनयम (4) के ख᭛ ड (क) ᳇ारा ᮧदᱫ शिᲦयᲂ का उपयोग करते ᱟए, ᭣ यूरो िनदशे दतेा ह:ै-

(i) िव᳒ुत् जल हीटर के लेबल पर ᮧदᳶशत स् टार ᭭ तर को सही करᱶ अथवा जांच के दौरान पाई गई ᮢुᳯटयᲂ और किमयᲂ को दरू करᱶ;

(ii) ᭣ यूरो के िनदᱷशᲂ का पालन करने के िलए बाजार स ेसभी ᭭ टॉक वापस ले लᱶ; और

(iii) िव᭄ापन कᳱ सामᮕी मᱶ ᮧदᳶशत ᳰकए गए िविशि᳥यᲂ मᱶ पᳯरवतᭅन करᱶ।

And whereas copies of the said draft regulations were made available to the public on 4th January 2016;

And whereas the suggestions received in this regard have been taken in to consideration;

Now therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the said Act, the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement.—(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater) Regulations,

2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—(1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Form” means a form appended to these regulations;

(d) “label period” means the validity period of the standing loss under energy consumption standard specified by the Central Government under clause (a) of section 14 of the Act and in case the end period of the validity period of the standing loss is not specified, it shall be deemed to be valid until new values for the same are specified by the Central Government;

(e) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, standing loss value, energy efficiency rating and performance characteristics;

(f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “star rating or star level” means the grade of standing loss (kWh/24hr/450C) displayed on the label of the electric storage water heaters notified under clause (a) of section 14 of the Act to denote the energy performance of water heater;

(h) “trader or seller” in relation to any labeled water heater means a person who sells or distributes any such water heater and includes trader, manufacturer and permittee given permission to affix label on such water heater;

(i) “water heater” means an appliance as specified in the notification under clause (b) of section 14 of the Act.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have the same meanings respectively as assigned to them in the Act.

3. Particulars to be displayed on label.—(1) On every water heater, the following particulars shall be displayed on its label, namely:-

(a) the logo of Bureau of Energy Efficiency;

(b) equipment;

(d) model name, number and year of manufacturing or import;

(e) rated capacity (Litre);

(f) rated input power (kW) (Actual Tested);

(g) standing loss (kWh/24 hr/450C);

(h) label period;

(i) star level; and

(j) unique series code.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.—(1) A label containing all the particulars specified in regulation 3 shall be displayed on every water heater within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of the energy performance standards under clause (a) of section 14 of the Act, every permittee shall ensure that

(a) the water heater put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the water heater shall also be in synchronization with such revised energy consumption standards, and shall not produce the water heater with the previous energy consumption standards;

(b) all the preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of commencement under these regulations.

5. Manner of display of label.—(1) The label shall be affixed at the front display of the unit and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model on display for identification purpose, at point of sale or hire and the label shall also be printed or pasted to the exterior to the casing containing the unit or model.

(2) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label.—(1) No star label shall be affixed on an electric water heater without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1) an application shall be made in Form-I and in electronic form:

Provided that separate application shall be made for each model of electric water heater.

(3) Every application under sub-regulation (2) shall be accompanied by –

(a) an application fee of two thousand rupees, payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment;

(b) a label security fee of one lakh rupees, payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment:

Provided that in case of small scale industry label security fee shall be only twenty -five thousand rupees; and

7. Grant of permission.—(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to terms and conditions as are specified in regulation 8, permission for affixing label on water heater in Form II or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein, a database of which shall also be maintained.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry of permission and such application shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, shall renew permission in Form II.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the electric water heater from the date from which the revised star level comes into force shall submit only a declaration as per Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the electric water heater is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. – Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of water heater shall conform to energy consumption standards for water heater notified by the Central Government under clause (a) of section 14 of the Act ;

(b) the label shall be affixed only on such model of water heater for which permission has been granted;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of water heater shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers and sellers appointed to sell their labeled products, on or before the 30th day of April of every year;

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labeling.

