(2) ये राजप; म: इनके &काशन क तारीख से &वृX त ह/गे। 2.2.2.2. प�रभाषाप�रभाषाप�रभाषाप�रभाषा ::::---- (1) इन िविनयम/ म:, जब तक �क संदभ से अZ यथा अपेि�त न हो,- (क) ''अिधिनयम” से ऊजा संर�ण अिधिनयम, 2001 (2001 का 52) अिभ&ेत है;

(ख) 'मॉडल/ का पPरवार' स ेमॉडल/ का ऐसा समूह अिभ&ेत ह,ै िजनके िलए पालन के सभी मानदडं एक समान ह>;

(ग) “&'प” से इन िविनयम/ के साथ संल] न &'प अिभ&ेत है;

2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (घ) “लेबल” से . वत: धारा ि.थरक एलईडी लै� प/ पर िचपकाई गयी या &द_श त िलिखत, मु�Mत, िचि`नत, मुहर लगी या aा�फक सामaी अिभ&ेत ह;ै (ङ) ‘‘लेबल अविध” से अिधिनयम क धारा 14 के ख5 ड (क) के अधीन केZ Mीय सरकार 8ारा अिधसूिचत ऊजा खपत मानक के अधीन &दीJ त �मता क िविध माZ यता अविध से अिभ&ेत ह:ै परZ तु य�द &दीJ त �मता क वैधता अविध क समािc को अिधसूिचत नहH �कया गया ह,ै तो इस ेतब तक माZ य समझ िलया जाएगा जब तक क इसके िलए नए मान क: Mीय सरकार 8ारा अिधसूिचत नहH �कए जाते;

(च) “अनुdािपत C यिD” से ऐसे C यिD या ऐसी एज:सी स ेअिभ&ेत है िजस ेिविनयम 7 के अधीन लेबल िचपकाने के िलए अनुdा दी गई है;

(छ) 'अनुसूची' से इन िविनयम/ के साथ संलग् न अनुसूची अिभ&ेत ह;ै (ज) '. वत: धारा ि.थरक एलईडी लै� प' से अिधिनयम क धारा 14 के ख5 ड (घ) के अधीन अिधसूचना म: िन?द @ ट एक उपकरण अिभ&ेत है;

(झ) “. टार रेgटंग या . टार . तर” से अिधिनयम क धारा 14 के ख5 ड (क) के अधीन केZ Mीय सरकार 8ारा अिधसूिचत &दीJ त �मता मानक पर आधाPरत . वत: धारा ि.थरक एलईडी ल>प के लेबल पर &द_श त ऊजा द�ता का aेड अिभ&ेत है;

(ञ) ''C यापारी या िवhेता से उस C यिD से अिभ&ेत ह ैजो ऐसे लेबलयु< त . वत: धारा ि.थरक एलईडी लै� प/ क िबh अथवा िवतरण करता ह ै और इसम: ऐसे दकुानदार, C यापारी, िविनमा ता और . वत: धारा ि.थरक एलईडी लै� प/ पर लेबल िचपकाने के िलए अनुमित &ाJ त अनुdािपत C यिD शािमल ह>। (2) उन श, द/ और पद/ के जो इसम: &यु< त ह ैऔर पPरभािषत नहH ह ै�कZ तु अिधिनयम म: पPरभािषत ह ैवही अथ होगा जो अिधिनयम म: ह।ै 3.3.3.3. लेबललेबललेबललेबल परपरपरपर �द�श�त �कए जाने वाला िववरण :�द�श�त �कए जाने वाला िववरण :�द�श�त �कए जाने वाला िववरण :�द�श�त �कए जाने वाला िववरण :---- (1) &X येक . वत: धारा ि.थरक एलईडी लै� प पर, इसके लेबल पर िन� निलिखत िववरण &द_श त �कया जाएगा, अथा त् :- (क) ऊजा द�ता , यूरो का &तीक िचZ ह;

(ख) िविनमा ता या आयातक और jाण् ड का नाम;

(ग) C यापार का नाम और संk या;

(घ) िविनमा ण या आयात का मॉडल और वष ;

(ङ) िवल�ण lंृखला कोड;

(च) वॉmस म: िबजली क खपत;

