1. Short title and commencement: (I) These rules may be c:.tlled the Chhattisgarh Legislative Assembly l\-lembers Family Pension Rules, 2006.
(2) These _1:ules shall be deemed to have come into force with effect· from 1 St'l. Fet,. 100S.
2. Definitio:ns: In these rules, unic~s the context othcr,vise requires:-
(a) "Act" mea.os·:h.: ChlrnHbgarh Vidh.rn Sabha SadsyH Vctan Bhatta Tatha Pension Adhinivam. 1971 (No.7 of 1973), . .
(b) fli_~onn" means form appended to these rules; /
(c) "Secretary 11 means the Secretary of the Chhattisgarh Legislative Asscmb!y an.d includes any nther officer of the Vidhan s~ibha as may be authorised by the speaker for the purposes of these rules.
3. Gl'ant of J:amily Pension:-(a) Every person, who is en ti tied lo pl..'nsion under Section 6-B of the Act shaii make an ap1)lication to the Secret~ry, in Form-A appended to these rutcs. The applkatimn-:!rnll be accompanied by three copies of the latest photograph and three specin1en signature duly aUestcd by a Gazetted Officer. . 292 (8)
(b) Every member shall submit nomin;ition/dedaration of the Family~ members/dependent in Form 'AA' who rirny be entitled.for Family Pension under section 6(b) of the Act. ,;;·
(c) Entitlement of Family Pension shall be as under:- Firstly: Spouse, Secondly: If spoirse not alive then son or unmarried daughter less .than age of twenty five years, Thirdly: If there is no ·living spouse or son or unmarried· d~t~ghti!·r uf Ic:;s t!;,1n tv.'enty fi_ye __ y(:ars of thv.; age then mother /fathc1: ot married daughter or widow/ divorced daugl1tcr till re-marriage, or upto the :,gl' of twf'nty fiv<' years fully rlep('ndent on ex-member having no other source of income.
(d) These rules shall be applkabk to the Family members of the Kx-member who died after the enforcement of the~c rules.

5. · Pension payment Order:-· (I) The Accountant General, Chhattisgarh shall on receipt of the sanction order, issue Pension Payment Order in Form-:-B to the Treasury Officer of the Treasury through which the pension is to be disbursed · under intimation to the applicant.
(2) Payment of pension by Treasury will be subject to the · · production of Certificate issued by a competent authority in Form-D.
Explanation:- For the purpose of this rule "the competent authority" shall he a First Class Magistrate or a Class-I Offi~er of the Central or State Government or a sitting Member of Parliament or Chhattisgarh Legislative Assembly or any other officer. referred to in rule-363 of lite Chlrniiis~arb Ticasury Code Vol.I. . ..._
