Training) NOTIFICAnON New Delhi the 20th March, 1990 O.S.R. 144~E). - In ~xercise of the pow~r5 conferr~ by sub-section (I ) and (2) of section 13 of the Administrative Tribunals Act, 1985 (3 of 1985), the Central Government hereby makes the (ollowing rules regarding the method of rccruitm'!nt to Accounts Personnel posts in the Central Administrative Tribunal, namely :-
1. Short tit le and commencem~nt.-(l) These rules may be called the Central Administrative Tribunal (Accounts Personnel posts) Recruitment Rules, 1990.
(2) They shall com~ into force on the date of their publication in the Official Gazette.
2. Application. --These rules shall apply to the posts m~ntioned in the column] or the Schedule annexed to these rules.
3. Number of P::Jsts, classiJication and scale ply.-The numb.:r of the said posts, their classification and the scales of pay attached thereto sh~U be as sDeCified in columns 2 to of 4 of the said Schedule.
4. MethOds of r~ruitmont, age limit, qualifications, etc.-The m:thod of recruitm~nl tJ the said posts, age limit, qualifications and other m1.tters relating thereto shall be as specified in coJumns S tJ 14 of the schedule aforesaid.
5. Ab'i')rptio,!regularisat;on of existing employees(l) Notwithstanding anything contained in the provisions of these rUles, the per sons holding the posts on the date of commencement or tho rultS eithe" (In transfer or on deputation basis and who fulfil the qualifica tion and expericna; laid down in these rules and who are considered suitable by the Departm ~ ntal Promotion Committee shall be eligibl e (.:>r abiOrjl:lon!re.!ularisation in tlte c0!8pactive grade subjoct to the condition that such pert;Onts exercise thoir option for the absorp tion and that their parent Department do not have any Objection to their being absorbed in the Tribunal. (2) The seniority of officers mentioned in sub-rule (I) shall be determined with reference to the dates of their regular appointment to the posts concerned:

6. Disqualification-No Person. -{a) who has entered into Or contracted a marriage with a person having a spouse living, Or (b) whO, having a spouse living , has entered into Or contracted a marriage with any other person;
shall be eligible for appOintment to any post in the Tribunal:
Provid~ thltt the C:!ntral Government may ir satisfiod that such marriage is permis<;iblo under the prrsonal laws applicable to such persons and tho other party to tho m!lrriage and that thero are other grounds for 50 doing, exempt any person from the operation of this rule.
7. Power to relax. - ( I) Where the Central Government is of th: opinion that it is necessary orexpe:dient so to do, it may. by order, for r~aSOT\5 to b: re:::orded in writing, relax. any of the provisions of peron~ for the post of deputy Controller of Accounts.
(2) Where the Chai rman, Central Administrative Tribunal is of the opinion that it is necessary or expedient ao to do, he may, by order and tor r .nsons to be recorded in writing, relax any of tile prOvisions of thes\! rures with respect to any c!au Or cat~gory of persons foJr the pOSH of Accounts OJUcors , Junior Accounts Officer, Senior Accounant and Junior Accountant .
