(tP-n1+1•1Cf) Raipur, the 14th January 2015 NOTIFICATION 138 (19) No. F-8-126/35/2015/47.- In exercise of the powers conferred by sub-section (1) of Section 20 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No 28 of 2006), the State Government, hereby, makes the following rules relating to Agricultural cattle preservation, namely:- RULES
1. Short title and commencement.- (1) These rules may be called the Chhattisgarh Agricultural Cattle Preservation Rules, 2014.
(2) It shall come into force from the date of its publication in the Official Gazette.
2. Definitions. - (1) In this rules, unless the context otherwise requires,-
(a) "Act" means the Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No. 28 of 2006);
(b) "Competent Authority" means at State Level, the Registrar, the Chhattisgarh Go-Seva Ayog and at District Level, Joint Director/Deputy Director who have been authorized by the State Government;
(c) "Institution" means such charitable institutions, which is engaged in Agricultural cattle welfare and which has been established for the purpose of keeping, breeding and maintaining Agricultural cattle or the purpose of reception, protection, care, management and treatment of infirm, aged and disease cattle or for seizing Agricultural cattle during useful or un-useful or illegal transportation, and includes Gosadan, Goshala, Pinjrapole, Gorakshan Sansthan and their Federation or union, which are registered under any Act for the time being in force;
(d) "Local Officer" means the Joint Director/ Deputy Director, Government of Chhattisgarh, Veterinary Services/Veterinary Assistant Surgeon (Registered with the Veterinary Council), who are officers working in Division/District /Development Block Level/ Sub-Inspector Police / Inspector Police/ Tehsildar / Naib Tehsildar / Commissioner, Municipal Corporation / Chief Municipal Officer /Panchayat Officer and Agricultural Cattle Welfare Officer.
(2) Words and expressions used herein but not defined shall have the same meaning as respectively assigned to them in the Act.
3. Issuance of Inter-State Transportation license under clause (h) of Section 2 of the Act.- (1) Any person, which includes transporter, who for the purpose of agriculture, dairy, improvement of breeding or for participation in Cattle fair and for similar purpose, which is different from the purpose of slaughtering, and who wants to transport from one State to another State through Chhattisgarh or from Chhattisgarh to other State or from other State to Chhattisgarh by any medium shall after deposition of fee of Rs 5000/- shall apply for license in Form- l(Part-1) to the concerned District Collector or any other officer authorized by him. The registration fee shall be paid in the favour of the concerned District Collector by way of demand draft through any nationalized bank, which shall not be refundable.
(2) All license issued shall be compulsorily reviewed every month by the District Collector. The license issued shall be for one place at a time. License shall clearly describe number of Cattle, type, validity period and way of transportation including medium.

(3) Any person applying for transportation license for within any District or Inter District of State of Chhattisgarh or Inter-State shall have to enclose compulsorily Cattle Health Certificate in Form - 1 (Part - II) of the Agricultural cattle to be transported, which has been issued by Veterinary Assistant Surgeon of Government Veterinary Hospital near to the place of sales /purchase. The provisions relating to the Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No.28 of 2006) and the Prevention of Cruelty to Animal Act, 1960 (No. 59 of 1960) and other related Acts and Rules shall be (endorsed) mentioned on the back of license and compliance of the same shall be mandatory for the License holder.
(4) Collector or any officer authorized by him for verification of the particulars of application in Form - 1, (Part-I) may conduct such investigation which he consider necessary. After such investigation if the collector is satisfied that the details in the application and the enclosed documents are correct than he shall issue Transportation License in Form - 2 within a period of two weeks from the date of receiving of application or he may, by order, reject the application by recording reasons for such rejection of application and shall also record information of rejection in the Government Register.
(5) Any person, who wants the license under sub-rule (2) and wh o is aggrieved by the order of the concerned District Collector, then h e may file application for_revision within 30 days from the date of receipt of order before the Divisional Commissioner. The Divisional Commissioner may call for and examine the record for the purpose of satisfying himself as to the correctness, legality or propriety of any order passed by the Collector or others and may pass such order which he consider appropriate and justified. The order passed by the Divisional Commissioner shall be final and no appeal shall lie to any Court.
