5. Responsibmty of public safely will lie with Contractor/agency during establishment or post establishment of Mast, Pole and laying of cable, during its maintenance or other related activities. The contractor/agency shall take all necessary safety steps and measures While executing the work and they will indemnify the MCC against any ~ccldent and damage caused to life or property during.

6. ,he contractor/agency or any 3'd party will not be allowed to display any advertisement on the Mast and Pole without permission of MCC.

7. In case of any damage to the essential Municipal SeNices i.e. water supply, sewerage system and telecommunication lines, electricity supply etc, it will be the responsibility of the contractor/agency to inform MCC within 24 hours. In case of failure of non-reporting, then the Bank Guarantee will be immediately forfeited. If the actual amollnt of damage is more than the amount of Bank Guarantee then, the same shall be recovered from the agency.

8. The permission will be granted by MCC within a pe,iod of 2 weeks SUbject to the application being complete with route details and fulfillment of all terms and condition as per guidelines.

g. An agreement will be executed between the contractor/agency and MCC regarding compliance of all terms and condition.

10. Contractor/agency will give a notice of 15 days with route details prior to trenching for fresh or maintenance/repair works. A separate Performance Bank Guarantee for maintenance/repair work will be furnished by the contractor/agency.

11.ln case of any dispute between the contractor/agency and MCC, the Commissioner, Municipal Corporation, Chandigarh will be the final authority for settlement of such dispute and such dedsion will be binding on both the parties.

12. For construction of RCC manhole, the structure will be designed as per the norms of Indian Road Congress. The agency will be responsible for maintenance and upkeep of the manholes from time to time. If any manhole comes in the way of approved alignment of any proposed water supply, sewerage of any other seNice, the agency will be bound to shift or remove the manhole/cable and make changes at its own cost.

" , ::, , ,, , , OFFICE ORDER ) "\ OFFICE OF COMMISSIONER, MUNICIPAL CORPORATION, CkANDIGAR---1 The Commissioner, Municipal Corporation, Chandigarh is pleased to accord the approval of the Guidelines regarding laying of City Gas Distribution Network (CGDN) & determination of charges, as approved by the Finance and Contract Committee in ils 284~ meeting held on 26.6.2018., This policy is hereby approved to implement the guidelines in the city Chandigarh. The main features of these guidelines will be as under:

1, Applicability/Eligibility The guidelines would be applicable to Municipal Corporation, Chandigarh which is approached for grant of NOC/Approvals/Clearance by the licensees who have been awarded ~I!!••."f'~ the work of laying of gas pipetines network'- '" ,2., 1.1 Any authorized lic~sees of Petroleum and Natural Gas Regulatory Board is eligible to seek/avail RoW facility/permission. However, enforceability of the permission so granted shall be restricted to the extent of provisions/scope of service contained/defined in the license agreement of that licensee and for the purpose for which it is granted subject to compliance of the terms and conditions fixed by Government of India or any Competent Authority from time to time.

1.2 The responsibility to obtain No Objection Certificate from various Department and Authority, other than the M.C., Chd as and when required shall be of the applicant licensee.

3. Conditions Precedent Licensee will carry out Ground Penetrating Radar (GPR) survey along the route plan where the CGDN is to be laid for detection of existing utilities. The date of utilities collected througll GPR survey would be unconditionally shared with relevant Authority free of cost.

Permission granted to the application licensee will not be transferable and will be valid only for the period lor which licensee has been granted.

Municipal Corporation, Chandigarh shal! not be responsible for any damages/claims towards laying of gas pipelines and resullant losses, if any, during the execution of the work course of official duty by any of their employees. .

2.1.1. For obtaining RoW facility/permissions the licensee will submit Common Application form (CAF) or application in the prescribed format along with a locality wise GIS map in the appropriate file format with detail description of location, route plan, relevant detait of the land with property ownership on which gas pipeline are to be laid, work plan (area wise and time, wise) and methodology to be used for laying for the gas pipeline Le. Horizontal Direction21 Dealing (HOD) technology or open trenching or both and processing fee, will be submitted along with the application.

2.1.2 Information regarding the depth and length of trench, dimensions (length, width, depth) of land (cross section) required for laying gas pipeline or any other details/ specification required by the relevant Authority will also be provided.

2.1.3 The appticant shall submit prescribed number of hard copies of the application along with a soft copy.

2.1.4 This policy is being framed for giving NOCs/Approvals/Clearance for laying Gas Pipeline•. For installing CNG Station, Storage Facilities, Pumping Station etc. The licensee shall separately obtain NOC f<om the district administration / M.C. after following the procedure.

4.1 If the damaged essential services are not restored within 24 hours then the cost of restoration incurred by the department shall be recovered at the rates of 1.5 times the actual cost incurred by the department along with 15% supervision charges from the licensee.

