1. सवंक्षप् त नाम ्रदा ंभ : - (1) इन वनयम का संवक्षप् त नाम ऊर्ाा िक्षता ब्यू ग (अविकाि य अन्दय कमाचाि य की भती, वनयुवतिय सेिा की कतें त ा वननंिन), वनयम, 2017 ै ।

(2) ये ार्पत्र में उनके ्रदकाकन की ता ीख कग ्रदिृत ै गे।

2. पि की सखं्या, िगीक ण ितेन म ििक् स में स् त - पि की संख्या, उनका िगीक ण इससे संलग् न िेतन म ििक् स स् त िे ै गे र्ग इन वनयम से उपानद्ध अनुसूची के स् तंभ (2) से ( ) में विवनर्िाष्ट ैैं।

3. वनयवुतिय ्रदाविका ी – ब् यू ग के समर न वनयंत्रण के अिीन, - (क) ब् यू ग में पि प ्रद येक वनयुवतिय केन्द रीय स का के अिीन समूै औकऔ समूै औखऔ पि के समतुल् य वसिाए उनके वर्न्द ै ें ऊर्ाा सं क्षण अविवनयम, 2001 (2001 का 52) की िा ा 9 की उपिा ा (1) (2) में विवनर्िाष् ट दकया गया ै , ब् यू ग के मैावनिकेक ्ा ा की र्ाएंगी; (ख) ब् यू ग में पि प केन्द रीय स का के अिीन समूै औगऔ के समतुल् य पि प ्रद येक वनयुवतिय ब् यू ग के सवचि ्ा ा की र्ाएंगी।

4. भती की पद्धवत, आय-ुसीमा, अैाताएं, आदि :- भती की पद्धवत, आयुसीमा, अैाताएं उससे संनंवित अन्द य नातें िे ै गी र्ग उक् त अनुसूची के स् तंभ (5) से स् तंभ (13) में विवनर्िाष्ट ैैं। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

5. ्रदा ंवभक गतन - (1) इन वनयम के ्रदा ंभ से पैले वनयुक् त ब् यू ग के ्रद येक कमाचा ी इन वनयम के ्रदा ंभ की ता ीख कग या इन वनयम के उपनंि के अिीन उसी पि प वनयुक् त दकए गए समेे र्ाएंगे वर्स पि प िे ् येष् तता, ्रदगन्द नवत सेिा की अन्द य कततों वननंिन के ्रदयगर्न के वलए ऐसे ्रदा ंभ से तीक पैले िा ण दकए ुए े प न्द तु यै दक त कालीन ऊर्ाा ्रदनंि केन्द र के कमाचाि य कग त न तक केन्द र के उपविवि में विवनर्िाष् ट सेिा के वननंिन कततों ्ा ा विवनयवमत दकया र्ाएगा र्न तक दक िे इन वनयम ्ा ा विवनयवमत दकए र्ाने का विकल् प नै ितेे प न्द तु यै भी दक एक ना दिया गया विकल् प अंवतम ैगगा।

(2) ब् यू ग में ्रदवतवनयुवतिय के आिा प , वर्सके अंतगात अल् पकावलक संवििा भी, पि प दकसी व् यवतिय कग वनयुक् त दकया र्ाएगा वर्स पि प िै पांच िर्ा से अन्द यून अिवि की सेिा पू ी क ली ै , उक् त पि प आमेलन के वलए विभागीय चयन सवमवत ्ा ा उसकी िा्र्ाक काया अंकन ि पगटा के आिा प उसकी उपयुक् तता वनिाा ण दकए र्ाने के अिीन ैते ुए विचा दकया र्ाएगा ऐसे आमेलन का अनुक ण क ने के पश् चात ्रदवतवनयुवतिय प या अल् पकावलक संवििा के आिा प उसकी ्रदा ंवभक वनयुवतिय की ता ीख से वनयवमत आिा प उस पि प चयन की उवचत ्रददिया अपनाए र्ाने के नाि, र् सा भी मामला ैग, वनयुक् त दकया र्ाएगा।

6. वन ैाता - (1) िै व् यवतिय, - (क) वर्सने ऐसे व् यवतिय से वर्सका पवत या वर्सकी प नी र्ीवित ै , वििाै दकया ै या वि िाै की संवििा की ै ; या (ख) वर्सने अपने पवत या अपनी प नी के र्ीवित ैते ुए दकसी व् यवतिय से वििाै दकया ै या वििाै की संवििा की ै , उक् त पिग प वनयुवतिय का पात्र नै ैगगा प न्द तु यदि केन्द रीय स का का यै समािान ैग र्ाता ै दक ऐसा वििाै ऐसे व् यवतिय वििाै के अन्द य पक्षका कग लागू स् िीय विवि के अिीन अनुज्ञेय ै ऐसा क ने के वलए अन्द य आिा ैैं तग िै दकसी व् यवतिय कग इस वनयम के ्रदितान से ूूट ि ेसकेगी।

