उ< त अिधसूचना वाल ेराजप3 क( ितयां, तारीख 24 जलुाई, 2014 को उपल? ध करा दी गई थी ;
और उ< त ा!प िनयम= क( बाबत जनता स े ाC त आ+पे= और सुझाव= पर, क� ीय सरकार Hारा िवचार कर िलया गया ह ै;
अत:, अब, क� ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क( धारा 110 Hारा दJ त शि< तय= का योग करते Kए, क� ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए िन� निलिखत िनयम बनाती ह,ै अथा2त ्:--
1. (1) इन िनयम= का संि+N नाम केO ीय मोटर यान (17वां संशोधन) िनयम, 2014 ह ै।
(2) इन िनयम= म� िविनQदR ट !प से अO यथा उपबंिधत के िसवाय, ये िनयम उनके राजप3 म� अंितम काशन क( काशन क( तारीख को वृT ह=गे। 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2. केO ीय मोटर यान िनयम, 1989 (िजसे इसम� इसके पV चात् मूल िनयम कहा गया ह)ै म�, िनयम 47 म� उपिनयम (2) के पV चात् िन� निलिखत उपिनयम अंत:W थािपत �कया जाएगा, अथा2त् :- "(3) 1 जनवरी, 2015 से ही J येक यान िनमा2ता !प 20, !प 22 और !प 22क के अनुसार यान के ? यौर= को https://www.vahan.nic.in/makermodel/ पोट2ल पर अपलोड करेगा ।"।
3. मूल िनयम= के िनयम 49 को िनयम 49 के उप िनयम (1) के !प म� सं6 यां�कत �कया जाएगा और इस कार सं6 यां�कत उप िनयम (1) के पV चात् िन� निलिखत उप िनयम अंत:W थािपत �कया जाएगा, अथा2त् :- "(2) J येक रिजW [ीकरण ािधकारी �कसी यान के िजसके अंतग2त कृिष [े< टर, पावर /टलर और संिनमा2ण उपW कर यान भी हB के रिजW [ीकरण के पV चात् यान के रिजW [ीकरण ? यौर= को https://www.vahan.nic.in/makermodel/ पोट2ल पर अपलोड करेगा:
परंतु मोटर यान= के रिजW [ीकरण के िलए पोट2ल के मा] यम से ऐसी आंकड़ा िविR ट संW करण 1 फरवरी, 2015 से भावी होगी:
परंतु यह और �क रा_ य सरकार� िव`मान रिजW [ीकरण �aया क( पbित को 1 अ< तूबर, 2015 तक जारी रख सक� गी । " ।
4. मूल िनयम= के िनयम 126ख के पV चात् िन� निलिखत िनयम अंत:W थािपत �कया जाएगा, अथा2त् :- "126ग. इस अिधसूचना के अंितम काशन क( तारीख से ही, िनयम 126 म� िविनQदR ट जांच अिभकरण केO ीय सरकार Hारा अिधकिथत �aया के अनुसार यान �कW म अनुमोदन के संबंध म� सूचना को https://www.vahan.nic.in/makermodel/ पोट2ल पर अपलोड कर�गी:
परंतु जांच अिभकरण 1 जनवरी, 2013 से 17 नव� बर, 2014, तक क( अविध के िलए (वह तारीख िविनQदR ट कर�, िजसको यह अिधसचूना काशन के िलए भजेी गई ह)ै �कW म अनमुोदन के िलगसेी डाटा क( िविR ट भी करेगी । " । [फा. सं. आरटी-11036/48/2014-एमवीएल] संजय बंदोपा] याय, संयुc सिचव �ट�पण�ट�पण�ट�पण�ट�पण :::: मूल िनयम भारत के राजप3 म� सा.का.िन. सं. 590(अ), तारीख 2 जून,1989 Hारा कािशत �कए गए थे और अंितम संशोधन सा.का.िन. स.ं 709(अ), तारीख 8 अ< तूबर, 2014 Hारा �कया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 17th November, 2014.
G.S.R. 810(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published as required under sub-section (1) of Section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide Notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 533(E), dated the 24th July, 2014 in the Gazette of India, Part II, section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of forty-five days from the date on which copies of the Gazette containing the said draft rules were made available to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 24th July, 2014;
And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by Section 110 of Motor Vehicles Act, 1988 (59 of 1988) the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3
1. (1) These rules may be called the Central Motor Vehicles (7th Amendment) Rules, 2014.
(2) Save as otherwise specifically provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules) in rule 47, after sub-rule (2) the following sub-rule shall be inserted, namely:- “(3) On and from the 1st January, 2015, every vehicle manufacturer shall, in accordance with Form 20, Form 22 and Form 22-A, upload the vehicle details in the portal https://www.vahan.nic.in/makermodel/”.
3. Rule 49 of the principal rules shall be numbered as sub-rule (1) of rule 49 and after sub-rule (1) as so numbered, the following sub-rule shall be inserted, namely:- “(2) Every registering authority shall after registration of a vehicle, including agricultural tractor, power tiller and construction equipment vehicles, upload the registration details of the vehicle on the portal https://www.vahan.nic.in/makermodel/:
Provided that such data entry processing through the portal for registration of motor vehicles shall be effective from the 1st February, 2015:
Provided further that the State Governments may continue the practice of existing registration procedure till the 1st October, 2015.”.
4. After rule 126 B of the principal rules, the following rule shall be inserted, namely,- “126C. On and from the date of final publication of this notification, the testing agencies specified in rule 126 shall, in accordance with the procedure laid down by the Central Government, upload information regarding vehicle type approval on the portal https://www.vahan.nic.in/makermodel/ :
Provided that the test agencies shall also enter the legacy data of type approvals for the period from the 1st January, 2013 till the .” [F. No. RT-11036/48/204-MVL] SANJAY BANDOPADHYAYA, Jt. Secy.
Note : The principal rules were published in the Gazette of India vide number G.S.R. 590(E), dated the 2nd June, 1989 and last amended vide number G.S.R. 709(E) dated the 8th October, 2014.