(छ) � यूमेनस म: &दीJ त &वाह;

(ज) &दीJ त / वाट म: &दीJ त �मता;

(झ) . वत: धारा ि.थरक एलईडी लै� प का . टार . तर; और (ञ) लेबल क अविध (2) लेबल का िडजाइन, रंग, आकार और सामaी इन िविनयम/ के साथ संल] न अनुसूची म: यथा: िविन?द n होगा। 4.4.4.4. लेबल"लेबल"लेबल"लेबल" के �दश�न के िलए समय सीमा : के �दश�न के िलए समय सीमा : के �दश�न के िलए समय सीमा : के �दश�न के िलए समय सीमा : ---- (1) िविनयम 3 म: िविन?द @ ट सभी िववरण वाला लेबल इन िविनयम/ के लागू होन ेक तारीख से छह माह क अविध के भीतर &X येक . वत: धारा ि.थरक एलईडी लै� प पर &द_श त �कया जाएगा। (2) केZ Mीय सरकार 8ारा अिधिनयम क धारा 14 के ख5ड (क) के अधीन अिधसूिचत संशोिधत ऊजा खपत मानक/ के आरंभ होने पर और आरंभ होने से, &Xयेक अनुdािपत C यिD या C यापारी या िवhेता सिुनिqत करेगा, �क - (क) िबh के िलए रखे गए . वत: धारा ि.थरक एलईडी लै� प पर संशोिधत . टार . तर &द_श त होगा और संशोिधत ऊजा खपत मानक/ के साथ संशोिधत समhमण अविध और . वत: धारा ि.थरक एलईडी लै� प या िविनमा ण वष भी संशोिधत ऊजा खपत मानको के साथ समhमण म: होगा और . वत: धारा ि.थरक एलईडी लै� प के साथ िपछली ऊजा खपत मानक के साथ उनका उX पादन नहH �कया जायेगा। ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (ख) C यवहारी, खुदरा C यापाPरय/ और उपभो< ताr क जागsकता सिहत सभी &ारंिभक उपाय उनक िश�ा के अपेि�त &चार-&सार के िलए उिचत योजना से करने ह/गे और इन िविनयम/ के अधीन ऐसे &ारंभ क ताPरख स ेछ: मास पूव के ह/गे। 5.5.5.5. लेबललेबललेबललेबल �द�श�त करने क% रीित�द�श�त करने क% रीित�द�श�त करने क% रीित�द�श�त करने क% रीित :---- (1) &X येक . वत: धारा ि.थरक एलईडी लै� प पर एक लेबल होगा, जो िबh . थल पर &द_श त �कया जायेगा और लेबल . वत: धारा ि.थरक एलईडी लै� प पर िन� निलिखत रीित म: िचपकाया जायेगा। क. अपने आप िचपकने वाला लेबल रैपर पर लगाया जाए; ख. . टार अंकन रेgटंग के अनुसार . वत: धारा ि.थरक एलईडी लै� प पर मुहर अं�कत क जाएगी, और ग. . टार अंकन के िलए मुहर का साइज 11.5 िम. मी. ऊंचा और 8.5 िम. मी. चौड़ा होगा। 6.6.6.6. लेबललेबललेबललेबल �द�श�त करने क% अनु(ा :�द�श�त करने क% अनु(ा :�द�श�त करने क% अनु(ा :�द�श�त करने क% अनु(ा :---- (1) , यूरो क अनुमित के िबना . वत: धारा ि.थरक एलईडी लै� प पर कोई . टार लेबल नहH िचपकाया जाएगा। (2) उप-िविनयम (1) के अधीन , यूरो क अनुdा लेने के &योजन के िलए &X येक jांड के िलए &'प1 म: िविन?