और उ; ूा@प िनयम< क' बाबत जनता स ेूाI आ)ेप< और सुझाव< पर के�ि!य सरकार 6ारा :वचार कर िलया गया है;
अतः अब के�ि!य सरकार उ; अिधिनयम क' धारा 110 6ारा ूदL श:;य< का ूयोग करते हुए, के�ि!य मोटर यान िनयम, 1989 का और संशोधन करने के िलए िनMनिल=खत िनयम बनाती है, अथा�त ्:— 695 GI/2014 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
1. (1) इन िनयम< का सं=)I नाम के�ि!य मोटर यान (ूथम संशोधन) िनयम, 2014 है ।
(2) िसवाय इन िनयम< मG अ� यथा उपबंिधत के ये िनयम 1 vDrwcj] 2014 से ूवLृ ह<गे ।
2. के�ि!य मोटर यान िनयम, 1989 (=जसे इसमG इसके पँ चात ् मूल िनयम कहा गया है) के िनयम 2 मG खंड (म) के पँ चात ्िनMनिल=खत खंड अंतःःथा:पत Aकया जाएगा, अथा�त:्— "(य) "चौपAहया साइAकल" से चार पAहय< वाला यान अिभूेत है और =जसमG िनM निल=खत :वशेषताएं हW, अथा�त:्—
(i) दरवाज< सAहत पूण�तया ूितवे:Yत बाड! ढांचा और =जसमG ः ट!य�रंग 9 ह!ल के मा[ यम स े ः ट!य�रंग िनयंऽण है =जसमG दरवाज< के उपर! Aकनारे नजद!क क' सीट क' उपर! सतह स ेकम से कम 200 एमएम पर हW;
(ii) =जसके Aकनारे और छ] त नM य साममी जैसे रे=_ सन, कपM+k, ` ला=ः टक आAद से नह!ं बनी हुई है;
(iii) माल यान, ः थोरा बाड! का आंत�रक )ेऽ यान क' चौM+kई को उसक' लंबाई से गुणा करने के पँ चात ्तीस ूितशत से अ� यून है;
(iv) याऽी यान< क' दशा मG अिधकतम अनुbेय कब� भार 450 माम और माल यान< क' दशा मG 550 Aकलोमाम है;
(v) याऽी यान क' दशा मG अिधकतम बैठने क' )मता चार (चालक सAहत) और माल यान< क' दशा मG दो याऽी (चालक सAहत), =जसमG चालक और सह याऽी के िलए दोन< याऽी यान और माल यान क' दशा मG पहली पं=_ त मG ः वतंऽ सीट< का उपबंध Aकया गया है;
(vi) माल यान< क' दशा मG अिधकतम अनुbेय िनAहत भार 550 Aकलोमाम है;
(vii) ूधान मूवर क' दशा मG अिधकतम अनुbेय नोदन श=_ त 15 Aकलोवाट पर 15 Aकलोवाट होगी जब समय समय पर संशोिधत संपीfM+त इd नीशन इंजन< और बैटर! 6ारा ूचािलत इंजन< के िलए ः पाक� इd नीशन इंजन के िलए आईएस 14599-1999 के अनुसार एमओएसआरट!एच/ट!एपी 115-116 के भाग चार के अ[ याय 1 के अनुसार पर!)ण Aकया जाए;
(viii) अिधकतम Aडजाइन गित 70 Aकलोमीटर ूितघंटा; और
(ix) =जनमG शेलर नह!ं है या Aकसी अk� शेलर क' कॉपिलंग के िलए कोई उपबंध नह!ं है" । ःपYीकरणःपYीकरणःपYीकरणःपYीकरण :—खंड (iv) के ूयोजन< के िलए कब� भार मG वैmुत/संकर यान< क' दशा मG बैट�रय< के ि9यमान का भार शािमल नह!ं है ।
3. मूल िनयम< के िनयम 50 के उप-िनयम (1) के खंड (vi) मG "दपुAहया और ितपAहया" शBद< के ःथान पर "दपुAहया, ितपAहया और चौपAहया के िलए" शBद रखे जा,aगे ।
4. मूल िनयम< के िनयम 93 मG,— (क) उप-िनयम (1) मG अंत मG और ःपYीकरण से पहले िनM निल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त:्— "परंतु यह Aक Aकसी चौपAहया साइAकल क' समम चौM+kई 1.5 मीटर स ेअनिधक होगी ।";
(ख) उप-िनयम (2) मG खंड (vii) के पँ चात ्िनM निल=खत खंड अंत:ः था:पत Aकया जाएगा, अथा�त:्— ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 "(viii) चौपAहया साइAकल क' दशा मG याऽी यान के िलए तीन मीटर और माल यान के िलए 3.7 मीटर";
(ग) उप-िनयम (4) मG खंड (iii) के पँ चात ्िनM निल=खत खंड अंत:ः था:पत Aकया जाएगा, अथा�त:्— "(iv) चौपAहया साइAकल< क' दशा मG 2.5 मीटर से अनिधक होगा"
