PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 705] ubZ fnYyh] cq/okj] vDrwcj 5] 2016@vkf'ou 13] 1938 No. 705] NEW DELHI, WEDNESDAY, OCTOBER 5, 2016/ASVINA 13, 1938 सड़क पᳯरवहन और राजमागᭅ मंᮢ ालय अिधसचूना नई ᳰद᭨ ली, 5 अ तूबर, 2016 सा.का.िन.953(अ).—कᱶ ᮤीय मोटरयान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 212 कᳱ उपधारा (1) ᳇ारा यथा अपेिᭃत के᭠ ᮤ ीय मोटर िनयम, 1989 का और संशोधन करने के िलए ᮧाᱨप िनयम िजनको के᭠ᮤीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 41 और 110 ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए बनाना का ᮧ᭭ताव करती ह,ै भारत सरकार मᱶ सड़क पᳯरवहन और राजमागᭅ मंᮢालय कᳱ अिधसूचना सं. सा.का.िन. 309 (अ), तारीख 16 माचᭅ, 2016 ᳇ारा भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i) मᱶ उनसे ᳇ारा संभा᭪ य ᮧभािवत सभी ᭪ यि तयᲂ ᳇ारा उस तारीख से जब ᮧाᱨप िनयमᲂ से अंतᳶव᭬ ट उ त अिधसूचना कᳱ ᮧितयां जनसाधारण को उपल᭣ ध करवाई गई थᱭ, से तीस ᳰदन कᳱ अविध कᳱ समाि᭡ त से पूवᭅ आᭃेप और सुझाव आमंिᮢत करने के िलए ᮧकािशत ᳰकए गए थे ; उ त राजपᮢ अिधसूचना कᳱ ᮧितयां जनसाधारण को तारीख 16 माचᭅ, 2016 को उपल᭣ ध करवाई गई थᱭ ; उ त ᮧाᱧप िनयमᲂ के संबंध मᱶ जनसाधारण से ᮧा᭡ त आᭃेपᲂ और सुझावᲂ पर कᱶ ᮤीय सरकार ᳇ारा िवचार ᳰकया गया ह ै; अत:, के᭠ ᮤ ीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 41 और 110 ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए के᭠ ᮤ ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन᭥ निलिखत िनयम बनाती ह,ै अथाᭅत्:-
1. (1) इन िनयमᲂ का संिᭃ᭡ त नाम कᱶ ᮤीय मोटर यान (17वॉ संशोधन) िनयम, 2016 ह ै।
(2) ये िनयम राजपᮢ मᱶ उनके अंितम ᮧकाशन के प᳟ात 1 अᮧैल, 2017 से ᮧवृ᭜ त हᲂगे ।
2. कᱶ ᮤीय मोटर यान िनयम, 1989 के ᮧᱧप 22 के ᭭थान पर िन᳜िलिखत ᮧᱧप अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत:्- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “ᮧᱧप 22 [िनयम 47(1) (छ), 115, 124(2) और 127 दिेखए] ᮧदषूण मानकᲂ सघंटक Ფािलटी के सरुᭃा मानकᲂ और सड़क-योयता के अनपुालन का आरि᭥भक ᮧमाणपᮢ (िविनमाᭅता या ई-ᳯरशा या ई-काटᭅ कᳱ दशा मᱶ रिज᭭ᮝीकृत ई-ᳯरशा या ई-काटᭅ संगम ᳇ारा जारी ᳰकया जाना ) यह ᮧमािणत ᳰकया जाता ह ैᳰक िन᳜िलिखत यान के उ᭜सजᭅन मू᭨य िजसके अंतगᭅत ᮤ᳞मान उ᭜सजᭅन सि᳖यम भी ह ᱹऔर ᭟विन मानक िजसके अंतगᭅत ᭟विन᭭तर भी ह ैमोटर यान अिधिनयम, 1988 और नीचे यथािवᳶनᳰद᳥ बनाए गए िनयमᲂ के उपबंधᲂ के अनुपालन मᱶ हᲂगे ।

6. उ᭜सजᭅन मू᭨य (िनयम 115(2) मᱶ िन᳸द᳥) (क) पैᮝोल/सीएनजी/एलपीजी /इलैिᮝक-हाईिᮩड यानᲂ के िलए ᮓम सं. ᮧदषूक ᮕाम/ᳰकलोमीटर या ᮕाम/ᮧितघंटा ᳰकलोवाट मᱶ ᮤ᳞मान