द @ ट तरीके से पंजीकृत . वयं अनुdािपत C यिD 8ारा �कया जाएगा, िजसके साथ ऊजा द�ता , यूरो, नई �द� ली के प� म: आहPरत िडमांड tाuट या भुगतान क �कसी अZ य काय इले< vॉिनक िविध 8ारा दये एक लाख sपए का लेबल &ितभूित संल] न होगा : परZ तु, लघु पैमाने के उwोग के मामले म:, लेबल क &ितभूित रािश केवल पx चीस हजार sपए होगी; (3) उप-िविनयम (2) के अधीन अनुdािपत C यिD के &Xयेक आवेदन-प; के साथ संल] न ह/गे - (क) &ित मॉडल के िलए दो हजार sपए का आवेदन शु� क ऊजा द�ता , यूरो, नई �द� ली के प� म: मांगदये tाuट आहरण 8ारा आहPरत या भुगतान के �कसी . वीकाय इले< vॉिनक मोड म: देय होगा; (ख) &'प-II म: यथा: िविन?द n द.तावेज; 7.7.7.7. अनु(ाअनु(ाअनु(ाअनु(ा �दान करना�दान करना�दान करना�दान करना :---- (1) िविनयम 6 के अधीन कोई आवेदन &ाc होने पर और इससे संतnु होने पर �क इसम: दी गई सभी अपे�ाr का पालन �कया गया ह,ै ,यूरो उ< त &ािc क अविध से मानक और लेबyलंग पर इसके &चालन मैनुअल म: िविन?द @ ट इस &ािc क अविध के अंदर, िविनयम 8 म: यथा: िविन?द @ ट िनबंधन और शतz के अ{यधीन इसके िलए अनुdा &दान कर सकता है। (क) &'प -।।। म: या इले< vॉिनक 'प म: jांड को रिज. vर कर:; या (ख) &'प- IV म: या इले< vॉिनक 'प म: . वत: धारा ि.थरक एलईडी लै� प पर लेबल िचपकाने के िलए अनुमित &दान करना। (2) , यूरो, &'प V म: रिज. टर बनाकर रखेगा और इसम: अनुdािपत C यिD के नाम &िव@ ट करेगा; (3) उप िविनयम (1) के अधीन &दX त ऐसी अनुdा ऐसी अविध तक िविधमाZ य होगी िजसके िलए &वृत अिधिनयम क धारा 14 के ख5 ड (क) के अधीन यथा-अिधसूिचत ऊजा खपत मानक .टार . तर िविन?द @ ट �कये गये: परZ तु यह �क अनुdािपत C यिD धारा 14 के ख5ड (क) के अधीन केZMीय सरकार 8ारा जारी आदशे/ के उपबंध के अनुसार &दान क गई अनुमित क ितिथ से 12 माह के अZ दर घोिषत जीवन के 25 &ितशत समय बाद 6000 घ5 ट/ के अZ दर � यू मेन रखरखाव क परी�ण Pरपोट जमा करेगा। (4) अनुdािपत C यिD 8ारा अनुdा के नवीकरण के िलए आवेदन छह माह के भीतर |कंतु इस अविध क समािc से एक माह पूव �कया जाएगा और इसके साथ ऊजा द�ता , यूरो, नई �द� ली के प� म: दये मांगदेय tाuट के 'प म: या इले< vॉिनक ढंग म: एक हजार sपए का शु� क लगा होना; (5) िविधमाZ यता क अविध समाJ त होने के बाद �कसी आवेदन का नवीकरण नहH �कया जाएगा ऐसे मामले म: अनुdािपत C यिD को नया आवेदन प; देना होगा; (6) उप- िविनयम (4) के अधीन नवीकरण के िलए आवेदन-प; िमलने पर और सभी अपे�ाएं पूरी होने के संबंध म: संतुn होने पर, ,यूरो ऐसा आवेदन &ाc होने क तारीख से एक माह क अविध के भीतर &'प IV म: अनुdा का नवीकरण कर सकता ह;ै (7) जो अनुdािपत C यिD उस तारीख से, िजस तारीख से संशोिधत . टार . तर लागू Sआ ह ै . वत: धारा ि.थरक एलईडी लै� प के िवwमान मॉडल पर लेबल िचपकाने को जारी रखने क अनुdा चाहता ह,ै &'प VI म: केवल एक घोषणा &. तुत करेगा; (8) य�द . वत: धारा ि.थरक एलईडी लै� प के नए मॉडल क योजना संशोिधत .टार .तर के साथ ताल-मेल िबठाकर शु' करने क योजना ह ैतो अनुdािपत C यिD नया लेबल िचपकाने क अनुdा लेगा और ऐसी अनुdा के िलए आवेदन संशोिधत .टार .तर के लागू होन ेसे छह मास पूव �कया जाए;

