Extraordinary• •ide notification of the Government of the India in the Ministry of Environment, Forest and Climate Change vide number $.0. 2045(E). dared 27 July 201S. inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from date on which copies of the Gazette containing the said notification were made available to the public;

(\!ll"i II-~ 3(ii) ] 13 j\'OW, TH EIt EFOI{E. in exerc ise of the powers conferred by sub-section ( l), clause (v) and clause [xiv ) of sub-secno n (2) and sub-section (3) of secti on 3 of the Environment (Protec tion) Act, 1986 (29 of 1986) read with sub­ rule (3) of rule 5 of the Environment (Protect ion) Rules, 1986, the Central Government hereby notifies an area 10 an extent varying from 80 to 125mt' ters from the boundary of die City Bird Sanctuar y Union terr itory Chandigarh as the City Bird Sanctuary Bee-sensitive Zone (hereinafter referred to as the Eco.sensinve Zone), details of wh ich arc as under, mundy;_ I. Ext.:ul antI buund aric s of Ec.....scns fttv e 7,(J II l' (i) The Eco-scnsitive Zone varies from 80 10 125 meters from the City Bird Sanctuary comprising an area of 12.0 hectares approximately. The boundary description of the g co-seesuive Zone is appended as A uueaure 1_

(ii) The Ecc-sensinve Zone is bounded by 3if43'43.5"N lat itude and 76°46· S8. 1" E longitude towards East (Point No. I of Annexure I map); 30· 43'43.4 ~~ latitude and 76°46'35 .9~E longitude towards west (Point ?-OO. A of Annexure I ma.,); 30"43'5 2.4"N latitude and 76°46 '50.2"E longitude towards north (Point No. G of Annexure I map) and 30"43' ) 4,J"N latitude and 76°46'42.9~E longitude towards sou th (Point No. L of Annexure I map) .

(iii) TIle map o f z co-sensntve Zone boundary together with its latitude and longitude is appended as Anne xure II.

(iv) The coordinates cf'Eco-senstnve Zone w ith its latitudes and longit udes are appended as Annexure III.

Il\ I.a tcr PI..n fur Ec....sensfrive Zc ne., (I) The Un ion territory Government shall, for the purpose ofthe Fcc-sensitive Zone prepare, a Zonal Master Plan, within a period of two years fru m the date of publ icat ion of final Mtji:(~tivn in the Dfflc ial Gaze tte, in consultation with loca l peop le and adheri ng to the stipulations given in this noti fication.

(Z) The said PIOlIl shall be approved by the Competent Au thority in the State Government.

(3) The sa id Plan shall be prepared by the Union territory Government for the Eco-sensuive ZOne in such mann er as is spec ified in this notification and also in consonance with the relevant Cen tral and Union terri tory Government taws and the guidelines issued by th e Central Governmen t, if any.

(-I) The sa id Plan shall be prepared in consultation with all concerned State Depa rtments, namel y:­ ( i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Maa icipal;

(vi) Revenue;

(vii) Agriculture;

(i,,) Chandigarh Pollution Control Com mittee.

[x] Irrigation; and

(xi) Public Works Department, for integra ting environmenta l and ecologica l cons iderations into it. . .

(6) The said plan shall provide for restcrarion of denuded areas, ~l1$e~a(ion of ~ xistir:g water ~Ies, managemen t of catchment areas, watershed management, groundwater management, soli and rnorsrure conservation, needs. of local community and such other aspects of the ecology and environme nt that need attention. .

(i ) The said Plan shall demarcate all the e"" isting worshipping places. village and urban settlemen ts. typ es anJ kinds of forests. agric ultural areas. fertile lands. green area, such as, parks and like pl aces . horticultural areas , orchards. lakes and other water bodies.

(8) The said Plan shall regulate deve lopm ent in Eco-sensitive Zone so as to ensure Eca- friendly development and livelihood security o f local communities.

