65.4 (3) Raipur. the 23rd December 2911 NOTIFICATION . No. F-6-74n-3/2010.- In exercise of the powers conferred by sub-section (2) of Section 258 read with Section 172 of the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959), the State Government, hereby, makes"the following further amendment in the Chhattisgarh Diversion of Land Rules, 1962, namely :- AMENDMENT In the said rules.- •

1. In these Rules, for the words. "Sub-Divisional Officer" wherever they occur the words. ··competent Authl1- rity" shall be substituted.

2. After Rule I, the following shaJI be added, namely:- .. 2. Definitions.- In these rules. unless the context otherwise requires,- ( a) "Act" means the Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959);

(b) "Commercial purpose" means the use of any premises for any trade or commerce or business, which shal1 include a shop, commercial establishment, bank, office, guest house, hostel, restaurant, dhaba (whether permanent or temporary structure), show-room, cinema, multiplex, petrol pump, explosive magazine, weigh-bridge, godown, workshop or any other commercial activity and shalJ also include the use thereof partly for residential and partly for commercial purposes;

(c) "Competent Authority" means, an authority as specified in Section 172 of the Act and in the schedule appended to these rules;

(d) "Developer" means a person, who desires or undertakes sub-division. re-constitution or improvement of plots;

(e) .. District Valuation Committee" means the committee constituted by State Government for a district from time to time under rule 4( I) of Lhe Chhattisgarh Preparation and Revision ofMarketValueGuideline Rules, 2000, made undenhc Indian Stamp Act. 1899 (1 or IXlJ9l:

(f) "Industrial Areas/Industrial Estate" means an area of land developed by the Chhattisgarh Industrial Development and Investment Corporation or private investors, as the case may • be, for setting up an industry or industries including essential welfare and supporting services e.g. post office, residential colony (for employees) educational institutions, cold storage, pollution control treatment plani electric power station and water supply and sewerage facilities, dispensary or hospital, bank, police station, fire-fighting station, weigh-

(j) bridge; i "Industrial purpose" means the use of any premises for workshop or an open area for any industry including medium or large scale unit or a tourism unit and shall include a brick kiln or a kiln but shall not include any premises used for a purpose as defined in clause (b ); "Institutional purpose" means the use of any premises or an open area by any establish­ ment, organization or association for the promotion of some object specially of general utility, charitable, educational or like purposes except public utility purpose; "Medical facilities" shall include clinics. dispensaries, medical hospitals. diagnostic cen­ ters and nursing homes etc.; "Master Plan Area .. means the area covered by Ma~ter plan prepared and approved for any urban area in accordance with the provisions of the Chhattisg.arh Town and Counlf)' Phm ning Act. 1973 (No. 23 of 1973); ,·-;,_.· .. . ·; . ; [ --< - 73- . 654 (4)

(s) "Planning Area" means the area ~overed under_ Master1 Plan or Development Plan of a city or a town; 0 Personn means a human being and shall include a firm, registered society, association of persons, corporate body_ or any other legal person; "Public utility purpose" means dharamshala, religious place, gausha1a or public park; "Rural Area" means an area which is not included in the notified area or urban bodies and their periphery belts; • "Residential Unit" means use of any premises for dwelling of human beings not exceeding area of 1200 sq. meters; "Residential Colony/Project" means residential plots/flats/house being developed by de­ veloper to sale further to interested persons; ''Section" means Section of Chhattisgarh Land Revenue Code, 1959 (No. 20 of 1959); "Schedule" means a Schedule appended to these rules; "Urban Area" means an area as defined under Section 2(z-4) of the Act.

3. Rule 2 of the rules shall be renumbered as,­ "2-A."

4. After Rule 12. the following shall be added, namely:- "13. Transfer of Diverted Land.- Any land duly diverted for any non-agricultural purpose under these rules may be transferred without payment of diversion fee.

14. Land for which Diversion not to be permitted.- No permission shall be granted for diversion of the- ( 1) Land which is under acquisition under the Land Acquisition Act, 1894 ( 1 of 1894 );

(2) Land falling within the boundary limits of any Railway Line, National Highways, State High­ way or any other road maintained hy the Central or State Government or any local authority as specified in any Act or Rules of the Central or State Government made in this behalf, or within the limit specified in the guidelines of the Indian Road Congress for establishment of industry from the middle point of National Highway/State Highway/Major District Road/ Other District Road/Rural Roads, whichever is Jonger;

(3) Land falling within the radius of 1.5 Km. of outer limits of abadi of a village for the purpose of an industrial unit or lim~ kiln or u crusher Unit or an Industrial area. This restriction shall not apply where the diversion is sought for the brick kiln or non polluting industry, small or cottage industry;

( 4) Land falling under catchment areas of a tank or village pond, river, nala, tank, lake or land used as pathway to any cremation or burial ground or village pond, even if not so recorded in the village revenue map or revenue record;

(5) Land falling within the radius of 10 meter of boundaries of the right of way of underground pipeline of all companies;

(6) Land falling within the radius of 50 meters of boundaries of oil companies storage depots;

(7) Land or building restricted under provisions of Central Electricity Authority (Measures relat­ ing to Safety and Electric Supply) Regulations, 2010. · Uidtt'i~ ~, ~ 23 ~ 2011 . -7q- 654 (5)

15. E:viction for violation of nd~-A person using any land in contravention of rule 14 or uses any land which is not recorded as bis holding-for any non-agricultural purpose, shall be liable to eviction in accordance with Section 250 of the Act.

16. Interest.- Any person ,who fails to deposit the amount of diversion fee within the time specified by the competent authority shall be ~able to pay interest at the rate of 12% per annum from the expiry of such period. · ,

17. Diversion Fee/Penalty/Pa~nt of Interest.-Amount of Diversion Fee, Penalty, Payment ·of Inte­ rest shaJI be deposited in bank or treasury in the related revenue heads by way of challan." ......__
