1. अिधस ू चना के �काशन क% तारीख से साठ िदन/ क% अविध क% समाि4 से प ू व1 आ&ेप और स ु झाव मा ं ग ेगए थे;

और, उ. राजप� क% अिधस ू चना क% �ितया ं जनता को 05 अग$त, 2016 को उपल9ध कराई गई थी;

और, क; <ीय सरकार को उ. �ा प िनयम/ के स ं ब ं ध म; साठ िदन/ क% अविध क% समाि4 के प>ात भी जनता स े कोई आ&पे और स ु झाव �ा4 नह@ ह A ए;

अतः, अब केB<ीय सरकार उ. अिधिनयम क% धारा 346 'ारा �दC शि.य/ का �योग करते ह A ए िन�निलिखत िनयम बनाती ह,ै अथा1त ् :-

1. स ं ि�� नाम और ार ं भः (1) इन िनयम/ का स ं ि&4 नाम छावनी (स ू चनाओ ं का तामील का � प और रीित) िनयम, 2017 ह।ै

(2) ये राजप� म; �काशन क% तारीख को �व ृ C ह/ग।े 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 4]

2. प�रभाषाए ं – (1) इन िनयम/ म; जब तक स ं दभ1 से अBयथा अपेि&त न हो:

(क) ‘अिधिनयम’ से छावनी अिधिनयम, 2006 (2006 का 41) अिभ�ेत ह;ै (ख) ‘� प’ से इन िनयम/ से उपाबM � प अिभ�ेत हN ;

(2) उन श9द/ और पद/ के, जो इन िनयम/ म; �य ु . ह ै िकBत ु , पOरभािषत नह@ हN, वही अथ1 ह/ग े जो Qमशः उनके अिधिनयम म; हN।

3. स ू चनाओ ं के �प- अिधिनयम के अधीन िकसी -यि. पर तामील िकए जाने के िलए अपेि&त सभी स ू चनाए,ँ इन िनयम/ से उपाबM � प/ म; क% जा सक; ग@।

4. स ू चनाओ ं को तामील करने क� रीित – िकसी -यि. को अिधिनयम के अधीन जारी क% गई �Tयेक स ू चना िन�न �कार से तामील या �$त ु त क% जा सकेगी – (क) स ू चना, ऐसे -यि. को दकेर या िनिवदC करके या डाक 'ारा भजेकर ;

(ख) यिद ऐसा -यि. िमल नह@ सकता ह ैतो उसके अ ं ितम Wात िनवास या कारबार के $थान के िकसी सहजXYय भाग पर स ू चना को िचपका कर, यिद ऐसा $थान छावनी के भीतर ह ैतो, स ू चना को उसके पOरवार के िकसी वय$क प ु Zष सद$य या सेवक को दकेर या िनिवदC करके या उस भवन या भ ू िम के, यिद कोई ह,ै िजससे यह स ं बिBधत ह,ै िकसी सहजXYय भाग पर िचपकवा कर ।

5. धारा 316 से 321 के उपब ं ध$ का लाग ू होना – अिधिनयम क% धारा 316 से 321 तक के उपब ं ध इन िनयम/ के अधीन जारी क% गई �Tयेक स ू चना को लाग ू ह/ग े। �प स ं 'या – 1 छावनी अिधिनयम, 2006 (2006 का 41) क� धारा 76 के अधीन लोक स ू चना धारा 76 क% अपे&ान ु सार कर िनधा1रण स ू ची तैयार करने पर उसक% स ू चना (तारीख) .................. को स�यक प से द ेदी गई थी। अब, छावनी अिधिनयम, 2006 क% धारा 76 के अपे&ान ु सार यह अिधस ू िचत िकया जाता ह ैिक म ु ^य अिधशासी अिधकारी तारीख ............................ से आ&पे/ क% स ु नवाई �ार�भ करेगा। (स ू चना के �काशन क% तारीख और स ु नवाई क% तारीख के बीच कम से कम तीस िदन का अ ं तर होना चािहए) । यह स ू चना छावनी अिधिनयम 2006 क% धारा 319 क% अपे&ान ु सार िन�निलिखत �म ु ख $थान/ पर लगाई जा रही ह ै:-

And whereas no objections and suggestions were received from the public in respect of the said draft rules by the Central Government, even after the expiry of a period of sixty days;

Now, therefore, in exercise of the powers conferred by section 346 of the said Act, the Central Government hereby makes the following rules, namely:-

1. Short title and commencement.— (1) These rules may be called the Cantonments (Forms and Manner of Service of Notices) Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) “Act” means the Cantonments Act, 2006 (41 of 2006);

(b) “Form” means Form annexed to these rules.

(2) Words and expressions used but not defined in these rules shall have the meanings respectively assigned to them in the Act.

3. Form of notices.—All notices required to be served on any person under the Act shall be in the Forms annexed to these rules.

4. Manner of service of notices.—Every notice issued under the Act to any person shall be served or presented-

(a) by giving or tendering the notice or sending it by post, to such person;

(b) if such person cannot be found, by affixing the notice on some conspicuous part of his last known place of abode or business, if within the cantonment, or by giving or tendering the notice to some adult member or servant of his family or by causing it to be fixed on some conspicuous part of the building or land, if any, to which it relates.

5. Application of provision of sections 316 to 321.—The provisions of sections 316 to 321 of the Act shall apply to every notice issued under these rules.