(2) इन वनयम के अिीन वनयुक् त ्रद येक व् यवतिय ब् यू ग में वनयुवतिय से पैले ्रदरूप-I में )गर्णा क ेगा।

7. वनयवुतिय ्रददिया - (1) दकसी भी व् यवतिय कग ब् यू ग में दकसी भी पि प तन तक वनयुक् त नै दकया र्ाएगा र्न तक दक िै - (क) भा त का नागि क न ैग या ऐसी श्रेणी के अंतगात आता ै र्ग कें रीय स का के अिीन वनयुवतिय के वलए पात्र न ैग; (ख) ब् यू ग में सीिी भती ्ा ा वनयुवतिय के वलए भा तीय वचदक सा पि र्ि अविवनयम, 1956 (1956 का 102) की पैली अनुसूची में सवम्मवलत वर्स् िीकृत ऐसे वचदक सा व् यिसासी से वर्नके पास न चल फ म वडवसन न चल फ सर्ा ी के समतुल् य वचदक सा अैाता ैग ्रदरूप ।। में वचदक सक िवृष्टया यगग् यता ्रदमाण-पत्र ्रदस् तुत न दकया ैग; (ग) वचदक सीय प ीक्षा के समय वचदक सा अविका ी या वचदक सा व् यिसायी की उपवस् वत में ्रदरूप ।।। में क न ्रदस् तुत दकया ैग उस प ैस् ताक्ष न दकया ैग प न्द तु यै दक ऐसे वनयगवर्त अ य ी के वलए या वर्नकी तीन मास से अनविक अिवि के वलए अस् ाई ै वसयत में वनयगवर्त ैगने की संभािना ैग, वचदक सक िवृष्टया यगग् यता ्रदमाण-पत्र की आिश् यकता नै ैगगी; ()) ्रदरूप IV में ार्वनष् ता की कप न ली ैग।

(2) वनयुवतिय ्रदाविका ी का स् ियं यै समािान र्ाता ै दक ब्यू ग में पैली वनयुवतिय के वलए चयवनत अ य ी के चि त्र पूिािृ्त ऐसे ैैं दक उनसे िै कें रीय स का के अिीन वनयुवतिय के वलए अनुपयुक् त नै ै ।

8. व् यािवृत इन वनयम की कगई नात ऐसे आ क्षण, आय-ुसीमा में ूूट अन्द य ि यायत प ्रदभाि नै डालेगी, वर्नका केन्द रीय स का ्ा ा इस संनंि में समय-समय प वनकाले गए आिके के अनुसा अनुसवूचत र्ावतय , अनुसवूचत र्नर्ावतय , अन्द य वपू़ेे िगतों , भूतपूिा स वनेक अन्द य विकेर् ्रदिगा के व् यवतियय के वलए उपनंि क ना अपेवक्षत ै । II (i) 3

9. ि वतियय का विज्ञापन - (1) ब् यू ग के पि प सभी वनयुवतिययां गर्गा समाचा ाष् िीय ि वनक समाचा पत्र में सम् यक विज्ञापन के पश् चात ैी की र्ाएंगी।

(2) इन वनयम के अिीन पि के वलए आिेिन ्रदस् तुत क ने की अंवतम ता ीख कग विज्ञापन में विवनर्िाष् ट दकया र्ाएगा।

10. आिेिन के वलए ्रदरूप कतें - ब्यू ग विज्ञापन में ्रदरूप विवनर्िाष् ट क ेगा वर्समें आिेिन ्रदस् तुत दकए र्ाएंगे, सा ैी, िस् तािेर् एिं ्रदमाणपत्र उन्द ै ें ्रदस् तुत क ने की पद्धवत आिेिन ्रदाप् त क ने के वलए अवभवैत अविका ी भी वनर्िाष् ट क ेगा।

11. आिेिन का ्रदससं् क ण - ब्यू ग के मैावनिकेक ्ा ा गितत संनंवित ूाननीन सवमवत ्रदाप्त आिेिन प विचा क ेगी आगे ्रदसंस् क ण के वलए पि की अपेक्षां के आिा प अ य् ाय की ूंटनी क सकती ै ।

