Naya Raipur, the2 lst November 20l7 NOTIFICATION No. F 3-25/2014/Home-l I. - In exercise oftbe powers conferred by Section 50 of the Chhattisgarh Police Act, 2007 (No. 13 of2007), the State Government, hereby, makes the following rules relating to duties and responsibilities of the Anti-Terrorist Squad for effective control over the extreme threat of terrorism in the State, namely :- RULES
1. Short title, extent and commencement.-
(a) These rules may be called the Chhattisgarh Anti-Terrorist Squad Rules, 2017.
(b) It shall extend to the whole State ofChhattisgarh.
(c) These rules shall come into force from the date of their publication in the Official Gazette.
2. Definition .- Words and expressions used herein but not defined shall have the same meaning as respectively assigned to them in the Chhattisgarh Police Act, 2007 (No. 13 of2007).
3. Duties and Responsibilities.- The main responsibility of the Anti-Terrorist Squad is surveillance over acts of terrorism, to control them and to neutralize the terrorist activities in the State. The scope of Anti-Terrorist Squad 1054 (2) ifo·flwl~ ~ . ~ 1~2017 relating to Intelligence gathering, strategy and investigation, etc. are as follows,-
(a) Collating Intelligence.- The Anti-Terrorist Squad shall collate intelligence regarding active terrorists in any part of Chhattisgarh and neutralize them by framing specialised strategy.
(b) Coordination and Information Sharing.- The Anti-Terrorist Squad shall coordinate and share information with the Special Branch and other units of the state, other states and Central intelligence agencies like the Intelligence Bureau (lB) and the Research and Analysis Wing (RAW).
(c) Surveillance.- The Anti-Terrorist Squad shall engage sources and agents to keep survei llance on terrorist groups, their supporters or sympathizers and such elements, which propagate radicalization and spread terrorism, by changing opinion and with object to collect information about them.
(d) Nodal Agency for Organised Crime.- The Anti-Terrorist Squad shall act as nodal agency to address the problem of organized crime in the State.
(e) Suppression of crime aiding terrorist organisations.- The Anti-Terrorist Squad, in coordination with other states and central organizations, shall identify criminal elements in the field of following organized crime, and shall try to neutralize them, namely :- i. Circulation of fake/counterfeit currency, ii. Robbery, iii. Hawala, iv. Smuggling of arms, ammunition, explosives and other dangerous elements, v. Frauds relating to issues of citizenship, passport and visa, v1. Cyber Crime, vii. Narcotics, viii. Extortion, and ix. Illegal trade in human Organs.
(f) Scrutiny of media.-AII the open sources of information like newspapers, television, internet and reports of various government departments shall be regularly scrutinized and evaluated.
(g) Setting up of Specialised Teams.-The Additional Director General (Intelligence) shall set up well-trained specialized teams for professional work like urban warfare, close combat, hostage, rescue, etc. These teams will be imparted training in weapons handling, Improvised Explosive Devices (IEDs), demining, etc. by professional trainers. At any time, upon receiving any intelligence of terrorists or their activities in any part of the State follow-up action with an appropriate strategy may be carried out by the abovementioned special teams under the supervision and control of senior officers.
(h) Cyber Crime.- Personnel skilled in technical know-how shall be selected to work in the information technology environment. Instruments for electronic surveillance, infrastructure for investigation of information received with the help of computers and latest software etc. shall be used by Anti-Terrorist Squad.
(i) Immediate Action.-Anti-Terrorist Squad shall investigate a ll crimes related to terrorist activities automatically.
G) Seditious offences.- Investigation of offences done by anti-national elements shall be carried out by the Anti-Terrorist Squad on the orders of the Director General of Police or Competent Court.

4. Investigation into crimes aiding terrorist organisations.- During investigation of any organized crime like engaging in bank robbery, circulation of Counterfeited Indian currency notes, hawala, smuggling of automatic weapons and explosives, creation of fake passports and visas for foreigners, narcotics trade, extortion and other organized crime, if any linkage with terrorism is found, Anti-Terrorist Squad shall take cognizance of such offences on the orders of the Director General of Police or Competent Court.
5. Immediate communication of the terrorist activity.- In the event of any terrorist activity in jurisdiction ofany police station, it shall be necessary for the concerned unit of the police station to communicate immediately to the Anti-Terrorist Squad. The officials from the respective unit shall continue to discharge their legal respons ibilities until the Anti-Terrorist Squad registers the case for further investigation.
6. Power to supervise Investigation .- The powers to supervise the investigation in the cases shall lie with the Additional Director General of Police (Intelligence), who shall form investigative teams in appropriate numbers, determine the number of technical and supervisory officers requuired during investigation, and shall pass the final order once the investigation is complete.
7. Laws Applicable.- Anti-Terrorist Squad shall carry out the investigation and prosecution related work of cases under its jurisdiction as per the provisions of the Code of Criminal Procedure, 1973 (No. 2 of 1974):
Provided that, procedure relating to investigation and prosecution shall also be carried out as per the provisions of various Special Acts like the Unlawful Activities Prevention Act, 1967 (No. 37 of 1967) and the Narcotic Drugs and Psychotropic Substances Act, 1985 (No. 61 of 1985), as the case may be.
8. Interpretation and application.- The interpretation and application of the provisions of these rules shall be made by the State Government and/or the Director General of Police, Chhattisgarh in accordance with the Chhattisgarh Police Manual, the Chhattisgarh Police Act, 2007 (No. 13 of2007), various anti-terrorism laws in force,judgements and decisions of the Supreme Court and High Court, sconstitutional arrangements and/or agreement between the State Government and the Central Government or International treaties signed by the Central Government in context of terrorism.
9. Amendment.- Amendments may be proposed to the rules from t ime to time in accordance with changes in the organizational structure of the Anti-Terrorist Squad or the applicable laws.
