/4-771-7 [ 3-117 3(i)] 1T11-ff 1TWT4 : alTITETRuf 3 MINISTRY OF MINORITY AFFAIRS NOTIFICATION New Delhi, the 25th September, 2014 G.S.R. 693(E).—In exercise of the powers conferred by sub-sections (1) and (2) of Section 12 of the Waqf Act 1995 (43 of 1995), the Central Government hereby makes the following rules further to amend the Central Wald Council Rules, 1998, namely:—
1. (1) These Rules may be called the Central Wakf Council (Amendment) Rules, 2014.
(2) They shall pone into force on the date of their publication in the Official Gazette.
2. In the Central Wakf Council Rules, 1998 (hereinafter referred to as the said rules), in rule 1, in sub-rule (1), for the word "WAKF", the word "WAQF" shall be substituted.
3. Throughout the said rules and in the Appendix attached thereto, for the word "wakf", wherever it occurs, the word "waqf' shall be substituted and such other consequential amendments as the rules of grammer may require shall also be made.
4. In rule 4 of the said rules,-
(i) in sub-rule (1), for the words "five years from the date on which he assumed such office", the words "three years from the date of constitution of the Council" shall be substituted;
(ii) after sub-rule (1), the following proviso shall be inserted, namely:- 'Provided that if a member is appointed subsequent to the date of constitution of tne Council, he shall hold office only for the remainder of the term, for which the Council has been constituted.";
(iii)'after sub-rule (3), the following sub-rule shall be inserted, namely:- "(4) A Member shall cease to be a Member if he ceases to hold the office on the basis of which he was appointed as Member under any of the sub-clauses specified under clause (b) of sub-section (2) of section 9 of the Act.";
5. In rule 7 of the said rules, after sub-rule (5), the following sub-rule shall be inserted, namely:- "(6) The Secretary shall cause the annual statement of accounts duly audited by the auditor, to be placed before the Council for approval and adoption of the Council, together with his observations and replies of the Council thereto."
6. In rule 8 of the said rules,-
(i) in sub-rule (1), for the words "two" and "five", the words "four" and "six" shall respectively be substituted;
(ii) in sub-rule (4), for the words "one month's", the figures and word "15 days" shall be substituted.
7. In rule 9 of the said rules, in, sub-rule (1), after the words "at least ten days in advance", the following words shall be inserted, namely:— "for the ordinary meeting and two days in advance for the extraordinary meeting."
8. In rule 11 of the said rules, in sub-rule (2),-
(a) under the heading Travelling Allowance,
(i) in clause (a),- (A)for sub-clause (i), the following sub-clause shall be substituted, namely:- "(I) One standard air fare (Economy Class)";
(B) sub-clause (ii) shall be omitted;
(ii) in clause (b), sub-clause (ii) shall be omitted.
(iii) in Note. - I, the words "in addition to the incidental expenses," occurring at the end, shall be omitted;
(iv) in Note III, for the words "rupees eight per Kilometre", the words "rupees twenty per kilometre or actual fare, whichever is less, subject to maximum claim of up to 50 kilometre for local travel." shall be substituted;
(b) under the heading Daily Allowance, in clause (a), for the words "rupees five hundred per day", the words "upto rupees five thousand for hotel or guest house accommodation," shall be substituted.
9. In rule 15 of the said rules, for sub-rule (1), the following sub-rule shall be substituted, namely:- 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3' "( 1) Subject to the provisions made in the budget in this regard and the instructions of the Government of India relating thereto,-
(a) The Chairperson may sanction a recurring expenditure up to Rs. 50,000 (Rupees fifty thousand only) and a non-recurring expenditure up to Rs. 2,00,000 (Rupees two lakh only) per annum in each case.
(b) The Secretary may sanction a recurring expenditure up to Rs.20,000 (Rupees twenty thousand only) and a non-recurring expenditure up to Rs. 40,000 (Rupees forty thousand only) per annum in each case."
10. In rule 17 of the said rules, for sub-rule (2), the following sub-rule shall be substituted, namely:- "(2) The Secretary shall have the power to sanction expenditure up to Rs. 10,000 (Rupees ten thousand only) for arranging refreshment such as high tea, lunch, dinner, etc., for members and invitees of the Council or its Committees during the meetings."
