2017.

(2) It shall come into force from the date of publication in the Gazette.

I. The amount received by the Home Department for Road Safety Fund from the assets received at the time of formation of the state of Chhattisgarh shall be called Road Safety Fund.

2. 100 percent amount of compounding fee levied by Police department under. MY Act shall be deposited into the Road Safety Fund.

3. The Police department shall not deposit and any amount in the fund d irectly and shall deposit the amount as per existing process under appropriate head. Thereafter each year the amount equivalent to 100 percent amount deposited in the previous financial year shall be transferred from the Consolidated Fund of the State into the said Fund established under the Public Account.

4. If any financial grant is made into the Fund by the Government of India or Government of Chhattisgarh, it shall also be deposited in this Fund.

The decision on proposal for use of the Fund shall be made by the Fund Management Committee.

The amount deposited in the Fund shall be used for road safety related works which include the following :- (I) Take all necessary steps for safe operation of road users and vehicles on all NH, SH and Urban roads.

(2) Take measures for prevention of road accidents, collection and appropriate analysis of data.

(3) Give information about traffic rules and create awareness in general public regarding these.

(4) Make arrangement of equipments for enforcement and control of road accidents.

(5) Take necessary steps to make traffic smooth and safe. Procurement and maintenance of traffic equipments.

(6) Procurement and maintenance of different types of vehicles, telecommunication equipments, CCTV etc for control of traffic.

(7) Any other IT based or mechanical work/solution related to road safety as deemed appropriate by the Committee.

(8) Organize publicity, training programs and seminars, workshop etc for awareness about safe traffic for general public, vehicle drivers and police officers and staffs etc of different levels.

(9) Reimburse the expenditure incurred on bringing to hospitals the persons injured in road accidents.

(10) Arrange ambulances and other equipments for providing quick medical assistance to persons injured in road accidents.

(11) Take measures to improve/ rectify the causes of road accidents after study and identify and rectify accident prone spots.

( 12) Make necessary arrangements for strengthening driving license system.

(I 3) Make suitable arrangements in transport offices for testing fitness of commercial vehicles.

Unless otherwise expected in any reference, in these rules :- • Fund means Chhattisgarh Road Safety Fund.

• Act means MV Act 1988 • State means State ofChhattisgarh.

(1) The entire amount collected by Police department through compromising fee under MV Act 1988 under head 0041- tax on vehicle 800- other receipts 0761-compounding fee I 03- receipt under fine. 0301- amount collected by transport department 0302- Amount collected by police department (Traffic police/Civil police).

(2) Financial grants received from Government of Chhattisgarh or Government of lndia.

Such works as permissible under these rules can be done in entire Chhattisgarh.

(1) The Home Department shall be the administrative department for this Fund and this Fund shall be managed by the Committee constituted as under :-

(i) Director Genei:al of Police, Chhattisgarh- Chairman

(ii) Additional Director General of Police (Traffic), Police Headquarter, Chhattisgarh-Secretary

(iii) Additional Transport Commissioner, Chhattisgarh- Joint Secretary

(iv) Assistant inspector General (Traffic), Police Headquarter, Chhattisgarh-Member

(vi) Director, Public Health Services, Chhattisgarh- Member

(vii) Director, School Education Services, Chhattisgarh-Member

(viii) Director, Urban Development Authority, Chhattisgarh-Member

(ix) Director, Higher Education, Chhattisgarh- Member (I) The Committee shall select and approve the projects funded by this Fund.

(2) The Committee shall monitor the physical and financial progress of the approved projects.

(3) The Committee shall ensure maintenance of account of the Fund as per rules.

The conditions for the projects funded by the Fund shall be as under :­ (I) The selection of the projects shall be in accordance with the standard prescribed from the time to time by state or central government

(2) Only such projects/ plans shall be funded from the fund that can be completed in only one time.

(3) Salary of the general personnel of the road safety cell and the establishment/office expenditure shall be made from the fund after approval by fund Management Committee.

(4) No amount related to the Fund shall be invested under any circumstances for earning interest through fixed deposit scheme or by giving loans.

(5) The amount sanctioned from the Fund shall be utilized only for the purpose for which it has been sanctioned.

(I) Additional Director General of Police (Traffic), after examining the proposals and schemes relate to road safety will submit it for consideration of the Fund Management Committee.

(2) After the approval of proposals/projects by the Fund Management Committee, formal administrative and financial sanction for funding will be issued by the Home Department.

(I) The coordination of necessary actions related to the successful implementation of schemes will be coordinated by the Additional Director General of Police (Traffic). The Head of the concerned department will be responsible for the proper implementation and regular supervision of the construction, suitable maintenance and repair etc of equipments purchased from the Fund.

(2) The concerned Head of the department shall be responsible for the implementation of the schemes in their respective jurisdiction.

They will supervise, monitor and review financial and physical progress of the schemes. The responsibility of issuing the certificate of completion of the schemes will be of the senior most district level officer of the concerned department.

Audit and Maintenance of 12 ( 1) The Police Head Quarter shall keep suitable records of the expenditure incurred from the Fund as per the provisions of the Records of the Fund mJlwl~(~, ~6~ 2011 I 064 (7) Rule of Chhattisgarh Financial Code and the Treasury Code and this will be reconciled with the records of the Accountant General (Accounts and Entitlement) Chhattisgarh, Raipur. Before the closure of yearly accounts, the reconciliation will be done and the orders relate to the adjustments will be made available to the office of the Account and General (A&E) Chhattisgarh, Raipur.

(2) The arrangement for surrender of the amount balance/unused at end of the financial year into the Consolidated Fund of the State from the amount made available in the Fund will be such that the amount made available from the revenue account to public account will be used as per rules and the amount unused will remain with the Fund. This amount will not be surrendered the end of the financial year.

(3) No amount of the Fund will be invested in the project.

( 4) The audit of this account will be done by the Accountant General (Audit) Chhattisgarh, Raipur.

(5) A detailed statement of the expenditure incurred from the Fund and income from the Fund will be made available to the State Government from time to time and on as required basis by the Police Head Quarters.

(6) The amount received from the allotment through the budget from Chhattisgarh Government in the Fund that has not been used at the end of financial year in the prescribed works/items for the financial year will be surrendered within stipulated time in the account head and the information related to it shall be made available to the Accountant General (Account and Entitlements) Chhattisgarh, Raipur.

(7) If any modification/change/amendment is required to be done in the rules, it will be done with the prior consent of the Accountant General (Audit) Chhattisgarh, Raipur.