Provided further that no use of tribal land sha ll be permitted for commercial and industrial development act ivities wi thout the prior ap proval of the Sta te Gov ernment and without compl iance of the prov isions of article 244 of the Constitution or the law for the lime being in force. including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of2007):

Provided also tha t any err or appearing in the land records with in me Eco- sensinve Zone shall be- corr ected by the Union territory Ijovemmenr, afte r obtaining the views of the Monitoring Committ ee, onc e in each case and the correction of sai d error sha ll be intimated to the Central Gove rnm ent in the Minist ry of Envi ronment. Provided also thai the above cor recu on of error shall nor incl ude change of land use in any case except as prov ided under this sub-paragraph;

Provided also that mere shal l be no consequent ial reduction in green area, such as forest area and a gricultural area and effort s sha ll be made to reforest the unused or unprodu ctive agricultura l areas .

Forest and Cli mate Cha nge (as ame nded from time to time) w ith em phasis on eco-rourism. eco-education and eco-developmenr;

(ii) New construction of hote ls and resorts shall not be per mitted within the Ecc-sensirive Zone;

(i ii) Till the Zonal Staster Plan is appr oved, development for tourism and ex pansion of exis ting tourism activities shall be permit ted by the concerned regul atory authorities based on the actual site speci fic sc rutin y and recommendation of the: Monitoring Commin«.

(6) Nclse IlUlJul ioll .- Cbandigarh Po llution Control Committee sha ll imple ment the re~ulations .for control ~f noise poll ution in the Eco-scnsirive Zone in accordance with the provisions stipula ted of the NOIse Pollution (Regulation An d Control ) Rules, 2000 undcr the Environment (Protection) Act, 1986 .

F) Air poll lltiulI.- Chandig arh Pollution Cont rol Commillee shall imple ment sta nda rds and .regulations for the contr~l of air pollution in the Ecc-sensuive Zo ne in acc ordance with the pro vis ions of the Air (Prevention and Control of Pollution) Act. 198 1 ( 14 of 198 J) and the rule made ther eun der.

( ~~ ) I l i.~ c h ;, r:: c uf l'n1 UCUts.• The discharge of treated effluent in Eco- sensuive Zone shall be in accordan~e with the provis ions of the Gene ral Standar ds for Discharge of Environmental Pollutants covered unde r the Environmental ( protection) Act, 1986 and rule s ma de thereunder.

(9) S<"llid wastes, - Disposa l of solid was tes shall be as under:- [ ~1"l 1I -@'6 J (ii)] 15 [ i} the solid waste dispo sal in Ecc- sensitive Zone shall be carried out in acco rda nce with the provistons of the Sol id Wa&tc Managl"ment Rules. 2016 published by the Government of India in the Ministry of Environment. Forest and Climate Change vide notification number 5.0. I J57 ( E). dated the 8'" April. 20 16 as amended from time to time;

(Ii ) TI~ local authorities shall draw up plans for the segregation of solid wastes intobioJegradable and non­ bio..lt'grailal.ole components;

(iii) The biudegraJ3ble material shall be rec ycled prefe rab ly through composting or vermicul ture;

(iv) The inorganic material may be disposed in an environmentally acceptable manner at site (s) identified outside the Ecc-sensinve Zone and no burning or incineration of solid wastes shall be permined in the Eco-seesitive Zone .

(10) Rio-m ed ica l wa ste .• The bio-medical waste disposal in the Ecc- sensiuve Zone shall be carried out in a..-ccrdance with the provision s o f the Bio-Medical Waste Management Rules, 2016 published by the Government of I" J ia in the Minist ry of Environ ment, Forest and Climate Change vide notification number G.S.R J4J (E), dated the 28do l\hrrh. 2016.:c; amended from time to nme.

(4) The activiuc e tha t are not covered in the: Schedule 10 the notification of the Government of India in the erstwh ile Ministry of En vironment and Forests number S.O. 1533(E), dated the 14'" September, 2006 an d are falling in the Eco­ sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Comm ittee based on the actual site-specific cond itions and referred to the concerned Regu latory Authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Conservator Forest (WL) shall be competent to file complaints under section 19 of the Environment (Protection) Act. 1986 (29 of 1986) against any person who conm venes the provisions of this notification.

(Il) Tl.e Monitoring Comm ittee may invite represe ntatives or expe rts from concerned Departments, represenau-..es from Industry Associat ions or co ncerned stakeholders to assist in its deli berations de pe nding on the requirements on issue 10 is-a-c basis.

(R) The Central Government in the Ministry of Environment, Forest and Climate Change may give such dir ection s. as it deems fit, 10 the Monitori ng Committee for effect ive discharge of its functions.
