Short Name and Commencement :-

(I) These rules niay he called the ''Chhattisgarh Municipal Corporation (faection of Temporary Tower or Structure for Cellular Mohile Phone) Rules, 20 I 0.
(2) These rules shall come into force fn1m the date of its puhlication in the Offi6al Gazelle.
Defin_itions :- ln.thcsc rules, unless the con1ext otherwise requires:- ( I) "Act" means the Chh-atLisgarh Municipal Corporation Act. 1956 (No. 23 of I 95f1) and the Chha1tisgarh MinicipalitiesAct; 19M (No. 37 of 1961).
(2) "Applicant" means any applicant who as Chairman. Secretary. General Mai1agcr.or any other desig nation is an authorised representative of an institution pr a Company. ·intends to set up a tower/reh1y station in the Municipal area for the purpose of telecommunication. · (:,) "Commissioner" means the. Commissioner of a Municipal Corporation.
(4) "Chief Municipal (ificer" means the Chid Municipal Officer of a Municipal Council or Nagar Panchayat.
(5) "Competent Authority" mcans the Commissioner in the case of Municipal Corporation and Chief Mlmitipal Officer in the case of Municipal Council and Nagar Panchayat.
(6) "Format" means the format (s) annexed to these rules .. •
(7) "Government''. means the State Government.' , ·
(8) "Municipal Area!' means such territorial area as falls under the Municipal Corporation or the Municipal Council or·Nagar Panchayat Limits: .
. . (9) "Municipal_ity" means thc Municipal Corporation or the Municipal Council or Nagar Panchaydt.

(10) ( I I) "Occupant" means 1h1~ nwnur of uny land or hu1lding.
"Permit'' means any permit or.consent to he.granted or granted in consonance with and under.these rules.
( 12) "Pulice Place" means any place which is not a private property and which is open for use hy the puhlic irrespective of whethcr such plm:e hclongs to the Municipality or not.
( 13) "Tower" means any temporary tower/structure erected for the ccllular phone telccommunication system.
Extent and Applicability :- These rules shall he in force in all Municipal Co~porations, Municipal Co.t.incils and Nagar Panchayats in the Stale of Chhattisgarh.

4. An applicant desirous or erecting a tower or renewal thereof shall submit to the Municipal< lffice an applica tion in Format- I. attaching thereto the following documcnts :--

(I) Consent of the owner or the·huilding and the agrecmL·nt with him.
(2) Receipt showing evidence of having paid the Permit Fee/Renewal Fee as prescribed hY. these Rulcs.
(3) In case the tower is proposed to he erected on a vacant land. consent or the owner ~if the land and the agreement with him.
(4)
(5) Relcvant drawing or the building and the tower for erection or the tower and certificate regarding structural safety and stability from a qualified structural engineer from any or the following institu tions:- a. National Institute or Technology, Raipur.
h. Certificate from any Government Enginecrin_g College. No other certificate shall he accepted.

(6) Indemnity Bond clearly staling that the applicant will he solely responsible for any loss or damage c,1uscd rn: consequences rlowing fro111 any civil or criminal proceedings.
(7) Wherever ncce~sary, ihc scr, ice provider mLhl \lhtain and produce No-Oh_jcclion Ct.::rtilicatc (NOC) from the Air Tral'lic Controller or 1he Airporis .'\uthority ol' lndi,1. Likewise in case or erecting towers near ancient/historical buildings. NOC ohta1ncd from the Archaeological Department must he allachcd.
(8) In case the tower is_ proposed to he erected within a radial distance or I()() mclcrs from sensitive building like Manlralaya. Vidhan Sabha, Chief Mini.,tcr's Rcsidrnce. High Court and District Court a NOC from the relevant department will have lo he oht.1incd and attached.
( I J A red signal light must he set atop every tower/relay station and a lightening conductor must hc installed for every tower/relay station.
(2) Adequate arrangements must he made to prevent fire acci_dcnls.
{3) The air and noise pollution caused hy the generator sd ne~1r the tower must conforn'! to lhe-ruirms of Chhallisgarh State Environment Conservation Board.

Receipt showing evidence of having paid the permit Fee/Renewal Fee as prescribed by these Rules.
In case the tower is proposed to be erected on a vacant land, consent of the owner .of the land and the agreement with him. .
Relevant drawing of the building and the tower for erection of the to.ver and certificate regarding structural safety and satability from a qualified structural engineer from any of the following institutions :- a. National Institute' of Technology, Raipur.
b. Certificate from any Government Engineering College. No other certificate shall be accepted.
In case the tower is in the proximity to a High Tension Power Line, the precise distance must be clearly mentioned .
Indemnity Bond clearly stating that the applicant will be solely responsible for any loss or dainage caused or consequences flowing from any civil or criminal proceedings.
Wh"rever necessary, the service provider must obtain and produce No-Objection Certificate (NOC) from the Air Traffic Controller of the Airports Authority of Indi~. Likewise in case of erecting towers near ancient/ historical buildings, NOC obtained from the Archaeological Department must be attached.
8. In case the tower is proposed to be erected within a radial distance of Chief Minister's Residence, High Court, a NOC from the relevant department will have t;) be obtained and attached.
