( l ) Any person who cuts, girdles, prunes or otherwise damages any specif ied trees standing on the holding belonging to the Aboriginal Tribes, or removes any part thereof, in contravention of the provisions of this Act or the rules made thereunder, shal l , 5 on convict ion be l iable to r igorous imprisonment which may extend to three years and f ine which may extend to ten thousand rupees.
(2) Wood of any specif ied trees consti tut ing the basis of act ion under sub-sect ion (1) shal l be seized and stand forfei ted to the State:
Provided that i f conspiracy, fraud and deception is played on the Bhumiswami, the sale proceeds of the wood, so forfei ted shal l be given to the extent of f i fty per cent, to Bhumiswami subject to a maximum l imit of Rupees Fif ty Thousand under the order of Col lector, after disposal of the cr iminal case.
(3) Any Government servant or any other person who acts with malaf ide intent ion in contravention of any of the provisions of this Act or rules made thereunder or passes an order or submits an incorrect report as provided under the rules or contravenes the express provisions of law or does not submit any report within a period of two months from the date of f i rst communicat ion shal l on convict ion be punishable with r igorous imprisonment which may extend to three years and f ine which may extend to ten thousand rupees.
(4) Without prejudice to the proceedings or punishment under subsection
(3) the said Government servant shal l also be l iable for discipl inary act ion under the service rules appl icable to him.