8.8.8.8. लेबललेबललेबललेबल पर िववरण �द�श�त करने के िलए िनबंधन और शत*पर िववरण �द�श�त करने के िलए िनबंधन और शत*पर िववरण �द�श�त करने के िलए िनबंधन और शत*पर िववरण �द�श�त करने के िलए िनबंधन और शत* :- &X येक अनुdािपत C यिD और C यापारी एवं िवhेता अथा त् :- (क) अिधिनयम क धारा 14 के ख5 ड (क) के अधीन . वत: धारा ि.थरक एलईडी लै� प के िलए ऊजा खपत मानक/ का अनुपालन;

(ख) . वत: धारा ि.थरक एलईडी लै� प के केवल ऐसा मॉडल पर लेबल लगाया जाए िजसके िलए अनुdा &दान क गई ह;ै (ग) . वत: धारा ि.थरक एलईडी लै� प पर अनुdािपत C यिD के खच पर लेबल लगाया जाए;

(घ) यह सुिनिqत �कया जाए �क . वत: धारा ि.थरक एलईडी लै� प के लेबल पर &द_श त . टार . तर हर समय बना रहगेा;

(ङ) िविनयम 9 म: यथािविन?द @ ट लेबल शु� क का भुगतान करेगा;

(च) , यूरो को िववरण मुहयैा कराएगा िजसम: लेबल लगे उपकरण/ को बनाने का , यौरा और िवX तीय वष क &X येक ितमाही के अंत म: आने वाले माह के भीतर &X येक ितमाही के िलए दये &ो�भूत लेबyलंग शु� क का िववरण हो;

(छ) , यूरो के पास &X येक वष 30 अ&ैल तक उनके लेबल यु< त उX पाद/ क िबh के िलए िनयु< त अिधकृत िवतरक/, C यवहारी, खुदरा C यापाPरय/, िवhेताr क अwतन सूची &. तुत क जाए;