9. Label fee.—(1) Every permittee shall pay to the Bureau a label fee of two rupees on each label affixed on the electric water heater.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under clause (b) of subregulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of Label Security deposit.—Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture of that particular model of electric water heater.

11. Verification by Bureau.—(1) The Bureau of Energy Efficiency or its designated agency may, either suo motu, or on a complaint received by it, carry out verification to ensure that the water heater conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission

(2) For the purpose of verification, the Bureau or its designated agency shall procure samples in random, from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification, by challenge testing the water heater in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL), a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau; and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund expenses to the complainant, the user of the label to the complainant; and where the sample passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of water heater used for testing fails the test during suo motu testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of water heater used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL) at the cost of the permittee.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permittee in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months from the date of issuance of Form V,

(i) correct the star level displayed on the label of the electric water heater or remove the defects and deficiencies of the failed model, found during the verification conducted as per regulation 11;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months from the date of receipt of test results from Bureau’s designated agency;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in subregulation (5),

(a) send the compliance report as per Form VI to the Bureau with respect to action taken in compliance with the direction; and

(b) where the compliance report referred to in clause (a) is not received or received without complying to any of the direction within aforesaid specified period, it shall be deemed as non-compliance of the direction issued and necessary orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of subregulation (6) of regulation 11 to all the State Designated Agencies for the purpose of taking action under section 17 of Act and enforcement of the order passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause

(a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (5) of regulation 11 for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as deemed fit by the Bureau within two months of sending report to the Central Government as mentioned in clause (b);

(d) intimate the concerned State Designated Agencies to initiate further legal proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee in accordance with production data, within the period specified under regulation 9;

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016, the Bureau hereby permits you to affix label as per details of approvals set out in the Annexure to this Form II.

2. This permission is subject to—

(a) the star level displayed on the label of the electric water heater shall conform to energy consumption standards for stationary storage type electric water heater notified under clause

(a) of the Act and terms and conditions provided in the aforesaid regulations;

(b) the label shall be affixed only on such model of electric water heater for which permission has been granted;

(d) the permittee shall ensure that the star level displayed on the electric water heater shall be maintained at least till the validity of the label or validity of their registration;

(e) the permittee shall pay the labeling fee of two rupees per label;

(f) the permittee shall furnish (in hard copy as well as through Standards & Labeling online webportal) to the Bureau a statement containing details of production of labelled equipment and the labelling fee payable for each quarter within a period of thirty days of the close of that quarter of the financial year;

(g) the permittee shall make available such other details of electric water heater as and when sought by the Bureau for which the permission has been granted.

3. This permission shall be valid from ............................... to .............................and may be renewed as prescribed. The permittee shall not withdraw the electric water heater from the market during the validity period of permission except with the prior approval of the Bureau.

5. Whenever the star level plan is amended or modified by the Bureau, the star level of the electric water heater shall be modified as follows:-

(a) if new model is launched synchronizing with the revised star level, an application for such permission shall be made to Bureau six months in advance of the date from which new star level comes in to force;

(b)Where the existing model is continued to give effect to the modified star level, only a declaration as per Form IV shall be submitted to the Bureau.

The results of the Test Report indicated that the sampled water heater failed to meet the standing loss (kWh/24 hrs/450C), standard, specified volume capacity etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Electric Water Heater manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... ..... dated........in the name of your authorised contact person . You were also requested to attend and witness the Second Check Verification Test of the samples at the NABL Accredited Laboratory M/s....................................................

5. The Sample for second check verification test, were picked up in accordance with paragraph 6 of S.O. number ….

6. The Test results are contained in Second Test Verification Report duly prepared checked and counter signed by the competent authorized personnel of the NABL Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O. number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Electric Water Heater manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (4) of Regulation 11of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Stationary Storage Type Electric Water Heater) Regulations, 2016, the Bureau hereby directs to:-

(i) correct the star level displayed on the label of the Electric Water Heater or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of subregulation (5) of Regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016

9. The Bureau shall take further follow up action in the matter in terms of sub-regulations (4), (5), (6), (7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016.