12. चयन की पद्धवत - चयन सवमवत ूांटे गए अ य् ाय के चयन कग अंवतम रूप िनेे के वलए य ावस् वत, वलवखत प ीक्षा या साक्षाका या िगन के आिा प अ य् ाय की वस ाि क क ेगी।

13. ् यषे् तता - कमाचाि य के नीच ् येष् तता समय-समय प केन्द रीय स का ्ा ा र्ा ी अनुिके के अनुसा ैगगी।

(i) दकसी मान्दयता ्रदाप्त विश् िविद्यालय से भौवतकी या सायन विज्ञान या ऊर्ाा यगर्ना अ ाकास् त्र में मास्ट वडर नी; या दकसी मान्दयता ्रदाप्त विश् िविद्यालय से इंर्ीवनय ी में न चल वडर नी;

(ii) िेतन म ििक् स के स् त 12 (78800 – 209200 रु.) में (पूिा पुन ीवक्षत िेतन नैंड -3 में 15600-39100 रुपए + र नेड िेतन 7600 रुपए में) समूै 'क' पि में पांच िर्ा का अनुभि; या

(iii) दकसी स का ी विभाग में िेतन म ििक् स के स् त 11 (67700 – 208700 रु.) में (पूिा पुन ीवक्षत िेतन नैंड 3 में 15600-39100 रुपए + र नेड िेतन 6600 रुपए में) समूै 'क' स का ी विभाग में समतुल् य पि में िस िर्ा का अनुभि; या

(iv) अनुसंिान संस् ान , स का ी विभाग या पवब्लक सेकट उपिम या स्िाय्त वनकाय या दकसी सांविविक वनकाय या दकसी द्यगवगक या विकास या वडर्ाइन संगतन में नीवतय या कायािम के विवन्मावत या कायाान्दियन के संनंि में वनम् नवलवखत में कम से कम पंरै िर्ा का पश् च अैाता अनुभि - (क) ऊर्ाा इसके सं क्षण के िक्ष उपयगग; (ख) ऊर्ाा लेखा प ीक्षा या ऊर्ाा ्रदनंिन क्षमतां का सुिढृीक ण; (ग) द्यगवगक या िावणव्यक संगतन में ऊर्ाा की खपत की नेंच मार्किं ग; ()) उपक ण या उपस् क के वलए मानक लेनललंग कायािम; (ङ) ऊर्ाा सेिा कंपवनय के सा विकास या संििान या कायाक ण; (च) द्यगवगक या िावणव्यक ्रदवतष्ठान या संगतन में ऊर्ाा िक्षता कग अपनाने के वलए निीन वि्त ीय तंत्र। िटप्पण अैाताएं अन्दय ा सुअ्ैात अ य् ाय की िका में केन्द रीय स का के वििेकानुसा वकव ल की र्ा सकती ैैं। िांू नीय

(i) दकसी मान्दयता ्रदाप्त विश् िविद्यालय से अ ाकास् त्र या ऊर्ाा यगर्ना अ ाकास् त्र में डाक् ट ेट वडर नी; या दकसी मान्दयता ्रदाप्त विश् िविद्यालय से इंर्ीवनय ी या व्यिसाय ्रदनंिन / ्रदकासन या द्यगवगक या ्रदणाली ्रदनंिन में मास्ट वडर नी; आयु – नै ; क वक्षक अैाता – ैां। सीिे भती दकए र्ाने िाले व् यवतियय के वलए एक िर्ा। ्रदगन्द नवत ्ा ा, वर्सके न ैग सकने प ्रदवतवनयुवतिय ्ा ा वर्सके अंतगात अल्पकावलक संवििा भी ै या सीिी भती ्ा ा। II (i) 5

(ii) ऊर्ाा सं क्षण अविवनयम, 2001 (2001 का 52) के उपनंि के अिीन ाष्ट्रीय प ीक्षा के आिा प ऊर्ाा ्रदनन्दिक अ िा ऊर्ाा लेखा प ीक्षक का ्रदमाणपत्र अ िा ्रदयावयत ऊर्ाा लेखा प ीक्षक के रूप में ्रदयायन ्रदाप्त;

(iii) ाष्ट्रीय ऊर्ाा की समस्यां ऊर्ाा के क्षेत्र में स का की नीवतय के सभी पि ्रदेक्ष्य िके में ऊर्ाा िक्षता का सं क्षण उसका ्रदग साैन। ्रदगन नवत या ्रदवतवनयवुतिय वर्सके अतंगात अल् पकावलक सवंििा भी ै ्ा ा भती की िका में ि े श्रवेणया ं वर्नस े ्रदगन्द नवत या ्रदवतवनयवुतिय वर्सके अतंगात अल् पकावलक सवंििा भी ै दकया र्ाएगा। यदि विभागीय चयन सवमवत ै , तग उसकी स ंचना भती क न े में दकन पि वस् वतय में स)ं लगक सिेा आयगग स ेप ामका दकया र्ाएगा