Explanation : (a) Each herd of Agricultural cattle shall not contain more tha n 25 Cattles at the time of transportation on foot. (b) If the transporter is a farmer or cow foster, then it shall be necessary for him to produce a copy of Voter ID card or Aadhaar Card or Job Card of MNREGA as his identity proof for the purpose of sale/purchase of the Agricultural cattle. A concerned farmer or cow foster shall not transport more than five Agricultural cattle at a time.
(c) It shall be necessary to ensure nutritional food /fodder, drinking water and appropriate rest during the transportation of Agricultural cattle in any circumstance. Transportation on foot of Cattle shall be prohibited before sunrise and after sunset from July to February and from 11.00 noon to 5.00 after noon from March to June. After drinking of water, 20 minutes rest shall be given before starting of transportation on foot of each Agricultural cattle and in the case of fodder one hour rest shall be given before starting transportation on foot.
(d) Any Agricultural Cattle shall not be transported on foot in case of heavy rain, storm, famine or muggy.
(e) While transporting through railway or any other vehicle, minimum space of two square meter per cattle shall be ensured as a protection from stampede, etc. Pregnant cows and buffaloes shall not be transported with other animals.
(f) There should be sufficient facility of air in vehicle during transportation of Agricultural cattle. Transporting Agricultural cattle in completely closed vehicle shall be a punishable offence.
(g) Health certificate of the Agricultural cattle issued from the Veterinary Assistant Surgeon shall be required by the seller or purchaser prior to sales/ purchase of the Agricultural cattle in any Gram Panchayat /Nagar Panchayat area or Cattle market/fair of the State of Chhattisgarh.
(6) The joint team of local Veterinary Assistant Surgeon, Police Sub-Inspector/ Inspector, Naib Tahsildar /Tahsildar and Chief Municipal Officer /Nagar Panchayat Officer shall regularly inspect the cattle market/fair in order to ensure that healthy cattle/ cattle suitable for agriculture are being sold/purchase for Agricultural purpose and not for the purpose of slaughtering and shall submit the inspection report in Form -1 (Part -III) to the Collector through the Joint Director/ Deputy Director, District in-charge of veterinary services.
(7) It shall be necessary to comply with the provisions of the Prevention and Control of Infectious and Contagious Diseases in Animal Act, 2009 (No. 27 of 2009) while transporting Agricultural cattle.
4. Registration of cattle trader under sub-section ti) of Section 2 of the Act. - ( 1) Any person, who trades in more than five Catties at a time, shall have to compulsorily register as Cattle Trader in the office of the District Collector of his domicile district. Application for registration shall be submitted in Form-3 (Part -I) along with registration fee of Rs. 3000. It shall be mandatory for the person doing Inter-State trade of Agricultural cattle to apply for registration in the office of concerned District Collector for registration as Cattle Trader. The Registration Certificate for Inter-State cattle trade shall be issued in Form-3 (Part-II) for 3 years. Renewal of registration shall be done for a maximum period of 3 years on payment of fee of Rs. 1000 per annum.

(2) The registration fee, shall be paid by crossed demand draft in the favour of concerned District Collector through nationalized bank and which shall not be refundable.
(3) The concerned District Collector, for verification of the particulars of application in Form-3 (Part-I) may conduct such investigation which on his own satisfaction he deems necessary. After inquiry, if the concerned District Collector is satisfied with the correctness of details given in the application and enclosed documents he shall issue the registration certificate in Form-3 (Part-II) and Identity Card in Form-3 (Part-III) within a period of two months from the date of submission of the application by the applicant or he may by order reject the application by recording reasons for such rejection and shall record such information in the Government register.
(4) It shall be mandatory for the Cattle Trader to carry Identity Card during trading in the Cattle market /fair.
