And whereas, object ions and suggestions we re received from all persons and stakeholders in respon se to t~ dnt ft notification have been duly cons idered by the Ce ntra l Government :
And ..... hereas, the Sukhna Wildlife Sa nctuary in the Union territory of Chandigarh sh ares the boundary with two other Stales viz Punjab and Harya na and Sukh na Wild life Sanc tuary falls in the Shival ik Hills which are ecologically senshiv e and geolo gically unstable and Ihus arc high ly prone 10 soil erosion duri ng rains and th e lot .al .area of Sukhna WiHl irc: S.l1c t ua ry is 25.98~9 squar e ki loIDflrtS(6~20.99 aern ).
And whereas, due to its ecolog ical, faunal, floral, geo-mo rphological. natural and geo logical significance for the purpose of protecting, propagating and developing wildlife and its en vironment, Ihis area was declared as Wildlife Sanctuary vue Chandigarh Adminis tration not ification No. 694.HII(4)..9&14519, dated the 6· March, 1998.
And whereas. as pe r Wildli fe Cen sus, carried out unde r the guidance of Wildlife Institute of India, during 2010, two species of Schedule s T and II and three spec ies of Sche du le 111 and man y species of Schedu le [V of Wildlife (Protection) Act. 1972 (5] of 1972), wen: repor ted in Sukhna Wildlife Sanc tuary; among prom inent spec ies present in the Sukhna Wildlife Sanctuary ere-Leopar (Pom herCl sp.). Sambar (Ruso sp.), Indtan Pangolin (Manis sp.), Golden Jackal (Canis). Grey Langur (Semnopithecus sp.) , Wild Boar (Sus sp.), Red Jungle Fowl (Gallus sp.), Ind ian Peafowl (Pallo sp.), Chital (Axis sp.}, Go lden Oriole (Ortotus sp.), Cobra (Op hiophagus sp.) , Russell ' s Viper (Daboia sp.), Indian Python (Python sp.}, etc. apart from this a ..... ide variety cf buuerfl ies (more than 70 species) and oeher insec ts are found in abundance.
And whereas, it is necessary 10 conserve and protect the area, the extent and boundaries of which are speci fied in paragraph I of this nctificancn, around tile protected area of the Sukhna Wildlife Sanctuary as Eco-sensuive Zone from C'l:ol0i:ical and environmental point of view and 10 proh ibit industncs Of class of i ndu~tries and their operations and prec esses in Ihe said Eco-sensuive Zone ;
Now, therefore, in exerciseof the powers conferred by sub-sec tion ( I ), clause (v) and clause [xiv ) of sub-sect ion (Z) and sub-section (]) of Section 3 of the Envi ron men t (Prolection) Act. 1986 (29 of 1986) read with sub-rule (]) of rule 5 of the Environment (Protection ) Rules , 1986, the Ce ntral Govern ment hereb y notifies an area of 1050 hectares, to .an eatent \'Ir~ ing fr om 2.0 kil(lmdrf 5 10 2.7S kilomet res fr om rhe boundar), or th e Sukh na \\'Hdli r~ Sane luat)' in the Union territory of Chandigarh on the sid e of Chandigarh as t he Su khna \\ii ldli fe Sanct ua ry Eco-sen sitf ve Zone (here inafter referred to as the Eco-sensiu ve Zone), de tails of which are as unde r. namely' - I. El ko t an d boundaries of u o- 'lensithe Zone.- (I) The extent of Eco-seusuiv e Zone varies from 2.0 kilometres to 2.75 kilometres from the boundary of the Su khna W ildlife Sanctuary in the Union territor)' of Chan digarh;
lhe Union territory Adm inistra tion of Chandigarh has divided the Eco-sensitive Zone in rwc zone s i. e.• Zone-l and zone II and The: eAlent of Zone -l is uplo 0.5 km of from the boundary of the Sukhna Wildlife Sanctuary and me balance area shall be in Zone-It and this has been done with the purpo se of having stricter norms in zone-l for protect ion of wildlife habitat; the atca of Eco-scnsinvc Zone is [050.0 hectares (on the side of Unio n territory ofChandigar h).

(S) There an: three villages falling within the Eco-sensitive Zone name ly, Khuda Alisher, Kishangar h and Kaimbwala.