(11) (12) (13) ्रदगन्द नवत ब्यू ग में संयुक् त वनेिकेक की श्रेणी के ऐसे अविका ी वर्न्द ै ने वनयवमत आिा प वनयुवतिय के पश् चात िेतन म ििक् स के स् त 12 (78800 – 209200 रु.) (पुन ीवक्षत र नेड िेतन 7600 रुपए) में पांच िर्ा सेिा की ै । िटप् पण - र्ैां ऐसे कवनष् त व् यवतियय के संनंि में, वर्न्द ै ने अपनी अैाक या पात्रता सेिा पू ी क ली ै , ्रदगन्द नवत के वलए विचा दकया र्ा ैा ैग, िैां उनके ् येष् त व् यवतियय के संनंि में भी विचा दकया र्ाएगा प ंतु यै तन र्न दक उसके ्ा ा की गई ऐसी अैाक या पात्रता सेिा, अपेवक्षत अैाक या पात्रता सेिा के आिे से अविक से या िग िर्ा से, इनमें से र्ग भी कम ैग, कम न ैग उन्द ै ने अपने ऐसे कवनष् त व् यवतियय सवैत, वर्न्द ै ने ऐसी अैाक या पात्रता सेिा पैले ैी पू ी क ली ै , अगली उच् चत श्रेणी में ्रदगन्द नवत के वलए अपनी पि िीक्षा की अिवि स लतापूिाक पू ी क ली ैग। ्रदवतवनयुवतिय (वर्सके अंतगात अल्पकावलक संवििा भी ै ) / आमेलन (क) कें रीय स का या ा्य स का या सं) ा् य क्षेत्र या विश् िविद्यालय या स का ी अनुसंिान संस् ान या पवब्लक सेक् ट उपिम या स का ी संगतन या सावंिविक वनकाय के ऐसे अविका ी,-

(i) र्ग मूल काड में वनयवमत आिा प सिकृ पि िा ण दकए ुए ैैं; या

(ii) वर्न्द ै ने िेतन म ििक् स के स् त 12 (78800 – 209200 रु.) (पुन ीवक्षत िेतन नैंड-3 में 15600-39100 रुपए + र नेड िेतन 7600 रुपए विभागीय चयन सवमवत (्रदगन्द नवत या वनयवुतिय प विचा क ने के वलए) वर्समें वनम् नवलवखत ै गे -

(1) मैावनिकेक, ऊर्ाा िक्षता ब्यू ग.......... अध्यक्ष;

(iii) वर्न्द ै न ेिेतन म ििक् स के स् त 11 (67700 – 208700 रु.) में (पुन ीवक्षत ितेन नैंड 3 में 15600-39100 रुपए + र नेड िेतन 6600 रुपए में) के पि में िस िर्ा वनयवमत सेिा की ै ; (ख) वर्नके पास स् तंभ (7) के अिीन सीिे भती दकए र्ाने िाले व् यवतियय के वलए विवैत अनुभि क वक्षक अैाता ैग। िटप् पण 1 ्रदवतवनयवुतिय की अिवि, वर्सके अंतगात केन्द रीय स का के उसी या दकसी अन्द य संगतन या विभाग में इस वनयुवतिय से तीक पैले िाि त दकसी अन्द य काड ना्य पि प ्रदवतवनयुवतिय की अिवि ै सािा णतया पांच िर्ा से अविक नै ैगगी। िटप् पण 2 - ्रदवतवनयुवतिय ्ा ा वनयुवतिय के वलए अविकतम आयु सीमा आिेिन ्रदाप्त क ने की अंवतम ता ीख कग ूप्पन िर्ा से अविक नै ैगगी। िटप् पण 3 - ्रदवतवनयुवतिय या अल् पकावलक संवििा की अिवि सािा णतया पांच िर्ा से अविक नै ैगगी कम-स-ेकम तीन िर्ा स लतापूिाक पूणा ैगने प अविका ी ब् यू ग में आमेलन के वलए विचा दकए र्ाने ैतेु पात्र ैगगा।

