Section 45: No challenge for a mistake committed in the bonafide exercise of one's duty

No election of a candi date shall be challenged merely on the ground that the Polling Officer '" the bonafide exercise of his duties has wrongly permitted or refused an elector permission to vote, as a result of proceedings under any of the provisions of rules 40, 42 and 44.