5 . Appointment of Agricultural Cattle Welfare Officer. - (1) Assistant Veterinary Medica l Field Officer of the Veterinary Development Department shall also act as Agricultural Cattle Welfare Officer. Also any Government or Non-Government person, who is working for the welfare of Agricultural cattle, protection and development may apply for appointment as Agricultural Cattle Welfare Officer in Form-4 (Part-I). Applicant shall also submit affidavit along with the application in Form -4 (Part -II). The Registrar / Joint Director /Deputy Director, as it deems necessary, may verify the correctness of the information furnished in such application. Before the appointment of Non-Government person as Agricultural Cattle Welfare Officer, it is necessary to obtain character certificate of the applicant issued by the superintendent of police of concerned district. It shall be mandatory for the Superintendent of Police to forward the desire character certificate to the Registrar, Chhattisgarh Go-Seva Ayog within 20 days.
(2) If the Registrar, Chhattisgarh Go-Seva Ayog /Joint Director / Deputy Director is satisfied that the information furnished in the application and enclosed document are correct and if the character certificate issued by Superintendent of Police is proper, then th e Registrar shall appoint the applicant as Agricultural Cattle Welfare Officer in Form -5 and shall a lso issue identity card and record all the particular in the register.
(3) The Agricultural Cattle Welfare Officer shall be appointed for the period of two years. The person appointed as Agricultural Cattle Welfare Officer shall have to submit work detail under Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No. 28 of 2006), of every six month in Form-6 to the Registrar, Chhattisgarh Go-Seva Ayog/ Joint Director/ Deputy Director. In case, if he does not submit said records for consequently two six months in the prescribed Form then his appointment as Agricultural Cattle Welfare Officer shall be cancelled by the Registrar, the Chhattisgarh Go-Seva Ayog /Joint Director/ Deputy Director.
(4) Renewal of appointment as Agricultural Cattle Welfare Officer shall be done by the Registrar/Joint Registrar/Sub-Registrar for two years, after review of the information, produced in specified Form-6 by such person who is working as Agricultural Cattle Welfare Officer in accordance with the Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No. 28 of 2006) as well as a fter re verification of character certificate of Non-Government person by the Superintendent of Police, if is found satisfactory.
6. Power of inspection and keep in custody under Section 13 of the Act.- (1) The Agricultural Cattle Welfare Officer shall have the right to enter and inspect area within its local jurisdiction, where he has reasons to believe that any crime has been committed or is being committed or may be committed, and shall also have powers to ta ke necessary action.

(2) Any Police Officer, who is not below the rank of Head Constable or any Competent Authority shall take the following actions in order to ensure the strict compliance of provisions of Section 4, 5 and 6 of the Chhattisgarh Agricultural Cattle Preservation Act, 2004 (No. 28 of 2006) or in order to satisfy himself that the above mentioned provisions are complied with, namely:-
(a) He shall be able to stop any vehicle, which is being used or is expected of being used for export of Agricultural cattle or its beef and shall also be able to enter and investigate it;
(b) Such Agricultural cattle, about which there is suspicion that any provision of Section 4, 5 and 6 is violated, is being violated or will be violated, shall seize along with the vehicle in which such Agricultural cattle or its beef was found or shall be able to authorize for its seizer and after this shall be able to make all the arrangements for producing its before the court and shall also ensure safe custody of thus acquired Agricultural cattle and vehicle till the pendency of the trial.
7. Confiscation by the District Magistrate.- The police is empowered to confiscate any vehicle, Agricultural cattle or its beef in case of any violation of Section 4,5 and 6 and the District Magistrate shall confiscate such vehicle, Agricultural cattle or its beef as per the provisions of Section 100 of Code of Criminal Procedure, 1973 (No. 2 of 1974) in following manner, namely: -
(a) He shall take possession of the vehicle;
(b) He may sent the Agricultural cattle or its beef into the custody of any organization or person registered with the Chhattisgarh Go-Seva Ayog; and
(c) The beef of Agricultural cattle shall be disposed of by the Pashudhan Vikas Vibhag in such manner as it deems fit.