(ज) ऐसे अZ य िनयम/ एवं शतz का पालन कर:गे जो , यूरो 8ारा मानक और लेबyलंग के संबंध म: , यूरो क &चालन िनयम पुि.तका म: िनिहत िनयम/ एवं शतz सिहत िविन?द ष् ट �कए गए ह/; 9.9.9.9. लेबललेबललेबललेबल शु+ कशु+ कशु+ कशु+ क : - (1) &X येक अनुdािपत C यिD, , यरूो को . वत: धारा ि.थरक एलईडी लै� प पर &X येक िचपकाए गए लेबल के िलए पांच पैसे लेबल शु� क का भुगतान करेगा। (2) उप-िविनयम (1) के अधीन िविन?द n लेबल शु�क, &Xयेक िवRीय वष क अंितम तारीख से एक माह के भीतर वा_ष क तौर पर �कया जाएगा; परZ तु यह �क यथािविन?द n अविध के भीतर लेबल फ स का भुगतान न करने पर, ,यूरो िविनयम 6 के उप-िविनयम (3) के ख5ड (ख) के अधीन लेबल &ितभूित िन�ेप संदX त से इस पर &ित वष दस &ितशत क दर स ेइस पर ,याज सिहत बकाया रकम वसुल कर सकता ह ैऔर य�द इसे जमा �कए जाने क अंितम तारीख से एक वष के भीतर पूरा लेबyलंग शु�क वसूल नहH �कया जाता तो ,यूरो अनुdािपत C यिD को &दR अनुdा र� कर सकता ह ैऔर अनुdािपत C यिD का नाम चूककता के 'प म: यथा समाचार प; म: और इले< vािनक साधन म: &कािशत कर सकता ह।ै 10.10.10.10. लेबललेबललेबललेबल �ितभूित �ितभूित �ितभूित �ितभूित िन�ेपिन�ेपिन�ेपिन�ेप का का का का �ितदाय�ितदाय�ितदाय�ितदाय :- िविनयम 9 के उप-िविनयम (2) के उपबंध/ के अ{यधीन, अनुdािपत C यिD . वत: धारा ि.थरक एलईडी लै� प का िविनमा ण बंद करने पर लेबल &ितभूित िन�ेप के &ितदाय का हकदार होगा। 11.11.11.11. - यू- यू- यू- यूरोरोरोरो .ारा स/ या.ारा स/ या.ारा स/ या.ारा स/ यापनपनपनपन :---- (1) , यूरो या इसक नामिन?द @ ट एज:सी या तो इसे िशकायत &ाJ त होने पर या . वत: संdान से यह सुिनिqत करने के िलए सX यापन करेगा �क . वत: धारा ि.थरक एलईडी लै� प इसके लेबल पर &द_श त . टार . तर और अZ य िववरण के अनु'प ह ैऔर यह अनुdा के अZ य िनबंधन और शतz के अनुपालन म: ह।ै (2) सX यापन के &योजन के िलए , यूरो या इसक नामिन?द @ ट एज:सी िविनमा ता सिुवधा से जैसे यह उिचत समझे, भ5 डारगृह या फुटकर िवhय क: M से यादिृxछक तौर पर नमूने एक; करेगा; (3) जहां उप- िविनयम (1) के अधीन िशकायत &ाc होने पर, ,यूरो 8ारा जांच और अंशांकन &योगशालाr हतुे रा�ीय परी�ण &Xयायन बोड 8ारा िविधवत &Xयाियत .वतं; &योगशाला म: . वत: धारा ि.थरक एलईडी लै� प क जांच को चुनौती दकेर सXयापन करना अपेि�त ह,ै (क) , यूरो 8ारा अनुdािपत C यिD को उ< त परी�ण करने के िलए सूचना जारी क जाएगी और िशकायतकता को , यूरो के पास उ< त समय के भीतर, िजसे , यूरो 8ारा िनधा Pरत �कया जाए, परी�ण, पPरवहन और अZ य अनुषंगी C यय/ से संबंिधत उ< त C यय जमा करने के िलए कहा जाएगा; (ख) य�द चुनौती के अधीन िलए गए नमूने िवफल रहते ह> तो अनुdािपत C यिD , यूरो को नमूने क लागत, नमूने के पPरवहन और परी�ण &भार के सभी C यय/ क &ितपू_त करेगा और , यूरो उ< त C यय का &ितदाय िशकायतकता को करेगा; और (ग) जहां उपकरण चुनौती परी�ण पर खरे उतरते ह ैतब िशकायतकता 8ारा जमा �कए गए उ< त C यय समप�त कर िलए जाएंगे। ¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5

(4) जहां, उप-िविनयम (1) के अधीन िशकायत &ाJ त होती है, य�द अनुdािपत C यिD उ< त समय के अंदर उप िविनयम (3) म: संद_भ त उ< त C यय जमा करने म: िवफल रहता ह ैतो , यूरो 8ारा –

(i) उप-िविनयम (3) म: संद_भ त . वत: धारा ि.थरक एलईडी लै� प के चुनौती परी�ण 8ारा सX यापन जारी रखा जाएगा; और

(ii) िविनयम 6 के अधीन &ाJ त आवेदन क कार वाई उ< त C यय के जमा होने तक . थिगत रखी जाएगी। (5) जहां परी�ण के िलए .वत: धारा ि.थरक एलईडी लै� प के नमूने परी�ण अथवा . वयं संdान परी�ण के दौरान या चुनौती परी�ण म: िवफल रहते ह>, अनुdािपत C यिD को एक अZय अवसर �दया जाएगा और ,यूरो, अनुdािपत C यिD क लागत पर रा�ीय परी�ण और अंशांकन &योगशाला बोड 8ारा िविधवत &Xयाियत .वतं; &योगशाला म: &थम जांच म: &युD . वत: धारा ि.थरक एलईडी लै� प के दगुन ेपPरमाण म: दसूरा परी�ण करेगा। (6) जहां, दसूरा परी�ण िवफल होता ह,ै , यरूो,- (क) अनुdािपत C यिD &'प VII, म: सभी रा� य नामिन?द @ ट एज:िसय/ को िनदशे देगा �क अनुdािपत C यिD दो माह क अविध के अंदर, - (i) . वत: धारा ि.थरक एलईडी लै� प के रैपर पर लगाए गए लेबल म: सही . टार . तर &द_श त करेगा अथवा परी�ण के दौरान ;ुPटय/ और किमय/ को दरू करेगा; (ii) , यूरो के �दशा- िनद�श/ के अनुपालन म: बाजार से सभी . टॉक को वापस लेगा; और (iii) िवdािपत सामaी पर &द_श त िववरण म: पPरवत न करेगा। (ख) दो माह के अंदर अनुdािपत C यिD का नाम, jा5 ड का नाम, मॉडल का नाम या मॉडल संk या, &तीक िच`न और अZ य िविशिnयां �कसी रा@ vीय या �े;ीय दैिनक समाचार प; और �कसी इले< vॉिनक साधन या अZ य �कसी 'प म: इसका &काशन करेगा, जो उिचत पाया जाए;