(ii) ᭟विन ᭭तर (िनयम 120 मᱶ िन᳸द᳥) :- (क) यान पर लगाए गए हानᭅ (कृिष ᮝेटरᲂ और सि᭠ नमाᭅण उप᭭कर यानᲂ से िभ᳖ सभी यानᲂ के िलए) .........डीबी(ए) (ख) बाय᭭टे᭠डरस ि᭭थित (कृिष ᮝेटरᲂ और सि᭠ नमाᭅण उप᭭कर यानᲂ स ेिभ᳖ सभी यानᲂ के िलए) .........डीबी(ए) (ग) ᮧचालक का ᮰वण ᭭तर (कृिष ᮝेटरᲂ और सि᳖माᭅण उप᭭कर यानᲂ के िलए) ........................ डीबी(ए) (िविनमाᭅता या रिज᭭ᮝीकृत ई-ᳯरशा या ई-काटᭅ संगम के ᮧािधकृत ह᭭ताᭃरकताᭅ के ह᭭ताᭃर ᳯट᭡ पण 1 –यह ᮧᱧप स᭥यक् ᱨप से मुᳰᮤत िविनमाᭅता के ह᭭ताᭃर सिहत, िविनमाᭅता कᳱ िलखावट और मुᮤा के अधीन ᭭याही से ह᭭ताᭃर कᳱ अनुिलिप लगाते ᱟए जारी ᳰकया जाएगा । ᳯट᭡पण 2 :- ई-ᳯरशा या ई-काटᭅ कᳱ दशा मᱶ यह ᮧᱧप स᭥यक ᱨप से मुᳰᮤत रिज᭭ᮝीकृत ई-ᳯरशा या ई-काटᭅ ऐसोिसएशन के ᮧािधकृत ह᭭ताᭃरकताᭅ कᳱ िलखावट और मुᮤ ा के अधीन ᭭याही स े ह᭭ताᭃर कᳱ अनुिलिप लगाते ᱟए जारी ᳰकया जाएगा । [सं. आरटी-11028/09/2015-एमवीएल] अभय दामले, संयुᲦ सिचव ᳯट᭡ पण :– मूल िनयम भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i) मᱶ अिधसूचना संयांक सा.का.िन. 590(अ), तारीख 2 जून, 1989 ᳇ारा ᮧकािशत ᳰकए गए थे और अिधसूचना संयांक सा.का.िन 903(अ) तारीख 23.09.2016 ᳇ारा उनका अि᭠तम संशोधन ᳰकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 5th October, 2016 G.S.R. 953(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by sections 41 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), were published, as required by sub-section (1) of section 212 of the said Act vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 309 (E), dated 16th March 2016, in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) inviting objections and suggestions from persons before expiry of a period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public; And whereas, copies of the Gazette containing the said notification were made available to the public on the 16th March, 2016; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government. Now, therefore, in exercise of the powers conferred by sections 41 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:
1. (1) These rules may be called the Central Motor Vehicles (17th Amendment) Rules, 2016.
(2) They shall come into force with effect from the 1st day of April, 2017, after their final publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989, for Form 22, the following Form shall be substituted, namely:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “Form 22 [See rules 47 (1)(g), 115, 124(2) and 127] INITIAL CERTIFICATE OF COMPLIANCE WITH POLLUTION STANDARDS, SAFETY STANDARDS OF COMPONENTS QUALITY AND ROAD-WORTHINESS (To be issued by the manufacturer or registered E-rickshaw or E-cart association in case of E-rickshaw or E-cart) It is certified that the following vehicle complies with the emission values, including mass emission norms and noise standards including noise level under the provisions of the Motor Vehicles Act, 1988, and the rules made thereunder as specified below:

3. Engine number (motor number, in : case of battery operated vehicles)
4. Emission norms applicable: [Bharat Stage- IV / VI /Bharat (Trem) Stage-III/III A etc.]
5. The emission, sound level for horn and pass by noise values of the above vehicle model, obtained during Type Approval as per Central Motor Vehicle Rules, 1989 are given below:
(i) Emission values [refer rule 115 (2)] :

(c) Operator’s ear level (for agricultural tractors and construction equipment vehicles ) ……………….dB(A) (Signature of manufacturer or of authorised signatory of registered E-rickshaw or E-cart Association) Note 1: This Form shall be issued with the signature of the manufacturer duly printed in the Form itself by affixing facsimile signature in ink under the hand and seal of the manufacturer.
Note 2: In the case of e-rickshaw or e-cart, this Form shall be issued with the signature of an authorized signatory of registered E-rickshaw or E-cart association duly printed in the Form itself by affixing facsimile signature in ink under the hand and seal of such signatory.