5. मूल िनयम< के िनयम 94 के उप-िनयम (3) के खंड (iv) मG "दपुAहया " और “ितपAहया” शB द< के ः थान पर "दपुAहया, ितपAहया और चौपAहया साइAकल” शB द रखे जाएंगे।
6. मलू िनयम< के िनयम 95 के उप-िनयम (1) के पहल ेपरंतुक मG "दपुAहया और “ितपAहया क' दशा मG” शB द< के ः थान पर "दपुAहया, ितपAहया और चौपAहया साइAकल क' दशा मG” शB द रखे जाएंगे।
7. मूल िनयम< के िनयम 96 के उप-िनयम (4) के खंड (ii) मG, "मोटर यान<" शBद< के ःथान पर, "मोटर यान< =जसके अं�तग�त चौपAहया साइAकलG भी हW" शB द रखे जाएंगे।
8. मूल िनयम< के िनयम 98 मG उप-िनयम (3) के पँ चात ्िनM निल=खत उप-िनयम अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “(3क) 1 vDrwcj] 2014 से ह! चौपAहया के ः ट!य�रंग ूयास समय-समय पर संशोिधत भारतीय मानक आई एस 11948-1999 के अनु@प ह<गे” ।
9. मूल िनयम< के िनयम 101 के उप-िनयम (2) के खंड (ii) के पँ चात ् िनM निल=खत खंड अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “(iii) चौपAहया साइAकल< क' दशा मG 1 vDrwcj] 2014 से ह! एआईएस 045/2004” ।
10. मूल िनयम< के िनयम 115 मG,—
(i) उप-िनयम (2) मG पैरा (i) मG, सारणी मG “दपुAहया और ितपAहया” पद जहां-जहां वे आते हW “दपुAहया, ितपAहया और चौपAहया साइAकल” पद रखे जाएंग;े
(ii) उप-िनयम 14 के पैरा (च) मG,— (क) उप पैरा (i) मG “1 vDrwcj] 2010” के ः थान पर िनM निल=खत रखा जाएगा, अथा�त ्:— “1 अूैल, 2010 और 1 vDrwcj] 2014 से ह! :विनिम�त चौपAहया साइAकलG”;
(ख) उप पैरा (ii) मG “1 vDrwcj] 2010” के ः थान पर िनM निल=खत रखा जाएगा, अथा�त ्:— “1 vDrwcj] 2010 और 1 vDrwcj] 2014 से ह! :विनिम�त चौपAहया साइAकलG”;
(ग) उप पैरा (iii) मG,— (अ) ूारंिभक भाग मG “दो पAहया और ितपAहया यान” शB द< के ः थान पर “दो पAहया, ितपAहया और चौपAहया साइAकलG” शB द रखे जाएंगे;
(आ) सारणी मG “ितपAहया” शBद दोन< ःथान< पर जहां वह आता है, “ितपAहया और चौपAहया साइAकलG” शB द रखे जाएंग;े
11. मूल िनयम< के िनयम 117 के उप-िनयम (3) के पँ चात ्िनM निल=खत उप-िनयम अंत:ः था:पत Aकया जाएगा, अथा�त ्:— 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(4) 1 vDrwcj] 2014 से ह! :विनिम�त ू]येक चौपAहया साइAकल को भारतीय मानक Bयूरो 6ारा :विनAद�Y भारतीय मानक: 11827-1995 क' अपे)ाओं के अनु@प गितमापी से सुस=p जत Aकया जाएगा” ।
12. मूल िनयम< के िनयम 118 के उप-िनयम (1) के परंतुक मG उप-खंड (ii) के ः थान पर िनM निल=खत उप-खंड रखा जाएगा, अथा�त ्:— “(ii) ितपAहया और चौपAहया साइAकलG”
13. मूल िनयम< के िनयम 119 के उप-िनयम (1) मG परंतुक के पँ चात ्िनM निल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “परंतु यह और Aक 1 vDrwcj] 2014 से ह! इस िनयम के अधीन अपे)ाएं ू] येक चौपAहया साइAकल को लाग ू ह<गी” ।
14. मूल िनयम< के िनयम 120 के उप-िनयम (2) के परंतुक के पँ चात ्िनM निल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “परंतु यह और Aक चौपAहया साइAकल< क' दशा मG अनुbेय [ विन सीमा गित के अधीन यान< के िलए 76dB(A) होगी ।” ।
