PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 818] ubZ fnYyh] lkseokj] uoEcj 28] 2016@vxzgk;.k 7] 1938 No. 818] NEW DELHI, MONDAY, NOVEMBER 28, 2016/AGRAHAYANA 7, 1938 सड़क पᳯरवहन और राजमागᭅ मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 28 नव᭥बर, 2016 सा.का.िन. 1096(अ).—के᭠ᮤीय मोटर यान िनयम, 1989 का और संशोधन करन े के िलए, मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 212 कᳱ उपधारा (1) कᳱ अपेᭃानुसार ᮧाᱨप िनयम भारत सरकार के सड़क पᳯरवहन और राजमागᭅ मंᮢालय कᳱ अिधसूचना सा.का.िन. संयांक 951(अ) तारीख 8 ᳰदस᭥ बर, 2015 ᳇ारा उन सभी ᳞िᲦयᲂ से, िजनके उनसे ᮧभािवत होने कᳱ संभावना थी, ᮧाᱨप िनयम भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i) मᱶ ᮧकािशत ᳰकए गए थ,े उस तारीख से िजसको उᲦ अिधसूचना से युᲦ राजपᮢ कᳱ ᮧितयां जनता को उपल᭣ध करा दी गई थी, तीस ᳰदन कᳱ अविध के अवसान से पूवᭅ आᭃेप और सुझाव आमंिᮢत ᳰकए गए थे ;
और राजपᮢ कᳱ ᮧितयां िजसमᱶ उᲦ अिधसूचना ᮧकािशत कᳱ गई थी, जनता को तारीख 8 ᳰदस᭥ बर, 2015 को उपल᭣ध करा दी गई थी ;
और उᲦ ᮧाᱨप िनयमᲂ कᳱ बाबत जनता से ᮧा᳙ आᭃेपᲂ और सुझावᲂ पर के᭠ᮤीय सरकार ᳇ारा िवचार कर िलया गया ह ै;
अत:, अब कᱶ ᮤीय सरकार मोटर यान अिधिनयम, 1988 (1988 का 59) कᳱ धारा 56 के साथ पᳯठत धारा 64 के खंड (ढ) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए के᭠ᮤीय मोटर यान िनयम, 1989 का और संशोधन करन ेके िलए िन᭥ निलिखत िनयम बनाती ह,ै अथाᭅत ्:-
1. (1) इन िनयमᲂ का संिᭃ᳙ नाम के᭠ᮤीय मोटर यान (21वा ंसंशोधन) िनयम, 2016 ह ै।
(2) ये िनयम राजपᮢ मᱶ उनके ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे ।
2. के᭠ᮤीय मोटर यान िनयम, 1989 (िजसे इसमᱶ इसके प᭫ चात मूल िनयम कहा गया ह)ै के िनयम 62 मᱶ,-- 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) उपिनयम (1) मᱶ,--
(i) पहले परंतुक मᱶ ''िनरीᭃण अिधकारी के प᭫ चात'्' ''िनरीᭃण अिधकारी के प᭫ चात'्' श᭣ द रखे जाएंग े;
(ii) दसूरे परंतुक के प᭫ चात ्िन᭥ निलिखत परंतुक अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत ्:- ''परंत ु यह भी ᳰक यᳰद ᮧथम परंतुक के अधीन सारणी मᱶ िविन᳸द᭬ ट परीᭃणᲂ का संचालन ᳰकसी रा᭔ य/संघ रा᭔ यᭃेᮢ, जहां यान का रिज᭭ ᮝीकरण ᳰकया गया था, से िभ᭠ न ᳰकसी रा᭔ य/संघ रा᭔ यᭃेᮢ मᱶ ᳰकसी िनरीᭃण अिधकारी या ᮧािधकृत परीᭃण कᱶ ᮤ मᱶ ᳰकया जाता ह ैतो िनरीᭃण अिधकारी, िजसने जांच का संचालन ᳰकया ह,ै उसी ᳰदन या अगल े कायᭅᳰदवस को उसकᳱ िनरीᭃण ᳯरपोटᭅ को ᮧᱨप 38क मᱶ http://parivahan.gov.in/vahan पोटᭅल पर अपलोड करेगा और अपने ह᭭ ताᭃर और मुहर के अधीन िनरीᭃण ᳯरपोटᭅ को रिज᭭ ᮝीकरण ᮧािधकारी को िनरीᭃण ᳯरपोटᭅ कᳱ तारीख से 15 ᳰदन के भीतर यᳰद िनरीᭃण अिधकारी ᳇ारा यान अिधिनयम और िनयमᲂ के उपबंधᲂ कᳱ अनुपालना करन ेवाला पाया जाता ह ै तो रिज᭭ ᮝीकरण ᮧािधकारी ᳇ारा उपयु तता ᮧमाणपᮢ जारी करने के िलए ᭭ पीड पो᭭ ट से भेजेगा और उसकᳱ एक ᮧित यान के चालक को दी जाएगी :