8. Revision before the Session Court against order of the District Magistrate.- Any person aggrieved with the final order passed by the District Magistrate or any result of order, within thirty days of passing of such order may file an application for revision before such Sessions Court within whose jurisdiction, Office of the District Magistrate is situated.
Explanation. - The time requisite for obtaining certified copy of order of the District Magistrate shall be excluded while computing period of thirty days referred to in this sub-rule.
9 . Protection and maintenance of the Agricultural Cattle.- ( 1) The acquired, usable, non usable, disabled, old or diseased Agricultural cattle shall be kept in any institution which is established under any law for the time being in force for the purpose of their protection, management, breeding, treatment and nutrition.
Such institutions shall submit the detail monthly report of the acquired Agricultural cattle to the concerned court in Form-7.
(2) Expense for maintenance shall be payable in accordance with Chhattisgarh Go-Seva Ayog Rules, 2005.
10. Aid and grant to the institution.- (1) Such institution having more than one hundred acquired, usable, un-usable, disabled, old or diseased Agricultural cattle shall received aids / grants under various schemes of the State Governments / Central Government.
(2) Grants shall be given in accordance with clause (x-ee) of Section 44 of the Chattisgarh Krishi Upaj Mandi Adhiniyam, 1972 (No. 24 of 1973).

Handing over of impounded Agricultural cattle.- Such wandering Agricultural cattle, which are captured by employees of cattle pound and are not released or auctioned shall be handed over to the institution by the local authority.
Levy of charges.- The expenditure incurred in the maintenance and nourishing of Agricultural cattle by the institution shall be recovered from the owner of such Agricultural cattle in accordance with the Chhattisgarh Go-Seva Ayog Rules, 2005.
Economic Rehabilitation Scheme.- (1) The Local Authority of the Municipal Corporations, Municipalities, Nagar Panchayats and Gram Panchayats shall prepare a list in Form-8 of such persons, who are partially or fully affected by the provisions of the Act and shall display it on the notice-board of their respective office for inviting objections. The objections, if any, received, shall be disposed of by Competent Authority. Thereafter, a final list of affected persons shall be prepared and the affected person shall be informed.
(2) The Local Officer of the local body shall send the final list to the Collector of the district.
(3) After receiving the final list from the local body, the Collector of the district shall get it scrutinized and after certifying it in Form-9, he shall recommend, on the basis of demands of affected persons, various self-employment schemes of concerned corporation, Board and/ or Department of the State Government and a copy of such list shall be endorsed to the local officer for co-ordination.
(4) Such Department, Corporation and/or Board after completing necessary formalities shall make the funds available to the affected persons, either directly or through banks.
(5) Monthly monitoring of economic rehabilitation of the affected person shall be done by the Collector, for which the local officer shall act as coordinator.
(6) After coming into force of these rules, the affected persons shall get benefit of this economic rehabilitation scheme only once.

138 (29) AGRICULTURAL CATTLE PRESERVATION ACT, 2004 The Chhattisgarh State is first state of the country, where the Chhattisgarh Agricultural Cattle Preservation Act, 2004 has been enforced for complete prohibition against slaughtering of all cow generation and buffaloes generation like cow of all age, calves and infants of buffaloes, bull, bullocks, buffaloes.
• Section 4 of the Act prohibited slaughter of the Agricultural Cattle • Section 5 of the Act prohibited keeping the beef of the Agricultural Cattle.
• Section 6 of the Act prohibited transportation of cow generation for slaughter and also provide for seizer of vehicle used for cattle transportation for six months and seizer of cattle transported.
• Violation of any of the provisions of Section 4, 5 and 6 of the Act is punishable with seven year imprisonment or with fine of Rs 50,000 / - or with both.
• Under Section 11 of the Act, burden of proof is on the accused in case of violation of any provisions of the Act.
• Under Section 12 of the Act, offence has been made cognizable and non bailable.
THE PREVENTION OF CRUELTY TO ANIMALS ACT, 1960 Chapter 3 of this act prohibits cruelty towards animal.