[ ा. सं.13/2/2007-ई.सी.] ार् पाल,आ् ाक सलाैका II (i) 23 MINISTRY OF POWER NOTIFICATION New Delhi, the 31st August, 2017 G.S.R.1125(E).—In exercise of the powers conferred by sub-section (2) of section 10 read with clause (d) of sub-section (2) of section 56 of the Energy Conservation Act, 2001 (52 of 2001), the Central Government hereby makes the following rules regulating the method of recruitment for the posts of officers and other employees of the Bureau of Energy Efficiency, namely:—

1. Short title and commencement.–(1) These rules may be called the Bureau of Energy Efficiency (Recruitment, Appointment and Terms and Conditions of Service of Officers and other Employees) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and level in pay matrix.- The number of posts, their classification, level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Appointing Authority.- Subject to the overall control of the Bureau,-

(a) every appointment to the post in the Bureau equivalent to Group `A’ and Group `B’ posts under the Central Government other than those specified in sub-sections (1) and (2) of section 9 of the Energy Conservation Act, 2001 (52 of 2001) shall be made by the Director-General of the Bureau; and

(b) every appointment to the post in the Bureau equivalent to Group `C’ posts under the Central Government shall be made by the Secretary of the Bureau.

4. Method of recruitment, age-limit, qualifications, etc.-The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Initial constitution.– (1) Every employee of the Bureau appointed before the commencement of these rules shall, on and from the date of commencement of these rules, be deemed to have been appointed under the provisions of these rules to the same post as he was holding immediately before such commencement for the purpose of seniority, promotion and other terms and conditions of the service:

Provided that, the employees of the erstwhile Energy Management Centre may opt to be governed by the terms and conditions of service specified in the bye-laws of the centre, unless they opt to be governed by these rules:

Provided further that, the option once excercised shall be final.

(2) Any person appointed to a post in the Bureau on deputation basis, including short term contract, on completion of a period of not less than five years, may be considered, subject to his suitability having been assessed on the basis of his annual performance appraisal report by the Departmental Selection Committee, for absorption in the said post, and following such absorption, he shall be taken to have been appointed to the same post on regular basis with effect from the date he was initially appointed on deputation or short term contract basis, after having followed due process of selection, as the case may be.

6. Disqualification.- (1) No person,–

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that, the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, and there are other grounds for so doing, exempt any person from the operation of this rule.

(2) Every person appointed under these rules, shall give a declaration in Form I before appointment in the Bureau. 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

7. Procedure for appointment.- (1) No person shall be appointed to a post in the Bureau, unless he –

(a) is a citizen of India or belongs to such category of persons as may be eligible for appointment under the Central Government;

(b) produces a certificate of medical fitness in Form II from a registered medical practitioner possessing a medical qualification equivalent to Bachelor of Medicine and Bachelor of Surgery included in one of the Schedules to the Indian Medical Council Act,1956 (102 of 1956) for appointment in the Bureau by direct recruitment;

(c) submits a statement in Form III and signs the declaration, in the presence of the medical officer or medical practitioner at the time of medical examination :

Provided that, no certificate of medical fitness shall be necessary if a candidate is employed or likely to be employed in a temporary capacity for a period not exceeding three months; and

(d) takes an oath of allegiance in Form IV.

(2) The appointing authority shall satisfy itself that the character and antecedents of a candidate selected for first appointment in the Bureau are such that they do not render such candidate unsuitable for appointment under the Central Government.

8. Saving.- Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

9. Advertisement of vacancies.- (1) All appointments to the posts in the Bureau shall be made after due advertisement in the employment news and national dailies.

(2) The last date for submitting applications for the posts under these rules shall be as specified in the advertisement.

10. Forms and conditions for application.–The Bureau shall specify in the advertisement the form in which applications shall be submitted, the documents and certificates and the mode of their submission and the designated officer for submission of applications.

11. Processing of application.–The respective screening committee constituted by the Director-General of the Bureau, shall consider the applications received and may shortlist candidates, based on the requirements of the job for further processing.

12. Mode of selection.-The selection committee shall recommend the candidates, on the basis of written test or interview or both, as the case may be, for finalising the selection of the shortlisted candidates.

13. Seniority.- The seniority among the employees shall be in accordance with the instructions issued by the Central Government from time to time.

14. Power to relax.–Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, and for reasons to be recorded in writing and in consultation with the Bureau, relax any of the provisions of these rules with respect to any class or category of persons.

(ii) possessing a certificate as energy manager or energy auditor or accreditation as accredited energy auditor based on the National Examination under the provisions of the Energy Conservation Act, 2001(52 of 2001);

(iii) over all perspective of national energy problems and policies of the Government in the field of energy and for promotion of energy efficiency and its conservation in the country. (b) having experience prescribed for direct recruits under column (7).

Note 1.- The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed five years.