(1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of forty-five days from the date of publication of the said notification in the Official Gazette;

And whereas copies of the said draft regulations were made available to the public on 5 th September, 2017;

And whereas suggestions have been received with respect to the said draft regulations within the period aforesaid;

And whereas the suggestions received in this regard have been taken into consideration;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Self-ballasted LED Lamps) Regulations, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Family of models” means group of models for which all the performance parameters are same;

(c) “Form” means a form appended to these regulations;

(d) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the self-ballasted LED lamp;

(e) “label period” means the validity period of the luminous efficacy under energy consumption standard notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, the end period of the validity period of the luminous efficacy is not notified, it shall be deemed to be valid until new values for the same are notified by the Central Government;

(f) “Permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “Schedule” means the schedule annexed to these regulations;

(h) “Self-ballasted LED lamp” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(i) “Star rating or star level” means the grade of energy efficiency displayed on the label of the selfballasted LED lamp based on luminous efficacy standard notified by the Central Government under clause (a) of section 14 of the Act;

(j) “Trader or seller” in relation to any labelled self-ballasted LED lamp means a person who sells or distributes such self-ballasted LED lamp and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such self-ballasted LED lamp.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label.- (1) On every self-ballasted LED lamp, the following particulars shall be displayed on its label, namely:-

(a) The logo of the Bureau of Energy Efficiency;

(b) Name of manufacturer or importer and brand;

(c) Trade name and number;

(d) Model and year of manufacturing or import;

(e) Unique series code;

(f) Power consumption in watts ;

(g) Luminous flux in lumens;

(h) Luminous efficacy in lm/W;

(i) Star level of self-ballasted LED lamp; and

(j) Label period;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.- (1) A label containing all the particulars specified in regulation 3 shall be displayed on every self-ballasted LED lamp within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that-

(a) The self-ballasted LED lamp put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the selfballasted LED lamp shall also be in synchronization with such revised energy consumption standards, and shall not produce the self-ballasted LED lamp with the previous energy consumption standards;

(b) All preparatory steps including awareness of the dealers, retailers and consumers, requisite publicity for their education shall be well planned and taken three months in advance of the date of such commencement, under these regulations.

5. Manner of display of label.- (1)There shall be a label on every self-ballasted LED lamp which shall be displayed at the point of sale and such label shall be affixed on the self-ballasted LED lamp in the following manner, namely:-

(a) self-adhesive label affixed on wrapper;

(b) the star marking as per the rating shall be stamped on the self-ballasted LED lamp; and

(c) the size of the stamp for star marking shall be 11.5 millimetre height x 8.5 millimetre width.

6. Permission for display of label.- (1) No star label shall be affixed on a self-ballasted LED lamp without obtaining the prior permission of the Bureau.

(2) For the purposes of obtaining permission of the Bureau under sub-regulation (1), an application for registration shall be made for every brand separately as specified in Form I, accompanied by a label security deposit of One lakh rupees, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any other acceptable electronic mode of payment:

Provided that in case of small scale industry, label security deposit shall be twenty-five thousand rupees only;

(3) Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by demand draft drawn in favour of the Bureau of Energy Efficiency, New Delhi or by any other acceptable electronic mode of payment;

(b) documents specified in Form II.

7. Grant of permission. -(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its operation manual on standards and labelling from the date of such receipt, grant, subject to such terms and conditions as are specified in regulation 8, –

(a) register the brand in Form III or in electronic form; or

(b) grant permission for affixing label on self-ballasted LED lamp in Form IV or in electronic form.