परंतु यह भी ᳰक यᳰद अगला उपयु तता ᮧमाणपᮢ रिज᭭ ᮝीकरण ᮧािधकारी के रा᭔ य/संघ रा᭔ यᭃेᮢ से िनरीᭃण अिधकारी या ᳰकसी ᮧािधकृत जांच कᱶ ᮤ से अिभᮧा᭡ त ᳰकया जाता ह,ै जहां यान का रिज᭭ ᮝीकरण ᳰकया गया ह ै।'';
(iii) ᭭ प᭬ टीकरण मᱶ, ''रा᭔ य सरकार ᳇ारा िनयु त'' श᭣ दᲂ के ᭭ थान पर ''रा᭔ य सरकार ᳇ारा िनयु त'' श᭣ द रखे जाएंगे ;
(ख) उपिनयम (2) के प᭫ चात,् िन᭥ निलिखत उपिनयम अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत् :-- ''(3) ᳰकसी यान कᳱ जांच के िलए फᳱस, जब िनरीᭃण अिधकारी से िभ᭠ न ᳰकसी िनरीᭃण अिधकारी या ᮧािधकृत जांच कᱶ ᮤ ᳇ारा रिज᭭ ᮝीकरण ᮧािधकारी के कायाᭅलय मᱶ जांच कᳱ जाती ह,ै िनयम 81 मᱶ यथा िविन᳸द᭬ ट होगी ।''
3. मूल िनयमᲂ के िनयम 81 मᱶ, सारणी मᱶ, ᮓम सं. 11 और उससे संबंिधत ᮧिवि᳥यᲂ के प᭫ चात ् िन᭥ निलिखत ᮓम सं. और ᮧिवि᭬ टयां अंत:᭭थािपत कᳱ जाएंगी, अथाᭅत् :--
(1) (2) (3) (4) (5) ''11क. रिज᭭ ᮝीकरण ᮧािधकारी के कायाᭅलय मᱶ िनरीᭃण अिधकारी से िभ᭠ न ᳰकसी िनरीᭃण अिधकारी या ᮧािधकृत परीᭃण कᱶ ᮤ मᱶ रिज᭭ ᮝीकरण ᮧािधकारी ᳇ारा उपयु तता का ᮧमाणपᮢ अनदु᭜ त या नवीकृत ᳰकए जाने के िलए ᳰकसी यान का परीᭃण का संचालन करना 62(2) मोटर साईᳰकल मैनुअल : दौ सौ ᱧपए ᭭ वचािलत : चार सौ ᱧपए ितपिहया या ह᭨ का मोटरयान या चौपिहया मैनुअल : चार सौ ᱧपए ᭭ वचािलत : छह सौ ᱧपए म᭟ यम या भारी मोटरयान मैनुअल : छह सौ ᱧपए ᭭ वचािलत : एक हजार ᱧपए ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
4. ᮧᱨप 38 के प᭫ चात ्िन᭥ निलिखत ᮧᱨप अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत ्:-- ''ᮧᱨप 38क [देिखए िनयम 62(1)] रिज᭭ ᮝीकरण ᮧािधकारी के कायाᭅलय मᱶ िनरीᭃण अिधकारी स ेिभ᭠ न ᳰकसी िनरीᭃण अिधकारी या ᮧािधकृत परीᭃण कᱶ ᮤ ᳇ारा सचंािलत ᳰकसी पᳯरवहन यान कᳱ िनरीᭃण ᳯरपोटᭅ यान, िजसकᳱ रिज᭭ ᮝीकरण सं. .......... ह,ै का अ᳒ोह᭭ ताᭃरी ᳇ारा आज िनरीᭃण ᳰकया गया ह ैऔर यह ᮧमािणत ᳰकया जाता ह ैᳰक यह मोटरयान अिधिनयम, 1988 (1988 का 59) और कᱶ ᮤीय मोटरयान िनयम, 1989 के उपबंधᲂ का अनुपालन करता ह ै तथा यह रिज᭭ ᮝीकरण ᮧािधकारी ᳇ारा उपयु तता ᮧमाणपᮢ जारी ᳰकए जाने के िलए उपयु त ह ै। यह ᳯरपोटᭅ http://parivahan.gov.in/vahan पोटᭅल पर अपलोड कᳱ जाएगी और मेरे ह᭭ ताᭃर और मुहर के अधीन रिज᭭ ᮝीकरण ᮧािधकारी को आज या अगल ेकायᭅ ᳰदवस को ᭭ पीड पो᭭ ट ᳇ारा आवेदन के ᮧᮓमण यान के संबंध मᱶ रिज᭭ ᮝीकरण ᮧािधकारी ᳇ारा उपयु तता ᮧमाणपᮢ जारी करने के िलए भेजी जाएगी । तारीख .............