Fee/Charges For laying of gas pipelines, the Restoration charges, Annual rent and Security deposit shall be taken as under:

(i) the Bank Guarantee shall be release after a period of one year of completion of the work to the satisfaction of the concerned authority (iI) Road cut calculation will be based on minimum width of 0.5m.

(iii) In case HOD (Horizontal Directional Drilling) method is used, the charges will be 50% para 4.1 column 3 Restoration and Rehabilitation Licenses will have two options as regards to restoration & rehabilitation. The restoration work can be carried out by the licensees themselves o.r they can get this work done through the Municipal Corporation, Chandigarh.

In case, licensees choose to carry out the restoration & rehabilitation work themselves, they would submit "Performance Bank Guarantee" equal to 50% of the amount as described in para

4.1 column 3 against the restoration cnarges and rehabilitate the site I infrastructure to its original condition at their own cost as per the drawings and specifications approved by the Municipal Corporation, Chandigarh. Gas Distributors shall complete the work of laying gas pipelines including restoration & rehabilitation thereon within permitted period and methodology as allowed by the Department while issuing NOCs I Approvalsl clearances. Needless to mention. the work would be carried out under the supervision of Municipal Corporation.

Chandigarh to its satisfaction for which licensee shall also deposit the departmental supervision charges @ 15% of total restoration charges. The licensee shall be responsible for the estoration and rehabilitation works dunng the defect liability period which shall be one year.

~nspections shall be carried out by respective wing of Municipal Corporation within the defect liability period and in case any defecV damage IS observed, the same shall be rectified by the licensee at its own cost.

In the alternative licensee can deposit restoration & rehabilitation charges as described in Para

4.4 4.1 column 3 and the work would be done through MUniCipal Corporation, Chandigarh.

5.2 The site or surface of roadl streets will be restored to its original position by the licensee in case they exercise as per Para 4.3 at their own cost as per the drawings and specifications approved by the Municipal Corporation, Chandigarh under the supervision of the Municipal Corporation authorities to its satisfaction. In case the licensee fails to do so, the Performance bank Guarantee will be forfeited and the said work will be executed by the Municipal Corporation, Chandigarh at the cost of the licensee.

5.3 Licensee will give a notice of 15 days with route details prior to trenching for maintenance I repair works of the already laidl existing pipelines.

5.4 The licensee shall abide by all the safety standards and measures as highlighted by the Petroleum and Natural Gas Regulatory Boardl Competent Authority as per terms and conditions of NOC I Approvals I Clearances.

5.5 Work should be executed phase wise without interrupting the traffic. Prior permission from the district administration for traffic management shall have to be obtained by the licensee.

5.6 The licensee shall give and advertisement in the newspapers having local circulation along with displaying notice at site before starting the work.

5.7 The licensee shall be solely responsible for any accident or damage due to its act, omissions or negligence.

6. Restrictions

6.1 Permission for RoW for laying of CGDN may be denied at location where it may cause disruptions in services and facilities.

6.2 Gas pipeline would be laid at the edge I as near as possible to the edge of available land width.

However, if for some reasons it is not possible to lay gas pipelines at the edgel as near as possible to the edge of available land width and if the safety standards permit, pipelines can be allowed to be laid under the carriage way. In case of canals and drains, RoU for laying gas pipelines, unless permitted otherwise will be invariably near the edge of land boundary.

6.3 It shall be ensured that the earth cutting is minimum and trenchless technology is used to the extent possible.

6.4 In case any shifting I alteration I encasing of pipeline is required due to widening of road I construction of road or any other structure (Flyover I bridge etc.), the same shall be done by the licensee at its own cost within specified period fixed by concerned department.

7. Other conditions ".1 The guidelines cover permission of Right of Use of way for laying CGDN. It shall not be applied to other facilities of the project such as CNG Station, Storage Facilities, Pumping Station etc.

The provisions of the Master Plan should be adhered to while granting sanction for the installation of CNG station, Gas Storage facilities, Gas Pumping Stations etc.

7.2 In case of any dispute between the licensee and Municipal Corporation, Commissioner, Municipal Corporation. Chandigarh will be final authority for settlement of such dispute and such decision will be binding on both the parities.

7.3 In case of any discrepancy in the interpretation of the guidelines the decision of the Commissioner, M.C. shall be final.

7.4 These guidelines shall be applicable from the date of approval with perspective effect.

' OFFICE ORDER NO. ~6' DATED: 20/1)12.0/.20 In partial modification of office order no. 120 dated 21.08.2018, the following guidelines regarding laying of City Gas Distribution Network(CGDN) and determination of charges are hereby amende"d/added in public inter~st:- The minimum validity of road cut permission for laying Gas Pipe shall be three month for more as per the site condition as per request of the applicant.

If monsoon falls within the validity period then the same shall be adjusted and extended accordingly so as to avoid to apply for extension of validity.

The time period as per case submitted shall be considered with time limit involvement, so that the permission shall be granted within one month from the date of receipt of application.

4. The permission for residual connection shall be granted at the level of concerned Executive Engineer.