(2) The Bureau shall maintain a register in Form V and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force:

Provided that the permitee shall submit the test report of lumen maintenance after 25 per cent. of declared life or 6000 hours within twelve months from the date of such permission granted in accordance with the provisions of the order issued by the Central Government under clause (a) of section 14 of the Act.

(4) An application for renewal of permission shall be made by the permittee from six months but not later than one month before its expiry and shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form IV.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the self-ballasted LED lamp from the date from which the revised star level comes into force, shall submit only a declaration in Form VI.

(8) The permittee shall seek permission to affix label afresh, if new model of the self-ballasted LED lamp is planned to be launched synchronising with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for self-ballasted LED lamp notified under clause (a) of section 14 of the Act;

(b) affix label only on such model of self-ballasted LED lamp for which permission has been granted;

(c) affix label on the self-ballasted LED lamp at the cost of the permittee;

(d) ensure that the star level displayed on the label of self-ballsted LED lamp shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30 th day of April of each year;

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standard and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of five paisa for each label affixed on the self-ballasted LED lamp;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year;

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under clause (b) of sub-regulation (3) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission, the Bureau may cancel the labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security deposit. - Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture self-ballasted LED lamp.

11. Verification by Bureau.- (1) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification to ensure that the self-ballasted LED lamp conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission.

(2) For the purposes of verification, the Bureau or its designated agency may pick up samples at random from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the self-ballasted LED lamp in an independent laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories,-

(a) the Bureau shall issue a notice to the permittee for carrying out such testing and the complainant shall be called upon to deposit such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time as may be determined by the Bureau;

(b) if the sample drawn under challenge testing fails, the permittee shall reimburse all expenses towards the cost of sample, transportation of sample and the testing charges to the Bureau and the Bureau shall refund the said expenses to the complainant; and

(c) where the equipment passes the challenge test, then the expenses deposited by the complainant shall stand forfeited.

(4) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expenses referred to in sub-regulation (3) within such time, the Bureau shall-

(i) continue the verification by challenge testing the self-ballasted LED lamp referred to in subregulation (3); and

(ii) the processing of application received under regulation 6 may be kept in abeyance till such expenses are deposited.

(5) Where samples of self-ballasted LED lamp used for testing fails, the test during suo motu testing or challenge testing, the Bureau shall afford the permittee another opportunity and the Bureau shall conduct a second test with twice the quantity of self-ballasted LED lamp used in the first test in an independent test laboratory duly accredited by the National Accreditation Board for testing and calibration laboratories at the cost of the permittee.

(6) Where the second test fails, the Bureau shall,-

(a) direct the permitte in Form VII, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months,-

(i) correct the star level displayed on the label affixed on the wrapper of self-ballasted LED lamp or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau;

and

(iii) change the particulars displayed on advertising material;

(b) publish in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation (6),-

(a) send the compliance report in Form VIII to the Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed to be non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(8) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub-regulation (7) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(9) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (6), the Bureau under intimation to all State Designated Agencies shall-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of subregulation (7) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c) publish in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months, the name of the permittee, brand name, model name or model number, logo and other specifications;

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee—

(a) fails to submit the test report specified in the proviso to sub-regulation (3) of regulation 7:

Provided that if, the permittee fails to comply with the test report submitted, action shall be taken as per sub-regulation

(9) of regulation 11.

(b) fails to comply with any of the terms and conditions specified under regulation 8;

(c) fails to pay label fee within the period specified under regulation 9;

(d) fails to comply with the directions issued under regulation 11.

1. (e) the permittee shall pay the label fee as specified by the Bureau;

(f) thepermittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year. The same details shall be furnished to the Bureau also through automated system;

(g) thepermittee shall make available such other details of self-ballasted LED lamps as and when sought by the Bureau of which the permission has been granted.

3. The permittee shall not withdraw the registered brand and the self-ballasted LED lamps from the market during the validity period except with the prior approval of the Bureau.

You were also required to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months, i.e., by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.

9. The Bureau shall take further follow up action in accordance with the provisions of these regulations.
