The Ancient Monuments & Archaeological Sites Remains Act 1958 (Amendment & Validation- 2010)State Act of Chhattisgarh · Act 24 of 1958

(1) The salaries and allowances payable to the whole-time Chairperson and whole-time members, and the other terms and conditions of their service or fees or allowances payable to the part­ time members, of the Authority shall be such as may be prescribed:

Provided that neither the salary and allowances nor the other terms and conditions of service of the whole-time Chairperson and whole­ time members shall be varied to their disadvantage after their appointment.

(2) The Authority shall regulate Its own procedure for the purposes of holding its meetings (including quorum of such meetings) and granting permissions under this Act.

(3) All the decisions of the Authority shall be published in such manner as it may decide and also on Its own website and on the website of the Central Government.

20-1. (1) The Authority shall exercise or discharge the following powers or functions, namely:-:-

(a) make recommendations to the Central Government for grading and classifying protected monuments and protected areas declared as of national Importance under sections 3 and 4, before the commencement of the Ancient Monuments and Archaeological Sites and Remains (Amendment and Valldatlon) Act, 2010;

(b) make recormmmdatiun& lo the Central Government for grading and classifying protected monuments and protected areas which may be declared after the commencement of the Ancient Monuments and Archaeological Sites and Remains (Amendment and Valldatlon) Act, 201 O_, as of national Importance under section 4;

(c) oversee the working of the competent authorities;

(d) to suggest measures for implementation of the provisions of the Act;

(e) to consider the Impact of large-scale developmental projects, including public projects and projects essential to the public which may be proposed In the regulated areas and make recommendations in respect thereof to the competent authority; '

(f) to make recommendations to the competent authority for grant of permission.

(2) The Authority shall, for the purpose of discharging functions under this Act, have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908 when trying a suit.' In respect of the following mattets, namely:- ··

(a) summoning and enforcing the attendance of any person and examining him on oath;

(b) requiring the discovery and production of documents; (c) any other matter which may be prescribed.