15. मूल िनयम< के िनयम 121 के उप-िनयम (3) के पँ चात ्िनM निल=खत उप-िनयम अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “(4) चौपAहया साइAकल क' बाड! पर मु/ य @प से ः पं ट अ)र< मG “_ यू” लेबल ए�रयल फ<ट मG काले अ)र< मG लगा होगा या Aकसी :वपर!त रंग मG यान के आगे और पीछे लगा होगा और उ_ त लेबल समुिचत बीमाओ ं मG होगा =जससे कुल ूदश�न )ेऽ 225 वग� सGट!मीटर स ेअ� यून होगा ।” ।
16. मूल िनयम< के िनयम 122 के उप-िनयम (1) मG,- (क) परंतुक मG, "एन ूवग� के यान" अ)र और शBद के ःथान पर "एन ूवग� के यान मालवाहक चौपAहया साइAकल" शB द रखे जाएंग;े (ख) पहले पंरतुक के पँ चात ्िनMनिल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “परंतु यह और Aक 1 vDrwcj] 2014 स ेह! इस िनयम के अधीन अपे)ाएं ू] येक चौपAहया साइAकल को लाग ू ह<गी” ।
17. मूल िनयम< के िनयम 125 मG,— (क) उप-िनयम (1) मG िनM निल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “परंतु यह और Aक 1 vDrwcj] 2014 से ह! इस िनयम के अधीन अपे)ाएं ू] येक चौपAहया साइAकल को लागू ह<गी” । पंरतु यह और Aक चौपAहया साइAकल के िलए सुर)ा बैs ट असेM बली और सेtट! बैsट एंकरेज बमशः आईएस 15140: 2003 और आईएस 15139: 2002 के अनु@प ह<गे";
(ख) उप-िनयम (2) मG पहले परंतुक के पँ चात ्िनM निल=खत परंतुक अंत:ः था:पत Aकया जाएगा, अथा�त ्:— “परंतु यह और Aक 1 vDrwcj] 2014 से ह! इस िनयम के अधीन अपे)ाएं ू] येक चौपAहया साइAकल को लागू ह<गी” । (ग) उप-िनयम (6) के पँ चात ्िनM निल=खत उप-िनयम अंत:ः था:पत Aकया जाएगा, अथा�त ्:Ñ ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 “(7) 1 vDrwcj] 2014 स ेह! चौपAहया सइAकल< के िलए सीटG उनके एंकरेज और शीष� :वौाम समय समय पर यथा संशोिधत एआईएस 023 : 2005 के अनुसार ह<ग,े जब तक Aक त] ः थानी वीआईएस :विश:Yय< को भारतीय मानक B यूरो अिधिनयम, 1986 (1986 का 63) के अधीन अिधसूिचत नह!ं कर Aदया जाता है ।” । [iQk- la- vkjVh&11028@09@2013&,eoh,y] lat; canksikè;k;] la;qDr lfpo पादपादपादपाद Aट`पणःAट`पणःAट`पणःAट`पणःÑÑÑÑमूल िनयम सा.का.िन. स.ं 590(अ), तार!ख 2 जून, 1989 6ारा ूकािशत Aकए गए थे और अंितम संशोधन सा.का.िन. स.ं 664(अ), तार!ख 27 िसतंबर, 2013 6ारा Aकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 19th February, 2014 G.S.R. 99(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under section 110 of the Motor Vehicles Act, 1988 (59 of 1988) vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 575(E) dated 27th August, 2013, in the Gazette of India, Extraordinary, Part II, section 3 sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
And, whereas, copies of the said Gazette notification were made available to the public on the 27th August, 2013;
And, whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:—
1. (1) These rules may be called the Central Motor Vehicles (1st Amendment) Rules, 2014.
(2) Save as otherwise provided in these rules, they shall come into force on the 1st October 2014.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 2, after clause (y), the following clause shall be inserted, namely:— ‘(z) “quadricycle” means a four wheeled vehicle and having the following features, namely:—