2. Zona l Mut~r Plan for Eco-sensltive ZO Il ~,- (I) The Union territory ofChandigarh shall, for the purpose of the ECG-sensitive Zone prepare, 11 Zonal Master PllUl , within a period of two years from the dale of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this nocification.
(2) The Zonal Master Plan shall be approved by the Competent Authority in the Union territory Government,
(3) The Zonal Maste r Plan for the Eco-sensiuve Zone shall be prepared by the Union territory Government in such manner as is specified in this notification and also in consonance with the Centra l and Union terri tory laws and the guidelines issued by the Central Government, if any.
(4) The said Plan shall be prepared in consultation with all Union territory Governm ent Departments, namelyt-
(i) Environment;
(ii) Forest;
(iii) Urban Development;
(iv) Tourism;
(v) Municipal ;
(vi) Revenue;
(vii) Agriculture;
(viii) ChanJigarh Pollution Control Committee;
[ix) Irrigation: and
(x) Public Works Department, for intcgrating environmental and ecological considerations into it.
(5) The Zonal Master Plan shall not impose any restrict ion on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastruc ture and activities 10 be more effic ient and ceo-friendly.
(6) The Zonal Master plan shall provide the deta ils for resorauon of denuded areas, conservation of exi sting water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and suc h other aspects of the ecology and environment [hat need attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban seulements. types and kinds of forests, agricultura l areas, fertile lands, green area, such as, parks and like places, hort icultural areas, orchards, lakes and other water bodies.
(S) The Zonal ~l asler Pian shall regu late development in Eco-sensinve Zone sc as to ensure Et a-fri endly developmen t and livelihood sec urity of local communities.
3. ~Iea~urn to be tak en b) Union territ or)' Go\'ernment.- The Union territ ory Government shall take the following measures for giving effect to the provisions of this notificat ion, namely> ( I) I. ::l n d u ~ c .- Forests, hort iculture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-scnsitive Zone shall not be used or conve rted into areas for commercial Of industrial related development activities:
Provided that thc conversion of agricultural lands within the Eco-sensiuv e Zone may be permitted on the recommendation of the Moni toring Committee, and with the prior appr oval of the Union territor y Government. to meet the residential needs of local residents, and for the acti vities listed against serial numbers 21, 23, 29 and 34 in column (2) of the Table in paragraph 4, namely-
(i) ecc- friendly couages for temporary occupation of tourists such as tents, wood en houses, for ceo-fri endly tourism activities;
(ii) small scale industries nol causing pollution;
(iii) rainwater harvesting: and (h') cottage industries including village artisans :

Provided further that no use of tribal land shall be penn ined for commercial and industrial development activities without the prio r approval of the Union territory Government and without compliance of the provisions of art icle 244 of the Constitution or the law for the time being in force, including the Sched uled Tribes and other Traditional Forest Dweller; (Recogn ition of Forest Rights) Act, 2006 (2 0( 2007);

(3) Touri~nl.- (a) The activity rela ting to tourism within the Ecc-sensirive Zone shall be as per Tourism Master Plan• ...hich shalt be pan of the zcnat Master Plan.
(Ill The Tourism Master Plan shall be prepared by the Department of Tourism, Union territory Government of CI,,,nJ ig.lfh in consultation with Department of Revenue and Forests, Government of Union territory of Chandigarh.

(7) .\ ir pollution .- Chandigam Pollution Control Commiuee shan implement standards and regu lat ions for the control of air pollutio n in the Eco- sensitive Zone in accordance with the provision. of the Air (Prevention and Control of I'ullution)Art, I'J81 ( 1-1 of 1981) and the rule made thereunder.
(II) Di-char gl' uf effluents.c-- The discharge of treared effluent in Eco-sensitive Zone shall be in accordance with th~ provislous of the General Standards for Discharge of Environmenlal Pollutants covered under the Environmental (Prol.e~ tion) Act, 1986 and rules made thereunder.
(9) Solid " lUlU . · Disposal of solid wastes shall be as unde r:-
(i) the solid waste disposa l in Eco-scnsinve Zone shall be carried out in accordance with the provisions of the Solid Waste Managemcnt Rules, 20 16 published by the Government of India in the Ministry of Environment , Forest and Climate Change I'ide notificatio n number S.O. 1357(E), dated the 8'" April 20 16 as amended from time to time;

( IO) RhJ-mcdita! wa.tc.- The bio-medical waste disposal in the Eco-sensinv e ZoIlCshall be carri ed out in accordance with the provisions of the Rio-Medical Wasle Management R ules, 20 16 publisbed by the Gov ernme nt of Intlia in the Mini>try of Environment, Forest and Cli mate Change vide not ification number G.S,R 343(E), dated the 28· March, 201 6, ,l~ ame nded from lime to time.

{5 1 The Member-Secretary o f the Monitoring Committee or the concerned Deputy Conservator Forest (WL) shall be competent to file complaints under section 19 of the Environment (Protection) Act. 1986 (29 of 19&6) against any person who contravenes the provisions of this notification.
(6) TIle Mon itoring Committee may invite represent atives or experts from concerned Departmen ts.

(10) The MonitoringCcmrmuee shall submit the annua l action taken report of its activities as on 31- March of ev ery year by 30" June of that year to the Chief Wiid Life Warden of the Union territory per proforma appended at Annn.urt' IV.
The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, 10 the Monitoring Committee for effective discharge ofits functions.
The Central Government and the Union territory Government may speci fy additional measures, if any. for giving effect to provisions of this notification.
The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon'ble Supreme Court ofI ndia or the High COUlt or National Green Tribunal.