िनरीᭃण अिधकारी का ह᭭ ताᭃर, नाम और पदनाम या ᮧािधकृत परीᭃण कᱶ ᮤ के ᮧािधकृत पᮢ धारक के ह᭭ ताᭃर सडंक पᳯरवहन कायाᭅलय, जहां तैनात ह ै िजला रा᭔ य शासकᳱय मुहर ।''। [सं. आरटी-11028/15/2015-एमवीएल] अभय दामल,े संयुᲦ सिचव ᳯट᭡पण : मूल िनयम भारत के राजपᮢ, असाधारण, भाग II , खंड 3, उपखंड (i) मᱶ अिधसूचना सं. सा.का.िन. 590(अ), तारीख 2 जून, 1989 ᳇ारा ᮧकािशत ᳰकए गए थे और अंितम संशोधन सा.का.िन. सं. 1034(अ), तारीख 02.11.2016 ᳇ारा ᳰकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 28th November, 2016 G.S.R. 1096(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 951(E), dated the 8th December, 2015 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the said Gazette notification were made available to the public on the 8th December, 2015;
AND WHEREAS, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] NOW, THEREFORE, in exercise of the powers conferred by clause (n) of section 64 read with section 56 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —
1. (1) These rules may be called the Central Motor Vehicles (21st Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the principal rules), in rule 62,-
(a) in sub-rule (1),-
(i) in the first proviso, for the words “after the Inspecting Officer”, by the words “after an Inspecting Officer” shall be substituted;
(ii) after the second proviso, the following proviso shall be inserted, namely:- “Provided also that if the tests specified in the Table under the first proviso are conducted by an Inspecting Officer or authorised testing station in a State/ Union Territory other than the State/ Union Territory where the vehicle is registered, the Inspecting Officer who conducted the tests shall, on the same day or on the following working day, upload his inspection report in Form 38A at the portal http://parivahan.gov.in/vahan and also send the inspection report signed under his hand and seal to the registering authority by speed post for issue of certificate of fitness by the registering authority within fifteen days from the date of the inspection report, if the vehicle is found by the Inspecting Officer to be in compliance with the provisions of the Act and rules and a copy shall be given to the driver of the vehicle:
Provided also that the next fitness certificate is obtained from the inspecting officer or an authorised testing station in the State/ Union Territory of the registering authority where the vehicle is registered.”;
(iii) in the Explanation, for the words “appointed by the State Government” the words “appointed by a State Government” shall be substituted;
(b) after sub-rule (2), the following sub-rule shall be inserted, namely:- “(3) The fee for testing of a vehicle when tested by an Inspecting Officer or authorised testing station, other than the Inspecting Officer in the office of the registering authority, shall be as specified in rule 81.”.
3. In rule 81 of the principal rules, in the Table, after the serial number 11 and the entries related thereto, the following serial number and entries shall be inserted, namely:-

Conducting test of a vehicle by an Inspecting Officer or Authorized testing station other than the Inspecting Officer in the office of the registering authority for grant or renewal of certificate of fitness by the registering authority Motorcycle Three wheeled or light motor vehicle or quadricycle Medium or heavy motor vehicle Manual: Two hundred rupees Automated: Four hundred rupees Manual : Four hundred rupees Automated: Six hundred rupees Manual: Six hundred rupees Automated: One thousand rupees 62(2)”;

4. After Form 38 of the principal rules, the following Form shall be inserted, namely:- “FORM 38A [See rule 62(1)] Report of inspection conducted on a transport vehicle by an Inspecting Officer or authorised testing station, other than the Inspecting Officer in the office of the registering authority Vehicle bearing registration number ………………………….. has been inspected by the undersigned today and it is certified that it complies with the provisions of the Motor Vehicles Act, 1988 (59 of 1988) and the Central Motor Vehicles Rules, 1989 and is fit for issue of a Fitness Certificate by the registering authority.
This report will be uploaded at the portal http://parivahan.gov.in/vahan and the inspection report signed under my hand and seal will be sent to the registering authority by speed post either today or on the next working day for processing the application for issue of certificate of fitness in respect of the vehicle by the registering authority.