(i) fully enclosed body structure with doors and having steering control through steering wheel with the top edge of the doors having at least 200 mm from adjacent seat base top surface;
(ii) with sides and top not made of flexible material such as rexin, cloth, plastic etc.;
(iii) for goods vehicle, cargo body internal area not less than 30% of the vehicle’s width multiplied by its length;
(iv) maximum permissible kerb weight of 450 kg in case of passenger vehicle and 550 kg in case of goods vehicle;
(v) maximum seating capacity of four (including driver) in case of passenger vehicle and two (including driver) in case of goods vehicle with independent seats provided for the driver and copassenger in the front row in the case of both passenger vehicle and goods vehicle;
(vi) maximum permissible pay load of 550 kg. in case of goods vehicles;
(vii) maximum permissible propulsion power of 15 kW of the prime mover be 15 kW, when tested as per Chapter 1 of Part IV of MoSRTH/ TAP 115-116 as amended from time to time for Compression Ignition engines and battery operated vehicles and as per IS 14599-1999 for Spark Ignition engines;
(viii) maximum design speed of 70 km per hour; and
(ix) not having trailers or any provision of coupling a semi-trailer.

Explanation:—For the purpose of clause (iv), kerb weight does not include mass of batteries in the case of electric/ hybrid vehicles’.
3. In rule 50 of the principal rules, in sub-rule (1), in clause (vi) for the words “For two and three wheelers” the words “For two wheelers, three wheelers and quadricycles” shall be substituted.
4. In rule 93 of the principal rules,—
(a) in sub-rule (1), the following proviso shall be inserted at the end and before the Explanation, namely:— “Provided that the overall width of a quadricycle shall not exceed 1.5metres.”;
(b) in sub-rule (2), after clause (vii), the following clause shall be inserted, namely:— “(viii) in the case of quadricycle, 3 metres for passenger vehicle and 3.7 meter for goods vehicle”;
(c) in sub-rule (4), after clause (iii), the following clause shall be inserted, namely:— “(iv) in the case of quadricycle, shall not exceed 2.5 metres”.
5. In rule 94 of the principal rules, in sub-rule (3), in clause (iv), for the words “two wheeler and three wheeler”, the words “two wheeler, three wheeler and quadricycle” shall be substituted.
6. In rule 95 of the principal rules, in sub-rule (1), in the first proviso, for the words “in the case of two and three wheelers” the words “in the case of two wheeler, three wheeler and quadricycle” shall be substituted.
