(ii) MlNI/lTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 30th April, 1998.
S.0.360(E).-Whereas under Sub-section (I) ofSection 72 ofthe Punjab Reorganisation Act, 1966 (31 of 1966), read with sub-section (3)thereof, the Board constituted under the Sikh Gurdwaras Act, 1925 (Punjab Act of 1925) shall, on and from the 1st day of November, 1966, continue to fun~tion and operate in those areas in respect of which it was functioning and operating immediately before that day, subject to such directions as may, from time to time, be ~sued by the Central Government until other provision is made by law in respect of the said Board; . .~ And, whereas, under sub-section (2) of the said section 72, any such direction may include a direction that any Jaw by which the said Board is governed shall, in its application to that Board, have effect, subject to such exceptions and may be specified in the direction;
Now, therefore, in exercise of the powers conferred by sub-section (I) read with sub-sections (2) and (3) of the said section 72, the Central Government hereby directs that the Sikh Gurdwaras Act, 1925 (Punjab Act 8 of 1925) shall have effect, as from the date of the issue of this notification, subject to the following further modifications, namely:-
1. In Section 47-A of the Sikh Gurdwaras Act, 1925,-
(i) in the heading, for the words "ofthe Board", the words "of the Board and ofCommittees" shall be substituted;
(ii) in sub-section (I), for the words "of the Board", the words" of the Board and of Committees" shall be substituted;
(iii) in sub-section (3), for the words "of the Board", the worlis "of the Board and of Committees" shall be substituted.
2. In section 88, in sub-section (3), for the words "and nominated shall notify," the words "and nominated the Chief Commissioner when in existence, otherwise the State Government shall notify" shall be substituted.
3. lIr'the Sikh Gurilwara Committee Election Rules, 1959,-.
in Rule 4, in sub-rules (I) and (3), for the words "the Commissioner, Gurdwara Election", the words "the Chief Commissioner when in existence otherwise the Commissioner, Gurdwara Elections" shall be substituted; .
in rule 6 for the words "the State Government", the words "the Chief Commissioner, Gurdwara Elec tions, when in existence, otherwise the State Government" shall be substituted.
4. This notification shall come into force on the date of its pJlblication in the Official Gazette.
