1. Tille - These bye-laws may be called the Chandigarh (Control and Regulation of Hedges and Fences) Bye-laws, 1971.
2. Definitions - I.n these bye-laws unless the context otherwise requires:- ..',
(a) "Hedge" means a close row of living bushes or small trees serving as a fence.
(b) "Licensing Officer" means the officer appointed as such by the Chief Administrator for granting licence under these bye-laws. .
(c) "Road junction" means a place where two roads cross each other.
(d) "V1, V2, V3 and V4 roads" means the roads specified as such in the Zoning Plan of any area of the Chandigarh City.
3. No occupier or owner of a residential building shall erect or re-erect hedges on the Government land (adjoining his residential building) unless he has obtained a licence under these bye-laws from the Licensing Officer.
4. Every application for grant of .licence shall be made to the Licensing Officer in Form "A" appended to these bye-laws. and shall accompany the follOWing documents.
(a) a site plan showing the boundaries of the plot adjacent to and in front of which the hedge is intended to be erected or re-erected and precise situation of the plot in re.lation to the street buildings or land adjoining il and the width of the adjoining streets.
(b) detailed drawings of the area proposed to be enclosed by the hedge along with its dimensions etc.
(c) a specification des~ribing the area proposed to be enclosed by the hedge in detail.
5. A licence in erect or re-erecl hedges shall be granted in Form "B" appended to these bye-laws.
6. The maximum area to be enclosed by any hedge shall be specified in the licence granted for its erection or re-erection, by the Licensing Officer keeping in view the Scanned by CamScanner -............

the area to be enclosed by the hedge shall be open at all times to the inspection of the Chief Administrator or any officer dUly authorized by him in this behalf, and the liclmces, if so required, produce the licence for the inspection of such officer.
the license shall have no right, time or interest in, on or over the land allowed to be enclosed by the hedge.
the hedge shall be kept properly trimmed at all times by the licensee.
8. No permission shall be granted for erecting or re-erecting hedges in front of residential buildings adjoinIng V1, V2, V3 and V4 roads or road junctions.
9. A licence granted under these bye-laws may be cancelled by an order in writing by the Licensing Officer for a breach of any of Ihe conditions of licences or any of the provisions of the bye-laws.
Provided that no licence shall be cancelled, unless an opportunity has been given to the licensee to explain his case.
10. For tile purpose of proper planning and development of Chandigarh the Chief Administrator may, by written order, reqt;ire any licence to remove the hedge within a specified period not exceeding thirty day and if the order is not complied with, the Chief Administrator shall be competent to remove the hedge at tile expense of the licensee.
11. (iii) The area enclosed by the hedge shall not be used for any other purpose except for growing grass or for planting offlowers.
(iv) No fence shall be erected or re-erected alongwith the hedge.
(v) the height of the hedge and of the flowering plants grown in the area enclosed by the hedge shall not exceed two feet.
(vi) The area allowed to be enclosed by the hedge shall be kept in· a good sanitary condition to the satisfaction of the Chief Administrator.

After brief discussion the following resolution was passed SUbject Updating of Hedges and unanimously:- Fences Byelaws.
The Hedges & Fences Bye-Laws E....- ..... which are being followed in Chandigarh for giving permission to house owners for erection of hedges were discussed in the Environment & city Beautification Committee on 11.6.99. Copy of Bye-laws is placed at Annexure-'F'. The committee discussed all the provisions of the Byelaws and decided to amend the provision 7 (i) which is as follows:- "Considered and resolved that the following amendment in Sub Clause No.(i} of Clause No.7 of the Chandigarh (Control and Regulation of Hedges and Fences) Bye Laws 1971 is hereby recommended for consideration by the Chief Administrator, Chandigarh:- The hedge shall be erected or reerected six feet away from the nearest kerb line of the adjoining V-6 road or roads subject to other conditions of the '·The hedge shall be erected or reerected ten feet away from the nearest kerb line of the adjoining road or roads.
The Committee recommended that Bye-laws.
It was further decided that a license fee of Rs.25/- per 100 square feet, per year shall be charged for giving permission for erecting hedges in the permissible area.