7. In rule 96 of the principal rules, in sub-rule (4), in clause (ii), for the words “motor vehicles” the words “motor vehicles including quadricycles” shall be substituted;
8. In rule 98 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely:— “(3A) On and after 1st October 2014, the steering effort of quadricycle shall conform to Indian Standard IS 11948-1999, as amended from time to time”.
9. In rule 101 of the principal rules, in sub-rule (2) after clause (ii), the following clause shall be inserted, namely:— “(iii) AIS 045/ 2004, in the case of quadricycles, on and after 1st October, 2014”.
10. In rule 115 of the principal rules,—
(i) in sub-rule (2), in paragraph (i), in the Table, for the expression “2 & 3-wheelers” wherever they occur, the expression “Two-wheelers, three wheelers and quadricycles” shall be substituted.
(ii) in sub-rule 14, in paragraph (F), –
(a) in sub-paragraph (i), for “1st April, 2010”, the following shall be substituted, namely:— “1st April, 2010 and quadricycles manufactured on or after 1st October 2014.”;
(b) in sub-paragraph (ii), for “1st October, 2010”, the following shall be substituted, namely:— “1st October, 2010 and quadricycles manufactured on or after 1st October 2014.”;
(c) in sub-paragraph (iii),— (A) in the opening portion, for the words “two and three wheeler vehicles” the words “two wheelers, three wheelers and quadricycles” shall be substituted;
(B) in the Table for “Three wheelers” at both the places where they occur, the words “Three wheelers and quadricycles” shall be substituted.
11. In rule 117 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely:— “(4) Every quadricycle manufactured on and after 1st October 2014, shall be fitted with a speedometer conforming to the requirements of Indian Standard :11827-2008 specified by Bureau of Indian Standards”.
12. In rule 118 of the principal rules, in sub-rule (1), in the first proviso, for sub-clause (ii), by the following subclause, shall be substituted, namely:— “(ii) three wheelers and quadricycles”
13. In rule 119 of the principal rules, in sub-rule (1), after the proviso, the following proviso shall be inserted, namely:— “Provided further that on and after 1st October 2014, the requirements under this rule shall be applicable to every quadricycle”.

14. In rule 120 of the principal rules, in sub-rule (2), after the proviso the following proviso shall be inserted, namely: — “Provided further that in case of quadricycles, the permissible noise limits for vehicles in motion shall be 76 dB(A).”.
15. In rule 121 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely:— “(4) The body of quadricycle shall prominently carry a label “Q” in capital and Arial font in black or any contrasting color in front and at the rear of vehicle and that the said label shall have suitable dimensions so that total display area is not less than 225 sq. cm.”.
16. (1) In rule 122, sub-rule (1),
(a) in the proviso, for the letter and words “N category vehicle” the letter and words “N category vehicle and Goods Quadricycle” shall be substituted.
(b) after the first proviso, the following proviso shall be inserted, namely:— “Provided further that on and after 1st October, 2014, the requirements under this rule shall be applicable to every quadricycle”.
17. In rule 125 of the principal rules,
(a) in sub-rule (1), the following proviso shall be inserted, namely:— “Provided that on and after 1st October, 2014, the requirements under this rule shall be applicable to every quadricycle: Provided further that the requirement for safety belt assembly and safety belt anchorages for quadricycles shall conform to IS 15140: 2003 and IS 15139: 2002, respectively”;
(b) in sub-rule (2), after the first proviso, the following proviso shall be inserted, namely:— “Provided further that on and after 1st October, 2014, the requirements under this rule shall be applicable to every quadricycle.”;
(c) after sub-rule (6), the following sub-rule shall be inserted, namely:— “(7) On and after 1st October, 2014, the seats, their anchorages and head restraints for quadricycles shall be in accordance with the specifications of vehicle Group B as specified in AIS 023: 2005 as amended from time to time till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986).” .
